10 358 Meeting of the Johnston County Board of Commissioners April 1 , 2013 10 00 am The Johnston County Board of Commissioners met in regular session Monday , April 1 , 2013 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Tony Braswell , Cookie Pope , Allen L Mims , Jr , DeVan Barbour , Ted G Godwin , and Chad M Stewart Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney David F Mills , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 10 00 am Commissioner Cookie Pope opened the meeting with a prayer Commissioner Allen L Mims , Jr led those in attendance in the pledge of allegiance to the American flag The Board welcomed newly appointed Commissioner Chad M Stewart to the meeting 1 Resolution in Memory of Commissioner Wade M Stewart Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board adopted the following resolution in memory of County Commissioner Wade M Stewart who passed away in January RESOLUTION IN MEMORY OF WADE M STEWART WHEREAS , Johnston County Commissioner Wade M Stewart departed from this life on Monday , January 14 , 2013 ; and WHEREAS , Commissioner Stewart was a resident of Johnston County his entire life and served our County with distinction ; and WHEREAS , Commissioner Stewart began his term as a County Commissioner in December 1998 , and worked tirelessly for the citizens , serving as Vice Chairman from December 2004 until December 2008 and as Chairman from December 2008 until December 2010 ; and WHEREAS , Commissioner Stewart demonstrated a deep and genuine love for the County and its citizens and earned the admiration and high regard of all those with whom he came into contact ; and WHEREAS , Johnston County and its people have benefitted from Commissioner Stewart’s knowledge , leadership , and concern for his fellow citizens and his contributions will forever serve as an example of dedicated public service ; and WHEREAS , Commissioner Stewart will be missed by all those whose lives he touched , especially the members of the Johnston County Board of Commissioners who saw him as a dear friend NOW , THEREFORE , BE IT RESOLVED that the Johnston County Board of Commissioners mourns the loss of Commissioner Wade M Stewart and extends to his family our sincere sympathy ; March 4 , 2013 10 00 am and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Fontana Drive SR 2689 Ext and Wheeler Court – Timberlake Subdivision – Phase 3 – Wilders Township C Resolution – Requesting NCDOT Participation for Improvements to Powhatan Road The Board adopted the following resolution requesting North Carolina Department of Transportation participation for improvements to Powhatan Road RESOLUTION Requesting North Carolina Department of Transportation Participation in Improvements to Powhatan Road WHEREAS , the Johnston County Board of Commissioners seeks to foster economic development in an effort to create and maintain employment for the citizens as well as capital investment for the County ; and WHEREAS , Powhatan Road is located within a major business and employment hub serving the interests of and contributing to the economic vitality of the Town of Clayton and Johnston County ; and WHEREAS , adequate road access and sound maintenance practices are essential parts of the infrastructure necessary to support investment and expansion of the employment base and protect the safety of the motoring public ; and WHEREAS , the North Carolina Department of Transportation promotes the economic wellbeing and safe public travel for communities across the State by providing new roadways , improvements to existing roadways , roadway maintenance , and public transportation NOW , THEREFORE , BE IT RESOLVED that the Johnston County Board of Commissioners is requesting the participation of the North Carolina Department of Transportation to provide necessary improvements to and maintenance of Powhatan Road in support of continuing economic vitality of this major employment area and assurance of safe roadway conditions for commuters and the public st Adopted this the 1 day of April , 2013 D Proclamation – National Public Safety Telecommunicator’s Week – April 14 - 20 , 2013 The Board adopted the following proclamation declaring the week of April 14 - 20 , 2013 as National Public Safety Telecommunicator’s Week in Johnston County National Public Safety Telecommunicator’s Week April 14 - 20 , 2013 WHEREAS , emergencies can occur at anytime that require police , fire or emergency medical services ; the E - 911 Communications Center was created to provide a vital contribution to the quality of life enjoyed by citizens and visitors to Johnston County ; and WHEREAS , when an emergency occurs , the access to a 911 center dramatically improves the prompt response of police officers , firefighters and paramedics , is critical to the protection of life and preservation of property ; andPage360 April 1 , 2013 – 10 00 am Continued WHEREAS , the Telecommunicators are trained , prepared and ready ; the safety of our police officers , firefighters and EMS personnel are dependent upon the quality and accuracy of information obtained from citizens who telephone the Johnston County E - 911 Communications Center ; and WHEREAS , Public Safety Telecommunicators are the first and most critical contact our citizens have with emergency services ; and WHEREAS , Public Safety Telecommunicators are the single vital link for our police officers , firefighters and EMS personnel by monitoring their activities by radio , providing