10 475 Meeting of the Johnston County Board of Commissioners January 3 , 2017 10 00 am The Johnston County Board of Commissioners met in regular session Tuesday , January 3 , 2017 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Ted G Godwin , Cookie Commissioner Ted G Godwin opened the meeting with a prayer The Johnston County Veterans Services Advisory Board led those in attendance in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Ted G Godwin , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Chairman Jeffrey P Carver asked for a motion to approve the Consent Agenda with the removal of the Tax Releases & Refunds for further discussion Commissioner Ted G Godwin moved the Board approve the consent agenda items removing Item E – Tax Releases & Refunds , for separate discussion Commissioner Cookie Pope seconded the motion to approve the consent agenda items as follows , and the motion carried unanimously Note The Tax Releases & Refunds were approved following the Delinquent Tax Collection Report later in the meeting A Approval of Minutes – December 5 , 2016 10 00 am and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Marshview Circle , Crosswalk Lane , and Creekcrest Court – Black Creek Crossing Subdivision – Pleasant Grove Township C Call for Public Hearing – Code of Ordinances Amendment – Chapter 24 The Board scheduled a public hearing for the February 6 , 2017 10 00 am meeting to receive public comments as well as review and consider adopting technical revisions to the Johnston County Code of Ordinances for Chapter 24 – Utilities D Town of Clayton – Appointment to Clayton Board of Adjustment Per the request of the Town of Clayton , the Board made the following appointment representing the ETJ area of the Town Board of Adjustment Johnny House , 2975 Covered Bridge Road , Clayton term expiring 12 31 2019 Page476 January 3 , 2017 – 10 00 am Continued 3 Public Comments A Citizen Comments by Ms Tucker Twisdale Ms Tucker Twisdale , 1755 Buffalo Road , Smithfield , North Carolina , addressed the Board regarding the proposed site for a public safety center Ms Twisdale spoke on the importance of a detention center being located as close as possible to the courtrooms , noting that for the site located on Buffalo Road , it would take additional time to transfer an inmate to the courts considering the stoplights and traffic along Buffalo Road Ms Twisdale asked the Board to consider the location of a public safety center where land is already available and to use the taxpayers ’ money as wisely as possible Ms Twisdale stated the public has voiced their opinion that the Buffalo Road site is not the site for a detention center 4 “ State of the County ” Address by Chairman Jeffrey P Carver Chairman Jeffrey P Carver presented the following “ State of the County ” address 2017 State of the County Address Johnston County , North Carolina Each January , the Chairperson of this Board presents the annual State of the County Address It is a time to briefly reflect on the past year as well as a time to look ahead I would like to first thank my fellow Commissioners for appointing me as Chairman and I am confident Vice Chairman Godwin feels the same We are honored to serve in these roles Congratulations again to our newest Commissioners Keith Branch and Larry Wood on their recent election to the Board We look forward to working with you as we make decisions that impact the citizens of our County I would ask the Board to consider focusing on three main objectives in 2017 ; facilitating continued job growth , supporting our education partners , and staying fiscally responsible to the taxpayers Let me first say that I am optimistic about the future of Johnston County I am sure the recent split votes on certain decisions by this Board have been noticed , but I want everyone to know that we remain united in doing our part to make Johnston County even better than it already is We have many great opportunities ahead of us in 2017 and beyond for Johnston County Before I spend a few minutes talking about the future , I would like to briefly look back at 2016 Even though 2016 was difficult at times , many good things happened We worked closely with the Board of Education to increase funding for teacher supplements as we are proud of our teachers and thankful for their commitment to education The County’s bond rating was upgraded by Moody’s last spring with the final sale of the 2013 bond referendum Since 1999 Johnston County has had seven bond rating upgrades , and we are now one step away from our goal of a “ AAA ” rating which I have no doubt we will meet These rating upgrades increase the County’s standing in the worldwide financial arena and lower borrowing costs for all Johnston County taxpayers Speaking of finances , I am very proud of our excellent audit report Thanks to our Finance team as well as every agency for your efforts We all know and realize that the taxes paid every year by hard - working Johnstonians are not the County’s money , but rather it is the taxpayers ’ money If you have driven by Novo Nordisk and Grifols recently , I am sure you have noticed the massive construction underway Novo Nordisk and Grifols are two of the largest private employers and taxpayers in Johnston County We appreciate their continued commitment