Johnston County employees represent over 1,000 men and women , working in 31 different service departments and agencies , devoted to making Johnston County a better place to work and live ; and Director J Chad McLamb 3 Public Comments A Statement by Commissioner Chad M Stewart – Proposed ABC Store in Princeton Commissioner Chad M Stewart read the following statement The sale and production of alcohol has always been a debate in our Country In fact General George Washington , then President’s first act after our independence was to put down the whisky rebellion Since that time there has been numerous occasions where our Nation , State and County have had debate as it relates to alcohol We even had a period of prohibition based on an amendment to our Constitution and then a repeal again based on an amendment to our Constitution Therefore , we can assume there will always be a debate as it relates to alcohol What is not debatable is the right of our people to peacefully address their government Although our local ABC Board has complied with all State and County regulations , and even advertised the site 31 days more than it was required , it appears some citizens of Princeton believe they have not had the opportunity to address the issue of an ABC Store in their community B Citizen Concern – Non - Operational Vehicles in Developed Communities Gary James , 224 Great Oak Drive , Garner , Johnston County , asked the Board to consider an amendment to the Code of Ordinances that would prohibit non - operational vehicles in developed communities Mr James stated he lives in the I - 40 NC 42 area where there are many subdivisions that have Homeowners Associations while some do not Mr James spoke on the impact that non - operational junk vehicles in developed communities have on surrounding property values and home sales Mr James stated he has driven around his area and it is a problem in his as well as other developed communities Mr James reported he has been advised by realtors of the difficulties with selling houses near residences that have non - operational vehicles in the yards Commissioner Allen L Mims , Jr asked Mr James if his subdivision has restrictive covenants Mr James responded his subdivision does have restrictive covenants ; however , they do not have a Homeowners Association to enforce those covenants Mr James stated in such cases , an individual can hire an attorney to file suit ; however , a suit would have to be filed against each individual homeowner that is in violation of the covenants which is not financially feasible for most residents Mr James also reported that even when there is a Homeowners Association , sometimes the Association will not enforce the covenants Commissioner DeVan Barbour asked if the County had the authority to adopt an ordinance targeting specific geographical areas such as subdivisions County Attorney David Mills stated he believed the County could adopt such an ordinance because essentially that is what zoning does Commissioner Barbour asked if there is a way to remedy situations with non - operational vehicles under current environmental or health regulations PagePage pageNumber6661 October 7 , 2013 – 10 00 am Continued Mr Mills advised if the non - operational vehicles are creating a situation that is impacting the general health and or welfare of the citizens then it can be handled under current environmental and health regulations or possibly through general police powers as a nuisance Following further discussion with Mr James , it was the consensus of the Board for staff to look into the issue as well as discuss the concerns with the Planning Board Planning Director Berry Gray explained that while he understands the concern , the County is bound by State Statutes which define junk vehicles Mr Gray stated there is a test that such vehicles must be unlicensed and meet one of three other criteria Mr Gray stated he wants to make sure everyone understands that even if an ordinance is adopted for non - operational vehicles it may not address the situation in Mr James ’ subdivision Percy Coleman , 41 Bayberry Lane , Smithfield , stated the owner of his subdivision encourages homeowners to enclose other vehicles in structures similar in construction to their homes so the surrounding property values will not be impacted C Citizens Concerns – Proposed ABC Store in Princeton Barry Merrill , 505 S Walnut Street , Princeton , addressed the Board concerning the proposed ABC Store in Princeton Mr Merrill read the following statement Chairman Carver , Commissioners , and County Manager Hester , Thank you for the opportunity to come before you this morning We represent a significant part of the community of Princeton , and we are here this morning to ask that our community be respected by our County I am Barry Merrill , publisher of the Princeton News Leader , a newspaper that was founded by the Princeton community I have owned and operated the paper for 31 years , and have been a Princeton and Johnston County resident for 20 years Since your last board meeting , there has come wide recognition in our community that our County