them information and insuring their safety ; and WHEREAS , Public Safety Telecommunicators of the Johnston County E - 911 Communications Center have contributed substantially to the apprehension of criminals , suppression of fires and treatment of patients ; and Whereas , Community & Senior Services of Johnston County is committed to valuing all individuals and recognizing their ongoing life achievements ; and Whereas , the older adults in Johnston County play an important role by continuing to contribute experience , knowledge , wisdom , and accomplishments ; and Whereas , our older adults are active community members involved in volunteering , mentorship , arts and culture , and civic engagement ; and Whereas , recognizing the successes of community elders encourages their ongoing participation and further accomplishments ; and Whereas , our community can provide opportunities to allow older citizens to continue to flourish by ? Litter Sweep for April 13 , 2013 through April 27 , 2013 in Johnston County PROCLAMATION SPRING LITTER SWEEP 2013 WHEREAS , the North Carolina Department of Transportation organizes an annual spring statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the spring 2013 LITTER SWEEP roadside cleanup will take place April 13 through April 27 , 2013 , and encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Correction inmates and community service workers , local government agencies , community leaders , civic and community organizations , businesses , churches , schools , and environmentally concerned citizens conduct annual local facility for some of the State’s programs that may be lacking facilities for patients that need service Mr Massengill noted they have several commitments from agencies in other regions and are looking at all ways to keep the facility going until contracts can be settled Commissioner Tony Braswell asked Mr Massengill if he had a timeframe as to when the State and Federal program contract issues would be resolved Mr Massengill stated Day by Day is estimating it will be two months before they will begin seeing any positive changes with the State and Federal contract issues so they can begin seeing patients for detoxification and residential services At the inquiry of Commissioner DeVan Barbour , Mr Massengill stated Day by Day needs about three months of financial assistance before they expect to begin receiving revenue from detoxification and residential services Commissioner Braswell asked about the income Day by Day is receiving from outpatient services Mr Massengill acknowledged that Day by Day is receiving some income from the outpatient services , but it is not enough to cover their operations Mr Massengill reported Day by Day is still requesting 50,000 each month for the next three months to help keep operations going Phillip Taylor , Volunteer Chaplain for Day by Day , presented and reviewed with the Board information on the beer and wine excise taxes that are allocated to counties and municipalities and asked if a portion of those funds could be used to help Day by Day Mr Taylor spoke on the importance of keeping Day by Day in operation Mr Taylor stated it used to cover the shortages Mr Cross reported the College had to use 40,000 of their Fund Balance to pay for the Wilson Building roof repair He stated there are funds remaining in reserves , but they would like to keep those funds to address any major problem going forward At the inquiry of Commissioner Barbour , Mr Cross reported the College has approximately 600,000 in reserves Chairman Jeffrey P Carver asked if the funds shortage at the College is the result of zero based budgeting Dr Johnson stated the College made their budget request to the Commissioners for Fiscal Year 2012 - 2013 based on their anticipated needs , which included increases they were projecting for the additional facilities that came online ; however , the Board of Commissioners funded what they felt the County could afford Commissioner Barbour stated he understands the situation the College is facing ; however , he felt that with it being this late in the budget year , he would prefer for the College to use funds from their reserves to cover the shortage and then adjust their budget request for Fiscal Year 2013 - 2014 Commissioner Allen L Mims , Jr stated he did not disagree with Commissioner Barbour ; however , according to the College , they did try to budget appropriately , but the County did not appropriate as much funding as the College asked for Commissioner Mims continued that if the College were requesting the additional funding for programs , then he would have a problem with the request , but College is asking for the additional money to pay their bills He stated the request is a lot of money but it has to be considered in the grand scheme Commissioner Mims noted the College is dealing with about 2 million in deferred maintenance At the inquiry of Commissioner Barbour , Mr Cross stated the College is looking at deferred maintenance issues that include needed repairs to some of the parking lots , roof repairs replacement , carpet replacement , etc He stated the College is deferring those projects as much as possible , and they are taking temporary measures on roof leaks until a major renovation can be afforded Dr Johnson noted the County has assisted the College with 2013 - 2014 Streamlined Annual Plan as presented 7 Emergency Services – Proposed Changes to the Emergency Operations Plan Emergency