to grow in Johnston County and will do everything we can to support their efforts along with every business in the County As mentioned , there were some difficult days in 2016 The CSX intermodal terminal project was a learning experience for us and I think we all learned valuable lessons In the end , CSX will build theirPage477 January 3 , 2017 – 10 00 am Continued intermodal terminal down the road in the Rocky Mount area and we are thankful that the project remained in North Carolina This project will greatly benefit our State and it is our belief that Johnston County will still see positive impacts from this project Hurricanes Fran and Floyd in the late 1990 ’ s greatly impacted Johnston County , but I don’t believe anyone could have been prepared for Hurricane Matthew and the devastation it brought to our State and County in October of 2016 So many of our citizens are still dealing with the aftermath of this historic storm and we continue to pray for the families and businesses that lost everything On the heels of Hurricane Matthew came a day of tragic accidents on Interstate 95 which created a hazardous materials incident that tested our public safety resources in Johnston County I am very proud of our staff along with all the other public safety agencies in the County that responded to both events Their dedication and work through all the long hours with these two events as well as all emergencies in our County are to be commended Looking to 2017 , the Board of Commissioners and the Board of Education have discussed needed renovation and repair projects primarily for our older schools that are estimated to cost as much as 30 million We will be meeting soon with Johnston County Schools to determine the next steps in that process I would ask that our Board commit to discussing and planning for a bond referendum in 2018 for both Johnston County Schools and Johnston Community College Johnston County has a great track record of building and renovating educational facilities to meet growth and we must continue such projects I am especially proud of how we have completed so many projects in the past 18 years without raising taxes or compromising our financial policies and bond ratings As we all know , a proposed public safety center has been in discussion by both the past Board and current Board , specifically a location for a proposed center While it appears that there are different opinions as to where a public safety center should be located , I want to make it very clear that the Board of Commissioners will work together as a team to do what is best for the County and the citizens Please understand that decisions like this are difficult and may be unpopular , but I would ask for everyone’s patience as we work through the due diligence of such a project In closing , we have much to be thankful for Our building permit numbers are up and our unemployment rate is down I look forward to our annual work session where we will chart the course the future I believe that 2017 will be a great year for Johnston County and I hope we all can continue to work together to promote job growth , support our education partners and remain fiscally sound Thank you , Jeffrey P Carver Chairman Johnston County Board of Commissioners 2017 5 Keep Johnston County Beautiful – Presentation of The Historic Architecture of Johnston County Keep Johnston County Beautiful President Susan Woodard along with Secretary Treasurer Flora Grantham and Heritage Center Director Todd Johnson presented a new publication entitled The Historic Architecture of Johnston County Ms Woodard stated Keep Johnston County Beautiful was created under the Cooperative Extension Office in the 1970 ’ s with a mission to promote the aesthetic and historic beauty of Johnston County She continued that the publication The Historic Architecture of Johnston County is a project that has been in the works for a long time , taking approximately 17 years to complete Ms Woodard presented a copy of the book to the Board of Commissioners as a gift to Johnston County Ms Grantham stated it has been a great honor to work with the committee to produce the publication and she is very excited to see it finished Page478 January 3 , 2017 – 10 00 am Continued Mr Johnson called to the Board’s attention in the appendices , a list of all the properties in Johnston County that have been deemed eligible for the National Register of Historic Places He explained that beside a lot of those properties in the western part of the County it now lists them as burned , demolished , or gone Mr Johnson stated he would like everyone to begin a dialogue concerning ways to keep these properties from going away because once they are gone , they are gone forever Mr Johnson spoke on the importance of such properties and the need to preserve them because they help to tell the story of Johnston County The Board thanked the committee for the publication and for all the work that was done to complete it At the inquiry of Commissioner Cookie Pope , Mr Johnson stated the publication is available for sale at the Heritage Center 6 Presentation of Audit Report for Year Ending June 30 , 2016 Alan Thompson , with Thompson , Price , Scott , Adams & Co PA , presented the audit report for the fiscal year ending June 30 , 2016 Mr Thompson