ABC Board has been considering opening a hard liquor store in our community , just outside the town limits , well within our extra - territorial jurisdiction , and as we will identify later in this meeting , near a number of churches and our high school Our ABC Board is required by the State to make notification to the community affected by a proposed new location , similarly to zoning changes , by posting a sign on a proposed location before the location can be approved by the ABC Commission in Raleigh Community comment is solicited and is to be considered by the ABC Commission In this instance , the manner in which the sign was placed , which Johnston County ABC General Manager Swade Carroll maintains follows state law , was flawed The sign was erected perpendicular to the roadway , over 40 yards off the east - bound side of US 70 , close to the length of a football field off the opposite side of the road Also , there is vegetation on fencing on property immediately adjacent to the developed property making the visibility of the sign to east - bound traffic more restricted Clearly , people who stopped at the immediately adjacent Dollar General store would have seen the sign , or who stopped at the Ormond’s Truck Stop near the lot could have seen the sign , due to their line of sight being drawn far off the roadway Due to the sign’s location , most traffic along US 70 would not see the sign The speed limit is 55 in front of the proposed location , it is near a slight curve , drawing more attention to the roadway , and it was virtually invisible to everyone unless they turned their heads from the roadway nearly 90 degrees to look at the property As there are alternative routes into town available , some residents infrequently travel that portion of US 70 There is a competing Family Dollar store in town that absorbs much of the business that might otherwise come to Dollar General There are several more convenient gas stations for town residents , as well Whether intentional or not , the sign did not effectively inform the community Our newspaper published an article based on a news release from the ABC Commission in RaleighPagePage pageNumber7662 October 7 , 2013 – 10 00 am Continued effectively stating that their hearing on the proposed site had been held prior to our paper being distributed that week I know most people in the Princeton Community were not aware until after that article appeared , nor was I Swade Carroll told a group of us last week that he had received four phone calls from the sign After our article appeared , our newspaper was asked to help in an effort to give our local citizens the right to speak to this process that was going on without their knowledge Whether intended or not , the County is seen as putting up a hard liquor store in our community in the dark of night Some in our community appealed to our Princeton Town Board , as provided in ABC regulations , to extend the comment period and to properly accept comments from our community The Princeton Town Board made a request to Raleigh and to the County ABC Board which is the legal response provided for in the law The request was rejected by both In Mr Carroll’s written response and ABC Board Member Steve Upton’s verbal response during a meeting in the County Manager’s Office last week , your ABC Board said that based on their manager’s recommendation , the request was turned down as unnecessary as they had fulfilled their requirements to proceed When I raised our community’s concerns over the process to Mr Hester and Commissioner Chad Stewart , who represents Princeton , Mr Hester and Commissioner Stewart graciously arranged that meeting with Mr Carroll and Mr Upton Our Mayor , Don Rains , also attended We all hoped that this appearance before you would be unnecessary and that our ABC Board would open up comment During that meeting , we presented to all present a list of over 150 local citizens who had signed a petition asking for an opportunity to speak to the issue There have been a few additions to that list since the meeting , but I have given each of you a copy of the current signers Very frankly , Mr Carroll used two words that angered me during that meeting in front of the others there and I believe , violated his legal responsibilities to his board and to this County When presented that list , his response was “ So what If you get all these people to call me , so what We are still going to do what we are going to do ” In fairness to Mr Carroll and his board , and to this board , I know they have little experience in encountering a community with strong feelings of opposition to putting up a hard liquor store I believe they have developed a callousness to what they see as a minority view in our society about the costs to our families from alcohol abuse Also , our Mayor was instrumental in starting this expansion of hard liquor sales in our community , but I can say with confidence that he had little recognition at the time of the depth of feelings against this store Even after his board voted to seek an opportunity for people to speak , I don’t believe he recognized it He