free cell use for all drivers , not just minors Page1290 February 4 , 2013 – 10 00 am Continued Chairman Carver thanked JoCo Teen Drivers for their efforts as well as Johnston County Schools for supporting their work He also thanked Ms Carroll as well as Teen Driving Safety Committee Chairman Charlie Parrish for their work with the initiative Commissioner Cookie Pope expressed her thanks to the students and the Committee and commented that a negative has been turned into a positive 4 Public Comments A Tax Revaluation Concerns from Dale Thompson Dale Thompson , 4542 Stevens Sausage Road , Smithfield , North Carolina , addressed the Board regarding his ongoing tax value appeal over property that contains a cell tower as well as his concerns over the 2011 Tax Revaluation Mr Thompson stated his appeal has not been resolved and he would welcome the opportunity to meet with Board Members and explain his concerns in more detail County Attorney David Mills explained that Mr Thompson’s appeal was heard by the Board of Equalization and Review as well as the Property Tax Commission which ruled in favor of the County and the appeal is now in the North Carolina Court of Appeals Mr Mills advised that the Board of Commissioners no longer have authority over the appeal because it is now in the hands of the courts Following discussion , Chairman Jeffrey P Carver stated once the North Carolina Court of Appeals has ruled on the appeal , he would be glad to sit down with Mr Thompson and discuss his concerns regarding the tax valuation process Mr Thompson also stated that he has not received copies of public records that he has previously requested from the County Mr Mills stated he would look into the public records request by Mr Thompson and provide him with any and all public records he has asked for B Animal Services – Update to the Board Director of Johnston County Animal Services Ernie Wilkinson provided a brief update to the Board Mr Wilkinson reported that the volunteer program is underway and Animal Services has received 16 applications from interested citizens who would like to become volunteers He stated an orientation class will be held on February 16 , 2013 with eight volunteers currently scheduled to attend Mr Wilkinson informed the Board that Animal Services began euthanasia by injection on January 23 , 2013 and plans to remove the gas chamber by February 15 , 2013 Mr Wilkinson also reported that he is working with a local veterinarian on setting up a spay and neuter program so that all animals leaving the shelter for adoption would be spayed or neutered He noted that the cost of the adoption fee would need to be adjusted which would require approval by the Board of Commissioners Mr Wilkinson stated he plans to make contact with all the other veterinarians in the County to see if they would like to participate in the program and he will report back to the Board when he has more details Commissioner Allen L Mims , Jr stated that he is glad the shelter is now using lethal injection for euthanasia ; however , he expressed concerns with completely removing the gas chamber Commissioner Mims continued that his concerns involve the safety of the staff when dealing with the euthanasia of feral animals He asked how staff would handle such instances Mr Wilkinson responded that Animal Services has procured sedation equipment that would minimize the safety risks to the staff when dealing with vicious and feral animals Mr Wilkinson stated he discussed getting an outside veterinarian to handle the injections ; however , he stated his staff stepped up and received the training necessary to perform the euthanasia in - house Mr Wilkinson complimented his staff , stating they have worked hard to implement the changes at Animal Services and he is proud of their efforts Mr Wilkinson thanked County Manager Rick Hester for his support during the process Commissioner Ted G Godwin asked about the difference in cost for gas versus lethal injection Mr Wilkinson stated the cost of the materials is approximately the same , but labor costs are higher with lethal injection Mr Wilkinson invited the Board Members to visit the shelter and see the changes being made Page2291 February 4 , 2013 – 10 00 am Continued Chairman Jeffrey P Carver commented on the recent changes and stated great strides have been made in the last 60 days at the shelter C Metro Energy Corp Michael Tucker of Chatham County , North Carolina , representing Metro Energy Corp , provided the Board with a brief background on his company Mr Tucker stated he would like to offer recycling services to the County with regards to the collection and disposal of scrap tires Mr Tucker noted that he has met with the County staff and hopes that he can offer his services in the future Following brief discussion , the Board asked staff to look into the request from Mr Tucker and report back to the Board 5 Johnston County Schools – Request to Transfer Funds for West Clayton Elementary School Roof Johnston