the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Tony Braswell , Cookie Pope , Allen L Mims , Jr , DeVan Barbour , Ted G Godwin , and Chad M Stewart Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney David F Mills , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 10 00 am Commissioner Cookie Pope opened the meeting with a prayer Commissioner DeVan Barbour led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Cookie Pope , seconded by Commissioner DeVan Barbour , and carried by unanimous vote , the Board approved the agenda as amended to include a discussion and possible action regarding current expense funding for Johnston County Schools before the scheduled Economic Development Incentive Grant Public Hearing 2 Consent Agenda Items Commissioner Tony Braswell asked the Board to consider removing Item B – Department of Transportation Additions to the System from the Consent Agenda since he would like to abstain from voting on the item due to a conflict of interest Commissioner Cookie Pope moved the Board remove Item B – Department of Transportation Additions to the System from the Consent Agenda to be voted on separately Commissioner Tony Braswell seconded the motion which carried by unanimous vote Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board approved the remaining consent agenda items as follows A Approval of Minutes – August 5 , 2013 10 00 am B Proclamation – 2013 Fall Litter Sweep – September 21 through October 5 , 2013 adopted as follows PROCLAMATION FALL LITTER SWEEP 2013 WHEREAS , the North Carolina Department of Transportation organizes an annual fall statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the FALL LITTER SWEEP roadside cleanup encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Correction inmates and community service workers , local government agencies , community leaders , civic and community organizations , businesses , churches , schools , and environmentally concerned citizens conduct annual local cleanups during FALL LITTER SWEEP and may receive certificates of appreciation for their participation ; and WHEREAS , the great natural beauty of our state and a clean environment are sources of great pride for all North Carolinians , attracting tourists and aiding in recruiting new industries ; and WHEREAS , the cleanup will increase awareness of the need for adopted as follows CHILD PASSENGER SAFETY WEEK 2013 PROCLAMATION WHEREAS , Children are our country’s most precious resource As parents and caregivers it is our responsibility to keep America’s children safe Every year , thousands of children are tragically injured or killed in motor vehicle traffic crashes For children age 3 and older , it is the leading cause of death It is hard to overstate the toll this takes on families Together we can put an end to this WHEREAS , Today , all 50 States , the District of Columbia , and our Territories have laws requiring the use of child safety seats and seat belts for children traveling in motor vehicles These laws were enacted because of the tremendous safety benefits they provide We know that child safety seats help save lives and reduce injuries We also know that they are most effective when installed and used correctly Sadly , nearly 3 out of 4 child safety seats are not used properly Starting now , working together , we must join forces to prevent these deaths and injuries WHEREAS , Johnston County is committed to working closely with our partners and safety advocates to help reduce the number of young lives lost on our roadways Our goal is to educate parents and caregivers on how to properly install and use child safety seats During Child Passenger Safety Week , there will be hundreds of free child safety seat inspection stations set up across the country We encourage all parents and caregivers to take advantage of this service and ensure that their children are getting the very best protection To locate an WEEK IN JOHNSTON COUNTY Whereas , fighting fires is one of the most hazardous professions requiring physical strength , stamina , extensive training , courage , and selfless concern for the welfare of others ; and Whereas , firefighters provide valuable services to the citizens of Johnston County , their communities , and the County ; and Whereas , firefighters make sacrifices to protect the lives and financial interests of the citizens of Johnston County ; and Whereas , firefighters respond to emergencies without hesitation when the call of duty arises ; and Whereas , firefighters work with public safety officials and law enforcement officers to protect the integrity of crime scenes , which is necessary to resolve arson cases ; and Whereas , firefighters reside in the community in which they serve and have a great appreciation for protecting their communities ; and Whereas , it is appropriate to recognize the duties and services that firefighters perform by observing Firefighters Development Incentive Grant Advertised in The Smithfield Herald – August 21 , 2013 Chairman Jeffrey P Carver opened the public hearing for the purpose of allowing public comment on a proposal for the County to provide certain economic incentives , pursuant to NCGS 