10 527 Meeting of the Johnston County Board of Commissioners December 3 , 2018 10 00 am The Johnston County Board of Commissioners met in regular session Monday , December 3 , 2018 at 10 00 am in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Commissioners Ted G Godwin , Chad M Stewart , Jeffrey P Carver , Larry Wood , Tony Braswell , Patrick E Harris , and RS “ Butch ” Lawter , Jr Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 10 00 am Commissioner Ted G Godwin opened the meeting with a prayer Marine Corps League Carry On Detachment 1236 of Clayton led those in attendance in the Pledge of Allegiance to the American Flag 1 Organization of the Board Chairman of the Board County Manager Rick Hester called for nominations for Chairman of the Board Commissioner Larry Wood nominated Commissioner Ted G Godwin to serve as Chairman There being no further nominations , the County Manager closed the nominations and Commissioner Ted G Godwin was elected by acclamation to serve as Chairman for a one year term Chairman Godwin thanked his fellow Commissioners for having confidence in him and stated he will endeavor to do his best Vice Chairman of the Board Chairman Ted G Godwin called for nominations for Vice Chairman of the Board Commissioner Larry Wood nominated Commissioner Chad M Stewart to serve as Vice Chairman There being no further nominations , the Chairman closed the nominations and Commissioner Chad M Stewart was elected by acclamation to serve as Vice Chairman for a one - year term Commissioner Stewart also thanked his fellow Commissioners for having the confidence in him to serve as Vice Hubbard recognized the Johnston County EMS Division for receiving the 2018 American Heart Association’s Mission Lifeline EMS Gold Plus Award for continued quality measures for the treatment of patients who experience severe heart attacks Mr Hubbard stated this is the second consecutive year the EMS Division has received this highest award of its type from the American Heart Association and he commended Deputy Director Josh Holloman and all the EMS employees for their work and dedication Mr Holloman stated the award shows that when someone suffers from a heart attack , they will receive the best care possible in Johnston County Mr Holloman thanked all those that play a part in saving lives including the Dispatchers , Fire Department Responders , EMTs , and Paramedics as well as the support they all receive from the Board of County Commissioners The Board congratulated the EMS Division on the accomplishment B Comments from Benson Mayor Jerry Medlin Benson Mayor Jerry Medlin invited the newly elected Commissioners to visit the Town of Benson anytime Mayor Medlin commended the Board of Commissioners as well as Johnston County Manager Rick Hester for the working relationship that Benson enjoys with the County Mayor Medlin spoke on his concerns with the education system as it relates to overcapacities and needed facilities improvements and encouraged the Board to think outside of the box when it comes to funding for Johnston County Schools The Board thanked Mayor Medlin for his comments C Recognition of Newly Elected Commissioners Chairman Ted G Godwin took a moment to welcome and recognize newly elected Commissioners Tony Braswell , Patrick Harris , and Butch Lawter Chairman Godwin noted that this is Commissioner Braswell’s second time serving on the Board and spoke on how Commissioner Braswell was a mentor for him when he was first elected Commissioner Harris expressed his appreciation to the citizens of Johnston County , stating he is honored to be serving as a Commissioner Commissioner Harris stated Johnston County is a fabulous place to be with many opportunities and a bright future ahead He noted there will be challenges , but he believes the Board can work together to make a difference Commissioner Harris recognized Emergency Services Director Kevin Hubbard and Deputy Director Josh Holloman stating that with his background in Emergency Services and EMS , he can say they are doing a fantastic job of saving lives in Johnston County Commissioner Harris saluted prior Boards for their support of the Emergency Services Department noting there are many people walking around today because of that department’s hard work and dedication Commissioner Lawter also expressed his appreciation to the citizens for their support Commissioner Lawter stated in his 15 years serving on the Clayton Town Council , he represented approximately 20,000 citizens ; however , just last evening he felt the responsibility sink in of now representing a County of over 200,000 citizens Commissioner Lawter stated he looks forward to using his background in engineering , infrastructure , and local government to help Johnston County with the opportunities it has in front Commissioner Lawter stated one thing he realized while on the campaign trail all over Johnston County , is that Johnston County is full of good people from one end to the other with citizens willing to roll up their sleeves to solve problems Commissioner Lawter stated he hopes to represent that same attitude on the Board of Commissioners by listening to the people and everyone rolling up their sleeves to get to work Commissioner Braswell thanked everyone for their support and stated he looks forward to helping carry out the great work the Board of County Commissioners has done in the past for the citizens Commissioner Braswell expressed his appreciation for the opportunity to serve again D CopTube America - JC , Inc Ida Morton , Director for CopTube County Manager Rick Hester recognized Assistant Health Director Steve Strickland in the audience and reported the Johnston County Health Department was recently awarded reaccreditation status by the North Carolina Local Health Department