told me last Thursday morning in front of the post office , expressing his surprise , that he had reviewed the list of signers after Monday’s meeting and that 2 3rds of the people who signed the petition asking for a hearing were people he considers friends Our community bears the scars and open wounds of injured families and torn - apart families from drug and alcohol abuse While we are not unique in that regard , we are a smaller , closer - knit community than most in the County As anyone will tell you , we are centered around the schools we fight for , we support , and we pray over We care passionately about our schools , and we care about one another I am disappointed to report that even after last Monday’s meeting and assurances our ABC Board would reconsider opening comment before today , they apparently chose instead to defer meeting or taking action , pending any guidance from your board and the re - appointment or replacement of their board member up for appointment today I have asked three other members of our community who hopefully you know to speak briefly in support of our request to be heard Jackson Stancil is my former Sunday School teacher , aide to our State Legislator and former County Commissioner JH Langdon , and Chairman of the Johnston County Republican Party Elmer Capps is the son - in - law of the late community leader Carl Gurley For many years Mr Capps was a well respected Agriculture Instructor in our schools and is the father of two current Ag teachers in our school system , was a long - time volunteer fireman , a near adoptive with the Board where he learned a valuable lesson from Representative James H Langdon , Jr on the importance of allowing people to voice their opinions and treating others as you would wish to be treated Mr Stancil stated he has been called by the people in the Princeton community who have told him they do not feel like they have had the opportunity to be heard Mr Stancil stated the people in the Princeton community should be heard Elmer Capps , 308 S Pine Street , Princeton , thanked the Commissioners for their work noting they often have to make unpopular decisions and he does not envy them Mr Capps stated he realizes that most alcoholics will find a way to get alcohol if they want it ; however , he opposes anything that will hurt the children Mr Capps stated he has taught many children that have suffered from the effects of alcohol abuse Mr Capps shared with the Board his personal experiences with those that have been affected by alcohol abuse stating that he believes an 2013 – 10 00 am Continued Mr Hinton presented copies of two newspaper articles one titled “ Princeton commissioners will appeal to ABC Board for delay on liquor store ” and the other titled “ JoCo ABC board says no to town’s request , Princeton store still a go ” from the Princeton News Leader Commissioner Tony Braswell asked if the Town of Princeton allows beer and wine sales in the city limits Mr Hinton stated when the County referendum for liquor by the drink was passed in the late 1990s , at that point there was no provision for a town to choose to become dry Mr Hinton stated there are two local outlets that sell wine and one outlet that sells beer within town limits He stated the Food Lion began selling wine in 2005 and Princeton is just now beginning to see the effects of local alcohol consumption in the community Motion by Commissioner Chad M Stewart failed for lack of a second Commissioner Chad M Stewart stated the issue today is about the people of Princeton having the right to be heard and he moved to request the Johnston County ABC Board to temporarily suspend any further action as it relates to an ABC store in Princeton until a public hearing and survey can be completed in the Princeton area The motion failed for lack of a second Page0665 October 7 , 2013 – 10 00 am Continued Commissioner DeVan Barbour asked how far along is the local ABC Board in the process of opening a store in Princeton Percy Coleman , 41 Bayberry Lane , Smithfield , stated the local ABC Board is taking aggressive steps towards opening a store in Princeton and it is his understanding that concrete has already been poured on the site Commissioner Allen L Mims , Jr stated he understands from one of the local ABC Board members that they will be leasing a building and he believes they may have already entered into a three year contract Commissioner Barbour asked if there has been a public hearing by the Princeton Town Council or if the public had been allowed to comment on the matter when the Princeton Town Council discussed it at their meeting in September Mr Merrill stated the ABC Commission gave their approval at a meeting on August 14 , 2013 He continued the Princeton Town Council met on September 2 , 2013 and Kelton Hinton , at that meeting , asked the Princeton Town Council to request a 45 day period to hear public comment in the Princeton community on the proposed store which is allowed under State Statutes Mr Merrill reported the ABC Commission and the local ABC Board refused that request for a 45 day public comment period Commissioner Barbour