the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Allen L Mims , Jr , Vice Chairman Jeffrey P Carver , Cookie Pope , Wade M Stewart , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer J Chad McLamb , and County Attorney David F Mills Chairman Allen L Mims , Jr called the meeting to order at 10 00 am Commissioner W Ray Woodall opened the meeting with a prayer Commissioner Jeffrey P Carver led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – August 6 , 2012 10 00 am and 6 00 pm ; August 20 , 2012 B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Contender Drive , Bayliner Court , Javelin Court , Bertram Drive , Fountain Drive , Triton Court , Regulator Drive , and Pursuit Court – Summerset Place Subdivision Phases 1 , 2 , & 3 – Clayton Township C Resolution – Governor’s Highway Safety Program Grant Application Per a request by the Johnston County Teen Drivers Committee , the Board adopted the following resolution authorizing a grant application in the amount of 15,200 from the North Carolina Governor’s Highway Safety Program to fund the JoCo Teen Drivers Program WHEREAS , Johnston County herein called the “ Agency has completed an application contract for traffic safety funding ; and that Johnston County Board of Commissioners herein called the Governing Body ” has thoroughly considered the problem identified and has reviewed the project as described in the contract ; THEREFORE , NOW BE IT RESOLVED BY THE Johnston County Board of Commissioners IN OPEN MEETING ASSEMBLED IN THE CITY OF Smithfield , NORTH CAROLINA , THIS 4th DAY OF September , 2012 , AS FOLLOWS 1 That the project referenced above is in the best interest of the Governing Body and the general public ; and 2 That Lu Hickey is authorized to file , on behalf of the Governing Body , an application contract in the form prescribed by the Governor’s Highway Safety Program for federal funding in the amount of 15,200 to be made to the Governing Body to assist in defraying the cost of the project described in the contract application ; and 3 That the Governing Body has formally appropriated the cash contribution of 0 required by the project contract ; andPage66 September 4 , 2012 – 10 00 am Continued 4 That the Project Director designated in the application contract shall furnish or make arrangement for other appropriate persons to furnish such information , data , documents and reports as required by That this resolution shall take effect immediately upon its adoption D Proclamation – 2012 Fall Litter Sweep – September 15 – 29 , 2012 adopted as follows PROCLAMATION - FALL LITTER SWEEP 2012 WHEREAS , the North Carolina Department of Transportation organizes an annual fall statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the FALL LITTER SWEEP roadside cleanup encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Correction inmates and community service workers , local government agencies , community leaders , civic and community organizations , businesses , churches , schools , and environmentally concerned citizens conduct annual local cleanups during FALL LITTER SWEEP and may receive certificates of appreciation for their participation ; and WHEREAS , the great natural beauty of our state and a clean environment are sources of great pride for all North Carolinians , attracting tourists and aiding in recruiting new industries ; and WHEREAS , the cleanup will increase awareness of the need for cleaner roadsides , emphasize the importance of not littering , and encourage recycling of solid wastes ; and th WHEREAS , the 2012 FALL LITTER SWEEP will celebrate the 24 Anniversary of the North Carolina Adopt - A - Highway program and its 5,000 volunteer groups that donate their labor and time year round to keep our roadsides clean ; and WHEREAS , the FALL LITTER SWEEP cleanup will be a part of educating the children of this great State regarding the importance of a clean environment to the quality of life in Johnston County and North Carolina ; and NOW , THEREFORE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS , does hereby proclaim September 15 – 29 , 2012 as FALL LITTER SWEEP time in Johnston County , and encourages all citizens to take an active role in making their communities cleaner th Adopted this the 4 day of September , 2012 E Proclamation – Child Passenger Safety Week and National Seat Check Saturday adopted as follows CHILD PASSENGER SAFETY WEEK 2012 PROCLAMATION WHEREAS , Children are our country’s most precious resource As parents and caregivers it is our responsibility to keep America’s children safe Every year , thousands of children are tragically injured or killed in motor vehicle traffic crashes For children age 3 and older , it is the leading cause of death It is hard to overstate the toll this takes on families Together we can put an end to this WHEREAS , Today , all 50 States , the District of Columbia , and our Territories have laws