Personal Real Property 49522 Tax releases - Personal Real Property 2,05980 Motor Vehicle releases refunds 7,14195 Recommended by Tax Administrator Pat Goddard Approved by Finance Director J Chad McLamb 3 Public Comments A ATV Complaint James Stephenson , 5581 Elevation Road , Benson , addressed the Board concerning his ongoing complaint regarding noise and dust created by the use of ATVs on property located on Telfer Lane Mr Stephenson reported on recent activities by the ATVs and how those activities have impacted him and his property Mr Stephenson stated he reported the recent activities to the Sheriff’s Department as well as Commissioners Wade M Stewart and DeVan Barbour He noted by the time the Deputy visited the property , it was after dark and there was nothing to see Mr Stephenson referenced previous correspondence from the County to the ATV owners on Telfer Lane and he asked if the correspondence meant that actions could be taken against the complaints by the Sheriff’s Department Chairman Allen L Mims , Jr recalled that because of the ATV activities from last summer , the County Manager and the County Attorney met with the ATV owners who were willing to work out a compromise ; however , Mr Stephenson was not open to any compromise County Manager Rick Hester confirmed that he and the County Attorney met with one of the ATV owners who was very open to compromise Following discussion between the Board and Mr Stephenson , Chairman Allen L Mims , Jr noted that during Board Comment he will be calling for a public hearing for the August 6 , 2012 6 00 pm meeting with regards to a proposed amendment to the noise ordinance that may have some impact on the activities At the inquiry of Commissioner Tony Braswell , Mr Stephenson stated that considering the way the ATV owners are currently running , there is no middle ground ; however , he would be willing to talk about the situation further 4 Sheriff’s Department – Request to Surplus and Auction Vehicles Sheriff Steve Bizzell requested the Board to declare the following vehicles surplus and approve for them to be sold at the Government Services Administration Auction on Monday , August 20 , 2012 at 2 00 pm by Manheim of NC Auto Auction in Kenly , NC Sheriff Bizzell stated the vehicles have major mechanical issues and are not worth the expense it would take to get them running again Year Make Model VIN Mileage 2005 Ford Crown Vic 2FAFP71W15X177589 114,015 2007 Ford Crown Vic 2FAFP71W97X142642 110,403 2007 Ford Crown Vic 2FAFP71W17X142649 127,575 Upon a motion by Commissioner Cookie Pope , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board declared the above listed vehicles surplus and approved for them to bePagePage pageNumber55 July 2 , 2012 – 10 00 am Continued sold at the Government Services Administration Auction on Monday , August 20 , 2012 at 2 00 pm by Manheim of NC Auto Auction formerly Aycock Auto Auction in Kenly , NC 5 Wilson’s Mills Fire Department – Request for Tax Exempt Loan Status Commissioner Jeffrey P Carver abstained from the following item and the Board agreed by consent Bentley Powell , Chief of the Wilson’s Mills Fire Department , requested the Board to grant the fire department tax exempt loan status so they can borrow 300,000 from First Citizens Bank at an interest rate of 325 over a ten year loan period for the purchase of a 2012 Pierce Pumper truck Chief Powell reported the total cost of the truck is 388,000 and County Finance Director Chad McLamb has reviewed the proposals and recommends the financing with First Citizens Bank He noted that Mr McLamb has also recommended the fire department to enter into a monthly payment schedule versus annual to save money on interest Commissioner Tony Braswell noted the Board has seen a range in the prices of fire trucks being purchased by the fire departments and he asked Chief Powell if he felt the truck they propose to purchase will be sufficient for their needs Commissioner Braswell questioned the range in pricing on some of the trucks Chief Powell stated that while he cannot speak for other fire departments , he believes the truck they are purchasing will be sufficient for their needs Chief Powell agreed that there is a range in pricing for trucks and he noted that they have ordered a conservative model for their needs and were able to piggyback off of a Wake County contract He stated Department of Insurance standards recommend the fire department to have five engines in service and the new truck will replace a 1981 model , which they hope to sell Upon a motion by Commissioner DeVan Barbour , seconded by Commissioner Tony Braswell , and carried by unanimous vote with Commissioner Carver abstaining , the Board adopted the following resolution approving tax exempt loan status for the Wilson’s Mills Volunteer Fire Department NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Wilson’s Mills Volunteer Fire Department of Johnston County , North Carolina the “ VFD ” , from First Citizens Bank , in a principal amount of 300,00000 , which loan is for the following purpose 2012 Pierce Pumper truck , which will be owned and operated by the VFD , and will be maintained at the following address 145 Fire Department Road , Clayton , NC 27527 RESOLVED , FURTHER , that the approval of the loan to the VFD set forth above is given solely for purposes of the public approval requirements for tax - exempt financing applicable to the VFD because of Section 150 e 3 and Section 147 f of the Internal Revenue Code of 1986 , as amended , and such approval does not obligate the County or its Board of Commissioners in any way regarding repayment of the debt nd Duly certified by the execution hereof and