State of the County Address Johnston County , North Carolina Here we are , another year has passed and 2011 had its ups and downs We had tornados and a hurricane that left their mark on our County and many of its citizens Through these weather events Johnston County employees rose to the occasion , whether by staffing shelters , managing and coordinating responses , repairing County utilities , attending to the injured , or the inspection of structures for safe reuse I am proud of our employees and their dedication to their jobs , their County and its citizens As a whole our employees strive to be the best county workforce in the state and here are some examples of how they shine • Johnston County received an award for our “ Teen Driving Safety Program ” • The Johnston County Animal Shelter received a “ Shelter We Love ” award • Cooperative Extension’s Shawn Banks received an award in “ Communication ” from the National Association of County Agriculture Agents and Amie Newsome received “ North Carolina Extension Agent of the Year ” from the NC Beekeepers Association • The Johnston County 911 Center was accredited as a “ Center of Excellence ” for the dispatching of Police , Fire , and EMS making it the first in North Carolina , the third in the United States , and the fifth in the World • Sheriff Steve Bizzell was recognized for his work with the ATF • Johnston County Schools received the highest ranking in all seven areas of accreditations by the national AdvancED Accreditation Commission • The Health Department received high marks in its “ Accreditation Award ” • The Johnston County Finance Department received a “ Certificate of Achievement of Excellence in Financial Reporting ” awarded by the Government Finance Officers Association of the United States and Canada • Pat Goddard received “ North Carolina Tax Assessor of the Year Award ” If I left anyone out I apologize The point being , we have great people and a great County Manager to lead them With the economy continuing at a slow pace the County is continuing to prepare for the future so as not to be caught behind the curve when things turn around Here are a few examples • We now have an emergency water connection with the City of Raleigh • The Wilson’s Mills to Cleveland water transmission project is complete • Permitting for a new water intake on the Neuse for a planned future water plant in the eastern part of the County is well underway • The paving of Monroe Road to assist traffic movement in the new Cleveland High School area is complete • The opening of the new Durwood Stephenson Hwy , which by the way could not have been named for a more deserving person , when it comes to roads or state county joint ventures , he is the man There have been a couple of grand openings that I McDonald franchises in Virginia , North Carolina , and South Carolina • Johnston Community College’s new Learning Resource Center “ Library ” , which is open to the public just as the Johnston County Smithfield Library , if you haven’t seen it , you need to go visit We continue to work to entice jobs to the County whether through new industry or existing industry expansion and I think there will be an announcement in the next couple of weeks of a 35 million expansion and 230 new jobs We will continue in 2012 to keep the citizens ’ best interest at heart and strive to keep Johnston County a great place to live , work , and raise a family Let me finish by thanking , the Board of Education and their administration for the great working relationship this past year and the eleven towns ’ elected officials and their staff for their willingness to work together on win win solutions for joint problems and a special thanks to my fellow Commissioners for the time they spend for the County and allowing me the privilege of being their Chairman Thank you and I hope Johnston County and its citizens have a great NEW YEAR 5 Public Hearing – Economic Development Incentive Grant Advertised – In The Smithfield Herald – December 21 , 2011 At the request of staff , Chairman Allen L Mims , Jr , tabled the public hearing until the February 6 , 2012 10 00 am meeting , and the Board agreed by consent 6 Presentation of Audit Report for Year Ending June 30 , 2011 Alan Thompson with Thompson , Price , Scott , Adams & Co PA , presented the audit report for the fiscal year ending June 30 , 2011 He stated the County received an unqualified opinion and there were no significant audit findings Mr Thompson continued that no difficulties were encountered while performing the audit , there were no uncorrected misstatements , there were no disagreements with management and management did provide a representation letter , and management did not consult with any outside auditors Mr Thompson noted in the revised audit that he presented to the Board , the State now requires the Tourism Authority to be considered separately as a component unit as opposed to being presented as a special revenue fund of the County In addition , based on the new legislation , the Authority should have a separate bond policy for the finance officer Mr Thompson reviewed a summary of financial information with the Board from 2007 to 2011 Mr Thompson noted that the tax collection rates continue to be consistently good He pointed out that Johnston County has continued to work with Johnston County Schools to provide for school construction and 99 of the total General