Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Ted G Godwin , Cookie Pope , Allen L Mims , Jr , Chad M Stewart , Keith Branch , and Larry Wood Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 10 00 am Commissioner Ted G Godwin opened the meeting with a prayer American Legion Post 346 Four Oaks led those in attendance in the Pledge of Allegiance to the American Flag Chairman Carver announced that at the January 3 , 2017 10 00 am meeting under the Consent Agenda , the Board had scheduled a public hearing regarding an ordinance amendment for Chapter 24 – Utilities to be held this month ; however , staff has requested to postpone the item to allow more time to research and prepare the amendments so no hearing would be held today 1 Approval Discussion of Agenda Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Keith Branch , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – January 3 , 2017 10 00 am and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Camden Place and Lightwood Circle – Camden Place – Boon Hill Township Meridian Drive SR 3141 ext , Devonshire Drive , Chambury Court , Banbury Court , Ashcroft Court , and Wellington Court – Chadbourne Phase 2 and the Director of the Airport and stated he looks forward to working with everyone Mr Lanier stated his office is open and he invited everyone to visit the Airport 4 Thanksgiving Fire Department – Request for Tax Exempt Loan Status Chairman Jeffrey P Carver recused himself from the discussion and vote regarding this item and the Board agreed by consent Vice Chairman Ted G Godwin led the discussion Finance Director and Assistant County Manager Chad McLamb stated the Thanksgiving Volunteer Fire Department is requesting the Board to grant them tax exempt loan status so they can borrow up to 558,350 for the purchase of a 2017 Pierce Enforcer Fire Engine Mr McLamb reported the Fire Department has obtained three financing quotes with the two lower quotes being only one basis point apart ; therefore , he recommends the financing either with the Local Government Federal Credit Union at 275 or First Citizens Bank at 276 and leave the final decision up to the Fire Department Page0520 February 6 , 2017 – 10 00 am Continued Thanksgiving Fire Chief Paul Zais stated they would be replacing one of their existing trucks that is 20 years old and was purchased used by the Thanksgiving Fire Department Chief Zais stated their community is growing and they need to grow with it to meet the demands Chief Zais reported his Board of Directors has recommended the financing from the Local Government Federal Credit Union due to the lower interest rate Vice Chairman Godwin stated as he understands , the Local Government Federal Credit Union does not require the tax exempt status for the loan because they are already tax exempt ; therefore , the Board could adopt the resolution for tax exempt status for First Citizens Bank and then the Fire Department could choose between the Local Government Federal Credit Union or First Citizens Bank Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Cookie Pope , and carried unanimously with Chairman Jeffrey P Carver abstaining , the Board adopted the following resolution approving tax exempt status in order to allow the Fire Department to choose financing either with First Citizens Bank or the Local Government Federal Credit Union NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Lawson addressed the Board and presented a proposal to donate land to Johnston County for the purposes of a public community park for families Mrs Lawson explained that she owns property in the Cleveland Community at the intersection of Polenta Road and Matthews Road which she hopes to leave part of as a family legacy She stated her father grew up in the Cleveland Community along with his siblings and she spoke on the history of the property noting that for a time much of the property was sold ; however , her father and his brother were able to eventually buy the land back Mrs Lawson stated she now owns the only part of the farm that is still in the family and she would like to give 127 acres to Johnston County to be utilized as a community park Mrs Lawson stated she hopes an agreement can be reached for her to give the land to the County and the County then establish and maintain a family park Dewey Lawson presented the following PowerPoint presentation to the Board toddlers to seniors Mr Lawson noted the location of the property on several maps for the Board stating there are really no family parks within the vicinity He referenced the Johnston County Tourism Authority’s County - wide Parks & Recreation Master Plan stating the park would meet an identified need according to the plan Mr Lawson continued that they realize there will be costs to develop the park and they recommend thePage3523 February 6 , 2017 – 10 00 am Continued County seek grant funds from the North Carolina Parks and Recreation Trust Fund He explained the grants are a dollar for dollar matching grant up to 500,000 and they feel the value of the land could be used as the County’s share of the matching funds Mr Lawson stated they believe the proposed use would be of high value to the Cleveland Community At the inquiry of Commissioner Allen L Mims , Jr , Mrs Lawson stated she owns approximately 69 acres of land directly across the road from the subject site which she plans to sell in the not too distant future Mr Lawson stated they expect the property will be developed for residential Chairman Jeffrey P Carver thanked Mr & Mrs