10 656 Meeting of the Johnston County Board of Commissioners December 7 , 2020 10 00 am The Johnston County Board of Commissioners met in regular session Monday , December 7 , 2020 at 10 00 am in the Second Floor Meeting Room of the Public Library of Johnston County and Smithfield located at 305 E Market Street in Smithfield , North Carolina The following members were present Present Commissioners Ted G Godwin , Chad M Stewart , Larry Wood , Tony Braswell , Patrick E Harris , RS “ Butch ” Lawter , Jr , and Fred J Smith , Jr Absent None Also Present Finance Officer and Assistant County Manager J Chad McLamb , Clerk to the Board Paula G Woodard , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Ted G Godwin called the meeting to order at 10 00 am Commissioner Butch Lawter opened the meeting with a prayer Commissioner Fred J Smith , Jr led everyone in the Pledge of Allegiance to the American Flag 1 Organization of the Board Chairman Ted G Godwin stated he has appreciated the opportunity to serve as Chairman these last two years Chairman Godwin thanked the staff for their help and support as well as his fellow Commissioners for their support to him during his time as Chairman He stated the experience has been challenging yet rewarding Chairman of the Board County Attorney Jennifer Slusser called for nominations for Chairman of the Board Commissioner Tony Braswell nominated Commissioner Chad M Stewart , seconded by Commissioner Larry Wood , to serve as Chairman There being no further nominations , the County Attorney closed the nominations and Commissioner Chad M Stewart was elected by unanimous vote to serve as Chairman for a one year term Chairman Stewart thanked his fellow Commissioners for this vote of confidence Chairman Stewart noted that Sheriff Steve Bizzell reminded him this morning that on this day 22 years ago , Sheriff Bizzell was sworn in as Sheriff of Johnston County for his first term and his father , Commissioner Wade M Stewart , was sworn in for his first term as County Commissioner Chairman Stewart took a moment to welcome new and returning Commissioners Ted G Godwin , Larry Wood , Tony Braswell , and Fred J Smith , Jr Vice Chairman of the Board Chairman Chad M Stewart called for nominations for Vice Chairman of the Board Commissioner Patrick E Harris nominated Commissioner Larry departments and staff that have been assisting and supporting the Health Department during the COVID - 19 Pandemic She also thanked the community partners for their assistance with testing including Johnston County Schools , Mr Marlon Lee and the Smithfield Progressive Men’s Club , Benson Mayor Jerry Medlin and the Benson Parks & Recreation Department , the Princeton Baptist Church , the Micro First Baptist Church , CommWell Health and Benson Health Dr Pearson updated the Board on the COVID - 19 Pandemic and stated the number of positive cases is increasing significantly and she noted the Thanksgiving surge is coming as well Dr Pearson stated as of yesterday Johnston County had 8,509 positive cases , 82 deaths , and 43 citizens in hospitals She stated they are continuing to respond to outbreaks in congregate living settings and Johnston County currently has eight active outbreaks and seven clusters Dr Pearson continued her remarks by stating the positivity rate in September was below 5 ; however , it has been increasing and currently stands at 111 She stated the hospitalizations are also increasing and Johnston Health has expanded to add a COVID unit at the Clayton hospital She stated the Health Department continues to encourage handwashing , social distancing , and wearing masks or face coverings Dr Pearson stated they expect a vaccine soon and the Vaccine Planning Committee will be meeting tomorrow to discuss logistics in an effort to be ready for vaccine distribution Dr Pearson thanked the Board for their support during this time At the inquiry of Commissioner Tony Braswell , Dr Pearson stated as a healthcare professional , she recommends everyone to wear a mask Dr Pearson stated wearing a mask would not 100 prevent someone from being infected ; however , it will decrease the risk She added the virus is affecting everyone and in addition to wearing a mask , she spoke on the importance of social distancing and frequent handwashing sanitizing Dr Pearson stated she wears a mask continuously and hopes others will do the same to help decrease the spread Emergency Services Director Kevin Hubbard thanked his staff in the Emergency Services Department and EMS for their hard work responding to COVID - 19 Mr Hubbard stated EMS is averaging approximately six COVID calls per day and is doing a phenomenal job maintaining their focus during these difficult times He noted supplies are currently stable , but he anticipates there may be changes in the supply chain as the virus gets worse and numbers increase Mr Hubbard stated they will continue to assist certain areas of Johnston County as well as a fire at the historic Gurley Mill in Princeton that caused a large scale power outage in that area Mr Hubbard stated during those events the community partners came together at a moment’s notice to help open shelters for those affected by these events Mr Hubbard thanked Johnston County Schools for opening a shelter during the flooding events and Pastor Matthew Cornett along with the members of the Princeton Church for opening a shelter during the power outage Mr Hubbard also thanked the Johnston County Sheriff’s Office for their assistance during the events The Board expressed their appreciation to all for their work and dedication 5 Public Comments A Recognition of Board of Elections County Attorney Jennifer Slusser recognized Elections Director Leigh Anne Price and her staff for doing an exemplary job during the 2020 election under very difficult