Fund debt relates to schools Mr Thompson continued that in 2007 the total General Fund expenditures were 158,464,000 and increased to 170,124,527 in 2011 However , Mr Thompson noted that approximately 52 of the total General Fund expenditures relate to schools and debt service for schools and when comparing 2007 to 2011 , there was a 148 million increase in expenditures related to education and debt service He stated when the expenditures related to schools and debt service are taken out , there has actually been a decrease in the other General Fund expenditures and he commended the County on being able to reduce those other expenditures over the last five years Mr Thompson presented the following five year comparison to few questions on some of the items that he would forward to Mr Thompson for a response later Page2665 January 3 , 2012 – 10 00 am Continued Commissioner Jeffrey P Carver moved the Board accept the audit as presented for fiscal year ending June 30 , 2011 Commissioner DeVan Barbour seconded the motion , which carried by unanimous vote 7 Thanksgiving Volunteer Fire Department – Request for Tax Exempt Loan Status Thanksgiving Fire Department Chief Gary House requested the Board to grant the fire department tax exempt loan status so they can borrow up to 650,000 from United Financial of NC , Inc at a rate of 427 over 15 years Mr House explained that the fire department wishes to purchase a 1998 Pierce Quantum Fire Truck at a cost of up to 180,000 as well as refinance their existing debt in the amount of 467,89721 The existing debt and the cost for the fire truck will be combined for a total of approximately 647,89721 Mr House reported that the fire department began looking at purchasing another truck approximately three years ago as well as looking at ways to save money He stated a new truck of similar type would cost between 850,000 to 860,000 The truck is considered dual purpose which means it is a rescue truck but also has water pumping capabilities that will allow the fire department to expand their services Mr House stated the cost of the truck is 149,000 ; however , the additional cost is to cover expenses associated with installing extra equipment apparatus in order to be compatible with the department’s existing equipment as well as bring it up to the current Department of Insurance standards Commissioner Tony Braswell asked Mr House to explain the bidding process for the financing Mr House stated he contacted four different financial institutions and requested bids on the combined debt which includes their existing debt as well as the truck loan and also financing for just the truck loan Mr House stated only two of the bidders submitted combined financing options , of which United Financial presented the best terms Mr House stated the existing debt consists of the department’s 2003 building loan and the loan for a 2005 truck He noted the payoff on the existing debt is presently 14 years County Finance Director Chad McLamb reported he had reviewed the financial proposals and by combining the existing debt and financing with the lower rate offered by United Financial , it will save the fire department money on interest over the term of the loan At the inquiry of Commissioner Braswell , Mr House reported he had held the required public hearing at the Thanksgiving Fire Department on December 29 , 2011 and no public was present Upon a motion by Commissioner W Ray Woodall , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board adopted the following resolution approving tax exempt loan status for the Thanksgiving Volunteer Fire Department NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Thanksgiving Volunteer Fire Department of Johnston County , North Carolina the “ VFD ” , from United Financial of NC , Inc , in a principal amount not to exceed 650,000 for the following • Purchase of a 1998 Pierce Quantum Fire Truck which will be owned and operated by the VFD at a cost not to exceed 180,000 and will be maintained at 2375 Thanksgiving Fire Road , Selma , NC 27576 ; and • Refinance existing debt in the amount of approximately 467,89721 RESOLVED , FURTHER , that the approval of the loan to the VFD set forth above is given solely for purposes of the public approval requirements for tax - exempt financing applicable to the VFD because of Section 150 e 3 and Section 147 f of the Internal Revenue Code of 1986 , as amended , and such approval does not obligate the County or its Board of Commissioners in any way regarding repayment of the debt 8 JCATS – Request County Match for CTP Grant Funds Lynn Lamberth , Executive Director for the Johnston County Area Transit System , requested the Board to approve a match in the amount of 77,303 for the North Carolina Department of Transportation Community Transportation Program grant for FY 12 - 13 The total grant from the DOT is 626,346 and is the major administrative and capital grant with which JCATS operates Ms Lamberth reviewed the following the information for use of the Federal and State grant and County match • 293,376 administrative expense request 15 County match required - 191,432 JCATS Administrative Staff - 101,944 other required administrative expenses , ie utilities , vehicle insurance , computer support , etc • 332,970 capital budget request 10 County match required Page3666 January 3 , 2012 – 10 00 am Continued - 172,000 - 4 replacement vehicles - 129,000 – 3 