Lawson for the proposal and stated the Board will take the request under advisement and ask the County Manager to look at it further Commissioner Cookie Pope asked Mr & Mrs Lawson if they have had any conversations with the Greater Cleveland Athletic Association GCAA regarding the property Mrs Lawson stated they have spoken with the GCAA who were interested in developing the property for athletic fields , but that is not her vision for the site Mrs Lawson stated there might be space for one or two fields on the site , but she would like to see a park built so all ages could enjoy the property Upon a question by Commissioner Chad M Stewart , Mrs Lawson stated if in working with a park planner it could be determined that there is room for her vision on the property as well as a playing field , then she would consider it , as long as it does not hamper her vision 6 Johnston County Schools – Update on Capital Needs Johnston County Schools Superintendent Dr Ross Renfrow thanked the Board for allowing them to update everyone on their facilities assessment He called on Chief Operations Officer Patrick Jacobs to present the update to the Board Mr Jacobs reported that several months ago , Johnston County Schools had an entire Facilities Assessment performed by an independent engineering and architectural firm to provide estimated costs for some of the projects that they felt were an extreme need Mr Jacobs reviewed the following list of identified current capital projects with the Board Page4524 February 6 , 2017 – 10 00 am Continued Upon a question by Commissioner Chad M Stewart , Mr Jacobs stated the Four Oaks Elementary School roof replacement will be a standing seem metal pitched roof , which is the same type being constructed on new schools Mr Jacobs explained the Smithfield Middle School roof replacement will not be a metal standing seam roof , due to the fact that all of the mechanical equipment is located on the roof of the school He stated to replace the roof with a standing seem metal roof , the cost would be four times as much because all of the mechanical equipment that would have to be relocated At the inquiry of Commissioner Keith Branch , Mr Jacobs stated the life of the new roof for the Smithfield Middle School would be 30 years Mr Jacobs spoke on the bleachers project at the Clayton High School , stating the condition of the current bleachers are a safety hazard and ADA compliance is needed Mr Jacobs explained the higher bid for the Selma Middle School chiller project is due to the increased cost to replace the controllers for the unit which are also in need of repair , and noted it is more cost effective to replace the controllers at the time the chiller is replaced Mr Jacobs stated currently there is a portable chiller at Selma Middle which has been there approximately one year being paid for at a monthly charge of 14,000 st Mr Jacobs stated if the projects on the list are approved , they anticipate a start time of March 1 with an estimated construction time frame of 120 days Commissioner Allen L Mims , Jr asked Mr Jacobs if he had any thoughts as to how the bid opening would come in for the two projects that have not yet received bids , noting that some of the other projects came in under bid Mr Jacobs responded he has no indication if the bids will come in above or below the estimated cost because every school is different and every chiller is different Commissioner Branch commented that moving forward since all the new schools are built with the same models , there should be better cost estimates in the future Mr Jacobs agreed stating they are trying to move away from water cooled chillers to air cooled chillers , but noted that engineering costs will always be involved anytime a large piece of mechanical equipment is replaced County Manager Rick Hester stated there was a joint meeting at the Local Government Commission several weeks ago regarding financing for the overall 30 million in capital needs and his recommendation is that the Board approve the current capital projects as identified in the list submitted today with the County fronting the funds for those projects to get started Mr Hester stated the County could then be reimbursed once the financing for the overall 30 million is obtained The Board discussed the timeline for the projects as identified today and when the funds would be needed Commissioner Branch asked about the status of the overall 30 million capital needs list Mr Jacobs reported they hope to secure all bids by the end of March and if approved by the Johnston st County Board of Education in April , they would begin two weeks after or by May 1 At the inquiry of Mr Hester , Dr Renfrow confirmed that the County needs to work on the financing for the entire 30 million in capital needs for the first of May Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Keith Branch , and carried unanimously , the Board voted to approve fronting the funds up to 24 million , with the flexibility for staff to work with Johnston County Schools if the construction bids come in slightly above 24 million , for the projects as identified by Johnston County Schools with the understanding that the County would be reimbursed once financing is obtained for the estimated 30 million in overall capital needs At the request of Commissioner Branch , it was the consensus of the Board for County Manager Rick Hester to work with Superintendent Dr Ross Renfrow on scheduling quarterly meetings with staff and members of both Boards to continue understanding