10 470 Meeting of the Johnston County Board of Commissioners September 4 , 2018 6 00 pm The Johnston County Board of Commissioners met in regular session Tuesday , September 4 , 2018 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Ted G Godwin , Cookie Pope , Allen L Mims , Jr , Chad M Stewart , Larry Wood , and Lee Jackson Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 6 00 pm and the following business was transacted 1 Public Comment A Resolution of Recognition – Johnston County District Five 10U Softball Team Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Larry Wood , and carried by unanimous vote , the Board adopted the following resolution congratulating and recognizing the Johnston County District Five 10U Softball Team on their recent State Championship win Commissioner Stewart read the resolution for those in attendance and presented a framed original to the team RESOLUTION RECOGNIZING THE JOHNSTON COUNTY DISTRICT FIVE 10U SOFTBALL TEAM Whereas , the Johnston County Board of Commissioners takes pride in recognizing the accomplishments of all athletic teams in Johnston County ; and Whereas , the Johnston County District Five 10U Softball Team won the 2018 Tarheel League 10U State Softball Championship in Shelby , North Carolina on July 22 , 2018 ; and Whereas , the Johnston County Board of Commissioners recognizes this great accomplishment ; and Whereas , this Championship brings statewide recognition and distinction to all of Johnston County Now Therefore , Be It Resolved , that the Johnston County Board of Commissioners hereby publicly recognizes and congratulates the Johnston County District Five 10U Softball Team on winning the 2018 Tarheel League 10U State Softball Championship th Adopted this the 4 day of September , 2018 Head Coach Ashley Strickland thanked the Board for the recognition and spoke on their championship win Coach Strickland also thanked Coaches Brian Lancaster and Scotty Weaver along with the parents that supported the team throughout the season At the request of the Board the following team members introduced themselves and stated their position on the team Joy Allen , Celeste Anchondo , Hayden Andrews , Emma Baker , Randi Deese , Destiny Gomez , Arissa Hey , Callie Lancaster , Katie McBryde , Danielle Morgan , Ava Strickland , and Amrynn Weaver The Board congratulated the players , coaches , and parents on the championship B NCACC 2018 Youth Voice Summit Johnston County Delegate Commissioner Ted G Godwin stated back in July , Miss Chloe Allen , 4 - H Member in Johnston County , was selected as the Johnston County Delegate for the 2018 North Carolina Association of County Commissioners Youth Voice Summit Commissioner Godwin stated he had the opportunity to meet with Miss Allen at the conference and she represented Johnston County very well Page471 September 4 , 2018 – 6 00 pm Continued 2 Public Hearing Rezoning and Special Use Requests Advertised – The News & Observer Friday Zone Edition – August 24 and August 31 , 2018 Certified letters were mailed to adjoining property owners on August 20 , 2018 Notices were posted at the locations on July 2 , 2018 for Cases 18 - 14 ; 18 - 15 ; and 18 - 16 The Chairman opened the Rezoning Hearing for Case 18 - 14 Case 18 - 14 Petition to rezone a 94 acre tract located at 309 Jeribec Dr in Pleasant Grove Township from Agricultural Residential AR to General Business - Special Use District GB - SUD Tax ID 13C02045S Owner Enrol Cromwell Applicant Jeremiah & Lakeitha Parker Planning Director Braston Newton stated the petition is to rezone a 94 acre tract located at 309 Jeribec Drive in Pleasant Grove Township from Agricultural Residential to General Business - Special Use District He stated the accompanying special use permit is to allow for commercial vehicle parking and single family residential Mr Newton stated the site is currently zoned Agricultural Residential and used for residential purposes The surrounding land uses are zoned Agricultural Residential and used for agricultural and residential uses The area is located within a designated “ Primary Growth Area ” on the County’s Comprehensive Land Use Plan which denotes areas in which high levels of growth pressures currently exist or are anticipated in the near term Mr Newton stated the request came in as a violation back in May of 2017 Chairman Jeffrey P Carver asked why it had taken so long for the case to come before the Board if the violation was issued in May of 2017 Mr Newton responded that in looking back at the case file , it appears there were some difficulties in making and maintaining contact with the property owners He stated the application for rezoning was filed in May of 2018 Commissioner Allen L Mims , Jr expressed concerns with rezoning a residential property to General Business – Special Use District He stated a special use has typically been included in order bring a use in harmony with the neighborhood ; however , in this case he does not know if the requested use would be in harmony Applicant