circumstances Ms Slusser stated they still have recounts as well as the 30 - day count to complete , but they are doing a fantastic job Ms Price stated because of the COVID - 19 Pandemic , this was one of the most challenging elections to date and she would like to thank her staff as well as all the county agencies that supported and assisted the Board of Elections during that time Ms Price also stated the most important people during the elections are the precinct officials and they were definitely the heroes during the 2020 election She thanked them for standing up to the pandemic and doing what needed to be done with the election The Board thanked Ms Price , her staff , the precinct officials , and everyone that had a part in the 2020 election B Princeton Mayor Don Rains – Presentation of Proclamation Princeton Mayor Don Rains spoke on the fire at the historic Gurley Mill in Princeton on November 18 , 2020 Mayor Rains presented and read the following Proclamation declaring December 7 , 2020 as Johnston County First Responder Appreciation Day as a thank you to all those that responded during this event TOWN OF PRINCETON Proclamation Declaring Monday , December 7 , 2020 Johnston County First Responder Appreciation Day WHEREAS , on Wednesday , November 18 , 2020 the Town of Princeton had one of the largest fires in its history at the property located 120 S Pine Street in the downtown business district ; and WHEREAS , the property has been a part of Princeton’s downtown facade since 1914 and was constructed as the Gurley Milling Company ; and WHEREAS , at approximately 6 50 in the evening an emergency call went out for assistance ; and WHEREAS , the following departments responded ; Princeton Fire and Rescue , Pine Level Fire , Brogden Fire , Selma Fire , Wilson Mills Fire , Bentonville Fire , Archer Lodge Fire , Bethany Fire , Thanksgiving Fire , Four Oaks Fire , Strickland Crossroads Fire , Cleveland Fire , and from Wayne County , Rosewood Fire , Grantham Fire and Oakland Fire ; and WHEREAS , the following additional emergency services responded ; Princeton Police Department , Four Oaks Police Department , Pine Level Police Department , Princeton Public Works Department , Johnston County Emergency Services EMS , Fire Marshall , & Emergency Management , Johnston County Sheriff’s Office , Johnston County Public Utilities and NC State Highway Patrol ; and WHEREAS , the Princeton Church of God located at 6085 US Highway 70 Princeton and Pastor Matthew Cornett facilitating the church as a shelter for victims of the fire ; and WHEREAS , the fire was brought under control by 9 00 pm by the dedicated and well trained firefighters from 15 departments in the Johnston County area ; and WHEREAS , the citizens of Princeton along with the Mayor and Board of Commissioners will forever be grateful for all that responded and appreciate the collaborated effort among agencies to ensure the safety of the citizens of Princeton during this horrific incident ; and NOW , THEREFORE , BE IT PROCLAIMED that I , Donald pageNumber6661 December 7 , 2020 – 10 00 am Continued The Board thanked Mayor Rains for the proclamation C Jeff Jennings – Public Library of Johnston County & Smithfield Jeff Jennings welcomed the Board of Commissioners to the Library for their meeting today Mr Jennings informed the Board that Library Director Renita Barksdale has offered her resignation effective th December 11 and the Library Board of Trustees has asked that he assume the role of Interim Library Director Mr Jennings stated he has resigned his position from the Library Board of Trustees to accept the interim position of Library Director just until a replacement is found Mr Jennings noted that he has had the opportunity to work with County Manager Rick Hester , Finance Director and Assistant County Manager Chad McLamb , as well as Human Resources Director Lu Hickey and he appreciates all their support and assistance Mr Jennings informed the Board that Megan Shaner is the new Chair of the Library Board of Trustees and they will be working hard to find a permanent replacement for the director position Mr Jennings reported that due to the COVID - 19 Pandemic , the Library is operating via curbside pickup only at the present time and he offered to answer any questions Commissioner Ted G Godwin stated Ms Barksdale will definitely be missed , but it is good to know that the Library will be in good hands The Board thanked Mr Jennings for the update 5 GoTriangle – Commuter Rail Study Update GoTriangle Chief Development Officer Katharine Eggleston addressed the Board with an update on the commuter rail study Ms Eggleston stated GoTriangle provides public transportation in a region that is experiencing rapid growth and demographic change She stated GoTriangle operates a regional bus and shuttle service , paratransit services , ride - matching and vanpools for a regional area Ms Eggleston reported GoTriangle’s statutory territory includes Wake , Durham , and Orange Counties as well as a ten mile area into adjacent counties , including Johnston County She stated GoTriangle and its transit partners are working to implement a connected network of multi - county transit expansions across the region She stated plans include continued expansion for bus service as well as the potential for commuter rail across the greater triangle area Ms Eggleston stated this past spring , Johnston County entered into a partnership with Wake and Durham Counties to continue the study of commuter rail She reviewed the following information with the Board on the progress of the study PagePage 1 billion , it is very important to make sure the project can secure federal funding as part of the financial plan She stated federal programs can provide up to 50 of the funding which means matching local investment dollar