10 525 Meeting of the Johnston County Board of Commissioners November 5 , 2018 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , November 5 , 2018 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Ted G Godwin , Cookie Pope , Allen L Mims , Jr , Chad M Stewart , and Larry Wood Absent Commissioner Lee Jackson Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 6 00 pm and the following business was transacted 1 Public Comment None 2 Manager Reports and Comments A Resolution for Permanent Utility Easement with the NCDOT At the request of staff , upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Larry Wood , and carried unanimously , the Board adopted the following resolution approving a permanent utility easement with the North Carolina Department of Transportation for the I - 95 bridge replacement project on Truck Stop Road in Kenly RESOLUTION Johnston County Board of Commissioners WHEREAS , the North Carolina Department of Transportation is currently engaged in a highway project designated as TIP Parcel No I - 5786A 011 in Johnston County ; and WHEREAS , the North Carolina Department of Transportation desires to construct and maintain a utility facility through and across the property of the County of Johnston being Tax ID # 03P06051K and being described as I - 95 Johnston County replace Bridge Number 117 on SR 2399 Truck Stop Road “ the Project ” ; and WHEREAS , the North Carolina Department of Transportation desires a Permanent Utility Easement from the County of Johnston for the Project ; and WHEREAS , the Johnston County Board of Commissioners desires to grant the North Carolina Department of Transportation a Permanent Utility Easement for the Project NOW , THEREFORE , BE IT RESOLVED , that the Johnston County Board of Commissioners does hereby approve the Permanent Utility Easement with the North Carolina Department of Transportation for highway project designated as TIP Parcel No I - 5786A 011 attached hereto , as is fully set forth herein th Adopted this the 5 day of November , 2018 B Consent Order – Wellons Construction , Inc County Attorney Jennifer Slusser presented a draft consent order authorizing the Chairman to execute necessary documents as it relates to a Petition for Writ of Certiorari for Wellons Construction , Inc Ms Slusser explained that on August 17 , 2018 , Wellons Construction , Inc filed a Petition for Writ of Certiorari relating to the denial of a preliminary subdivision plat approval under the County subdivision ordinance Ms Slusser stated if approved by the Court , within 60 days of the entry of the Consent Order , the Planning Board will approve the Petitioner’s preliminary subdivision plat for the property Ms Slusser stated staff requests approval of the proposed consent order and to authorize the Chairman to execute the necessary documents Page526 November 5 , 2018 – 6 00 pm Continued Commissioner Ted G Godwin asked what could be done in the future to prevent such situations Chairman Jeffrey P Carver stated he has spoken with staff who will be reviewing the ordinances in order to look at possible amendments that would avoid similar issues in the future The Board briefly discussed things to be considered when looking at possible ordinance amendments Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Larry Wood , and carried unanimously , the Board approved the consent order as presented by staff , authorizing the Chairman to execute necessary documents as it relates to a Petition for Writ of Certiorari concerning the denial of a preliminary subdivision plat approval under the County subdivision ordinance for Wellons Construction , Inc 3 Board Reports and Comments None There being no further business , Commissioner Allen L Mims , Jr moved the Board adjourn Commissioner Cookie Pope seconded the motion , which carried by unanimous vote The meeting adjourned at 6 15 pm Jeffrey P Carver , Chairman Paula G Woodard , Clerk to the BoardPage