158 - 71 , to a company that is considering the location and or expansion of facilities in Johnston County , North Carolina Economic Development Director Peggy Anderson informed the Board that Novo Nordisk of Clayton is planning a 102 million expansion that would increase employment at their facility by 110 jobs She stated the County is proposing to offer an Economic Development Incentive Grant to Novo Nordisk for the expansion The percentage terms for the Economic Development Incentive Grant are proposed as follows addressed the Board and stated the expansion will make it possible for the Clayton facility to continue meeting the increasing demand for diabetes pharmaceuticals in the United States market Mr Eriksen stated the expansion will be completed in phases over the next three years and he thanked the Board of Commissioners for working with Novo Nordisk in the past as well as in the future Commissioner Cookie Pope expressed her appreciation to Novo Nordisk for creating new jobs Chairman Jeffrey P Carver thanked Novo Nordisk for choosing to expand their operation in Johnston County noting the County will be meeting with the bond rating agencies soon and the announcement by Novo Nordisk will greatly enhance the County’s position At the inquiry of County Attorney David Mills , Mr Eriksen confirmed that Novo Nordisk has other facilities that were considered for the expansion , and the County’s incentive grant offer is part of the reason Novo Nordisk chose Johnston County for the expansion over other locations There being no further comments , the Chairman closed the public hearing Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board approved entering into an Economic Development Incentive Grant agreement with Novo Nordisk based on the percentage terms outlined above 7 New Economic Development Director Chairman Jeffrey P Carver recognized Mr Chris Johnson in the audience and congratulated him on being named the County’s new Economic Development Director Chairman Carver noted Mr Johnson will begin work with the County on September 23 , 2013 He thanked current Economic Development Director Peggy Anderson for her excellent work with the County over the past few years 8 Triangle Land Conservancy – Walnut Hill Preserve – Request for Stormwater Land Dedication Program Funds Triangle Land Conservancy Executive Director Chad Jemison addressed the Board and requested the County to consider allocating 231,000 from the Stormwater Land Dedication Program Fund to assist with the Walnut Hill Preserve Conservation Project Mr Jemison explained the Walnut Hill Preserve Project is a 409 acre property that straddles the Wake Johnston County line He stated of the 409 acres , approximately 70 acres is in Johnston County near Clayton Mr Jemison stated the property is on the Neuse River Greenway , adjacent to the new Clayton River Walk , and would also connect to the Mountains - to - Sea Trail He stated the Triangle Land Conservancy views the Walnut Hill Preserve as an addition to the Clayton River Walk property allowing for the preservation of more than 700 acres of land Mr Jemison stated the Triangle Land Conservancy has assembled organizations to provide funding for the 7 million project with Wake County contributing 16 million , the NC Clean Water Management Trust fund contributing 700,000 , the Environmental Enhancement Grant Program contributing 80,000 , and Triangle Land Conservancy committing over 400,000 in private contributions Commissioner Ted G Godwin asked Mr Jemison to explain Wake County’s role in the project Mr Jemison explained that Wake County agreed to invest 16 million towards the acquisition of the acreage located in Wake County and the Wake County Commissioners stated they wanted to hold the conservation easement on the Wake County property Mr Jemison stated if Johnston County wishes to hold the conservation easement on the Johnston County acreage , the Triangle Land Conservancy would welcome that discussion He noted that by holding the conservation easement , it would involve monitoring and maintenance Commissioner Godwin stated he is in favor of open space ; however , he is unwilling to part with County funds for property that the County would not own Page0639 September 3 , 2013 – 10 00 am Continued Commissioner Allen L Mims , Jr commented there is the option of the County holding the conservation easement and asked about that process Mr Jemison explained the Triangle Land Conservancy will hold the deed to the property , but another entity will hold the conservation easement , just like Wake County has chosen to do for their portion of the acreage Mr Jemison stated if Johnston County does not want to hold the conservation easement for the Johnston County acreage and assume the accompanying responsibilities , then the Triangle Land Conservancy would partner with another entity to hold the easement Commissioner Tony Braswell noted the funds that would be used for the project would come from the County’s Stormwater Land Dedication Program Fund which is not included in the General Fund He added the Stormwater Land Dedication funds are paid by developers Commissioner Braswell stated he feels the