10 1 Meeting of the Johnston County Board of Commissioners November 6 , 2017 10 00 am The Johnston County Board of Commissioners met in regular session Monday , November 6 , 2017 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Ted G Godwin , Cookie Pope , Allen L Mims , Jr , Chad M Stewart , and Larry Wood Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 10 00 am Commissioner Cookie Pope opened the meeting with a prayer and called for a Moment of Silence in remembrance of the victims and their families from the recent mass shooting in Texas American Legion Post 71 Clayton led those in attendance in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Chad M Stewart , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the consent agenda items as follows Commissioners Pope and Godwin asked everyone to remember the Veterans Day Ceremony to be held on November 10 , 2017 at 11 00 am at the Smithfield - Selma High School Gym A Approval of Minutes – October 2 , 2017 10 00 am and 6 00 pm ; Chad McLamb 3 Public Comments A Research Triangle Regional Partnership Update Research Triangle Regional Partnership Executive Director Ryan Combs visited the meeting and provided the Board with an update on the activities at the Partnership Mr Combs stated he has been at the Partnership for eight months and it has been a unique and incredible opportunity to go out and brag on the State of North Carolina Mr Combs reported on recent site selection consultant trips and spoke on how he has been promoting the benefits of locating in Johnston County as well as highlighting the County’s existing industries including Grifols and Novo Nordisk Mr Combs thanked Economic Development Director Chris Johnson for being a part of one of the recent site selection consultant dinners Mr Combs spoke on a recent recruiting trip to Ireland and how that country is currently a hotbed for expanding industry He noted companies such as Google , Paypal , and Facebook have large presences in Ireland and he hopes to become a gateway between there and the United States Mr Combs stated his goal is to establish as many relationships as possible with people in the external markets both nationally and internationally in an effort to promote all North Carolina has to offer Mr Combs also spoke on the importance of being an economic driver for small businesses and helping them to grow and expand He thanked Mr Johnson for his assistance to the Partnership stating he enjoys working with him and Johnston County The Board thanked Mr Combs for the update B Industry Appreciation Award – Johnston County Industries , Selma , North Carolina The Board of Commissioners and the Johnston County Economic Development Advisory Board recognized Johnston County Industries of Selma for their commitment to Johnston County by honoring the company with the County’s Industry Appreciation Award which is presented to industries quarterly Economic Development Director Chris Johnson introduced Economic Development Advisory Board Chair and Selma Mayor Cheryl Oliver for the presentation Mayor Oliver stated Johnston County Industries JCI was established in 1975 through the vision of Mr Nolan Hinson who wanted a place dedicated to serving people with disabilities who were seeking employment She continued that powered by a vision along with a 12,000 grant , three staff members , and a lease on 2,000 square feet , JCI was launched Mayor Oliver spoke on the expansions JCI has undergone over the years noting they are now headquartered in Selma but occupy 130,000 square feet of space across locations in Johnston ,PagePage pageNumber55 November 6 , 2017 – 10 00 am Continued Wayne , Sampson , Lee , and Harnett Counties She stated JCI employs over 200 full - time and part - time workers and also operates the JCI Thrift Store & Donation Center as well as the Cyber Café restaurant in the Johnston Medical Mall Mayor Oliver also spoke on programs established by JCI that serve the younger population helping them to obtain high school diplomas and community based vocational training along with job search assistance Mayor Oliver stated as a JCI Board member , she can personally attest that JCI does not grow their business just for the sake of becoming bigger , but rather for their purpose of empowering people with disabilities and disadvantages to succeed through training and employment Mayor Oliver presented the award to JCI stating they are a blessing to all the communities they have a presence in President & CEO Bill Sharek thanked everyone for the award and expressed his appreciation to the Board of Commissioners for their many years of support to JCI Mr Sharek commended his staff stating they are the real heroes of the company who work every day giving life to JCI Mr Sharek shared some statistics with the Board noting that over the last five years , JCI has served almost 5,400 people helping to get them on a pathway from disability into gainful employment He stated in the last five years , JCI has placed 1,389 people in gainful employment opportunities and through their youth programs , they have helped 260 students obtain their diplomas or GED and then on to employment Mr Sharek reported in the last four years JCI has doubled revenues and increased employment in the production areas from 85 to 216 He spoke on the economic impact JCI has had stating they have generated approximately 40 million worth of revenue during the last five years Mr Sharek thanked the Board for partnering with JCI on the use of the Unity House in Selma located on Richardson Street and also expressed their appreciation for the recent renovations He stated JCI plans to spend their own funds to improve the driveway , parking area , and landscaping around the facility Mr Sharek presented a Certificate of Appreciation to the Board of Commissioners for their support of the facility on Richardson Street in Selma stating with the recent renovations they have tripled the size of their programs at that location Mr Sharek also thanked Mayor Oliver and Selma for their support to JCI He introduced and recognized Vice President Patricia Little , Vice President Johanna Barker , Manager of Business Development & Employer Services Marie Day , and Manager of Marketing & Public Relations Nancy Bartholomew The Board thanked Mr Sharek and JCI for their continued growth in Johnston County C Introduction of New Selma Town Manager Selma Mayor Cheryl Oliver introduced the Town of Selma’s new Manager , Mr Elton Daniels to the Board of Commissioners The Board welcomed Mr Daniels to the meeting and to Johnston County D Update on Recent Opioid Forum Health Director Dr Marilyn Pearson thanked the Board of Commissioners for their support for the Opioid Forum held on November 3 , 2017 at the Johnston County Agricultural Building Dr Pearson stated approximately 100 people attended the forum and she feels it was a success She stated they plan to release a summary report soon as well as develop a task force noting it is a very important public health issue 4 Bentonville Volunteer Fire Department – Approval of Tax Exempt Loan Status Chairman Jeffrey P Carver recused himself from the discussion and vote on this item and turned the meeting over to Vice Chairman Ted G Godwin Finance Director and Assistant County Manager Chad McLamb explained the Bentonville Volunteer Fire Department is requesting the Board to grant them tax exempt loan status so they can borrow up to 100,000 from First Citizens Bank for the purchase of a 2017 Freightliner E - One 1500 1000 Pumper Tanker at an interest rate of 245 with a 10 year term Mr McLamb stated he has reviewed the documentation and recommends the financing from First Citizens Bank with monthly payments Bentonville Fire Chief John Beasley offered to answer any questions Chief Beasley stated the fire department would prefer to set up the loan with an annual schedule since most of their payments come in to the fire department annually Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Cookie Pope , and carried by unanimous vote with Chairman Jeffrey P Carver abstaining , the Board adopted the following resolution granting the Bentonville Fire Department tax exempt loan status PagePage pageNumber66 November 6 , 2017 – 10 00 am Continued NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Bentonville Volunteer Fire Department , Inc the “ VFD ” , from First Citizens Bank & Trust Company in an amount up to 100,00000 for the purchase of a 2017 Freightliner E - One 1500 1000 Pumper Tanker RESOLVED , FURTHER , that the approval of the loan to the VFD set forth above is given solely for purposes of the public approval requirements for tax - exempt financing applicable to the VFD because of Section 150 e 3 and Section 147 f of the Internal Revenue Code of 1986 , as amended , and such approval does not obligate the County or its Board of Commissioners in any way regarding repayment of the debt Duly certified by the execution hereof and the placement hereon of the seal of said county , th this 6 day of November , 2017 Vice Chairman Godwin turned the meeting back over to Chairman Carver 5 Public Utilities – Approval of Equipment Purchase – Vacuum Purchase Utilities Director Chandra Farmer , PE , explained the Department of Utilities received pricing for a vacuum truck from Vacall ™ through the National Joint Powers Alliance contract # 022014 - GRD Ms Farmer reported in the past , the County has relied on rental equipment or contract services for sewer main cleaning and inspection ; however , this equipment will allow the County to provide more efficient routine sewer operations , emergency response and safe excavation for existing utility locations Ms Farmer stated the proposal for purchase of the truck is 367,47041 and the Department of Utilities ’ FY 17 18 budget includes a 350,000 capital appropriation from Fund 68 Retail Sewer Operations for the vacuum truck However , an additional 350,000 in capital expenditures is budgeted from the account for “ Wastewater Pump Station Upsizing and Improvements ” Ms Farmer stated the Department proposes to fund the remaining 17,47041 from the additional capital in Fund 68 - Retail Sewer Operations Ms Farmer requested the Board’s approval of the proposed vacuum truck purchase from Vacall ™ in the amount of 367,47041 and to fund the remaining cost of 17,47041 from the additional capital in Fund 68 - Retail Sewer Operations Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the vacuum truck purchase from Vacall ™ in the amount of 367,47041 and to fund the remaining cost of 17,47041 from the additional capital in Fund 68 - Retail Sewer Operations 6 Public Utilities – Buffalo Water District – 2017 - 2018 Hydraulic Improvements Budget Upon a motion by Commissioner Cookie Pope , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board recessed regular session to sit as the Buffalo Water District Board Sitting as the Buffalo Water District Board Utilities Director Chandra Farmer , PE , stated the Buffalo Water District has received a Notice of Intent to Fund from NCDEQ Division of Water Infrastructure DWI for the proposed 2017 - 18 Hydraulic Improvements project She explained the proposed project includes a 20 ” water main from the water treatment plant to Buffalo Road Ms Farmer reported the project is identified in the “ Johnston County Public Utilities 2017 Capital Improvements Plan adopted September 4 , 2017 ” Following is the proposed project budget Technical Services Engineering Surveying Permitting 78,00000 Construction 2,020,00000 Contingency 202,00000 Loan Closing 46,00000 Total Project Cost 2,346,00000 Funding for the proposed project is as follows NCDEQ DWI Drinking Water Loan max interest rate of 153 2,300,00000 Fund 69 Appropriations 46,00000 Total Project Funds 2,346,00000 Ms Farmer stated the Buffalo Water District has not received the formal loan offer from NCDEQ DWI , but the offer should be sent after the engineering report is approved Ms Farmer continued that engineering expenses have been identified by DWI as eligible for reimbursement as part of the proposed loan ; however , if by unforeseen circumstances , the loan offer is not received or approved , funds would be appropriated from Fund 69PagePage pageNumber77 November 6 , 2017 – 10 00 am Continued for