requiring the use of child safety seats and seat belts for children traveling in motor vehicles These laws were enacted because of the tremendous safety benefits they provide We know that child safety seats help save lives and reduce injuries We also know that they are most effective when installed and used correctly Sadly , nearly 3 out of 4 child safety seats are not used properly Starting now , working together , we must join forces to prevent these deaths and injuries WHEREAS , Johnston County is committed to working closely with our partners and safety advocates to help reduce the number of young lives lost on our roadways Our goal is to educate parents and caregivers on how to properly install and use child safety seats During Child Passenger Safety Week , there will be hundreds of free child safety seat inspection stations set up across the country We encourage all parents and caregivers to take fighting fires is one of the most hazardous professions requiring physical strength , stamina , extensive training , courage , and selfless concern for the welfare of others ; and Whereas , firefighters provide valuable services to the citizens of Johnston County , their communities , and the County ; and Whereas , firefighters make sacrifices to protect the lives and financial interests of the citizens of Johnston County ; and Whereas , firefighters respond to emergencies without hesitation when the call of duty arises ; and Whereas , firefighters work with public safety officials and law enforcement officers to protect the integrity of crime scenes , which is necessary to resolve arson cases ; and Whereas , firefighters reside in the community in which they serve and have a Anderson informed the Board that the Economic Development Office would like to have a comprehensive natural gas study completed for the County Ms Anderson stated the study would provide exact locations of natural gas lines as well as capacity estimates and cost estimates to upgrade and or construct new natural gas lines She noted the total cost of the study is 113,000 and the Economic Development Corporation has allocated 40,000 towards that cost leaving a balance of 73,000 Ms Anderson stated she believes the County would benefit from the study because while locations of existing natural gas lines are known , it is uncertain if those lines could handle additional capacity Ms Anderson noted the gas company will allow the Economic Development Office to look at their maps ; however , they will not release copies of those maps Ms Anderson continued that the office has had numerous projects inquire about Johnston County that needed natural gas Ms Anderson introduced Economic Development Advisory Board Chairman Allen Wellons and Four Oaks Mayor and Economic Development Advisory Board Member Linwood Parker Economic Development Advisory Board Chairman Allen Wellons agreed that a County - wide study would be beneficial to economic development efforts Mr Wellons noted the Four Oaks Business Park does not have natural gas and many industries requiring natural gas want to be in a business park setting He stated the study would also help to identify capacity needs across the County Mr Wellons reported that since the 9 11 terrorist attacks , the natural gas companies will not release copies of their maps so the study would provide much needed information At the inquiry of Commissioner DeVan Barbour , Ms Anderson confirmed that 113,000 would cover the cost of the comprehensive study She noted that originally , the cost was higher ; however , staff was able to negotiate that cost down approximately 40 Commissioner Barbour asked once the study is completed and improvements are identified , who would be responsible for funding those upgrades Ms Anderson stated once an industry commits to a location , the natural gas company would then work with that industry on the funding for upgrades or extensions Upon questions by Commissioner Tony Braswell , Mr Wellons confirmed the study would look at the areas around the major highway corridors Mr Wellons stated without the study , the County does not really know what the needs are Ms Anderson stated the study would take approximately three to four months to complete and she feels it is a necessary tool for economic development Mr Wellons stated another benefit of the study would be having information readily available to relay to a potential industry as to where the lines and capacities are as well as how much it would cost to extend lines to a new area Ms Anderson agreed that the Economic Development Office needs information for companies that are considering Johnston County County Manager Rick Hester stated Ms Anderson has researched all other funding sources for assistance with the cost of the natural gas study Ms Anderson stated she has been unable to secure other funding sources because those agencies all require job creation as a component