Accreditation Board in November The Board congratulated the Health Department on the reaccreditation status F Invitation from Gracie Wells Chamblee Gracie Wells Chamblee of Clayton congratulated the newly elected Commissioners On behalf of the Johnston County Branch of the NAACP , Ms Chamblee invited the Commissioners to attend the upcoming annual Dr Martin Luther King , Jr Prayer Breakfast on January 12 , 2019 at 8 00 am at the Johnston County Agricultural Auditorium She stated anyone who would like to attend could contact her for ticket information 5 Public Hearing – Economic Development Incentive Grant Agreement Advertised The News & Observer Friday Zone Edition – November 23 , 2018 The Chairman opened the public hearing for the purposes of receiving public comment on a proposed economic development incentive grant Chairman Ted G Godwin called on staff for an explanation of the proposed grant Economic Development Director Chris Johnson explained the proposed economic development incentive grant is for an expansion at Novo Nordisk in Clayton Mr Johnson thanked Novo Nordisk for choosing Johnston County and noted the project was very competitive with other states and countries offering proposals Mr Johnson reported the project will have an investment of 22 million and create 22 full time jobs at an average annual salary of 58,000 Mr Johnson reported the Economic Development Advisory Board Incentive Committee recommends approval of a seven year grant based on 50 of the ad valorem taxes on the net new taxable investment for the expansion County Attorney Jennifer Slusser presented a proposed draft Economic Development Incentive Grant Agreement to the Board and outlined the main points of the proposed agreement Ms Slusser called the Board’s attention to the section within the agreement that stipulates the incentive grant is based upon the company meeting the required capital investment and job creation numbers Ms Slusser noted that although the funds for the incentive grant will be paid from the County’s general fund , no payment will be made until the company has satisfied the terms within the agreement and paid their taxes At the inquiry of Chairman Godwin , Ms Slusser stated the proposed incentive grant is consistent with other past grants offered to the biopharmaceutical partners Mr Chad Henry , General Manager for the Novo Nordisk Pharmaceutical Industries Clayton facility , addressed the Board and stated this was a very competitive project Mr Henry stated having the County’s support as well as the incentive grant program was key to making the project happen Mr Henry thanked the Board of Commissioners on behalf of Novo Nordisk , stating the County has been an amazing partner in helping to bring the best medicines possible to diabetics in the United States Commissioner Chad M Stewart thanked Novo Nordisk for their investment in Johnston County and for providing jobs to the citizens Architects – Proposed Public Safety Center Project Update Dan Mace , with Moseley Architects , presented an update to the Board regarding the proposed public safety center project Mr Mace introduced Todd Davis with Moseley Architects and Chad Simmons with McGill Associates and reviewed the following information with the Board PagePage pageNumber7533 December 3 , 2018 – 10 00 am ContinuedPagePage Continued Mr Mace concluded the presentation by reviewing the next steps and an estimated timeline for the project He noted that Moseley would meet with the Sheriff and his staff during the schematic design phase to finalize plans and make sure the facility is operationally functional He stated after the schematic design phase is completed , Mosely would then come back to the Board of Commissioners with cost estimates before requesting approval to proceed with the design development phase Mr Mace reported that further along in the process and closer to the actual bid date , cost estimates would be narrowed down and final detailed estimates generated Mr Mace stated such facilities are complex construction projects and he suggested the Board consider finding a qualified group of contractors that have constructed jail facilities of this magnitude before Mr Mace reported the total estimated project timeline is 38 months from start to completion and he offered to answer any questions Commissioner Butch Lawter asked about other counties that have similar facilities Mr Mace responded that Harnett County has a similar facility in size as well as possibly Iredell and Bladen Counties and he recommends touring other similar structures Upon a question by Commissioner Lawter , County Manager Rick Hester stated the County has not yet entered into a contract with Moseley for the schematic design phase ; however , he would like to recommend the Board consider actions related to the land purchase and schematic design today Mr Hester reported funds have been included in the budget for the land purchase and schematic design Chairman Ted G Godwin commented on the number of schools the County has constructed over the past 20 years , but noted it is probably every other generation that has to look into building a facility like a public safety center of this magnitude Commissioner Godwin stated the facility is needed and it behooves the Board to move forward Commissioner Patrick E Harris stated it is important to recognize that such a facility is a huge expenditure and it needs to be something that will well serve the County long term Commissioner Harris asked if the proposed facility would meet the Sheriff’s long term needs Page2538 December 3 , 2018 – 10 00 am Continued Mr Mace confirmed that the proposed facility is based on population projections and they believe it will meet the needs He noted in the beginning there will be some room for the County