Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Allen L Mims , Jr , Vice Chairman Jeffrey P Carver , Cookie Pope , Wade M Stewart , W Ray Woodall , DeVan Barbour , and Tony Braswell Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer J Chad McLamb , and County Attorney David F Mills Chairman Allen L Mims , Jr called the meeting to order at 10 00 am Commissioner W Ray Woodall opened the meeting with a prayer Commissioner DeVan Barbour led those in attendance in the pledge of allegiance to the American flag 1 Approval Discussion of Agenda Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Jeffrey P Carver , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – February 6 , 2012 10 00 am and 6 00 pm B Proclamation – Week of the Young Child – April 22 – 28 , 2012 The Board adopted the following proclamation declaring the week of April 22 – 28 , 2012 as The Week of the Young Child in Johnston County Proclamation The Week of the Young Child April 22 – 28 , 2012 WHEREAS , the Partnership for Children of Johnston County and other local organizations , in conjunction with the National Association for the Education of Young Children , are celebrating the Week of the Young Child , April 22 through April 28 ; and WHEREAS , these organizations are working to improve early learning opportunities , including early literacy programs , that can provide a foundation of learning for children in Johnston County ; and WHEREAS , teachers and others who make a difference in the lives of young children in Johnston County deserve thanks and recognition ; and WHEREAS , public policies that support early learning for all young children are crucial to young children’s futures NOW , THEREFORE , BE IT RESOLVED , that the Johnston County Board of Commissioners hereby proclaims April 22 - 28 , 2012 as The Week of the Young Child in Johnston County and encourages all citizens to work to make a good investment in early childhood in Johnston County th Adopted this the Girl Scouts of the USA , which began in 1912 when Juliette “ Daisy ” Gordon Low gathered 18 girls in Savannah , Georgia , to provide them the opportunity to develop physically , mentally , and spiritually ; andPage751 March 5 , 2012 – 10 00 am Continued WHEREAS , for 100 years , Girl Scouting has helped build millions of girls and women of courage , confidence , and character who act to by the North Carolina Jail Inspector E Neuse Riverkeeper Foundation – Annual Neuse River Spring Cleanup – Request to Waive Landfill Tipping Fees The Board waived the landfill tipping fees on the day of the 2012 Annual Neuse River Spring Cleanup which is scheduled for April 7 , 2012 , for trash collected in Johnston County F Order to Advertise Tax Liens Pursuant to NCGS § 105 - 369 a and b1 , the total amount of unpaid real estate taxes for 2011 is 5,383,30081 as of January 31 , 2012 To satisfy the requirement of NCGS § 105 - 369 b1 , notices of unpaid delinquent taxes were sent via US mail to Committee’s efforts have played a part in that decrease Mr Parrish stressed the Committee will continue its work He noted the County allocated 10,000 in FY 11 - 12 for the program and asked the Board to continue that funding for FY 12 - 13 Mr Parrish also reported the Committee has been approached by private companies and individuals who would like to donate to the program and he asked the Board for their approval to solicit and accept those private donations He stated the Committee is planning a summit on April 19 , 2012 as well as a program in the fall and would recognize private sponsorships during such events Mr Parrish noted that if the Committee received an offer for a large sponsorship they would either bring that back to the Board or inform the County Manager Mr Parrish added the Committee will continue to look for grant funding At the inquiry of Chairman Allen L Mims , Jr , Mr Parrish reported the Committee is not established as a 501 c 3 nonprofit corporation and all funds for the program are handled through the County County Manager Rick Hester noted that most of the current fiscal year allocation of 10,000 has been used towards the Committee’s activities Chairman Mims stated he did not believe there will be a problem allocating another 10,000 in the upcoming FY 12 - 13 budget Chairman Mims asked his fellow Commissioners how they felt about the Committee soliciting and accepting private sponsorships and donations It was the unanimous consensus of the Board to allow the Committee to solicit and accept private sponsorships and donations Commissioner Jeffrey P Carver instructed staff to work with Mr Parrish on establishing a 501 c 3 non - profit corporation B Comments from Chuck Fager – Opposition to Tolling on Interstate 95 Chuck Fager , 223 Hillside Avenue , Fayetteville , North Carolina , presented a handout to the Board regarding the proposed tolling of