any design services completed She requested the Board to approve the proposed project budget via adoption of the capital project budget ordinance in order for staff to proceed with the project design Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the project budget via adoption of the following capital project ordinance CAPITAL PROJECT ORDINANCE FOR THE BUFFALO WATER DISTRICT 2017 - 18 HYDRAULIC IMPROVEMENTS PROJECT BE IT RESOLVED by the Board of Commissioners the “ Board ” of the County of Johnston , North Carolina the “ County ” , sitting as the governing body of the Buffalo Water District the “ District ” , that pursuant to Section 132 of Chapter 159 of the General Statutes of North Carolina , the following capital project ordinance is hereby adopted Section 1 The project authorized is the Buffalo Water District 2017 - 18 Hydraulic Improvements Project the “ Project ” The Project includes a 20 - inch water main from the County’s water treatment plant to Buffalo Road and is to be financed by a Drinking Water State Revolving Fund Loan and an appropriation from the Water District Operating Fund “ Fund 69 ” Section 2 The officers of the District are hereby directed to proceed with the capital Project within the terms of the Drinking Water State Revolving Fund Loan offer and the budget contained herein Section 3 The following amounts are appropriated for the Project Technical Services 78,000 Construction 12 Manager Reports and Comments None 13 Board Reports and Comments A Appointment of Commissioner for District 6 Vacancy Commissioner Ted G Godwin stated when Keith Branch resigned the Commissioner District 6 seat effective at the end of September , it was encumbered upon the Board of Commissioners to name a replacement Commissioner Godwin reported the Board solicited interested parties from District 6 with four individuals stepping forward for consideration Commissioner Godwin thanked Commissioners Chad M Stewart and Larry Wood for working with him to engage the assistance of the Republican Party Chair Patrick Harris and Vice Chair Michelle Haller to help with the selection process Commissioner Godwin thanked Mr Harris and Ms Haller for their assistance stating they were instrumental in helping organize the process including the development of a series of questions that were used to interview the candidates Commissioner Godwin stated after the resumes were reviewed and the interviews were conducted , the group could not come to a consensus for a unanimous top recommendation Commissioner Godwin prefaced his next remarks by stating that his comments are from him and should not be viewed as a report from the group He explained that while all the candidates expressed similar fiscal conservative values , the depth of the level of experience varied greatly with one resume standing out in terms of activity and service back to Johnston County and organizations within District 6 Commissioner Godwin stated during the interviews , again that same individual stood out considerably in terms of awareness of topics such as county budgets , revenue streams , debt capacities , and tax issues Commissioner Godwin stated that individual was Mr Lee Jackson who is a CPA and has also participated in audits for municipal entities and is well versed in financial dealings with respect to public dollars Commissioner Godwin continued that since North Carolina General Statutes require the appointed person to serve only until the next regular ballot cycle , the new Commissioner would only serve until December 2018 He explained the appointee will have to file in February and immediately face the primary election with the general election in November whereupon the voters can then properly exercise their choice for the District 6 Commissioner Commissioner Godwin stated since the appointment would be for a relatively short period of time , he believes it is important to select the person best qualified to have immediate relevance in contributing to major and important discussions that will be facing the Board and he believes that person is Mr Jackson Commissioner Godwin concluded his remarks by stating he was impressed with all the candidates in that they all had very good qualities and he felt they could all eventually be very good Commissioners ; however , he feels Mr Jackson can bring the most to the Board in the short period of time Commissioner Godwin stated he encourages all the applicants to considering filing for election in February and let the voters have their say Commissioner Chad M Stewart noted that in many instances , when a Board has to appoint a fellow Commissioner it can often be under unfortunate circumstances and therefore , it is not something that Boards enjoy doing Commissioner Stewart stated he is glad all the applicants to file for election in order to let the voters decide who represents them Commissioner Allen L Mims , Jr stated this will be the third time this Board has had to appoint a Commissioner since he has been elected and he spoke on the fact that there have always been different opinions as to who should be appointed , but then that is perhaps why during an election one person typically does not get all the votes Commissioner Mims spoke on the learning curve that the newly appointed Commissioner will have and how the Board must find someone they feel they can work well with and can begin contributing in a hurry Commissioner Mims stated being a county commissioner is not an easy job and what people often do not realize is that the Commissioners also serve on many other committees as commissioner representatives ; therefore , the Board needs someone that has been around and has knowledge of the County Commissioner Mims stated after reviewing the resumes , he can agree with Commissioner Godwin that Mr Jackson had the best resume and has probably done the most as far as community organizations Commissioner Mims also encouraged the applicants not appointed to consider filing for the seat in February so the people can ultimately decide Commissioner Allen L Mims , Jr moved the Board appoint Mr Lee Jackson to fill the Commissioner District 6