for dollar She explained that in the first phase of the study they looked at the Mebane to Selma corridor to identify options that they believe would be competitive for funding , which yielded two potential projects , those being Durham to Garner and Durham to Clayton She stated they will be looking at the feasibility of both of those options over the next 12 months and the key question will be if there is a cost effective way to extend that service from Garner to Clayton Ms Eggleston continued with the presentation as follows PagePage pageNumber9664 December 7 , 2020 – 10 00 am Continued Ms Eggleston stated ultimately in addition to a decision on how and when to move forward with the project , GoTriangle will be looking to the Johnston County Board of Commissioners to participate in a decision on whether the eastern terminus of the first phase should be Garner or extended into Clayton She stated if the decision is for the first phase of construction to extend into Clayton , the funding plan would have to be determined for the local costs Ms Eggleston concluded the presentation and offered to answer any questions by the Board She noted they will be seeking feedback from the public as to what else should be considered and they look forward to sharing that information with the Board of Commissioners Upon questions by Commissioner Butch Lawter , Ms Eggleston spoke on the differences between commuter rail and light rail noting that light rail is focused in one area while commuter rail serves a larger region with a focus on commuting and access to jobs during peak hours She stated the study should be completed hopefully by this time next year , but it will depend on the coordination and communication with the rail partners Ms Eggleston stated the timeframe for construction completion depends on funding ; however , if all the funding can be secured by the end of 2021 , they hope to open the service in approximately one decade from now Commissioner Lawter stated in Johnston County , there is an interest to extend the service to Selma and he inquired into that possibility as well as the factors that go into those decisions Ms Eggleston responded that for the first phase of implementation , it is important to identify a segment that will be competitive for the federal money and it seems that the Garner and Clayton end points are the most logical areas to consider in this phase Ms Eggleston stated as other areas continue to growth they can becomePage0665 December 7 , 2020 – 10 00 am Continued more eligible for funding for future extensions She stated because they are in the early planning stages , they can take into account longer commuting patterns to try and work those into the models At the inquiry of Commissioner Ted G Godwin , Economic Development Director Chris Johnson stated from an economic development perspective , a transit is a two - way track , which in addition to taking people out of county to work , it can also bring them into Johnston County Mr Johnson stated in most Requests for Information that the office responds to , the need for employees is the most important component and he sees the commuter rail project as a win for Johnston County 7 Moseley Architects – Detention Center Project Update for Phases 1 & 2 and Authorization to Proceed with Design Development of Phase 2 Dan Mace with Moseley Architects provided the Board with an update on Phase 1 which includes the construction of the new detention center and Phase 2 which involves the Public Safety Center that would house the Sheriff’s Office , 911 - Communications , and the Emergency Services Department Mr Mace reviewed the following information with the Board Page1666 December 7 , 2020 – 10 00 am ContinuedPage2667 December 7 , 2020 – 10 00 am Continued Mr Chad Simmons with McGill Associates continued the presentation by reviewing the following proposed site plan for Phase 2 – Public Safety Center Mr Simmons stated since the last meeting , they have obtained concurrence from the US Army Corps of Engineers that the wooded area is not wetlands ; and therefore , will not be subject to provisions of the 404 Act that governs wetlands He stated they are currently seeking concurrence from the NC Department of Environmental Quality DEQ but he does not expect DEQ to go against the Army Corps of Engineers Mr Mace reviewed the proposed floor plans with the Board and pointed out the spaces for the Sheriff’s Office , Emergency Services , and 911 - Communciations Page3668 December 7 , cost under 18 million He stated if the Board chooses to proceed with the Design Development Phase , at the conclusion of that phase they will have completed drawings and can have a more detailed lowering that to 5 in the next phase once more detailed contract documents have been prepared Commissioner Ted G Godwin spoke on the importance of having a functional and well - built structure while making sure the cost of materials is not considered extravagant Sheriff Steve Bizzell stated he has been most impressed with Moseley Architects , McGill Associates , and TA Loving Company throughout the process of design and construction of the Detention Center Sheriff Bizzell stated the construction site has been kept very clean and organized Sheriff Bizzell stated he along with Emergency Services Director Kevin Hubbard and 911 - Communications Director Jason Barbour and Assistant Director Brett Renfrow have met with Mr Mace and his team on this project several times regarding the Phase 2 Public Safety Center in an effort to analyze every part of the facility to realize any cost savings possible Commissioner Lawter encouraged staff to make sure that the technology needs for the future are considered given that technology will be a key part of this center 911 - Communications Assistant Director Brett Renfrow