Lakeitha Parker , 309 Jeribec Drive , stated they work for themselves , come home every weekend , and did not know it would be a problem to park their trucks at the property Ms Parker stated others in the subdivision have parked their trucks so they assumed it was okay She stated they park their trucks in their driveway while others park on the side of the road Ms Parker stated they have lived at the property for five years and the violations are all based on hearsay with no one actually visiting the site to see the trucks personally Chairman Carver reminded everyone that the Board is here to determine if the property should be rezoned and how it would be a benefit to the community Ms Parker reiterated that she and her husband decided to drive for themselves and they just want to park their trucks at the property on the weekends when they visit their children Upon questions by Commissioners Allen L Mims , Jr and Chad M Stewart , Ms Parker stated her children live in the home and she and her husband come home on the weekends to visit them Ms Parker stated there were three trucks being parked at the residence for her , her husband , and her brother Gail McGuire , 326 Jeribec Drive , addressed the Board and spoke in opposition to the request Ms McGuire stated the road is not a state maintained road , already has potholes , and the residents are concerned about the condition of the road getting even worse She continued that the property is in the middle of their neighborhood and she also expressed concerns that emergency vehicles could not travel down the road when the trucks are parked in the roadway Donna Wooten , 329 Jeribec Drive , addressed the Board speaking in opposition and stated she has been held up several times by trucks parking in the neighborhood Ms Wooten stated the biggest concern for her is that no one maintains the road She reported there was a Homeowners Association that restricts commercial trucks ; however , the HOA was never really active At the inquiry of Commissioner Stewart , Ms Wooten stated they mostly see the trucks on the weekends Page472 September 4 , 2018 – 6 00 pm Continued There being no further public comments , the Chairman closed the public comment portion of the hearing Mr Newton reported the Planning Board recommended denial of the rezoning and adoption of a Resolution for the Statement of Consistency as submitted in the agenda packet Chairman Carver instructed the Clerk to make the e - 341 , prior to adopting or rejecting a zoning amendment , the governing board is required to adopt a statement approving or rejecting the zoning amendment and describe if the amendment is consistent or inconsistent with the comprehensive zoning plan and why the board considers the action taken to be reasonable and in the public interest ; WHEREAS , the County Planning Board has reviewed a proposed amendment to The Official Zoning Maps of Johnston County , for the parcel identified as tax Tag ID 13C02045S located at 309 Jeribec Dr , as shown on the attached Exhibit A , from Agricultural Residential to General Business - Special Use District to allow for commercial vehicle parking and single family residential WHEREAS , based on a review of the proposed amendment the Planning Board found that the proposed amendment is inconsistent with the Johnston County Comprehensive Land Use Plan and updates and further recommended that the Board of Commissioners deny the proposed amendment ; and WHEREAS , this Board has reviewed and considered the above written recommendation of the Planning Board and has held a public hearing on the proposed amendment , and this Board desires to deny the zoning amendment and adopt a statement describing why the adoption of the proposed amendment is inconsistent with the Johnston County Comprehensive Land Use Plan and updates and the Board considers the proposed amendment to not be reasonable and in the public interest NOW , THEREFORE , BE IT ORDAINED BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERS THAT 1 This Board finds and determines that the adoption of the proposed amendment to the Official Zoning Maps of Johnston County is inconsistent with the Johnston County Land Use Plan and updates thereto because the Land Use Plan and updates indicate that a Comprehensive Land Use Plan Objective 1A states that the County regulations and zoning should be adjusted so as not to encourage growth outside of municipal areas 2 This Board finds and determines that it is not reasonable and in the public interest to adopt the proposed amendment because a The General Business - Special Use District GB - SUD Tax ID 06G05016C Owner Fred & Joanne Randall Applicant Randy Maine Planning Director Braston Newton stated the petition is to rezone 90 acres of a 323 acre tract located at 4913 Lee Drive in the Cleveland Township from Agricultural Residential to General Business - Special Use District He noted the accompanying special use permit is to allow for commercial vehicle parking andPage473 September 4 , 2018 – 6 00 pm