of their funding At the inquiry of Chairman Allen L Mims , Jr , Mr Wellons stated they have considered the option of approaching the municipalities for help with funding the study Four Oaks Mayor and Economic Development Advisory Board Member Linwood Parker addressed the Board Mayor Parker stated the Mayors ’ Association has endorsed the natural gas study for the County Mayor Parker stressed the need to attract more manufacturing industries to the County because of the associated higher paying jobs Mayor County was recently eliminated from consideration for a prospect that would have created 750 jobs because there is no natural gas at the Park Mayor Parker stated while he cannot commit funding from the Town of Four Oaks today , he believes the Four Oaks Town Council would like to be a part of the process He added the study will take three or four months to complete and the County must begin the process now Mayor Parker stated even with the downturn in the economy , Johnston County has continued to grow because of the commitment by the County Commissioners , the Economic Development Advisory Board , as well as the municipalities and he spoke on the importance of continuing that commitment Commissioner Braswell asked the County Manager to come up with a recommendation on funding the September 2012 6 Public Utilities – Proposed Authority for Protection and Maintenance of Existing Riparian Buffers Assistant Director of Utilities Chandra Coats explained that the Neuse River Riparian Buffer Protection Program 15A NCAC 2B 0233 is currently implemented and enforced by the North Carolina Department of Environment and Natural Resources , Division of Water Quality NCDENR DWQ The rules require minimum 50 foot vegetated buffers on surface waters Ms Coats reported in March 2010 , NCDENR implemented changes to the “ NCDENR Stormwater Design Manual ” modifying the design and construction of level spreaders that are required per the Neuse River riparian buffer rules Level spreaders are often required in residential subdivisions and commercial developments to distribute or diffuse concentrated stormwater flow intoPage175 September 4 , 2012 – 10 00 am Continued a buffered stream The newest design guidelines require developers to seek regulatory approval from NCDENR DWQ and Johnston County stormwater plan approval Ms Coats stated this duplicity in regulation increases the burden of the regulatory approval process for new developments Ms Coats continued that Rule 15A NCAC 02B 0241 states that local governments may request the authority to implement and enforce the State’s Neuse River riparian buffer protection requirements She noted Johnston County currently administers and enforces local 100 foot buffers on certain designated perennial streams in the County Currently , complaints regarding buffer encroachments are initially investigated by the County’s Stormwater Administrator for legitimacy , and then referred to DWQ for enforcement actions Ms Coats reported that seeking delegated powers from the State to enforce the buffer rules will incur minimal additional expenditure in County resources and will significantly improve services to County citizens and developers County Stormwater Administrator Jamie Guerrero explained that the guidelines were changed for level spreaders in 2010 which then required the development community to get authorization for the bypass channel to discharge through the buffer Mr Guerrero stated when the developer submits a stormwater application to the County Office they must also submit the same to DWQ for review of the very same items to make sure they comply with the very same rules Mr Guerrero stated when the DWQ gets the application they then review the entire project and not just the level spreaders He stated he has received several complaints from developers saying they have already complied with the County stormwater rules and regulations , yet DWQ is offering comments about items not even related to stormwater rules Mr Guerrero reported staff discussed the development community’s concerns with DWQ who contended that they cannot issue buffer authorization without looking at every other component Mr Guerrero also noted another issue for the development community is the amount of time it takes DWQ to complete their review Mr Guerrero stated the County staff is trained to review the exact same rules and regulations and no additional staff would be required to enforce the buffer rules locally He noted staff is already responding to buffer complaints from citizens in that the County often receives the first call Mr Guerrero stated DWQ has reduced their staff and now only has one or two staff members covering five or six counties Upon a question by Chairman Allen L Mims , Jr , Mr Guerrero stated staff is requesting complete authority to administer the buffer rules locally so if there is a violation it would go through the