the placement hereon of the seal of said county , this 2 day of July , 2012 6 Johnston County Airport Terminal Building Project Johnston County Airport Director Ray Blackmon reviewed a PowerPoint Presentation with the Board concerning the Airport’s new terminal building project Mr Blackmon introduced Airport Authority Chairman Ray Hales , current Board Member Ken Starling as well as former Board Member Dr Leonard Woodall in the audience Mr Blackmon explained the Johnston County Airport is currently a Group II airport and they would like to position the operation to become a Group III airport which will allow them to take on larger corporate type business aircraft He stated the Airport presently does not have adequate space in between the runway and the taxiway in order to expand the ramp area which is needed to become a Group III airport Mr Blackmon also noted the existing building was constructed in 1978 and they have outgrown the space as well as the building must come down to make room for the ramp area expansion Mr Blackmon stated they currently have a projected need for approximately 8,500 square feet of space and would like to build a structure that will be adequate for the next 30 years He stated the total cost of the building project is estimated at 39 million with the local share estimated at 14 million The Johnston County Airport has 800,000 in their CD fund balance and 96,687 in the Airport Authority general fund account which would be put towards the project He stated the County presently owes the Airport 511,000 in past local grant fund matches that the Airport Authority fronted on behalf of the County and now is requesting the Board to commit to an acceptable repayment schedule so the funds can be used towards the new terminal building project Mr Blackmon reviewed the following presentation with the Board PagePage pageNumber66 July 2 , 2012 – 10 00 am Continued Project Funding Request Johnston County Airport JNX New Terminal Building July 2 , 2012 Johnston County Airport JNX New Terminal Building Project Background & Justification • Existing Terminal Built in 1978 original building • Only miscellaneous minor renovations undertaken since • Original airport and terminal area designed for Group I aircraft single engine and short wingspan • Currently the airport is classified as Group II airport single multi - engine and longer wingspan with the demand to support Group III aircraft on a regular basis • Currently there is inadequate clearance for larger aircraft to safely taxi in the vicinity of the Terminal Building when any aircraft are parked Johnston County Airport JNX New Terminal Building Proposed Terminal Group III T W OFA to L ’ L Tie - 2014 budget Chairman Allen L Mims , Jr asked about the construction timeline Mr Blackmon reported surveying work on the project is just now beginning with plans for site work to start as soon as possible He stated construction on the building is anticipated to begin this time next year Commissioner Jeffrey P Carver asked about current aircraft traffic and fuel sales Commissioner Carver also inquired as to how the Airport Economic Development Incentive Grant program is doing Mr Blackmon stated presently the Airport has approximately 65 operations takeoffs and landings on average per day He noted fuel sales remain strong with all the hangers being full and the need is there to construct more hangers Mr Blackmon stated the Airport Economic Development Incentive Grant program presently has one grant project ongoing and he is in talks with another opportunity Mr Blackmon stated the primary reason for the new terminal is that they have outgrown their existing space and need to expand the ramp area Mr Blackmon reported the project will encourage more traffic by providing a more attractive place to fly into with the larger facilities Johnston County Airport Authority Chairman Ray Hales stated the expansion will not only help with aircraft placement at the Airport , but will help transition them to a Group III operation Commissioner Tony Braswell moved the Board approve for the County to proceed with entering into a repayment schedule for the 511,000 reimbursement on past local grant fund matches in accordance with a payment schedule that is satisfactory to the County Manager and the County Finance Director to begin in FY 2013 - 189,90186 Unenforceable accounts represent 3819 of the Unpaid Balance of Real and Personal Property 189,90186 497,21358 381932 Tax Collection Rate Summary as of June 30 , 2000 9377 2001 9544 2002 9601 2003 9680 2004 9735 2005 9817 2006 9833 2007 9835 2008 9858 2009 9867 2010 9863 2011 9861 2012 9868 Summary Johnston County tax collections remain very strong This is our highest collections percentage in my tenure with the county and we believe it is the highest collections rate ever Our thanks go in large part to the Citizens of Johnston County for paying their taxes The 2011 levy was increased by 10,202,14063 mostly due to the 2011 countywide revaluation This year we also saw an increase in the registered motor vehicle levy Notably with this increase in the amount to collect , the tax collections staff was able to exceed last year’s overall collections percentage Bankruptcy protection coupled with the one appeal at the property tax commission represents 3819 of the unpaid balance of real and personal property taxes As in previous years , the collection of the motor vehicle tax remains one of our most difficult challenges This year we continued to experience a drop in the percent of citizens paying their motor vehicle tax bills before the delinquency date th As of June 30 , 8069 of May and 6428 of June motor vehicle bills had