Continued construction equipment storage Mr Newton stated the site is currently zoned Agricultural Residential and used for residential purposes The surrounding land uses are zoned Agricultural Residential and used for agricultural and residential uses as well as General Business – Special Use District and Mobile Home Park District The area is located within a designated “ Primary Growth Area ” on the County’s Comprehensive Land Use Plan which denotes areas in which high levels of growth pressures currently exist or are anticipated in the near term Mr Newton stated the request came in as a violation Applicant Randy Maine , 4913 Lee Drive , stated the complaints began during a remodel of his residence Mr Maine explained that during the remodel , they had a dump trailer in the driveway as well as deliveries of cabinets , flooring , and furniture which came in on trucks Mr Maine stated it was said in the complaint that his employees park at the property , but he would like to clarify that his employees meet him on the job site and do not come to his home and materials are also delivered to the job sites Mr Maine reported six people live in his home and together they own nine vehicles which are all on his insurance policy Mr Maine stated it has also been said that he parks a dump truck at his home , but he does not own a dump truck Mr Maine continued that the road is privately owned , but there are trash trucks as well as school buses that travel down the road which far outweigh any of his vehicles and he does not believe he is destroying the road Mr Maine stated he owns a remodeling company and when he has material left over on a job site , it is brought to his residence for storage and he would like to continue to do that Mr Maine stated any trucks or trailers on his property are in his name and not his business Mr Maine spoke of another dump truck business that was operated out of the property back in 2008 Mr Maine acknowledged that there were some issues with cleanliness around his property , but stated that has since been cleaned up Mr Maine expressed his frustration concerning people who spoke at the Planning Board meeting in opposition but do not live in the area and do not know the facts Commissioner Chad M Stewart asked Mr Maine for more information as to why there was a violation or why he is requesting the rezoning if he does not have employees visiting the site and everything for the business is done offsite Mr Maine responded he is requesting the rezoning because he was thrown into the system Mr Maine stated there was a time when he had to dump materials from a job site at the property ; however , he has since cleaned that up Mr Maine stated the trucks at the property are the trucks he drives every day and consist of a dump trailer and a flat trailer Upon questions by Chairman Jeffrey P Carver , Mr Maine stated he has lived on the property for four years and noted there was nothing on the property at the time of purchase because it was a foreclosure that had been cleaned out Mr Maine stated he owns two campers and a food truck both with no tags , that are parked in the back Mr Maine referenced a tractor trailer on the aerial photograph that appeared to be parked just over the property line and stated that was not his truck and that it belongs to the neighbor Mr Maine stated he has not said anything about the tractor trailer because he wants to be a good neighbor Shannon Parker , 1270 Peach Orchard Road , Four Oaks , spoke in opposition to the request Ms Parker acknowledged the tractor trailer at the property line and stated it belongs to her brother and that he uses it for storage of furniture Ms Parker stated the area is residential and the road is not state maintained Ms Parker reported her brother helps to maintain the road Ms Parker stated she lived there for 23 years prior to getting married and her family still lives there She stated if the road is damaged then her family repairs it Ms Parker stated the area is residential and should always remain that way Ms Parker stated she has seen a welding truck parked at the site and she does not know if it is for Mr Maine’s business or not , but it is parked there At the inquiry of Commissioner Larry Wood , Ms Parker stated the issue is that trucks go in and out of the site seven days a week on a non - state maintained road and a business should not be operated in a residential area Mr Maine readdressed the Board and stated the welding truck belongs to his son who has been living at his home Mr Maine stated his son’s residence will be ready in two weeks and he will move and take the truck with him There being no further public comments , the Chairman closed the public comment portion of the hearing Mr Newton reported the Planning Board recommended denial of the rezoning and adoption of a Resolution for the Statement of Consistency as submitted in the agenda packet PagePage pageNumber5474 September 4 , 2018 – 6 00 pm Continued Commissioner Chad M Stewart stated there are a lot of questions