County’s processes He stated fines can be issued for those found in violation Mr Guerrero reported that State law requires all penalties and fines collected by the County to go to the School System Mr Guerrero stated one final benefit of having local authority is that over the years staff has developed a good relationship with not only the citizens of Johnston County , but the development community as well Mr Guerrero noted when he becomes aware of a situation , many times he can contact the developer who will resolve the matter before having to get DWQ involved or issuing penalties Chairman Mims commented it appears to him that by having local authority it would help speed up the process and improve customer service Chairman Mims asked about additional staffing needs Mr Guerrero confirmed no additional staff would be required Ms Coats stated in order to obtain authority for the buffer rules , the County must apply to NCDENR DWQ , adopt the necessary ordinances or resolutions to establish and maintain the State’s riparian buffer protection requirements , and establish a plan to address violations She stated staff respectfully requests the Board’s consideration to seek delegated authority for implementing and enforcing the Neuse River riparian buffer protection program in Johnston County’s planning jurisdiction Utilities Chandra Coats informed the Board that sedimentation and erosion control requirements established under the “ Sedimentation Pollution Control Act of 1973 ” require a sedimentation and erosion control plan to be submitted and approved prior to land disturbing activities exceeding one acre for residential , industrial , educational , institutional or commercial development She noted these requirements are currently implemented and enforced by the North Carolina Department of Environment and Natural Resources , Division of Land Resources NCDENR , DLR for land disturbing activities in Johnston County However , the rules allow for local governments to implement and enforce sedimentation and erosion control requirements within their own planning jurisdictions Ms Coats reported staff investigated a local program in 2004 and at the time , a land developers stakeholders meeting indicated support for a County program Many developments were in the planning , design , and construction phases and staff concluded that the County could provide better service to developers and citizens with County permitting authority However , additional staffing was required to administer the program and the Board chose to table the matter at that time Ms Coats continued that based on the current level of growth in the County and current staffing expertise , staff recommends reconsideration of a local sedimentation and erosion control program A local program could be implemented without the immediate need for additional staffing and existing County staff can provide accurate technical review , in addition to courteous and timely responses to complaints County Stormwater Administrator Jamie Guerrero explained that when a residential development is constructed , the developer installs temporary sediment basins as erosion control measures and often times the basins are left and become unsightly and hazardous Mr Guerrero continued that he receives numerous complaints about the basins which he has to refer to DENR He stated DENR does not require bonding or any sort of funding mechanism for the final grading to remove the basins He noted there are several subdivisions in the County where the developer has gone bankrupt or the subdivision has been developed and sold off with the basins still in place Mr Guerrero stated one of the advantages of taking the program on locally is the County can require bonding from the developer prior to plat approval to provide for a mechanism of funding to finish the erosion sediment control and remove the basins Chairman Allen L Mims , Jr stated staff has offered to have stakeholder meetings He asked if those meetings would be held prior to approaching DENR and seeking delegation of the program authority Mr Guerrero confirmed that prior to requesting delegation of program authority , the County would host a stakeholders meeting to gauge support from the development community , if the Board authorizes staff to go forward If the Board elects to move forward , an ordinance would be adopted and request for local delegation would be submitted to the Sedimentation Control Commission for approval He stated staff respectfully requests the Board’s consideration to seek delegated authority for a local Sedimentation and Erosion Control Regulatory Program Upon a motion by Commissioner Wade M Stewart , seconded by Commissioner Chairman Allen L Mims , Jr reappointed Dr Robert Bylciw , Ricky Young , and Alan Chip Hewett to the Hospital Authority Board of Commissioners for three year terms to expire on September 30 , 2015 10 Update from Health