expansion vehicles - 20,745 for other capital copier , mobile radios , vehicle lettering and logos - 11,225 for baseline technology Ms Lamberth stated the administrative budget has not changed ; however , the capital budget request has increased due to fleet turnover which is regulated by DOT replacement standards and the need for three expansion vehicles to accommodate increased demand She offered to answer any questions Commissioner Tony Braswell asked , with regards to JCATS ’ five year plan , what could be done additionally , to create a better rider availability in the County Commissioner Braswell also asked about a commuter service Ms Lamberth stated the five year plan recently completed by JCATS is a requirement of the DOT and under the plan , JCATS will be looking to expand their existing ridership as well as expand the service more into the employment area and possibly expand into a commuter service into Raleigh She noted that through the Rural Operating Assistance Program Grant , JCATS does offer some public transportation and the DOT is encouraging the expansion of that service She reported JCATS is presently trying to work more with the business community in the Clayton and Smithfield Selma areas to determine and address the demand Ms Lamberth stated their fleet size has been expanded to 29 vehicles which up from 19 vehicles six years ago Commissioner Braswell stated as the County’s population has grown , he believes JCATS can play a vital role in the future with commuter service park and ride options Commissioner Cookie Pope inquired if JCATS provides service at Johnston Community College and Johnston County Industries Ms Lamberth responded that Johnston County Industries is one of JCATS largest customers and they have seen a significant increase in requests at Johnston Community College for public transportation Chairman Allen L Mims , Jr recalled that there used to be a fixed route in the Clayton area and he asked if the route was still in operation Ms Lamberth reported JCATS did offer a fixed route in the Clayton area as well as in Smithfield a few years back ; however , at that time , the demand was not there She stated that considering how much the County has grown , JCATS will review those opportunities again in the future as well as marketing for such routes Commissioner Jeffrey P Carver asked how JCATS decides on the number of replacement and new vehicles as well as how surplus vehicles are sold Ms Lamberth explained that JCATS must follow the DOT replacement vehicle requirements which are based on mileage She noted that last year , the DOT did allow JCATS to retain some of the vehicles so long as they were maintained to certain standards Ms Lamberth stated the surplus vehicles are sold at public auctions Commissioner DeVan Barbour moved the Board approve the matching requirement for the NC DOT Community Transportation Program grant for FY 12 - 13 for JCATS Commissioner W Ray Woodall seconded the motion , which carried by unanimous vote 9 Department of Social Services – Request for Additional Technology Position Director of Social Services Earl Marett requested the Board to approve an additional permanent position Applications Programmer in the DSS Technology Unit Mr Marett spoke on the increase in demand for services in food nutrition , crisis assistance , Medicaid , and daycare assistance programs over the last four years He stated so far , the increased demand has been met with employees working overtime and on weekends Mr Marett noted that if healthcare reform goes through as is currently presented , the Medicaid cases alone could experience a 50 increase Mr Marett stated the County cannot afford to hire enough workers and provide enough space to manage the increasing caseloads He stated there is a new NC Fast Program being piloted by DSS in the food nutrition division and another pilot program is forthcoming for the Medicaid program Mr Marett added that at the present time , each investigator’s caseload consist of approximately 27 cases when they are only supposed to have approximately 10 cases He stated the only way he believes DSS will be able to keep up with the continued growth in cases is for the agency to automate their systems Page4667 January 3 , 2012 – 10 00 am Continued Mr Marett explained the new position would be responsible for the Integrated Social Services Information ISSI System modification for Johnston County He reported the existing Technology Services Department has been excellent to work with ; however , the work is more than what they can handle At the inquiry of Chairman Allen L Mims , Jr , Mr Marett reported approximately 60 of the cost for the position will be funded from ongoing State and Federal funding sources with the remaining cost coming from within the DSS budget for the current fiscal year Commissioner Jeffrey P Carver stated he sits on the DSS Board and the request for the Applications Programmer position has been under discussion and review for the past ten months Commissioner Carver referenced the Cost Benefit Analysis in the agenda packet and stated the position would have a breakeven point at 6 months Commissioner Carver stated it is his understanding that the position would be responsible for the modifications and implementation of the new technology that would improve the work output and efficiency of social workers Commissioner Carver stated the new technology would