Interstate 95 in North Carolina Mr Fager expressed his opposition to tolling on Interstate 95 in North Carolina and spoke on the potential economic impacts that tolling would have on Johnston County as well as other counties in North Carolina along Interstate 95 Mr Fager also noted his concerns regarding the increase in traffic on US Hwy 301 that would occur from vehicles diverting off of Interstate 95 to avoid the tolls and the possible safety issues that could arise He asked the Board to consider adopting a resolution in opposition to tolling on Interstate 95 in North Carolina Chairman Allen L Mims , Jr thanked Mr Fager for his comments and noted the Board items to be returned to the Sheriff’s Department budget 5 Update from Sheriff Steve Bizzell At the inquiry of Chairman Allen L Mims , Jr , Sheriff Steve Bizzell reported to date , his office has issued three panhandling permits and they are in the process of notifying those that may not be aware of the permit requirement and that the permit must be displayed at all times Sheriff Bizzell stated it seems that most of the panhandlers are moving within the city limits Chairman Mims asked if the Sheriff’s Office had issued any littering citations recently , noting that the Commissioners are still receiving complaints from citizens regarding littering Chairman Mims also asked if the Sheriff’s Office has seen an increase in calls from citizens regarding the discharge of firearms in residential areas since the County’s firearms ordinance was adopted Chairman Mims noted that he received a call from a concerned citizen who may appear before the Board at the 6 00 pm meeting during Public Comment on such a matter Sheriff Bizzell stated while the Sheriff’s Office is seeing the aftereffects of littering in the County , it is difficult to catch people in the act , but the deputies are always on the lookout Sheriff Bizzell reported his office is still receiving calls from citizens complaining of individuals shooting in residential areas which are being investigated Upon a question by Commissioner DeVan Barbour , Sheriff Bizzell stated his office recently responded to an instance in the McGee’s Crossroads area of individuals shooting at exploding targets and the matter has been resolved At the inquiry of Commissioner Wade M Stewart , Sheriff Bizzell explained that the cost of cleaning up after methamphetamine labs is increasing and he noted each cleanup is costing the County an average of 3,000 Sheriff Bizzell stated he expects to exceed his budget line item for that expense this fiscal year Sheriff Bizzell reported the State of North Carolina is researching a program in which he hopes will be enacted soon , whereby the State would offer container sites just for methamphetamine lab cleanup and the SBI would be responsible for delivering the materials to the container sites relieving the counties from that burden Sheriff Bizzell expressed his frustration with criminals making methamphetamine and then contaminating the rivers , streams , and ditches where ultimately the taxpayers will pay for the cleanup Sheriff Bizzell added it is not fair to the taxpayers and something needs to be done The Board thanked the Sheriff for the update PagePage pageNumber8757 March 5 , 2012 – 10 00 am Continued 6 Nursing Home Adult Care Home Community Advisory Committee – Update to the Board Jimmy Parker , Chairman of the Nursing Home Adult Care Home Community Advisory Committee , provided the Board with an annual update on the Committee’s work Mr Parker stated that the Committee is established under North Carolina General Statutes with a responsibility to visit all the long term care facilities in the County and inspect the conditions in which the residents live , assure that the residents ’ Bill of Rights are behind upheld and help residents with any other concerns The Nursing Home Board is also charged with documenting the visits and filing reports with the Ombudsman which are now available on the County’s website Mr Parker stated another component of their work is keeping the community informed about long term care and other issues affecting the elder population He added the mission is to serve as grassroots volunteer advocates for every resident that calls a long term care facility in Johnston County home Mr Parker noted currently there are 15 active Committee Members and the Committee is allowed to have up to 25 members Mr Parker recognized Committee Vice Chairman George Smith and Ombudsman Nancy Murphy in the audience Mr Parker reported currently there are 21 long term care facilities in the County with a total capacity for residents exceeding 1,100 He stated over the past year the Committee has seen changes including the opening of a new facility for family care while another family care center closed as well as there have been conversions in some of the