the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Ted G Godwin , Cookie Pope , Allen L Mims , Jr , Chad M Stewart , Keith Branch , and Larry Wood Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 10 00 am Commissioner Cookie Pope opened the meeting with a prayer Commissioner Ted G Godwin , Veterans Services Advisory Board Chairman Rudy Baker , and Veterans Services Officer Robert Boyette led those in attendance in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Larry Wood , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – August 7 , 2017 10 00 am and 6 00 pm B Resolution Honoring Samuel E “ Sam ” Robertson Per the request of Attorney Allen Tew , the Board adopted the following resolution honoring th Samuel E “ Sam ” Robertson for his 100 birthday RESOLUTION HONORING THE LIFE OF SAMUEL E “ SAM ” ROBERTSON LIFE - LONG CLAYTON RESIDENT WHEREAS , On September 24 , 1917 , Battle Moore Robertson and Claudia Robertson welcomed their youngest child , Sam into the world in Clayton , North Carolina ; and WHEREAS , Sam grew up in Clayton graduating from Clayton High School , thereafter attending Randolph Macon Academy and Duke University ; and WHEREAS , Sam was drafted by the Army Air Force in 1943 , and served during World War II as a ball turret gunner strapped in the belly of the B - 17 Flying Fortress manning two , 50 caliber machine guns ; and WHEREAS , Sam flew 18 bombing missions over Germany and several humanitarian missions dropping food and supplies to civilians in the Netherlands ; and WHEREAS , 0n one occasion , Sam was stuck in the turret as a result of German flack , unable to exit the turret prior to landing , resulting in an aversion to seat belts and a physician’s excuse from wearing a seat belt , which he carries with him while driving each day ; and WHEREAS , following the war , Sam returned home , joined the family business , BM Robertson Mule Company , where he still “ works ” , married Elizabeth “ Betsy ” Avera , raised two fine children , Elizabeth R “ Betty ” Goodwin and John William Robertson , and became an essential part of the fabric of the Town of Clayton ; and WHEREAS , Sam , a life - long , loyal member of Horne Memorial Church , has lived a quiet daily life characterized by devotion to his faith , family , and friends , hard work , honesty , humility , and humor , influencing countless people by his life of service to our country and community , and is a living example of our State motto , “ Esse quam videri ” , To be , rather than to seem ; and th WHEREAS , the County of Johnston wishes to honor Sam Robertson on the occasion of his 100 birthday for his behavioral health is an essential part of health and one’s overall wellness ; and WHEREAS , prevention of mental and or substance use disorders works , treatment is effective , and people recover in our area and around the nation ; and WHEREAS , preventing and overcoming mental and or substance use disorders is essential to achieving healthy lifestyles , both physically and emotionally ; and WHEREAS , we must encourage relatives and friends of people with mental and or substance use disorders to implement preventive measures , recognize the signs of a problem , and guide those in need to appropriate treatment and recovery support services ; and WHEREAS , an estimated 36,000 people in Johnston County are affected by these conditions ; and WHEREAS , to help more people achieve and sustain long - term recovery , the US Department of Health and Human Services HHS , the Substance Abuse and Mental Health Services Administration SAMHSA , the White House Office of National Drug Control Policy ONDCP , and Johnston County Substance Use Collaborative invite all residents of Johnston County to participate in National Recovery Month NOW , THEREFORE , THE JOHNSTON COUNTY BOARD OF COMMISSIONERS , does hereby proclaim September 2017 as National Recovery Month in Johnston County and calls upon the citizens of Johnston County to observe this month with appropriate programs , activities , and ceremonies to support this year’s Recovery Month th Adopted this 5 day of September , 2017 D Proclamation – 2017 Fall Litter Sweep – September 16 - 30 , 2017 adopted as follows PROCLAMATION FALL LITTER SWEEP 2017 WHEREAS , the North Carolina Department of Transportation organizes an annual fall statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the FALL LITTER SWEEP roadside cleanup encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation cleanup by sponsoring and organizing local roadside cleanups ; and WHEREAS , Adopt - A - Highway volunteers , Department of Transportation employees , Department of Public Safety – Division of Adult Correction inmates , community service workers , local government agencies , community leaders , civic and community organizations , businesses , churches , schools , and environmentally concerned citizens conduct annual local cleanups during FALL LITTER SWEEP and may receive certificates of appreciation for their participation ; and WHEREAS , training , courage , and selfless concern for the welfare of others ; and Whereas , firefighters provide valuable services to the citizens of Johnston County , their communities , and the County ; and Whereas , firefighters make sacrifices to protect the lives and financial interests of the citizens of Johnston County ; and Whereas , firefighters respond to emergencies without hesitation when the call of duty arises ; and Whereas , firefighters work with public safety officials and law enforcement officers to protect the integrity of crime scenes , which is necessary to resolve arson cases ; this capacity has become a way of life for me , something that I truly love and enjoy As a lifelong resident of a county that has raised me and my two adult children , I will always cherish and remember the opportunity the taxpayers of Johnston County have afforded me I would be remiss if I did not mention that my children and I are proud graduates of Smithfield Selma Sr High School and we would not have had it any other way As I ride around the county , I am truly humbled by