to grow into and until that time , the County can look at leasing those beds to other counties to help offset capital and or operational costs At the inquiry of Commissioner Chad M Stewart , Mr Hester noted there will be some beds left at the Courthouse for those that are scheduled for court Finance Director and Assistant County Manager Chad McLamb reported the County spends a little over 1 million annually to house inmates in other counties , so those funds could be converted towards the debt service on a new facility Chairman Godwin commented that in talking about land for the proposed facility , the Board learned that it is not uncommon for many places in Johnston County to have issues with soil , especially for a facility of this size Chairman Godwin called on Chad Simmons with McGill Associates to comment Mr Simmons confirmed that the County would run into this same type of soil in other areas of Johnston County and there are options during construction to address any issues with soils that may be more cost effective than a full depth soil replacement He noted the initial estimates were a worst - case scenario and it is his opinion that there will be opportunities during design for the cost to come down Mr Hester recommended the Board consider taking the following actions 1 Exercise the option and close the sale of the property located at US Hwy 70 Business East and Yelverton Grove Road in Smithfield , allowing him as County Manager to execute any documents necessary to facilitate the closing on terms not materially inconsistent with the Option to Purchase dated March 5 , 2018 ; and 2 Authorize him as County Manager to enter into an agreement for design services with Moseley Architects for the public safety facility on behalf of the County with authorization to proceed with schematic design of the project Chairman Godwin reported the Smithfield Town Council approved the rezoning needed on the site identified for the project Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Chad M Stewart , and carried unanimously , the Board voted to take the following actions 1 Exercise the option and close the sale of the property located at US Hwy 70 Business East and Yelverton Grove Road in Smithfield , allowing the County Manager to execute any documents necessary to facilitate the closing on terms not materially inconsistent with the Option to Purchase dated March 5 , 2018 ; and 2 Authorize the County Manager to enter into an agreement for design services with Moseley Architects for the public safety facility on behalf of the County with authorization to proceed with schematic design of the project 7 Emergency Services – Approval for Sole Source Purchase of Cardiac Monitors Defibrillators Emergency Services Director Kevin Hubbard reported staff received bids in May of 2017 to obtain cardiac monitor defibrillators as part of an Assistance to Firefighters Grant and Zoll Medical Corporation was recommended by staff and approved by the Board of Commissioners for the purchase with those devices being successfully implemented at that time Mr Hubbard continued that the Fiscal Year 2018 - 2019 budget included funding to purchase nine additional cardiac monitor defibrillators for a total quoted cost of 256,54725 and the purchase will allow Emergency Services to continue standardizing ambulances with each staffed paramedic unit having consistent equipment Mr Hubbard stated by standardizing complex medical equipment such as the cardiac monitor defibrillator , the opportunity for human error when treating and transporting cardiac patients is minimized Mr Hubbard explained 1,264,94139 and YTD 18 - 19 is 5,073,43954 15 2019 Revaluation Update Tax Administrator Jocelyn Andrews provided the Board with a brief update on the 2019 revaluation Ms Andrews recognized and commended her staff for the amount of work they are keeping up with considering it is the end of the year along with revaluation time Ms Andrews reported that as is normally done at the end of every December , the tax listing forms will be mailed on December 27 , 2018 She continued that this year , on December 31 , 2018 the 2019 revaluation notices will also be mailed out and most citizens will receive their notices on January 2 , 2019 which is the same day that the Tax Department will open the online portal for those who wish to schedule a time to meet and discuss their value Ms Andrews noted citizens will have various ways to schedule a meeting including the online portal , telephone , in person , or by mail Ms Andrews stated this will be a very busy time in the Tax Department and they will be scheduling the informal appeals in locations across the County for the convenience of the taxpayers At the inquiry of Chairman Ted G Godwin , Ms Andrews reported there is a video explaining the revaluation process on the County’s website She stated with the video , staff tried to simplify the revaluation process and help explain exactly what it is and why it must be done Ms Andrews noted staff is still working with the revaluation data and it is still a little too early to report on the trends they are seeing The Board thanked Ms Andrews for the update 16 Manager Reports and Comments A Resolution of Support for Town Limit Signage for the Town of Clayton Per the request of the Town of Clayton , upon a motion by Commissioner Patrick E Harris , seconded by Commissioner Butch Lawter , and carried unanimously , the Board adopted the following resolution RESOLUTION ENDORSING CLAYTON TOWN LIMIT SIGNS BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERS WHEREAS , the Johnston County Board of Commissioners supports the installation of Clayton town limit signs inside NCDOT right - of - way along corridors entering the municipal limits of Clayton ; WHEREAS , Johnston County