Walnut Hill Preserve Project meets the intent of the Stormwater Land Dedication Program which is to protect the watershed Commissioner Mims noted the land would connect to the nature trails in Clayton and he asked if the Triangle Land Conservancy had contacted the Town of Clayton to gage their interest in possibly holding the conservation easement Mr Jemison stated they did contact the Town of Clayton ; however , Clayton has chosen not to pursue the opportunity at this time Commissioner Godwin asked how much is available in the Stormwater Land Dedication Program Fund and he questioned how many citizens in other parts of the County would actually use the property Commissioner Chad M Stewart asked for more information on what would be involved with the County holding the conservation easement Commissioner Cookie Pope asked about the Moore Farm Conservation Project and how the Walnut Hill Preserve Project differs Johnston County Stormwater Administrator Jamie Guerrero explained that the County has a Stormwater Management Program which limits the amount of impervious area that can be developed He stated if a developer wishes to exceed that limit , then the developer can either dedicate land into a permanent conservation easement on their own or contribute to the County’s Stormwater Land Dedication Program Fund The Land Dedication Program Funds can then be used by the County to purchase conservation easements , protect open space , and preserve land in the watershed Mr Guerrero reported the Walnut Hill Preserve Project does meet the intent of the Stormwater Land Dedication Program in all aspects He pointed out that although the project only involves approximately 70 acres in Johnston County , the Walnut Hill Preserve as a whole includes 409 acres of permanent conservation that will protect the entire watershed He stated the advantage of the project over the Moore Farm Project is that the Walnut Hill Preserve will allow for public access with recreational areas and trails He stated in the case of the Moore Farm Project , the Moore Family retained ownership of the property with a permanent dedicated conservation easement to the Triangle Land Conservancy meaning the property cannot be publicly accessed Mr Guerrero stated the County could hold the conservation easement for the Johnston County acreage ; however , he stated a fund would have to be established for maintenance and monitoring of the easement and typically the County has not done this due to liabilities and maintenance costs Mr Guerrero stated the current balance of the Stormwater Land Dedication Program Fund is 466,20036 He noted all the water from the Walnut Hill Preserve land drains into the Neuse River and by having the property in permanent conservation , it protects the entire County’s water supply since the Water Treatment Plant’s intake is located on the Neuse River Commissioner Braswell commented that because the Neuse River is the source of the County’s water supply , it is imperative that the Board make sure the water supply is protected Commissioner Godwin asked if it would be possible in the future to have projects like this in more centrally located areas of the County Page1640 September 3 , 2013 – 10 00 am Continued Mr Guerrero noted that most of the Stormwater Land Dedication Program funds were collected for projects developed in the I - 40 NC 42 corridor area and the Triangle Land Conservancy has been working to identify projects in that corridor for dedication ; however , he stated such projects depend on landowners that are willing to participate Upon a question by Commissioner Stewart , Mr Guerrero reported staff tries to find projects where the funds can be spent within the same sub - watershed as they are collected ; however , it is not a requirement Mr Guerrero noted ultimately all the watersheds in Johnston County drain to the Neuse River and protection of the Neuse River is the goal in the end Commissioner Pope noted approximately 150 acres of the property is farmland and she asked if that land would be continuously kept for farm production Mr Guerrero stated the farmland would remain in production so long as there is an entity that chooses to farm the land and after that it would be kept in permanent conservation Commissioner Godwin stated he cannot support spending the money because the project is not more centrally located Commissioner Braswell stated he can support the project because he sees it as an opportunity to protect the entire watershed Upon a question by Commissioner Godwin , Mr Jemison stated the Triangle Land Conservancy hopes to close on the property by the end of September or early October He stated the Triangle Land Conservancy would then launch a campaign to raise private dollars and grant funds to help develop trails with the hopes of having the property open to the public in the next three to six years Commissioner Mims asked how the Stormwater Land Dedication Program Funds are accounted for in the County’s finances County Finance Director Chad McLamb stated the funds are classified as proprietary funds in the restricted fund balance Commissioner Pope asked if the ad valorem taxes would be affected on the