Department At the request of Commissioner Cookie Pope , Health Director Dr Marilyn Pearson provided the Board with an update on the recent outbreak of West Nile Virus in other states Dr Pearson stated at the present time , there are no reports of West Nile Virus in Johnston County She noted that labs are running out of testing materials because there are so many tests being administered Dr Pearson stated the Health Department is working with the Division of Public Health on getting information out to the public Upon a question by Commissioner Jeffrey P Carver , Dr Pearson stated the Health Department will begin offering flu vaccines soon and she noted that citizens can schedule appointments at the Health Department to receive a flu vaccine Dr Pearson also reported that the Tetanus - Diphtheria - Pertussis Tdap Vaccine is recommended for any adult that is updating their Tetanus vaccine She stated it is important for persons in contact with new babies to have the vaccine in that adults are carriers of the illness which can be passed onto infants Page680 September 4 , 2012 – 10 00 am Continued 11 Delinquent Tax Collection Report Tax Administrator Pat Goddard reported on the collection of delinquent taxes for the month of August 2012 As of August 31 , 2012 , the Tax Department has collected 790 of the real and personal levy for 2012 , and 5827 of the motor vehicle levy Through the NC State Debt Setoff Program , 27 accounts have been paid for a total of 3,01017 as of August 31 , 2012 The next foreclosure sale date is September 27 , 2012 Ms Goddard stated 3,214 calls were received by the Tax Office in the ten days following the tax bill mailing and 763 payment plans have been made as of August 31 , 2012 12 Manager Reports and Comments A Request from Johnston Community College County Manager Rick Hester explained that all of the Community College employees are State employees ; however , a few of those College employees are locally funded He noted that most of those locally funded positions involve housekeeping and maintenance positions Mr Hester reported the College did not budget funds for the 12 raise that was given to State employees for those locally funded positions and has requested the County to allocate funds in the amount of 16,525 to cover the cost Following questions and discussion , it was the consensus of the Board to have the County Manager research the request further and report back to the Board at the 6 00 pm meeting Note At the 6 00 pm meeting , the Board voted to allocate funds in the amount of 16,525 from Capital Outlay to the College to cover the cost of the 12 raise for the locally funded employees B Temporary Satellite Smithfield EMS Unit County Manager Rick Hester reported that during the Market Street Neuse River Bridge replacement project , scheduled to begin later this month , the County will be placing a temporary satellite EMS unit at the Wilson’s Mills Fire Station No 2 while the bridge is being replaced 13 Board Reports and Comments A Reminder of Joint Meeting with the Board of Education Chairman Allen L Mims , Jr reminded everyone of the joint meeting with the Board of Education to be held on Thursday , September 6 , 2012 at 6 00 pm at the AG Glenn Building in Smithfield for the purposes of listening to a presentation from the Operations Research and Education Laboratory th B Recognition of Craven County’s 300 Anniversary Chairman Allen L Mims , Jr stated he has received notice that Craven County will be celebrating their th 300 Anniversary and they have invited the Commissioners to attend some of the ceremonies that will be marking this occasion Following discussion , it was the consensus of the Board to send a letter of congratulations to the Craven County Board of Commissioners C Princeton EMS Transition Update The Board briefly discussed the Princeton EMS Unit transition Chairman Allen L Mims , Jr noted that the Princeton EMS Board members will be meeting with the Princeton Town Council later this evening ; however , no changes are anticipated from what has been negotiated to this point It is hoped that an agreement will be signed soon Commissioner Tony Braswell thanked Chairman Mims for all his work on the transition Commissioner Braswell expressed concerns that an agreement has still not been reached Princeton Fire Chief Ken Starling noted that the EMS portion of the building and property has been transferred to the Fire Department and the Fire Department has agreed to purchase additional property for a newPage781 Johnston County EMS Division Chief Josh Holloman reported the County has received title to the two Princeton EMS ambulances and staff will be working on restocking them with medical supplies and getting the required State inspections Mr Holloman stated staff will also work on moving to the EMS portion of the building later in the day There being no further business , Commissioner Cookie Pope