Management Coordinator Darrell Alford asked the Board to approve changes and adopt new guidelines to the Johnston County Emergency Operations Plan as it relates to Federal Nuclear Regulatory requirements Mr Alford explained that under Federal Nuclear Regulatory Guidelines , counties that are within 50 miles of a fixed nuclear facility must participate once every 24 years in a planned exercise Johnston County falls within 50 miles of the Harris Nuclear Plant located in western Wake County which is known as the Ingestion Pathway Zone or IPZ Mr Alford stated the current Johnston County Emergency Operations Plan only included limited information concerning radiological materials ; therefore , staff has drafted changes to reflect current guidelines and standards that were already being utilized by the State and counties that participate yearly in events with nuclear facilities Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the changes as submitted by staff following and adopted the new Federal Nuclear Regulatory Guidelines as part of the Johnston County Emergency Operations Plan Insert the following text in the Hazardous Materials Emergency Support Function ESF – 10 and the Hazardous Materials Response Sections of the Johnston County Emergency Operations Plan “ For incidents involving the Harris Nuclear Plant or transportation incidents Documents for USDA - Rural Development Wilson’s Mills to Cleveland Water Transmission Main Division 2 Extension Assistant Director of Utilities Chandra Coats , PE , explained that the Board of Commissioners accepted a low interest loan from USDA – Rural Development on February 28 , 2011 , for construction of the following projects 1 Phase 2 – Wilson’s Mills to Cleveland water transmission mains ; 2 20 ” water main to serve the East Clayton Industrial Area ; and 3 replacement of the SR 1010 Cleveland Road booster pumping station She reported construction has been completed for the original scope of the projects However , the budget adopted on February 6 , 2011 included 822,28200 for “ Additional Work ” for the Wilson’s Mills to Cleveland Water Transmission Mains Division 2 project Ms Coats stated since the original project was completed under budget , USDA has authorized the County to proceed with the “ Additional Work ” to include a 16 ” water main extension along Cleveland Road from Wellons Road to the new 1010 Booster Pump Station Ms Coats asked the Board to formally accept and approve the construction documents for the “ Additional Work ” , which is a their review He stated he along with Assistant Director of Utilities Chandra Coats and Engineering Consultant Kim Rineer prepared and developed the draft CIP Assistant Director of Utilities Chandra explained that staff will be applying for funding for various projects next fiscal year and the County could receive a more favorable review by the funding agencies if the 20 Year CIP is adopted and in place Commissioner Allen L Mims , Jr noted in the options for the Water Fund Revenue Adjustments , Option 1 called for the base fees to be adjusted by 050 per month starting in 2014 - 2015 and he asked how much revenue could be generated from that increase until 2027 when 80 million will be needed for improvements Mr Broome stated Option 1 would generate approximately one third of the needed 80 million for improvements which could be established as a reserve fund He stated staff would recommend borrowing the entire amount needed for the improvements up front , less any funding that could be obtained by grants , and then use the reserve funds to help pay the debt service Commissioner Mims asked for more information on Option 2 regarding restructuring the conservation rate schedule Mr Broome explained that for some time , the State has been encouraging the County to adopt tiered conservation rates He reported the State does not accept the County’s current conservation rate of charging an additional fee for those customers that use over 9,000 gallons per month , which are typically those customers that irrigate their lawns Mr Broome stated a new conservation rate schedule may become law if current proposed legislation passes Commissioner Ted G Godwin asked if staff had a recommendation of whether to go with Option 1 or Option 2 Mr Broome stated it would be his recommendation to partially adjust the base fee in FY 2013 - 2014 and again in FY 2014 - 2015 and wait on restructuring the conservation rate to see what actions will be taken by the State At the inquiry of Chairman Jeffrey P Carver , Mr Broome stated staff would like for the Board to review the draft CIP as well as send it for review by the County’s financial consultant , Davenport He stated Administrator Pat Goddard reported on the collection of delinquent taxes for the month of March 2013 She noted in addition to garnishments and bank attachments , eight foreclosure complaints were filed resulting in a collection of 8,85931 As of March 29 , 2013 , the Tax Department has collected 9770 of the real and personal levy for 2012 , and 8236 of the motor vehicle levy Through the NC State Debt Setoff Program , 607 accounts have been paid for a total of 60,71401 as of March 29 , 2013 The next foreclosure sale date is scheduled for April 25 , 2013 Ms Goddard reported the tax liens Manager Reports and Comments A Administration Finance Temporarily Relocating County Manager Rick Hester reported that due to a leak in the Administration and Finance Departments , both offices would