the rewarding career I have had as an elected official when I see the growth and progress of our great county and school system , knowing I played a small part in that success Often in life unexpected opportunities occur that one has to take advantage of for their future and the st future of their family July 31 , I started a new career with a major Insurance Company and based on my schedule and responsibilities it is with sadness but in the best interest of the taxpayers of Johnston County , my family , and myself that I tender my resignation as a Johnston County Commissioner today to be effective September 30 , 2017 This is necessary for me to maximize my new career opportunity and also only fair to the taxpayers based on new daily time constraints Rick and staff , I would like to thank you for taking me under your wing the last nine months and teaching me about all the facets of county government The laymen have no idea what is involved in the daily operations to insure that they have the resources , from trash disposal to waste water to drinking water to public safety , needed to live a comfortable and safe life I was overwhelmed by our visits to the different departments and how they all work together to make Johnston County a great place to live I hope the taxpayers realize Mr Clifton and his team for their hard work and commitment Commissioner Cookie Pope commented that she visits courthouses throughout the State and she would put Johnston County’s above all others stating the facilities are always exceptionally clean and well maintained D County Leadership Forum on Opioid Abuse Health Director Dr Marilyn Pearson announced the Health Department will be partnering with various agencies in the County to host a County Leadership Forum on Opioid Abuse She stated the forum is scheduled for November 3 , 2017 during lunch time and will be held at the Johnston County Agricultural Center Dr Pearson stated she would provide more detailed information on the forum at a later date E Citizen Concern – Chris Krencicki Mr Chris Krencicki , 109 Hinton Court , Clayton , addressed the Board and spoke on a situation in his neighborhood where he stated a neighbor has approximately 17 junk vehicles on the property which exceeds the maximum number of vehicles a private individual is allowed to buy and sell Mr Krencicki spoke on how he feels the actions of the neighbor are impacting his property tax values and he expressed frustration that he lives outside of the city limits of Clayton but within their ETJ and neither the Town nor the County will enforce regulations Mr Krencicki stated he is requesting fairness and for the rules and regulations to be enforced Mr Krencicki stated this issue has been ongoing with him contacting both the County and the Town of Clayton for help and he is upset that no one will enforce the rules The Board discussed the situation with Mr Krencicki and possible options that could be pursued Commissioner Allen L Mims , Jr stated he has been hearing about this issue for some time and as he sees it , there are two options to consider which are 1 to amend the County’s ordinance to incorporate junk vehicles within the nuisance ordinance instead of the zoning ordinance since the zoning ordinance is not enforced withinPagePage pageNumber9830 September 5 , 2017 – 10 00 am Continued the ETJ areas ; or 2 for the County to send an official letter to the Town of Clayton notifying them of the intent to take back the extended ETJ area Commissioner Mims continued that the Town of Clayton’s nuisance ordinance only covers their city limits and not the ETJ area Commissioner Mims noted the Town could include junk vehicles as part of their zoning ordinance which would allow them to enforce the rules within the ETJ , but they have not done that Commissioner Mims stated this is not the only complaint he has heard around Clayton and something needs to be done Staff reported that Mr Krencicki is scheduled to meet with them on Friday of this week to review the situation and more information could be shared with the Board after that meeting F North Carolina Representative Donna White North Carolina Representative Donna White thanked the Commissioners for their service to Johnston County Representative White stated she was pleased to be able to help bring financial support to the communities in Johnston County that she represents ; however , she wished to correct one matter Representative White stated it had been reported in the media that she was not aware that Cleveland is not a town , and she would like to clarify that having represented the Cleveland Community for some time , she is well aware it is not a town Representative White stated she has met with the North Carolina Department of Commerce regarding the financial support and will be providing a letter to the County that states the funds can be used for anything in the community except supporting a festival Representative White stated many people from the Cleveland area have expressed to her that they hope the funds can be used to improve athletics in the community The Board thanked Representative White for visiting the meeting 4 Public Hearing – Public Utilities – Draft 20 Year Capital Improvements Plan Advertised – The Smithfield Herald – August 23 , 2017 The Chairman opened the public hearing to receive public comment on the draft 20 - Year Capital Improvements Plan CIP for water , wastewater and reclaimed water facilities in Johnston County Director of Utilities Chandra Farmer stated the Department of Utilities has completed a proposed 20 - Year Capital Improvements Plan which includes facility improvements and additions , new facilities and major capital purchases for water distribution , water supply , wastewater collection , wastewater treatment and reclaimed water distribution through FY 37 38 Ms Farmer stated current and future water and wastewater demand analyses were conducted by the Department of Utilities and Hazen and Sawyer utilized the water demand projections to update the County’s water system hydraulic model and recommend improvements to meet