property County Tax Administrator Pat Goddard stated if a conservation easement is in place , the value would be reduced ; however , Ms Goddard noted with a piece of property this size , it is most likely already in the Present Use Value Program Mr Jemison confirmed the property is already in the Present Use Value Program Commissioner Tony Braswell moved the Board approve the request by the Triangle Land Conservancy and allocate 231,000 from the County’s Stormwater Land Dedication Program Fund towards the Johnston County portion of the Walnut Hill Preserve Conservation Project without the County holding the conservation easement on the Johnston County acreage Commissioner DeVan Barbour seconded the motion which carried by the explained the project will move the 911 phone system to a hosted platform as well as move the method in which 911 calls are received to IP technology The monthly reoccurring expense will be 53,85676 which is approximately 2,50000 more each month than the existing monthly charge Mr Barbour stated the 911 surcharge revenue will cover 100 of the expense The County Attorney has reviewed the terms in the contract and finds them satisfactory Page2641 September 3 , 2013 – 10 00 am Continued Upon a question by Commissioner Ted G Godwin , Mr Barbour stated staff has analyzed the move in an effort to anticipate any failures that could occur and he noted numerous safe guards have been built in the process to avoid downtimes as much as possible Commissioner Ted G Godwin moved the Board approve for the County to enter into a contract with CenturyLink for the hosted Next Generation 911 Project Commissioner Cookie Pope seconded the motion which carried by unanimous vote 10 Public Utilities – Amendment to the 2013 Capital Improvements Plan Director of Utilities Chandra Coats reported the 2013 Capital Improvements Plan CIP was approved by the Board of Commissioners during the June 25 , 2013 meeting and included a project to replace filter towers and rebuild filter group # 1 She stated the project was estimated to cost 1,500,000 and anticipated to be completed in the 2014 - 15 fiscal year Ms Coats continued that during pre - design investigations of the project , staff has determined the scope of the project must be expanded to include the addition of a new filter group , structural improvements to the enclosure , and chemical feed improvements Filter area structural improvements have been determined to be quite extensive and a long term shut down of one filter group will be required Firm purchase supplies may not be adequate to cover the loss of capacity Ms Coats stated the revised project will cost an estimated 4,700,000 and would be constructed in two phases , the first of which is a 3,500,000 project to add an additional filter group and improve chemical feeds The second project to rebuild filter group # 1 is scheduled to be completed in Fiscal Year 2016 - 2017 Ms Coats presented an Amendment No 1 to the CIP and asked the Board to consider approving the amendment She noted that staff has factored in the amendment to the financial model and does not anticipate needing to modify the rates for the project beyond what has been originally projected Commissioner Ted G Godwin commented that the amendment is a significant change Ms Coats agreed that the amendment is a significant change and stated staff had not anticipated needing to go ahead with the larger project until analyses came back that indicated structural problems due to corrosion caused County Public Utilities 2013 Capital Improvements Plan adopted by the Johnston County Board of Commissioners on June 25 , 2013 The project in need of revision is W - 11 Replace Filter Towers and Rebuild Filter Group # 1 In the original text the project is described as follows W - 11 Replace Filter Towers and Rebuild Filter Group # 1 - 1,500,000 The Johnston County Water Treatment Plant was originally constructed as a 4 mgd plant in 1994 and upgraded to 12 mgd during the following 12 years The filter effluent towers will need to be replaced during the planning period The original filter group is showing signs of deterioration The CIP includes replacing three filter towers and rehabilitating filter group # 1 The projects will be funded through a DWSRF loan The amendment would replace structural steel framework over filter group # 1 will also be required , some of which require process components to be taken off line for extended periods Considerable redundancy has been designed into most of the plant processes ; however , no redundancy is available for filtration Major filter maintenance often requires an entire group of four cells to be removed from service The scope of the anticipated repairs merits the addition of a fourth filter group The second phase of the project includes replacing equipment for filter group # 1 and structural repairs The projects will be funded with two DWSRF loans This change in scope will also affect the 20 year projections for the water budget presented in the plan Replacement pages reflecting this change are included with this amendment Page3642 September 3 , 2013 – 10 00 am Continued 11 Public Utilities – Water Treatment Plan