been collected but it is too early in the collections cycle to begin enforced collections for those two months The unpaid balance for May and June was 468,584 of the total 856,983 unpaid for 2011 - 2012 or 5468 Ultimately most of these taxes will be collected The low “ voluntary ” collection rate coupled with the monthly billing cycle is the reason a 90 collection rate for motor vehicles is exceptional for any North Carolina county This is our fourth year to collect over 91 According to the State Treasurer’s previous fiscal year 2010 totals , Johnston County has the fourth highest overall collection rate among counties with a population of greater than 100,000 We ranked second in the highest collection rate excluding motor vehicles For motor vehicle collections , we ranked fourth for counties in our population range Regardless the ranking , our RMV collection rate is excellent The Johnston County Tax Office Employees and the Citizens of Johnston County are due all the credit for accomplishing this remarkable collection rate It requires everyone’s best effort from placing values on property , to answering the phone , to assisting taxpayers , to collecting the tax whether voluntary or enforced to achieve this goal Page414 July 2 , 2012 – 10 00 am Continued With the increased amount to collect and the county’s dependency on the property tax to fund necessary services , the challenge is to continue to collect at these levels while maintaining outstanding customer service Property taxes represented 6119 of the general fund budget for 2011 - 2012 By collecting the taxes owed , the tax rate in subsequent years remains lower for all taxpayers All county employees in the tax administration office remain dedicated to the fair and equitable treatment of the citizens of Johnston County I recognize , appreciate , and am sincerely thankful , for the dedicated day to day work of the tax collections staff in accomplishing this remarkable tax collection rate I thank each of you for your continued support of me and the tax office staff Without your support in collecting taxes in difficult situations this high level of achievement , which saves all taxpayers money , would not be possible As required by state law , this is a true and accurate settlement pursuant to NCGS 105 - 373 I request the Johnston County Board of County Commissioners accept the settlement and pursuant to NCGS 105 - 321 charge me as Tax Collector with the responsibility for collection of the 2012 taxes by all legal means necessary Motion to Accept Tax Settlement and Charge Tax Administrator to Collect 2012 Taxes Commissioner Jeffrey P Carver moved the Board accept the Annual Tax Settlement for 2011 taxes , and issue the following charge to the Tax Administrator for collection of 2012 taxes Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote You are hereby authorized , empowered , and commanded to collect the taxes set forth in the tax records filed in the office of the Tax Administrator and in the tax receipts herewith delivered to you , in the amounts and from the taxpayers likewise therein set forth Such taxes are hereby declared to be a first lien upon all real property of the respective taxpayers in Johnston County , and this order shall be a full and sufficient authority to direct , require , and enable you to levy on and sell any real or personal property of such taxpayers , for and on account thereof , in accordance with law 10 Boys & Girls Club – Youth Voice 2012 Summit Mamie Moore , Director of the Boys & Girls Club of Selma , introduced Gabriel Zhan’e Haire who will be attending the North Carolina Association of County Commissioners Conference in August for the Youth Voice 2012 Summit representing Johnston County Ms Moore reported during the 2012 Youth Summit , the Association will be asking youth representatives to learn more about select county government services and responsibilities and then use what they have learned to develop potential solutions to a county problem Ms Moore stated that Miss Haire inspires her every day by wanting to make a difference in the County She added Miss Haire is a rising senior at Princeton High School with plans to attend Duke University Ms Haire provided the Board with a background on her education and volunteer experiences in the County , specifically with the Boys & Girls Club Ms Haire stated she will be attending the Association of County Commissioners Conference in August and would like to talk about the issues regarding teen driving and specifically , how the Teen Driving Safety Program has impacted teen driving in Johnston County Chairman Allen L Mims , Jr noted that Commissioners Tony Braswell and Cookie Pope worked together to get the Teen Driving Safety Committee started Commissioner Cookie Pope spoke on the impact that peer pressure has on teens today and how the Committee has learned that by involving teens in their work it seems to help spread the word on the importance of driving safely in the County She added teens are more likely to listen to each other versus listening to parents , teachers , or other adults Commissioner Pope expressed her appreciation to Miss Haire for wanting to help and she offered to meet with her again in the future Commissioner Tony Braswell spoke on how the Committee began , stating the goal was to try and get all the different groups together such as Johnston County Schools , the Department of Transportation , the Highway Patrol , the Sheriff’s Office , the District Attorney’s Office , citizens , parents , and students so they could work together and formulate one program He stated the program is now being administered by the teens with adultPage515 July 