future demands In addition , Hazen and Sawyer implemented the wastewater projections to complete the update to the Engineering Report for the Johnston County Regional Wastewater Treatment Facility for the proposed wastewater treatment recommendations Ms Farmer continued that the Department of Utilities utilized the demand projections to complete the water supply and wastewater collection improvements recommendations and Willdan Financial Services used growth projections , billing data and previous CIP documents to create a financial model and recommend rate structures The model will be updated with the final 2017 CIP for future financial planning and rate adjustment recommendations Ms Farmer stated based on current projections , the capital project needs for the department exceed 330,000,000 over the twenty year planning period and is summarized below in five year increments Water Water Wastewater Farmer stated the County will need to pursue outside funding , as well as adjust user charges periodically in order to fund the proposed projects without overburdening the customer base The Department of Utilities recommends the County continue to partner with the NC Division of Water Infrastructure and USDA Rural Development to secure low interest loans and grant funding for major projects She noted in addition , the model developed by Willdan Financial Services gives the County a critical tool to effectively evaluate proposed future rate adjustments Ms Farmer stated the complete CIP was made available to the Board and the public for review and she offered to answer any questions Ms Farmer requested the Board to adopt the CIP document Page0831 September 5 , 2017 – 10 00 am Continued Upon a question by Commissioner Allen L Mims , Jr , Ms Farmer stated funding for the improvements would not come from the County’s general fund , but from the enterprise fund as well as loans and grants She stated as growth increases , the customer base increases and based on the financial model , there will be rate adjustments proposed over time Ms Farmer stated the rate adjustments would be modest with no dramatic increases to the customers as improvements are added Commissioner Mims commented that everyone needs water , but he asked Ms Farmer if she sees a real need to expand wastewater if the County were to change its policies on who wastewater service is provided to , such as saving it more for industrial , retail , and schools versus residential Ms Farmer explained that wastewater is very expensive to treat and transmit with one of the major components of that treatment cost being nitrogen She reported the County is very limited as to how much nitrogen can be discharged back into the Neuse River after treatment Ms Farmer stated the County has the same nitrogen allocation today with the plant rated at 95 million gallons per day gpd as what it will have when the plant is expanded to 135 million gpd unless additional nitrogen purchases are pursued from others or advanced treatment technologies are implemented which is very expensive Ms Farmer reported with the current flows and current committed capacities , the County has approximately 1 million gpd of capacity remaining and the County should consider how it wants to utilize that remaining capacity She noted the County also provides bulk treatment for several of the towns and will continue to do so Ms Farmer reported wastewater is a significant cost in the next five year period on the CIP with about 52 million proposed for the next wastewater treatment plant expansion and associated improvements that would also be necessary at the solids handling facility at the Landfill At the inquiry of Commissioner Ted G Godwin , Ms Farmer explained that when the County purchased the wastewater treatment plant from the Town of Smithfield years ago , the County provided bulk service to Smithfield , Selma , Pine Level and Four Oaks with them paying one rate She continued that the Town of Clayton purchased capacity in the County’s plant at a later date because they also have their own plant Ms Farmer stated Clayton purchases capacity in the plant on a contract basis under the interlocal agreement when they need it Commissioner Godwin asked how would the remaining wastewater capacity be affected if one of the towns being provided bulk service were to have a large residential development constructed Ms Farmer stated under the current structure , the County has 1 million gpd per day available that would be allocated to that development with the town paying their current user charge Upon questions by Commissioner Chad M Stewart , Ms Farmer noted that 1 million gpd is the current remaining capacity left in the plant and as an example , a larger industry such as Grifols , utilizes approximately 600,000 gpd Chairman Jeffrey P Carver stated in a recent meeting , he learned that 4 million gallons of wastewater capacity costs approximately 40 million to construct Chairman Carver stated the Board really needs to look at the issue and perhaps do more planning with less zoning Ms Farmer clarified that a 4 million gpd expansion actually costs more along the lines of 52 million when taking into account the associated upgrades needed at the solids handling facility There being no Representatives – Allocation from the North Carolina General Assembly Denton Lee , representing the Cleveland Community , thanked the Board for allowing them to speak Mr Lee also thanked Commissioner Keith Branch for his service and wished him well Mr Lee recognized and thanked Representative Donna White in the audience for being at the meeting today He also recognized and thanked representatives of the Greater Cleveland Chamber of Commerce , the Cleveland Athletic Association , Pop Warner Football , the Rotary Club , the Cleveland Volunteer Fire Department , community business owners , farmers , and developers and he read from the following prepared statement Page1832 September 5 , 2017 – 10 00 am Continued These folks are important leaders in our community , and they are passionate about helping our community and Johnston County