allow the social workers to continue working on their caseload while they are sitting in the courtroom waiting on other cases to be heard Upon a question by Commissioner DeVan Barbour , Mr Marett reported DSS has 20 social workers sitting in the courtrooms every Wednesday and the new technology would allow them to be able to continue their work by using laptops while they wait for the court cases to conclude Commissioner Barbour asked if the Technology Services Department could implement the new technology without hiring an additional person Mr Marett stated the additional Applications Programmer is needed to convert and implement the new technology Commissioner Carver stated that Commissioner Barbour brought up a good point by asking if the Technology Services Department could implement the new technology without hiring additional personnel He stated that there are other County departments that have their own technology personnel and he has asked the County Manager and the Technology Services Department to put together an analysis of the existing technology organizational structure and forward the information to the Board Commissioner Wade M Stewart asked for more information on exactly what the new Applications Programmer would do and why the position would be needed on a continuing basis Mr Marett reported the ISSI Program is a case management program for Child Welfare social workers that was originally developed by Mecklenburg County DSS and is currently being used in Mecklenburg , Buncombe , and Catawba Counties The system will require an extensive modification for use in Johnston County ; however , once completed the system will significantly increase the efficiency and effectiveness of the social workers He stated once the new technology is implemented , the Applications Programmer would still be needed to maintain the system as well as continue to work with the technology as it advances Mr Marett also stated the position would work with the other pilot programs that will be coming in the future Commissioner Carver stated in the past , the Board has granted new positions with the provision that once the federal and or state funding is eliminated , then the position is eliminated ; however , he noted that in this case , the position will continue to be needed to maintain the new system to meet the increased demand at DSS Commissioner Carver reiterated that he has been challenging DSS to show that they need the additional position over the past ten months and to his knowledge he believed it would be the first position that would be added in the three years that he has served on the DSS Board Commissioner Stewart questioned if the technology is already being used in other areas of the State , then why it could not simply be implemented with the County’s system without hiring a new position Commissioner Stewart also asked if the new position is approved , would additional programmers be needed in the future Mr Marett reported there are other technology issues with Medicaid and the NC Fast Program that will have to be addressed and maintained which will necessitate the new position Mr Marett reported it is his hopes that no other programmers will be needed in the future ; however , he could not guarantee it Mr Marett stated if the new technology cannot be implemented , then the alternative is to hire more social workers Commissioner Cookie Pope asked about existing employees in the DSS Technology Unit Page5668 January 3 , 2012 – 10 00 am Continued Mr Marett reported DSS presently has three employees in the Technology Unit He noted that the positions are supervised by the County’s Technology Services Director ; however , they are classified as DSS employees so the County can receive reimbursement for their salaries He stated the new Applications Programmer would be handled the same Commissioner Jeffrey P Carver moved the Board approve the new Applications Programmer Position in the DSS Technology Unit Commissioner Tony Braswell seconded the motion , which carried by unanimous vote Commissioner Carver challenged the County Manager and the Technology Services Department to look at the overall organizational structure of the technology employees 10 Health Department – Request for Additional Positions Health Director Dr Marilyn Pearson stated the Health Department requests approval for three Social Workers and one Public Health Nurse in the Care Coordination for Children CC4C and Obstetric Care Management OBCM Programs to be funded by the North Carolina Division of Medical Assistance Dr Pearson recalled that at the Board’s meeting in September , she mentioned additional staff may be needed depending on the caseload She reported that over the past few months , a significant increase in referrals to the programs has made the need for additional staff apparent Dr Pearson explained that the Health Department’s monthly payment from Medicaid of 58,000 is based on a per member per month fee Dr Pearson reported the cost of the four positions will be covered by the monthly per member per month fee She asked the Board to approve the positions so long as the Medicaid funding is available to cover the associated cost Commissioner Tony Braswell moved the Board approve the three Social Workers and one Public Health Nurse in the Care Coordination for Children and Obstetric Care Management Programs so long as the Medicaid funding is available to cover