2 , 2012 – 10 00 am Continued assistance Commissioner Braswell referred Miss Haire to the Teen Driving Safety Committee Chairman Charlie Parrish and Vice Chair Lynda Carroll , noting they have done a great job Commissioner Braswell stated he believes the Committee’s work is helping but everyone must continue to bring awareness to the issue so teens will remember that they are not invincible Commissioner Braswell also spoke on the importance of accountability Chairman Mims stated many teens new to driving do not know their limitations and he expressed the need to find ways to get the message across Chairman Mims stated the Board would appreciate Miss Haire coming back and sharing what she learns at the Conference in August and possible solutions on how to help 11 Manager Reports and Comments A Resolution Accepting SRF Loan - NC 42 West Force Main Replacement Project Per the request of Public Utilities , upon a motion by Commissioner Tony Braswell , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board adopted the following resolution accepting the 200,000 State Revolving Fund Loan for construction of the NC 42 West Force Main Replacement Project RESOLUTION BY JOHNSTON COUNTY BOARD OF COMMISSIONERS STATE REVOLVING LOAN FOR NC 42 WEST FORCE MAIN REPLACEMENT PROJECT WHEREAS , the North Carolina Clean Water Revolving Loan and Grant Act of 1987 has authorized the making of loans and grants to aid eligible units of government in financing the cost of construction of wastewater treatment works , wastewater collection systems , and water supply systems , water conservation projects , and WHEREAS , the North Carolina Department of Environment and Natural Resources has offered a State Revolving Loan in the amount of 200,000 for the construction of the NC 42 West Force Main Replacement Project , and WHEREAS , Johnston County intends to construct said project in accordance with the approved plans and specifications , Now , therefore , be it resolved by the Johnston County Board of Commissioners That Johnston County does hereby accept the State Revolving Loan offer of 200,000 That Johnston County does hereby give assurance to the North Carolina Department of Environment and Natural Resources that all items specified in the loan offer , Section II – Assurances will be adhered to That Rick J Hester , County Manager , and successors so titled , is hereby authorized and directed to furnish such information as the appropriate State agency may request in connection with such application or the project ; to make the assurances as contained above ; and to execute such other documents as may be required in connection with the application That Johnston County has substantially complied or will substantially comply with all Federal , State and local laws , rules regulations , and ordinances applicable to the project and to Federal and State grants and loans pertaining thereto Adopted this the 2nd day of July 2012 , at Smithfield , North Carolina B Request for Closed Session County Manager Rick Hester requested a closed session - NCGS § 14331811 a 3 – Attorney Client Privilege 12 Board Reports and Comments A Public Hearing Scheduled – August 6 , 2012 6 00 pm Meeting – Code of Ordinance Amendment Chairman Allen L Mims , Jr scheduled a public hearing for the August 6 , 2012 6 00 pm meeting for the purposes of allowing public comment on a proposed amendment to the noise ordinance in the Code of Ordinances Chairman Mims stated the County Attorney will be working on a proposed amendment B Recognition of Princeton Fire Department Commissioner Tony Braswell thanked the Princeton Fire Department and the Princeton Fire Chief Ken Starling for their support to the County during the transition of the Princeton EMS operations Commissioner Braswell noted the fire department has worked with the County to make sure the transition went smoothly andPage616 July 2 , 2012 – 10 00 am Continued the Board appreciates the fire department’s hospitality in allowing the County to operate from the fire department’s facilities C Update on EMS Transitions At the request of Commissioner Cookie Pope , Director of Emergency Services Kim Robertson and EMS Division Chief Josh Holloman updated the Board on the transition of the Clayton , Princeton , and Smithfield EMS operations to the County over the weekend Ms Robertson reported the County began providing services at Princeton , Clayton , and Smithfield over the weekend She noted that meetings and work to prepare for the transitions began approximately three months ago and she expressed her appreciation to County Manager Rick Hester , Finance Director Chad McLamb and his staff , Human Resources Director Lu Hickey and her staff , along with County Attorney David Mills for all their assistance Ms Robertson stated the transitions would not have been successful without the support from staff as well as the support from the Board of Commissioners Ms Robertson also thanked Princeton Fire Chief Ken Starling for allowing EMS to utilize the fire department for the Princeton EMS operations Mr Holloman reported transitions are going smoothly at the three agencies He echoed Ms Robertson’s comments that it would not have been successful without everyone’s assistance Mr Holloman thanked Ms Robertson , Emergency Management Coordinator Darrell Alford , and Assistant Director of Emergency Services Chris Perry for their support to the EMS Division He noted that things will probably come up ; however , the County will continue to provide the excellent service that the citizens are used to receiving The Board thanked the Emergency Services staff for all their work on the transitions 13 Closed Session – NCGS § 143 -