asked for clarification on a vote that had been taken by the Princeton Town Council on the proposed ABC store Mr Merrill stated Princeton Mayor Don Rains clarified to him that one of the Princeton Town Councilmen made a motion for the Town Council to vote to reject the store in the Princeton ETJ and that motion was defeated 3 to 2 Mr Merrill continued that Mayor Rains reported if the Princeton Town Council had been asked to take a vote in favor of the store they would not have done that because the Town Council did not know the feelings of the people of Princeton at that time Commissioner Barbour asked if the ABC store discussion had been an item on the Princeton Town Council’s agenda so the public would have been aware that it was going to be discussed Mr Merrill reported the discussion was not an item on the Princeton Town Council agenda Mr Merrill stated there are some people in the Princeton community that support an ABC store ; however , he does not believe there is a clear indication about how the community feels because many people were unaware Mr Merrill reiterated the need for the Princeton community to be heard Commissioner Stewart stated he appreciated Mr Merrill’s involvement and commented that is why he made a motion for the local ABC Board to temporarily suspend any further action as it relates to an ABC store in Princeton until the people of Princeton could have an opportunity to be heard Commissioner Stewart stated he believes there was no ill - intent by any of the parties involved as to the placement of the notification sign and he is just asking for the right of the people of Princeton to be heard Commissioner Ted G Godwin stated he is sensitive to the plight of the people in the Princeton community ; however , he does not think it is within the Board of Commissioners ’ statutory authority to intervene at this point Commissioner Godwin commented that the Commissioners can certainly look at the makeup of the local ABC Board as openings come up Keith Brinson , 396 Bug Shop Road , Princeton thanked Commissioner Stewart for his previous motion Mr Brinson stated he cannot understand why the motion did not receive a second Commissioner Mims stated if the local ABC Board felt they had carried out the notification process properly then that is why they probably went ahead and began moving forward with the store Commissioner Mims noted that no local ABC representatives were present and before he takes a vote on a motion to ask them to postpone their activities , he would like to find out more information as to how far along they are in the process Commissioner Mims stated he certainly does not wish for the Town to have something they do not want because he does not feel anyone living in the community will buy anything if they do not want it Commissioner Mims noted the Rosewood ABC store revenue is shared in Wayne County He added that he feels perhaps the Johnston County ABC Board was looking to put a store at that location to catch thePage1666 October 7 , 2013 – 10 00 am Continued beach traffic on US Hwy 70 since the Clayton Bypass now causes much of that traffic to miss the Clayton store Commissioner Mims stated Princeton receives approximately 6,300 a year in shared ABC revenue and it could be seen as hypocritical if Princeton does not want to have a store , but does want to receive their portion of the revenue Commissioner Mims also stated he has never heard of alcohol being sold to a minor in an ABC store in Johnston County , but he has heard many instances of where minors have been sold beer and wine from convenience stores Commissioner Mims stated he does not want to see something pushed on a community that does not want it and although he does not believe the Board of Commissioners has any authority to stop it , he would like to see more due diligence performed Commissioner Mims stated if the Princeton Town Council asked for a 45 day public comment period , then he does not understand why the local ABC Board denied that request Commissioner Mims stated he needs more information before taking any kind of action County Manager Rick Hester stated he would check with the local ABC Board as to how far along they are in the process and if they have entered into a contract Mr Merrill stated the building permit for the store has been filed , but he clarified that he visited the site yesterday and no concrete has been poured on the site as of yet After further requests from the audience , Commissioner Mims stated he is unwilling to make a motion at this time because he is unsure as to exactly what authority the Board of Commissioners has on the matter County Attorney David Mills advised that the location of an ABC Store is solely within the purview of the local ABC Board and the North Carolina ABC Commission and he would be very cautious with taking any kind of formal action Commissioner Braswell noted earlier comments by Mr Brinson and stated he also is unsure what authority the Board of Commissioners has which is why he did not second Commissioner Stewart’s motion Commissioner Braswell stated none of the Commissioners have a deaf ear to the people