facilities to create more memory care options which is a growing need Mr Parker added there have been expansions for rehab services in at least two of the facilities Mr Parker noted that some of the overall strengths in the County are the good community involvement from local Church and Civic Groups and that most of the facilities have dedicated and well trained staff Mr Parker informed the Board there is new management in some of the facilities which has proven to be good in most cases He explained during the past year , new legislation was enacted requiring infection control training for adult care home medication technicians and other staff that have hands on care of patients Mr Parker noted usual weaknesses that involve high staffing turnover , a lack of training in some of the facilities and aging facilities in need of repair or updating Mr Parker briefly updated the Board on the star rating system which is intended to allow people to compare facilities within the regions ; however , he stated the Committee’s findings are that the star ratings are not very informative and they only suggest using those ratings as one tool when selecting a facility for a family member or friend and not as a sole measure Mr Parker reported the Nursing Home Board Committee Teams , during the past year , conducted 65 facility visits spending approximately 1,400 hours on the visits which generated over 100 reports Mr Parker stated the reports focus on three primary areas including an assessment of the residents , the living accommodations , and the services the residents receive Mr Parker reported some of the residents ’ complaints involve the quality and portions of food , inadequate heating facilities , and family concerns about improper patient discharge from facilities Mr Parker noted that one facility was recently closed due to environmental conditions ; however , corrective measures were taken and that facility has since reopened He stated the Committee members are advocates at all times and continually work to resolve issues for the residents or refer the matters to the Ombudsman who in turn works with the appropriate State agencies for a resolution Mr Parker stated the Committee members continue to attend community events and distribute materials related to long term care He stated the Committee provides information to people who are selecting a facility for a family member as well as the members are available to speak to civic groups and or Churches He noted the Committee officers attended leadership training sessions conducted by the Ombudsman Program and from the sessions received special training in certain areas , shared experiences with other communities , and established a listserve so they can communicate with each other on universal problems Mr Parker stated they have updated the Strategic Plan that was put in place three years ago to include providing at least ten hours of continuing education credits for the members during the year He noted a primary problem the Nursing Home Board has is recruiting and retaining members as well as the lack of funds to reimburse the members for travel expenses He offered to answer any questions Upon a question by Commissioner Tony Braswell , Mr Parker confirmed that Brithaven has obtained a Certificate of Need for a 100 - bed facility to be located beside the Johnston Health Clayton Medical Center on Hwy 42 , but he is unsure if construction has begun The Board thanked Mr Parker for the update and thanked the Director of Utilities and Engineering Tim Broome explained that in accordance with the interlocal agreement between the County and the Town of Princeton , the County has agreed to pay 25 , not to exceed 150,000 , for modifications to the Princeton elevated tank He reported the Town bid the project and awarded a construction contract last month and has now requested the County to make the first 75,000 payment The Town has also requested a certification from the County that the amount of 150,000 is available for the project Mr Broome continued that the 150,000 was not included in the FY 11 - 12 budget as Princeton’s project had been delayed and their construction schedule was indefinite He asked the Board to appropriate 150,000 from Fund 67 reserve for funding the County’s share of the tank modifications Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner W Ray Woodall , and carried by unanimous vote , the Board approved the allocation of 150,000 from Fund 67 reserve to fund the County’s share of the Princeton elevated tank modifications 8 Public Utilities – Community Development Block Grant Requirements Director of Utilities and Engineering Tim Broome reported in order to comply with the funding conditions of a Community Development Block Grant NO 10 - C - 2212 awarded for water and sewer to serve the Brookside Landing multifamily