the difficulties everyone is dealing with associated with growth as well as continue to build the relationship between the two organizations Page5525 February 6 , 2017 – 10 00 am Continued 7 Johnston Community College – Update on Capital Needs Johnston Community College President Dr David Johnson and Vice President of Administration , Financial , and Information Technology Services Dr Darryl McGraw addressed the Board regarding additional capital funding Dr Johnson reviewed the following information with the Board Dr Johnson reviewed with the Board current unmet needs at an estimated total cost of 1,327,034 and requested the County’s assistance with funding Dr Johnson stated they have major electrical infrastructure needs noting one issue is a failure waiting to happen and they would like to get ahead of it He noted the parking lot repairs are greatly needed and in many cases the parking lot has disintegrated down to the subgrade , and they continue to have roof issues Dr Johnson stated some of their HVAC systems are 30 + years in age with one chiller being down altogether He stated their information technology infrastructure is behind and the students , employers , and community is suffering because of that Dr Johnson presented a proposal to the Board to help address the unmet needs He requested the Board allow the College to use 1,327,034 from the bond funds that are encumbered for capital construction projects , and then ask the County for reimbursement when those bond funds are needed for already identified capital construction projects Page6526 February 6 , 2017 – 10 00 am Continued Upon a question by Chairman Jeffrey P Carver , Finance Director and Assistant County Manager Chad McLamb confirmed that the bonds have been sold and funds are in - hand Commissioner Keith Branch asked why the bond funds had not been used yet Dr McGraw explained that the College is required to go through the State Construction Office and even something such as a small roofing project , although it might take three months physically to complete , can often take at least a year to plan He stated one example is their Student Success Center which has already been in the planning stages for nine months , but he anticipates it make take as long as two more years until completion County Manager Rick Hester recommended the Board approve the request by the College and for the Board to consider incorporating the 1,327,034 into a future bond referendum Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Allen L Mims , Jr , and carried unanimously , the Board voted to approve the request from Johnston Community College to use the available bond funds up to 1,330,000 for the unmet capital needs as identified by the College 8 Johnston County Visitors Bureau – Presentation of Annual Report Johnston County Visitors Bureau President Donna Bailey - Taylor presented the Visitors Bureau annual report to the Board She stated according to the Economic Development Partnership of North Carolina , in 2015 visitors to Johnston County spent 22172 million which is an increase of 32 from 2014 and Johnston County st ranks 21 in the State of North Carolina for visitor spending Ms Bailey - Taylor reviewed the following financial statement with the Board Page7527 February 6 , 2017 – 10 00 am Continued She stated the Visitors Bureau is funded by a 3 room tax paid by visitors staying in accommodations in the County with the Towns of Smithfield , Selma , Kenly , and Benson having an additional 2 room tax which is dedicated to each town’s individual marketing campaigns Ms Bailey - Taylor spoke on the staff within the office and reviewed some of the marketing projects undertaken by the Visitors Bureau which included a new “ Blogger Fam Trip ” that generated seven articles and a lot of social posting engagements She also spoke on new group tour itineraries such as the “ Sip and Stay Package ” and the “ Girlfriend’s Getaway Package ” which continue to drive room revenues for participating hotel partners Ms Bailey - Taylor stated the Visitors Bureau strives to be a good partner to other organizations and County agencies by offering their marketing services and spoke on projects where they have helped agencies like the Heritage Center and the Economic Development Office tell the story of Johnston County Ms Bailey - Taylor reported since 1987 , the Visitors Bureau has given 11 million back to the community to help build the tourism infrastructure She pointed out the community support given for 2015 - 2016 , as follows Ms Bailey - Taylor concluded her presentation by stating the Visitors Bureau considers their role with the Board and the County as a partner and they hope to continue the dialogue on recreation and the County - wide parks and recreation master plan She offered to answer any questions Commissioner Keith Branch asked what is the Visitors Bureau’s fund balance County Finance Director and Assistant County Manager Chad McLamb stated as of the last report he received , the fund balance was approximately 700,000 which is somewhere in between 50 to 60 of a fund balance for the Visitors Bureau Commissioner Branch asked why the fund balance is so large Page8528 February 6 , 2017 – 10 00 am Continued Ms Bailey - Taylor stated at one point the Visitors Bureau was looking for a permanent office and had hoped to buy property so they did not spend any of their reserves for several years She noted approximately 250,000 of that fund balance belongs to the individual towns The Board thanked Ms Bailey - Taylor for the