10 873 Meeting of the Johnston County Board of Commissioners October 2 , 2017 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , October 2 , 2017 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Ted G Godwin , Cookie Pope , Allen L Mims , Jr , Chad M Stewart , and Larry Wood Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 6 00 pm and the following business was transacted 1 Proclamation – National 4 - H Week and Update from Johnston County 4 - H Johnston County Cooperative Extension Director Bryant Spivey thanked the Board of Commissioners for allowing Johnston County 4 - H to address the Board He introduced 4 - H Youth Development and Extension Agent Lori McBryde for the presentation Ms McBryde presented and reviewed the following handout with the Board Ms McBryde requested the Board to adopt a proclamation declaring the week of October 1 – 7 , 2017 as National 4 - H Week in Johnston County She thanked the Board of Commissioners for all their support to 4 - H inPage874 October 2 , 2017 – 6 00 pm Continued Johnston County Ms McBryde also introduced Nicole Worth and Chloe Allen who are students currently involved in 4 - H to speak to the Board Miss Worth and Miss Allen both spoke on the opportunities and advancements that 4 - H has given to them and what it means to be involved with the organization Miss Worth stated through the support of 4 - H and her family , she is proud to be a North Carolina State 4 - H Officer Miss Allen spoke on how 4 - H has helped her overcome shyness and develop friendships across the State of North Carolina The Board thanked Mr Spivey , Ms McBryde , and all those involved with 4 - H for their dedication Chairman Jeffrey P Carver spoke on the importance of training the next generation in the County and he stated it is programs like 4 - H that help define our youth and put them in leadership opportunities Commissioner Larry Wood read aloud the following proclamation and moved for its adoption , seconded by Commissioner Cookie Pope , and carried unanimously NATIONAL 4 - H WEEK DECLARATION WHEREAS , 4 - H youth across the nation are leading efforts to solve problems in their communities and make a difference for their futures ; and WHEREAS , 4 - H is the largest youth development organization in North Carolina and the largest in the nation with over six million participants ; and WHEREAS , 4 - H in North Carolina claims 218,669 youth members and 21,413 volunteers , while Johnston County’s 4 - H program numbers more than 3,700 members and more than 300 volunteers ; and WHEREAS , 4 - H as part of the NC Cooperative Extension System of NC State University and NCA & T State University is a program where youth learn through opportunities that provide them hands - on experiences in 4 - H’s mission mandates of science , engineering and technology ; healthy living ; and citizenship ; and WHEREAS , 4 - H has connected youth and their communities with the innovative research and resources from our nation’s 106 land - grant universities and colleges for more than 101 years NOW , THEREFORE , the Johnston County Board of Commissioners , do hereby proclaim October 1 - 7 , 2017 , as National 4 - H Week in Johnston County We urge the people of this County to take advantage of the opportunity to become more aware of this special program that enhances our young people’s interests in their futures as part of Johnston County 4 - H Youth Development and to join us in recognizing the unique partnership between our County and our State University System nd Adopted this the 2 day of October 2017 2 Public Comment A Visit from the 2017 Miss Benson Pageant Winners The Board welcomed 2017 Little Miss Benson Avery Lassiter and 2017 Miss Benson Charli Rosenberg to the meeting and congratulated them on their pageant win B Proclamation – Domestic Violence Awareness Month Harbor Executive Director Kay Johnson requested the Board to adopt a proclamation for Domestic Violence Awareness Month She updated the Board on statistics and activities at the Harbor Shelter noting in FY 2016 - 2017 Harbor served 2,829 individuals She stated the staff continues to help victims with domestic violence protective orders and they are seeing an increase in family violence as well as other areas associated with mental illness , trauma , and the homeless Ms Johnson stated as they have for the last 33 years , Harbor continues to serve those impacted by family violence and she thanked the Board of Commissioners for their support Commissioner Chad M Stewart read aloud the following proclamation and moved for its adoption , seconded by Commissioner Ted G Godwin , and carried unanimously Page875 October 2 , 2017 – 6 00 pm Continued PROCLAMATION DOMESTIC VIOLENCE AWARENESS MONTH OCTOBER 2017 WHEREAS , home should be a place of warmth , unconditional love , safety , and peace ; however , tragically for many Americans , these are blessings that are tarnished by violence and fear ; and WHEREAS , domestic violence touches the lives of Americans of all ages , leaving a devastating impact on women , men , and children of every background and circumstance with a family’s home becoming a place of fear , hopelessness , and desperation when a woman is battered by her partner , a child witnesses the abuse of a loved one , or a senior is victimized by family members ; and WHEREAS , domestic violence remains a major public health , social justice , and human rights issue requiring particular attention , and its interventions must be with the inclusion of both women and men at all levels ; and WHEREAS , there is an urgent need , more than ever , to get involved ; and WHEREAS , the wide prevalence of domestic violence and sexual assault , along with the shocking silence and inaction around these issues , compels all of us to come together and get involved to end the abusive violence in our relationships , in our families , and in our communities ; and WHEREAS , since 1984 , HARBOR , INCORPORATED has been actively involved in addressing domestic violence in our community and has collaborated with numerous people and groups to respond , educate , and bring awareness to all people about domestic violence ; and WHEREAS , HARBOR , INCORPORATED serves approximately 3,000 direct victims and others annually and would like to invite everyone to support October 2017 as Domestic Violence Awareness Month , as it will be dedicated to the TAKE A STAND AGAINST DOMESTIC VIOLENCE Campaign Together We Can End Domestic Violence and Sexual Assault ; If approved , applicant must provide to the Planning Office a Site Plan for their review and approval ? Applicant must comply with the requirement of the Johnston County Land Development Code regarding landscaping , buffering and fence or any additional requirements as approved by this Board ? Applicant will be notified in writing of the Board’s decision ? If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to the Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of County Commissioners ? Applicant’s Special Use Permit will expire at the end of twenty - four 24 months if it