senior housing project near the intersection of Glen and Cleveland Roads , the Board of Commissioners adopted required resolutions on December 5 , 2011 He stated the North Carolina Department of Commerce CDBG Compliance Section has reviewed the adopted resolutions and documentation submitted by Johnston County and in order to satisfy the remainder of the program requirements the CDBG Section has requested the County to amend the previously adopted Section 3 Plan , adopt a Section 504 Compliance Officer Grievance Procedure , and adopt a fair housing plan Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board adopted the following two resolutions and fair housing plan for the Community Development Block Grant Brookside Landing water and sewer project Johnston County Community Development Block Grant Program Project # 10 - C - 2212 Local Economic Benefit for Low - and Very Low - Income Persons Section 3 Plan This resolution amends the CDBG - HD Section 3 Plan adopted December 5 , 2011 It shall be the policy of Johnston County County , in conducting its Small Cities Community Development Block Grant CDBG Housing Development program , to ensure that , to the greatest extent possible , contracts for work are awarded to business concerns located or owned in substantial part by persons residing in the Section 3 covered area , as required by Section 3 of the Housing and Urban Development Act of 1968 , Johnston County has developed and hereby adopts the following Plan This Section 3 Plan shall apply to services needed in connection with the grant including , but not limited to , businesses in the fields of planning , consulting , design , building construction renovation , maintenance and repair , collection of delinquent taxes for the month of February 2012 She noted in addition to garnishments and bank attachments , four foreclosure complaints were filed resulting in a collection of 12,78066 As of February 29 , 2012 the Tax Department has collected 9580 of the real and personal levy for 2011 , and 8328 of the motor vehicle levy Through the NC State Debt Setoff Program , 907 accounts have been paid for a total of 99,28823 as of February 29 , 2012 The next foreclosure sale date is scheduled for March 28 , 2012 Ms Goddard stated that pursuant to NCGS 105 - 369 c , tax liens will be there are no scheduled rezoning cases for the April 2 , 2012 6 00 pm meeting and he suggested the Board consider holding their 2012 annual work session that evening instead It was the unanimous consensus of the Board to hold the 2012 annual work session at the April 2 , 2012 6 00 pm meeting in the Board of Commissioners meeting room B Resolution In Opposition – Tolling on Interstate 95 Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner DeVan Barbour , and carried by unanimous vote , the Board adopted the following resolution in opposition to tolling on Interstate 95 RESOLUTION OF THE JOHNSTON COUNTY BOARD OF COMMISSIONERS OPPOSING THE TOLLING OF INTERSTATE 95 IN NORTH CAROLINA WHEREAS , In January of 2012 the North Carolina Department of Transportation NCDOT released the I - 95 Corridor Planning & Finance Study identifying tolling as the most feasible means for funding future improvements of Interstate 95 in North Carolina ; and WHEREAS , Prior to the release of the I - 95 Study , the NCDOT submitted an application to the Federal Highway Administration requesting approval to implement tolling on the Interstate 95 Corridor under the Interstate System Reconstruction & Rehabilitation Pilot Program ; and WHEREAS , Interstate 95 is a primary transportation artery in Johnston County and a major catalyst for tourism and economic development ; and WHEREAS , Significant negative impacts for communities and businesses that depend on Interstate 95 travelers for their livelihood could occur due to travelers diverting to alternate roads to avoid tolls ; and WHEREAS , The Johnston County Board of Commissioners believes that the I - 95 Corridor Planning & Finance Study does not provide sufficient information on alternative funding sources for future improvements to Interstate 95 ; and WHEREAS , The Johnston County Board of Commissioners further believes that the 64 million I - 95 Corridor Planning & Finance Study completed by the NCDOT does not provide sufficient information on the economic impact of tolling to the citizens , businesses , and communities in Johnston County and along the Interstate 95 Corridor NOW THEREFORE BE IT RESOLVED that the Johnston County Board of Commissioners hereby opposes the tolling of Interstate 95 and requests the NCDOT to fully investigate alternative sources of revenue to finance future improvements of Interstate 95 ; and BE IT FURTHER RESOLVED that the Johnston County Board of Commissioners requests the NCDOT to undertake a comprehensive study of the economic impacts of tolling for