the cost of the positions Commissioner W Ray Woodall seconded the motion which carried by unanimous vote 11 12 Public Utilities – NC 42 West Force Main Replacement Project Public Utilities – Water Supply Quality Improvements – Phase 2 At staff’s request , Chairman Allen L Mims , Jr tabled the two Public Utilities items until the February 6 , 2012 10 00 am meetings and the Board agreed by consent 13 Public Utilities – Conservation Easement for St Johns Wood Subdivision Phase II County Attorney David Mills explained that under NCGS Chapter 160A Part 4 , the County is authorized to acquire interest in real estate for the purpose of imposing conditions on that real estate and reconveying it to the original owner to preserve , by the limitation of its future use , open spaces in areas of natural and scenic value The developer for St Johns Wood Subdivision Phase II has requested to participate in the County’s Land Dedication Program by dedicating a permanent conservation easement in order to increase the maximum impervious area limit within the subdivision under the County’s Stormwater Ordinance He stated the property the developer wishes to dedicate for conservation purposes does not fit within the guidelines for the Triangle Land Conservancy Therefore , the developer requested the County to acquire the property as a conservation easement ; however , Johnston County Public Utilities does not wish to own any interest in real estate for this purpose Mr Mills stated the proposal before the Board is for the owners of the property to convey the property to the County and the County will immediately reconvey the property back to the original owners , with covenants and restrictions designed to preserve the property in its natural condition Chairman Allen L Mims , Jr asked County Stormwater Administrator Jamie Guerrero to provide more details on the matter Mr Guerrero explained that under the County’s Stormwater Ordinance , residential subdivisions are allowed a maximum of 15 impervious area ; however , those located within Environmental Sensitive Areas ESA are limited to a maximum of 12 impervious area St Johns Wood Subdivision Phase II is located within an ESA therefore it is allowed a maximum of 12 impervious area Mr Guerrero continued that the developer has a potential buyer that wishes to build a product that would exceed the 12 limit and according to the County’s Ordinance , the 12 limit can be exceeded if the developer participates in the Land Dedication Program by paying the fee - in - lieu or putting land in a permanent conservation easement Mr Guerrero stated the developer had the extra land available to put in a permanent conservation easement He noted it would be the first easement the County has participated with in that most developers choose to pay the fee - in - lieu Mr Page6669 January 3 , 2012 – 10 00 am Continued Guerrero continued that most of the proposed easement property is located within the buffer area that is protected under State laws He further noted that the developer would not be able to use the land in the conservation easement as part of the calculation of impervious area for any future phases of the subdivision Upon a question by Commissioner Jeffrey P Carver , Mr Guerrero stated the fee - in - lieu would have been approximately 28,000 if the developer had chosen to pay it At the inquiry of Commissioner Wade M Stewart , Mr Guerrero reported had the subdivision not been located in an ESA , the developer would not have exceeded the impervious area limit Commissioner Cookie Pope asked if the County would have any responsibility to maintain the conservation easement property Mr Guerrero reported the County would have no responsibility to maintain the easement property that it would be up to the developer He stated if the developer failed to maintain the easement or built something on the easement , they would be in violation of State buffer laws as well as the County could fine the developer , remove the structures , restore the property to its original condition , and place a lien on the property to recover the costs Mr Guerrero reported it is not likely that the developer will build on the conservation easement property because due to its location , it is undevelopable Commissioner Carver asked Mr Guerrero if he anticipated more conversation easement requests coming in the future rather than paying the fee - in - lieu Mr Guerrero reported usually most developers will pay the fee - in - lieu because they do not have the extra land to put into a conservation easement James Lipscomb , Hometown Realty in Clayton , representing the developer of St Johns Wood Phase II , thanked the County for working with them on the easement project Mr Lipscomb spoke on his concerns with the regulations and requirements associated with Environmentally Sensitive Areas and how such rules affect smaller developments Mr Lipscomb asked the Board to work with the County staff and see if anything could be done to alleviate some of the requirements in the future Chairman Mims commented that there are other things that could be done to comply with the rules and regulations ; however , he acknowledged that the alternatives can be cost prohibitive Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner DeVan Barbour , and carried by unanimous vote , the Board approved the conservation easement and authorized the County Attorney to complete the