is not used as permitted within the time period ? When necessary , staff informed the applicant of further Planning and Zoning Department requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements ? Subsequent to the pre - application consultation , all required notices were mailed to property owners within 500 feet The property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On August 15 , 2017 the Johnston County Planning Board held a public hearing regarding Rezoning Special Use Permit Case 17 - 17 and made the following recommendations Upon a motion by Mr Creech to approve Rezoning Case 17 - 17 , seconded by Mr Summerlin , Rezoning Case 17 - 17 was approved at the August 15th , 2017 Planning Board Meeting with a unanimous vote of 7 - 0 Upon a motion by Mr Summerlin to approve the Special Use Conditions for Rezoning Case 17 - 17 , seconded by Ms Hackler , the Special Use Conditions for Rezoning Case 17 - 17 were approved at the August 15th , 2017 Planning Board Meeting with a unanimous vote of 7 - 0 Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated as to maintain or promote the public health , safety , and general welfare ; Applicant Using our knowledge and experience in the automotive industry and in general business , it is our desire to provide customers with reliable and excellent quality automobiles We value honesty and hard work We wish to bestow upon our community and all patrons great service and the respect we want rendered to our own selves We plan to develop an attractive and safe auto display area and sales office in accordance with all established and proposed regulations 2 That the use of development appears to comply with all required use and intensity regulations of Articles II & IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - 257 and with all applicable regulations ; Applicant We will comply with all the codes , ordinances , and regulations such as but not limited to NC Fire and Building Code , proper commercial parking guidelines including ADA compliant handicap aisle , follow design and maintenance of landscape requirements , and meet NCDOT driveway entrance standards 3 That the use or development is located , designed , and proposed to be operated so as to maintain or enhance the value of contiguous property , or that the use or development is a public necessity ;PagePage pageNumber7879 October 2 , 2017 – 6 00 pm Continued Applicant The Pleasant Grove township and surrounding areas are growing dramatically Automobiles are in high demand and we wish to help provide these assets We plan to provide a clean and neat business property with reasonable business hours The design and lighting will be unobtrusive and follow all codes , ordinances , and regulations We will continue to maintain our business and property as such 4 That the use or development conforms with general plans for the physical development of the County’s Planning jurisdiction , the Design Manual , or other development policies as adopted by the Board of Commissioners Applicant There are similar businesses or small automotive sales and repair shops in the area , as the County’s policies and intent we intend to emphasize the existing character of the area We strive to maintain the safety , welfare , and quality of life the community and customers through compliance with all set regulations , ordinances , standards of design of land development and infrastructure , and by our own conduct Specific Land Uses APPLICANT To allow for automotive sales and reconditioning Special Use Conditions 1 Permitted Uses Automotive sales and reconditioning 2 The Special Use Permit shall expire with the violation of any Special Use Condition 3 Applicant shall submit a detailed site plan for review and approval by the Planning and Zoning Department Staff 4 A Class B 2 large trees , 3 small trees , and 9 shrubs every 100 linear feet landscape buffer shall be installed along NC Hwy 50 5 All signage shall comply with the sign code limited to one 60sf ground or monument sign only 6 All buildings and or structures must comply with rules enforced by Federal , State and Local agencies 7 Lighting shall be dark sky and engineered so as not to shine onto adjacent properties 8 Hours of operation shall be 7 00 AM to 7 00 PM , seven days a week 9 Limited to the storage and display of 30 vehicles for sale 10 10 ft of Right of Way shall be dedicated to NC Hwy 50 , per NCDOT Mr Gray listed and reviewed the special use conditions with the Board Commissioner Ted G Godwin asked how the buffer would be integrated into the entrance of the site Mr Gray stated if the Department of Transportation allows the existing driveway to remain as is , then staff would work with the applicant on the buffer requirement Commissioner Allen L Mims , Jr commented on the unusual zoning boundary noting it only covers a small part of the existing building and he asked how setbacks would be addressed Mr Gray explained that setbacks are based off of property lines He stated in this case , the rezoned area would not be a standalone lot and therefore could not be sold as such Mr Gray stated the vehicles for sale would have to remain within the rezoning boundaries Applicant Danielle Stephenson , 18 Gordon Farm Drive , Benson , offered to answer any questions Ms Stephenson stated only a front portion of the building is included in the rezoning boundaries and they would frame that portion in to house the office for the automotive sales , per Division of Motor Vehicle requirements She stated the automotive sales would have its own separate entrance from the nursery operation Ms Stephenson stated they are acceptable to the special use conditions as proposed There being no further public comments , the Chairman closed the public comment portion of the hearing Mr Gray reported the Planning Board recommended approval of the special use permit based on the information presented in the fact sheet along with the findings of fact , summary of evidence , and special use conditions There being no further comments , the Chairman recessed the Special Use Hearing for Case 17 - roads to undeveloped property from the site Mr Ashness stated over 40 of the site is planned for open space and water and sewer service would be provided by Johnston County Public Utilities Mr Ashness stated the property is located in a Primary Growth Area on the County’s Comprehensive Land Use Plan and there will be a perimeter buffer around the site Mr Ashness noted specific care would be taken to provide an ample buffer from the existing residential lots in all directions Mr Ashness reported they sent out a notice to roughly 80 neighbors within 500 feet of the property lines for a th community meeting on September 26 and had four neighbors attend He stated comments received related to traffic and buffers and he feels the neighbors are now pleased with the lots and agree that the traffic signal , turn lanes , and other traffic improvements are needed Upon a question by Commissioner Allen L Mims , Jr , Mr Ashness stated they received no comments on the proposed stub -