continue to be a great place to live and work As background for why we are here today , let me take you back a few months , to the February meeting of this Board At that meeting you heard an appeal from Cleveland Community property owners Dewey and Bet Lawson who wanted to donate 12 acres of land to the County for recreational use You asked your County Manager to evaluate the offer He in turn , contacted several community leaders , including many of us here today We met and had a great discussion about the property In the end , we all came to a similar conclusion that the cost to create viable recreational facilities or open space on this tract , even if the cost of the land was free , was cost prohibitive We also sadly acknowledged there was no reliable or ready source for funding the necessary improvements We went away disheartened that we didn’t have a way to add much needed recreational space for our community or the resources to maintain it Thankfully , this is not the end of the story The discussion about this property made us painfully aware that , despite the great work done by the many volunteers of the Greater Cleveland Athletic Association and the POP Warner Association to provide sports opportunities for the youth of our community , we are woefully deficient in athletic fields and recreational space We have a number of athletic fields and a gymnasium that the county has generously allowed us to use for our youth programs , but the community is outgrowing that space with no means to expand it This year we are having to turn away children because we do not have space to accommodate all our youth who want to participate in sports activities Practice space is so critical that we often use elementary school playgrounds and space generously offered by area churches To add further insult , even though we have wonderful youth programs , these programs only address organized sports for our youth In a community of 27,000 residents about 14 of the population of Johnston County , it is shocking that there are no public access playground facilities or walking trails or family picnic areas or parks or tennis courts or biking trails , and there are no adult programs of any kind The 27,000 number is the approximate population in the McLemore Fire District When we look around us at Clayton , Garner , Smithfield , Four Oaks , Wilson’s Mills , we see towns that are investing heavily in parks and recreation for their citizens Why Because these towns understand that parks and recreation contribute to better health and an improved quality of life When we look at ourselves we see a community with 27,000 residents , and growing daily , that doesn’t have a single sliding board or swing or picnic table for families to enjoy Although a bit unusual among NC counties , Johnston County has taken a path that relegates the acquisition , development , and maintenance of parks and recreation to the incorporated communities within the County As a result , unincorporated areas of the county , like the Cleveland Community , are left with few sources from which to fund quality of life improvements , like parks , athletic fields , and open spaces Please don’t take these comments as critical of your leadership , it is simply a fact that we need to acknowledge , and recognize that if anything is going to change it is up to us We are not suggesting that you should create a county - wide parks and recreation department and start spending general tax dollars on Cleveland What we are suggesting is that , under your current authority , you can provide the structure for a parks and recreation district , and we will provide the leadership , governance , and self - funding A great start to self - governance for the Cleveland Community would be to create a Parks and Recreation District authorized to acquire and maintain parks , open spaces , and athletic fields The growth in western Johnston County has been good for the county , and county taxpayers That growth has allowed this Board to fund new and refurbished school facilities , increased investment in schools and law enforcement , and expanded water and sewer services , without increasing the tax rate Because of that growth , all County citizens have enjoyed a flat ad valorem tax rate for many years What a blessing that is for our citizens who are on fixed incomes It is incumbent on each of us to continue to encourage and manage the growth that has come our way However , if we don’t start actively setting aside open spaces and building parks in fast - growing unincorporated areas like Cleveland , our quality of life will deteriorate and , as a result , the growth we have enjoyed will slow down , to the detriment of our County Over the past several months we have had ongoing , productive conversations with Rick Hester , with your County Attorney , Jennifer Slusser , with Mrs Pope , Chairman Carver , and other County officials regarding how the Cleveland Community might go about creating a Cleveland Area Parks andPage2833 September 5 , 2017 – 10 00 am Continued Recreation District that could manage the acquisition of open space , development of parks and athletic fields , and ongoing maintenance for those facilities We are here today to request 2 things 1 For this Board to authorize your County Manager and your County Attorney to assist the Cleveland Community in working through the exploratory process , including possible state legislation and a voter referendum , to create a Parks and Recreation District that will allow the community to self - determine its future direction for acquiring land and developing recreational opportunities within the current boundaries of the Cleveland Volunteer Fire Department McLemore Fire District 2 Approve the Greater Cleveland Chamber of Commerce to apply for the North Carolina Department of Commerce Downtown Revitalization grant allocated by the 2017 General Assembly to the Cleveland Community in the amount of 30,000 , to be used to fund expenses that will be necessary in the exploration , planning , and possible creation of a Cleveland Area Parks and