stated his firm issued an unmodified report or “ clean report ” and there were no significant audit findings He continued that no difficulties were encountered while performing the audit , there were no disagreements with management , management did provide a representation letter , and management did not consult with any outside auditors Mr Thompson continued his presentation by reviewing a summary of the financial outstanding tax collection rate Mr Thompson stated the collection percentage is incredible considering the size of the County He noted that his firm audits other counties and towns and no one else has a collection rate comparable to Johnston County Mr Thompson spoke on the importance of a good collection rate stating it does impact the bond rating which in turn lowers debt costs He continued with Declare Ambulances Surplus EMS Division Chief Josh Holloman explained that Emergency Services is requesting the Board to adopt a resolution declaring the following ambulances as surplus and approve for them to be sold by electronic public auction GovDeals 2001 Ford Wheeled Coach 73 Engine VIN # 1FDXE45F21HB51554 Mileage 145,583 2009 Ford Wheeled Coach 60 Engine VIN # 1FDXE45P19DA74316 Mileage 136,628 Mr Holloman spoke on the condition of the ambulances stating they have extensive mechanical and electrical issues and have been deemed too costly to repair At the inquiry of Commissioner Allen L Mims , Jr , Mr Holloman reported staff does evaluate the units for possible remounting ; however , in this case these were not eligible for remounting due to extensive electrical problems Mr Holloman stated staff would like to sell the ambulances on GovDeals Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Ted G Godwin , and carried unanimously , the Board adopted the following resolution RESOLUTION DECLARING PERSONAL PROPERTY AS SURPLUS AND AUTHORIZING THE SALE OF SURPLUS PROPERTY BY ELECTRONIC PUBLIC AUCTION WHEREAS , Johnston County owns the following equipment , hereinafter referred to as “ surplus property ” , that is either obsolete or no longer needed for any governmental use by the County ; and 2001 Ford Wheeled Coach 73 Engine VIN # 1FDXE45F21HB51554 Mileage 145,583 2009 Ford Wheeled Coach 60 Engine VIN # 1FDXE45P19DA74316 Mileage 136,628 WHEREAS , the Johnston County Board of Commissioners is desirous of declaring the equipment as surplus and selling at an electronic public auction as authorized by NCGS 160A - 270 ; and NOW , THEREFORE , BE IT RESOLVED , by the Johnston County Board of Commissioners as follows 1 The equipment as listed above is hereby declared to be surplus property ; 2 The County Manager or his designee is hereby authorized to sell by electronic public auction the surplus property described above to the highest bidder The auction will begin on January 17 , 2017 at 8 00 am and end on February 28 , 2017 at 5 00 pm via electronic public auction on GovDeals – wwwgovdealscom , said electronic address being where the information about the property to be sold can be found and where electronic bids may be posted ; 3 Surplus property will be sold “ as is ” , all sales final , cash , certified check , or money order only Johnston County makes no express or implied warranties of merchantability of any surplus property , or part thereof , or its fitness for any particular purpose regardless the County’s website at wwwJohnstonNCcom at least ten 10 days prior to the public auction rd Adopted this the 3 day of January , 2017 8 Health Department – Community Health Assessment Transportation Survey Update Health Director Dr Marilyn Pearson stated every four years , Public Health Departments are charged with performing a community health assessment She explained that in the process , information is gathered from the community residents as well as statistics from the State Center for Public Health which are studied to determine the main causes of illnesses and deaths in the County Dr Pearson stated that information is then assembled and reviewed by a committee to develop focus areas , strategies , and action teams to improve the health of the people in the County Dr Pearson stated in 2010 the focus areas were access to health care , cancer ,Page0484 January 3 , 2017 – 10 00 am Continued obesity , diabetes , and injury prevention with a focus on teen motor vehicle deaths Dr Pearson stated in the last community health assessment of 2014 , three focus areas were developed which are 1 access to health care which includes physical and behavioral health ; 2 obesity and overweight ; and 3 nutrition and physical activity Dr Pearson continued that the access to care action team has identified five strategies as follows 1 Working with health care providers in the community to continue to take care of uninsured and low income residents ; 2 Providing health literacy workshops ; 3 Expanding access to application counselors that can assist with health literacy and insurance enrollment ; 4 Expanding the provider networks ; and 5 Developing a health related transportation committee to explore options for transportation Dr Pearson reported transportation is an issue for many citizens which has necessitated the need for the Community Health Assessment Transportation Survey She stated the subcommittee for transportation is chaired by