about exactly what takes place at the property Commissioner Ted G Godwin commented it appears the rezoning came in as the result of a violation and the question is whether or not the applicant is operating a business out of the home Commissioner Allen L Mims , Jr stated the road is not public which means there is no public access to the back portion of the property which is the area being requested for the rezoning and he questioned if the request is approved could it be considered spot zoning There being no further comments , the Chairman recessed the Rezoning Hearing for Case 18 - - - - Minors 99 131 Total Lots 176 203 Total Acres 41052 52431 Valid Lots 11,314 Adjustments 121 added , 216 removed never developed or recorded The Board discussed the format and data contained within the activity report and asked if a more detailed version could be created Mr Newton responded that he would be looking at revising the current format of the monthly activity report and would share that with the Board soon The Board also discussed the need to continue discussions regarding growth in the County and how it impacts things such as wastewater and school capacities Commissioner Allen L Mims , Jr stated it would be helpful to know what the municipalities are seeing as far as residential growth so that could be considered when looking at school capacities 4 Manager Reports and Comments None 5 Board Reports and Comments A Rezoning Application Process Timeline At the request of Commissioner Ted G Godwin , the Board discussed the timeline for the rezoning application process Commissioner Godwin noted that once an application for a rezoning is denied by the Board of Commissioners , a petitioner must wait 12 months from the date of denial before they can resubmit another application Commissioner Godwin asked if the ordinance should be changed so that a petitioner could be allowed to resubmit another application 12 months from the date of the original submission instead of from the date of denial He noted under the current process , applicants must wait as long as 15 months or more before their petition can be heard again Following discussion , staff was instructed to look at the process and bring back ideas for the Board to consider PagePage pageNumber8477 September 4 , 2018 – 6 00 pm Continued B Revaluation Schedule Commissioner Ted G Godwin stated the County’s current revaluation schedule is every eight years and he asked the Board to discuss the possibility of shortening the cycle to six years initially and then perhaps four years Commissioner Godwin noted he attended the 2018 County Commissioners Conference last week and learned that many counties are moving to shorter cycles in an effort to create fairness Commissioner Allen L Mims , Jr commented that the Board had discussed going to a six year cycle some time ago Following discussion , staff was instructed to research the various options and bring back a list of pros and cons for the Board to consider Staff was also instructed to gather more information as to how often other counties hold revaluations C DSS Update from the 10 00 AM Meeting Commissioner Chad M Stewart recalled the update from the Department of Social Services at the 10 00 am meeting Commissioner Stewart noted that in response to questions , the DSS staff had reported their error rate was 2 according to their last audit ; however , Commissioner Stewart wanted to clarify that the 2 error rate was determined before the NC Fast System was implemented Commissioner Stewart commented that because of all the issues NC Fast has caused , the 2 error rate would not be a good comparison to go by D Alliance Behavioral Healthcare Board Representation Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Chad M Stewart , and carried unanimously , the Board appointed Commissioner Lee Jackson in his individual capacity to fill one of the two seats representing Johnston County on the Alliance Behavioral Healthcare Board of Directors E Commissioner Compensation Human Resources Director Lu Hickey provided the Board with salary information from the recent Mercer Compensation Study as it relates to County Commissioners , noting that Johnston County’s Commissioner compensation is very low when compared to other similar counties Ms Hickey stated based on the Mercer study , staff recommends a salary adjustment for the Board of Commissioners to the market average rate of 16,000 annually for Commissioners and 19,000 annually for the Chairman Based on the information from the Mercer Compensation Study , upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Lee Jackson , and carried unanimously , the Board voted to set the Commissioner compensation at 1,000 per month and the Chairman compensation at 1,100 per month There being no further business , Commissioner Larry Wood moved the Board adjourn Commissioner Cookie Pope seconded the motion , which carried by unanimous vote The meeting adjourned at 7 30 pm Jeffrey P Carver , Chairman Paula G Woodard , Clerk to the BoardPage