Filter Additions and Chemical Feed Improvements Director of Utilities Chandra Coats explained that in accordance with the previous item Adoption of Amendment No 1 to the Capital Improvements Plan the Water Treatment Plant needs improvements necessary to sustain operations She explained that due to the age of certain components , increased plant production , and opportunities for chemical cost savings , several improvements are required The proposed improvements include adding a fourth filter group with four filter cells , repairing damaged concrete in existing filter groups no 1 and no 2 , and improving the polymer feed system Ms Coats stated the original plant facilities are approaching twenty years old and maintenance and repairs are increasing in frequency and scope , as anticipated Some repairs require process components to be taken off - line for extended periods Considerable redundancy has been designed in most of the plant processes ; however , no redundancy is available for filtration Ms Coats continued that major filter maintenance often requires an entire group of four cells out of 12 cells , total to be removed from service and during periods of high water usage when a portion of the plant is off line , supplemental bulk water must be purchased from outside sources at higher costs , subject to purchase agreement limits and to the extent supplies are available The addition of a fourth filter group will provide the required redundancy and will facilitate an increase in plant production capacity in the event a supplemental raw water allocation could be obtained from the Neuse River in the future Ms Coats stated major repairs are required for two filter groups , which will involve removal and replacement of concrete surfaces in their outlet structures The concrete has been damaged by chemical reactions , and the replaced surfaces will have a special coating to eliminate the problem Several other less critical filter improvements and modifications are necessary such as reinforcing filter wash troughs , addition of filter media , and valve replacement Ms Coats explained in addition to work on the plant’s filters , improvements to the chemical feed system supplying polymer to the clarifiers are needed Installation of additional polymer feeders to provide one feeder for each clarifier will allow precise chemical dosing and facilitate savings in polymer usage She stated savings from reduced chemical usage and reduced filter backwash frequency should offset the cost of polymer system improvements over a few years Ms Coats stated the estimated project cost for the proposed improvements is approximately 3,500,000 and staff proposes to fund the project through a low interest , State Revolving Loan from the Division of Water Resources Ms Coats reported staff has factored debt service payments into the financial model for the water fund and determined the improvements will be affordable She asked the Board to consider adopting a resolution authorizing the submission of an application for the State Revolving Loan Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board adopted the following resolution authorizing an application for a State Revolving Loan RESOLUTION BY GOVERNING BODY OF APPLICANT WHEREAS , the Federal Safe Drinking Water Act Amendments of 1996 and the North Carolina Water Infrastructure Act of 2005 NCGS 159G have authorized the making of loans and grants to aid eligible units of government in financing the cost of construction of drinking water system improvements , and WHEREAS , Johnston County has need for and intends to construct a drinking water system project described as the Johnston County Water Treatment Plant Filter Additions and Chemical Feed Improvements , and WHEREAS , Johnston County intends to request state loan assistance for the project NOW THEREFORE BE IT RESOLVED , BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERS That Johnston County will arrange financing for all remaining costs of the project , if approved for a State loan award That Johnston County will adopt and place into effect on or before completion of the project a schedule of fees and charges and other available funds which will provide adequate funds for proper operation , maintenance , and administration of the system and the repayment of all principal and interest on the debt That the Johnston County Board of Commissioners agrees to include in the loan agreement a provision authorizing the State Treasurer , upon failure of the Johnston County to make scheduled repayment of the loan , to withhold from Johnston County any State funds that would otherwise be distributed to the local government unit in an amount sufficient to pay all sums then due and payable to the State as a repayment of the loan That Johnston County will provide for efficient operation and maintenance of the project on completion of construction thereof That Rick J Hester , County Manager , and successors so titled , is hereby authorized to execute and file an application on behalf of Johnston County with the State of North Carolina for a loan to aid in the construction of the project described above Page4643 September 3 , 2013 – 10 00