in the Princeton community and even though it is not his official district , he lives close to the area and he is sensitive to the feelings of the community Commissioner Braswell stated everyone must understand that the Board of Commissioners cannot dictate actions it has no legal authority to do Chairman Jeffrey P Carver accepted a request from Commissioner Allen L Mims , Jr to be excused from the remainder of the meeting due to a dental appointment Commissioner Mims left the meeting at 11 00 am D Recognition of County Finance Department County Manager Rick Hester recognized the County Finance Department for recently receiving the Certificate of Achievement for Excellence in Financial Reporting awarded by the Government Finance Officers Association of the United States and Canada for the third year in a row The Certificate of Achievement is the highest form of recognition in the area of governmental accounting and financial reporting The County Finance Department Rural Operating Assistance Program ROAP grant for FY 2013 - 2014 Neal Davis , Executive Director for Community & Senior Services JCATS , outlined the program totals of the proposed FY 2013 - 2014 ROAP grant , following Mr Davis also noted that he had copies of the “ Voluntary Title VI Public Involvement ” form which collects information on race , color , national origin and gender of the attendees interviewing citizens throughout the County asking what the agency is doing well and what the areas that they need to focus on are Mr Davis stated they were able to develop a list of goals along with strategies to work towards He stated the strategic plan is a roadmap for their agency and he welcomes any thoughts or comments from the Board of Commissioners once they have had a chance to review the plan Commissioner Tony Braswell thanked Mr Davis and his Board of Directors for their work 6 911 Communications – Approval of Lease Contract Director of 911 Communications Jason Barbour requested the Board to approve entering into a three year lease contract with Communications International to purchase necessary equipment to construct a radio site on the County’s water tank at McGee’s Crossroads Mr Barbour stated the cost for the equipment is 356,80185 which is already included in the approved FY 2013 - 2014 Budget ; therefore , no additional allocation is required He reported by adding this site to the current public safety radio system it will improve coverage for Fire , EMS , and the Sheriff’s Office Mr Barbour offered to answer any questions County Finance Director Chad McLamb Delinquent Tax Collection Report Tax Administrator Pat Goddard reported on the collection of delinquent taxes for the month of September 2013 She noted in addition to garnishments and bank attachments , 10 foreclosure complaints were filed resulting in a collection of 10,92547 She reported that as of September 30 , 2013 , the Tax Department has collected 1223 of the real and personal levy for 2013 , and 6063 of the motor vehicle levy Through the NC State Debt Setoff Program , 23 accounts have been paid for a total of 2,44211 as of September 30 , 2013 The next foreclosure sale date is scheduled for October 30 , 2013 Ms Goddard also reported the County has received 429,67453 in Tax and Tag Together revenue as of September 30 , 2013 12 Manager Reports and Comments A Request to Surplus Vehicle for Sheriff’s Office At the request of Sheriff Steve Bizzell , upon a motion by Commissioner Tony Braswell , seconded by Commissioner Cookie Pope , and carried unanimously , the Board declared the following vehicle surplus that was involved in an accident and is considered a total loss 2009 Crown Victoria , VIN 2FAHP71V69X121900 , County Asset # 018987 B Department of Social Services – Impacts from Federal Government Shutdown Director of Social Services Earl Marett and Assistant Director Tina Corbett addressed the Board and reported on possible impacts to DSS as a result of the Federal Government shutdown Mr Marett reported there are a few programs where funding could be delayed ; however , he hopes that the shutdown will be resolved before it becomes an issue Mr Marett stated he does not see any impacts with Medicaid or Food Nutrition services and those programs should continue However , Mr Marett stated DSS is closely monitoring the childcare funding because there could possibly be delays to that program Mr Marett stated he would not make any decisions to curtail services as of right now Page8673 October 7 , 2013 – 10 00 am Continued C County Employee Length of Public Comment item regarding the proposed ABC Store in Princeton Commissioner Braswell thanked Commissioner Chad M Stewart for his work on the issue stating he understands what Commissioner Stewart has dealt with in recent days trying to represent the people of Princeton Commissioner Braswell briefly spoke on his own experiences and commented on the difficulties of putting aside personal feelings and personal beliefs in order to carry out the obligations of being a County Commissioner Commissioner Braswell stated government must be fair and allow for the proper avenues on issues ;