County Schools Superintendent Dr Ed Croom requested the Board of Commissioners to approve the transfer of 700,000 from Current Expense to Capital Outlay Dr Croom explained the request is due to an unforeseen emergency at West Clayton Elementary School He stated extensive structural damage has been caused to the roof at the school due to heavy rains experienced in the fall of 2012 , causing leaks in the buildings and damage inside the school The transfer of funds would cover the cost of the roof replacement Dr Croom offered to answer any questions Upon a question by Commissioner Allen L Mims , Jr , Dr Croom stated the roof at West Clayton Elementary is over 30 years old Commissioner DeVan Barbour asked how many flat roofs remain in the County Dr Croom stated he is unsure exactly how many flat roofs remain , but he noted that Johnston County Schools is no longer using that design At the inquiry of Commissioner Cookie Pope , Dr Croom confirmed that the roof replacement at West Clayton Elementary School will be an A - Representing the Archer Lodge Area By unanimous vote show of hands , the Board reappointed Clyde Castleberry to serve a two year term to expire on February 28 , 2015 Representing the Clayton Area By unanimous vote show of hands , the Board reappointed Jody McLeod to serve a two year term to expire on February 28 , 2015 Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried unanimously , the Board made the following appointments on the Economic Development Commission Representing the Pine Level Area Reappointed Randy Jones to serve a two year term to expire on February 28 , 2015 Representing the Princeton Area Reappointed Brandon Holland to serve a two year term to expire on February 28 , 2015 Representing the Selma Area Reappointed Cheryl L Oliver to serve a two year term to expire on February 28 , 2015 11 Delinquent Tax Collection Report Tax Administrator Pat Goddard reported on the collection of delinquent taxes for the month of January 2013 She noted in addition to garnishments and bank attachments , nine foreclosure complaints were filed resulting in a collection of 17,98813 As of January 31 , 2013 , the Tax Department has collected 9474 of the real and personal levy for 2012 , and 7730 of the motor vehicle levy Through the NC State Debt Setoff Program , 74 accounts have been paid for a total of 11,21006 as of January 31 , 2013 The next foreclosure sale date is scheduled for February 27 , 2013 Ms Goddard stated the delinquent 2012 notices were mailed on January 18 , 2013 and pursuant to NCGS 105 - 369 c , tax liens will be advertised in March Ms Goddard also reported that the new online credit card fee is now 185 plus 010 per transaction which is down from 229 plus 015 per transaction The Board briefly discussed the new Tag and Tax Law that will take effect in July 12 Manager Reports and Comments A Reminder of Annual Work Session County Manager Rick Hester reminded everyone that the Board of Commissioners will be holding their annual work session on March 1 , 2013 at Johnston Community College beginning at 8 30 am B Request to Surplus Vehicle At the request of the Buildings & Grounds Department , upon a motion by Commissioner Tony Braswell , seconded by Commissioner Ted G Godwin , and carried unanimously , the Board declared the following vehicle as surplus and approved for it to be sold at the next public auction to be scheduled at a later date 1996 Ford F250 – Mileage 159,306 VIN Number 1FTHF25H4TEB77394Page7296 February 4 , 2013 – 10 00 am Continued 13 Board Reports and Comments Chairman Jeffrey P Carver reminded everyone that there is no 6 00 pm meeting due to no scheduled rezoning cases to be heard A Four Oaks EMS – Request to Construct New EMS Building Following brief discussion , it was the unanimous consensus of the Board for Four Oaks EMS to proceed with the next steps in their due diligence of investigating the construction of a new facility on their current site B Comments from Commissioner Ted G Godwin Commissioner Ted G Godwin commented on the earlier presentation by students from West Johnston High School on putting together a Safe Driving Summit in Johnston County as well as encouraging the creation of new laws with regards to cell phone use and driving Commissioner Godwin praised the students for their efforts on promoting safe driving for teens in Johnston County Commissioner Godwin stated he believes the work that the students are putting forth towards educating other teens in an effort to reduce teen deaths is the right direction ; however , he expressed concerns with looking to a central government to pass rules or laws to solve the problem Commissioner Godwin stated that he is not trying to put a damper on the enthusiasm or efforts of JoCo Teen Drivers , but he is concerned with laws that would restrict the freedom of the citizens There being no further business , Commissioner Allen L Mims , Jr moved the Board adjourn Commissioner Cookie Pope seconded the motion , which carri