report 9 EMS – Approval of Non - Emergency Convalescent Medical Transport Franchise EMS Division Chief Josh Holloman recalled that at the end of August 2016 , Johnston Ambulance Service abruptly closed leaving a big gap with medical transports in the County Mr Holloman thanked North State Medical Transport and Samaritan Ambulance Service for stepping up and doing a tremendous job by helping Johnston County meet the needs Mr Holloman stated even with the two companies , staff has determined there is still a gap noting it has been communicated to the County by the hospital system as well as the assisted living facilities He also stated the County EMS System has had to run a number of transports recently Mr Holloman reported the EMS Advisory Committee discussed the issue and reviewed an application from MedEx Medical Transport to provide services He stated on January 24 , 2017 the EMS Advisory Committee recommended the Board of Commissioners approve a third franchise to MedEx Medical Transport Mr Holloman stated MedEx Medical Transport meets all the requirements of the County and staff agrees with the recommendation by the EMS Advisory Committee At the inquiry of Commissioner Allen L Mims , Jr , Mr Jeff White representing MedEx Medical Transport , reported that MedEx is based out of Ahoskie , North Carolina with offices in Martin , Pitt , Greene , Lenoir , and Wilson Counties He stated MedEx has been in business since 2010 and would have an office in Johnston County Mr White stated he is in the process of looking for space and hopes to have a local presence within 90 days Johnston Health Chief Operating Officer Ruth Marler thanked Samaritan Ambulance Service and North State Medical Transport for their work with transports in the County Ms Marler stated they rely on both North State and Samaritan for transports , but even with these two companies , they have still have had to use 911 when there has been an emergency situation and a transport was needed right away Ms Marler reiterated they are very appreciative of the services by North State and Samaritan , but there is still a void and as the County continues to grow , the need for transport services will increase She stated Johnston Health has written a letter of support for MedEx Medical Transport and offered to answer any questions Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote , the Board granted a franchise to MedEx Medical Transport for non - emergency medical transport services in Johnston County 10 Public Utilities – Cleveland Area Consolidation Sanitary Sewer Project Public Utilities Director Chandra Coats explained that in June 2016 , the Board of Commissioners accepted a loan offer from the North Carolina Division of Water Infrastructure and adopted the budget for the Cleveland Area Consolidation Sanitary Sewer Project She stated bids were received on January 17 , 2017 for project construction The bid advertisement and opening procedures were consistent with statutory requirements to the best of staff’s knowledge Four 4 bids were received , as follows Ms Coats reported the lowest responsive bid was submitted by JF Wilkerson Contracting Co , Inc of Morrisville , NC in the amount of 936,27000 JF Wilkerson Contracting Co , Inc is County’s water and sewer rate study She stated the study is well underway and being completed by Willdan Financial Services Ms Coats stated in order to meet the County’s growing demands , staff has included capital improvements projects in thePage1531 February 6 , 2017 – 10 00 am Continued study which consist of near term expansions at the wastewater treatment plant and the water treatment plant , in addition to future water supply purchased from neighboring jurisdictions Ms Coats stated the study also includes multiple pipeline and pump station projects for both water and sewer and although staff expects the County’s customer base to continue to grow , these necessary capital projects may have an impact on the bulk and retail customer rates in the near future Ms Coats stated staff will have more information in the coming weeks and has asked representatives from Willdan to assist with presenting the results of the study hopefully in April Upon a question by Chairman Jeffrey P Carver , Ms Coats confirmed that it is very likely the County will have rate increases at some point in the future in order to expand infrastructure to keep up with the demands Commissioner Allen L Mims , Jr asked for an update on the operations at the wastewater treatment plant since the flooding from Hurricane Matthew Ms Coats reported the wastewater treatment plant is operating and treating all the wastewater coming in and everything is in compliance with permit limits ; however , there are still some temporary facilities running on the site and the SCADA controls are still not fully restored Ms Coats stated FEMA representatives will be in the County tomorrow meeting with staff to discuss mitigation and perform a site inspection so staff can look at future projects to better protect the plant 12 Discussion – Johnston County Audit Commissioner Keith Branch reported he recently met with staff to discuss the audit process and in talking with staff as well as looking back through the minutes , it appears that it has been 13 or 14 years since the audit was put out for bid Commissioner Branch spoke on his concerns with using the same firm for so many years and stated it is also his understanding that the firm has used the same audit manager for a number of years as well He noted that in looking a