Mental Health Director Dr Janis Nutt The survey was initiated in November of 2016 and the committee has been working with community partners , Community Care of Wake and Johnston County , Johnston Health , medical providers , Johnston County Emergency Services , the faith network collaborative , the Community Paramedic Program , and many others Dr Pearson stated the hope is to gather data and identify the main transportation issues Dr Pearson submitted a copy of the survey to the Board and offered to answer any questions She stated they will come back and report on the results of the study once completed Upon a question by Commissioner Ted G Godwin , Mental Health Director Dr Janis Nutt stated in addition to offering the survey in the local medical provider offices , they also plan to offer the survey to the general public in areas where a lot of people gather such as public libraries , the courthouse , senior centers , and post it on the Health Department’s website Dr Nutt welcomed more ideas on where to offer the study Dr Pearson stated the survey will also be offered at County agencies such as the Department of Social Services and the Health Department Commissioner Godwin suggested sending it to the municipalities where it could be posted in the town halls 9 Register of Deeds – Refund of Excise Tax County Attorney Jennifer Slusser stated she has reviewed a request for refund of overpayment of revenue stamps from Roper & Taylor , PA Pursuant to NCGS § 105 - 22837 , the request must be made within six 6 months after the date the tax was paid and must explain why the taxpayer believes a refund is due Ms Slusser explained that Ann Weaver with Roper & Taylor , PA , has presented a request for refund of 50000 She stated a General Warranty Deed was inadvertently recorded with excise taxes in the amount of 50000 paid to the Johnston County Register of Deeds The deed was meant to be recorded in Wake County , where the property is located The deed was subsequently recorded in Wake County and the excise tax was paid Ms Slusser stated this request meets the statutory requirements for refund and she recommends the Board of Commissioners approve the refund in the amount of 50000 Commissioner Ted G Godwin moved the Board approve the refund in the amount of 50000 to Roper & Taylor , PA Commissioner Cookie Pope seconded the motion which carried by unanimous vote 10 Budget December 31 , 2016 , the Tax Department has collected 7772 of the real and personal levy for 2016 The next foreclosure sale date is scheduled for January 25 , 2017 The registered motor vehicle collections for December 2016 are 948,93257 and YTD 16 - 17 is 6,602,17659 Ms Garner reported the 2017 Tax Listing Forms were mailed December 29 , 2016 and January 5 , 2017 is the last day to pay the 2016 tax bills without interest Page3487 January 3 , 2017 – 10 00 am Continued Ms Garner took a moment to thank the Commissioners for all their support to the Tax Office as they collect the taxes Ms Garner thanked her staff stating she owes them a great deal of gratitude for all they do every day 12 Tax Releases & Refunds 11 16 2016 – 12 15 2016 Chairman Jeffrey P Carver asked for more information on the Tax Releases & Refunds concerning two amounts for Bizzell Church Solar 1 LLC Tax Administrator Sheila Garner explained that the first entry for Bizzell Church Solar 1 LLC in the amount of 91,45741 dated November 21 , 2016 was to account for a discovery that involved fencing on the site She stated the second entry in the amount of 73,16593 on December 7 , 2016 was to account for an exemption that was approved Ms Garner stated Bizzell Church Solar 1 LLC was then immediately rebilled the correct amount to account for the exemption and the fencing Ms Garner stated the entries were simply paperwork needed to correct the bill Upon a motion by Commissioner Allen L Mims , Jr , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the 14 Board Reports and Comments A Question Regarding Visitor’s Bureau Budget Revision Commissioner Ted G Godwin mentioned the budget revision from the Visitor’s Bureau that was included in this month’s budget revisions and asked for more information Visitor’s Bureau Executive Director Donna Bailey - Taylor explained the budget revision is needed to appropriate funds from the Tourism Authority’s fund balance to cover the cost of a project related to the rebuilding of their website with a content management system She stated it is a big project which will take approximately six months to complete , but once completed the website will be more efficient for staff to manage B Chairman Appointments Chairman Jeffrey P Carver stated he is still working on the Chairman Appointments he asked for any Commissioners to contact him if they have any specific interests on serving on a particular board or committee C Legislative Goals Conference Chairman Jeffrey P Carver stated the North Carolina Association of County Commissioners is asking if anyone from Johnston County can attend this year’s Legislative Goals Conference being held January 12 - 13 in Wake County at the Raleigh Marriott Crabtree Valley If so , they need a voting delegate to represent Johnston County Commissioner Ted G Godwin volunteered to attend the conference representing the County and be the voting delegate