stated they have put a lot of time and work in the technology for the building to make sure it will serve the County well for many years to come while making sure it is cost effective Mr Renfrow stated they are looking at equipment for the 911 Center that will best protect the citizens while remaining conscious of the cost Mr Renfrow noted in addition to other communication equipment , a tower will need to be constructed on site which is estimated to cost approximately 150,000 He stated some of that equipment can be paid for from the North Carolina 911 Fund Commissioner Lawter asked if in addition to the Sheriff’s Office , 911 - Communications , and Emergency Services , if any other agencies could be located at the site such as the Sheriff’s Fleet Services Building and Fueling Center Page6671 December 7 , 2020 – 10 00 am Continued Sheriff Bizzell stated it is his opinion that the current Fleet Services Building and Fueling Center is in good working order at their current location ; however , the Board could look at moving them in the future if necessary Emergency Services Director Kevin Hubbard stated regarding technology , staff has spent a lot of time looking at the needs , particularly for the Emergency Operations Center , that will carry them into the future He stated with this new facility , it would eliminate all the current limitations they experience at the current EOC Mr Mace concluded the presentation by reviewing the estimated construction schedule with the Board Mr Mace stated Moseley is prepared to move forward with the Design Development for the Phase 2 - Public Safety Center if the Board would like to proceed Mr Mace noted that the bidding climate is still very favorable and they would like to proceed as quickly as possible in order to take advantage of the competitive bidding market Sheriff Bizzell noted that the Detention Center cost came in approximately 12 million under the originally anticipated budget and he is hopeful the Public Safety Center would see the same bidding climate Commissioner Patrick E Harris stated he has looked at the proposal for Phase 2 and thinks that Sheriff Bizzell , Mr Hubbard , and Mr Renfrow have done a phenomenal job working with the architects on the design Commissioner Harris stated he understands the concerns by Commissioner Godwin ; however , he looks at this as an opportunity to build a facility that will meet the needs for the next 40 years and more Commissioner Patrick E Harris moved the Board authorize Moseley to proceed with Design Development for the Phase 2 Public Safety Center Commissioner Larry Wood seconded the motion Commissioner Godwin stated the design is very good and he commends Mr Mace and his team ; however , he wants to emphasize function over form Commissioner Godwin also noted this space would create much needed space in the Courthouse so he can support the motion Commissioner Lawter expressed his appreciation to the design team and the staff for the thoroughness that has gone into this project The motion carried by unanimous vote 8 Alliance Health – Update and Request Support for Tailored Plan Application Brian Perkins , Senior Vice President of Strategy and Government Relations with Alliance Health , addressed the Board to provide an update and request a letter of support for their Tailored Plan Application Chairman Chad M Stewart also recognized Mr Lee Jackson who serves on the Alliance Health Board of Directors representing Johnston County along with Commissioner Tony Braswell Page7672 December 7 , 2020 – 10 00 am Continued Mr Perkins stated Alliance Health is the public managed care organization MCO that provides behavioral health services for the uninsured and those on Medicaid in Johnston County , Cumberland County , Durham County and Wake County He stated North Carolina is in the midst of transitioning the Medicaid program and Alliance’s role in that is to become an integrated tailored program Mr Perkins stated they are in the process of responding to a Request for Applications RFA from the North Carolina Department of Health and Human Services to become a tailored plan Mr Perkins stated a significant part of that application process is for Alliance to demonstrate and explain the various partnerships with the communities He stated the partnership with Johnston County is very important and one that they would like to highlight in the application Mr Perkins requested the Logan Penny who have been working on a new preparedness calendar for the citizens Ms Wood explained that Emergency Services is always looking for better ways to share information with the community on the importance of being prepared for emergencies She stated the calendar is an effort to get more information to the citizens and they worked with Fire Services , Emergency Management and EMS to cover all areas of concern Ms Wood presented copies of the calendar to the Board and encouraged the Commissioners to share them with the citizens Commissioner Patrick E Harris thanked the staff for their necessary public services provided by Town to properties annexed in the District ; and WHEREAS , the County and Town cooperate to encourage and promote development opportunities in and around the personal property improvements on the Site Said payment will be made from Johnston County general funds to Town not later than April 15 in each year , beginning April 15 , 2021 , with respect to the Net New Ad Valorem Tax Revenue received by County during the previous calendar year with respect to the real and personal property improvements on Site The parties understand and agree that Net New Ad Valorem Tax Revenue may reduce or increase from year to year due to depreciation or new value added to the Site , as applicable The calculation of Net New Ad Valorem Tax Revenue shall not include any fire , insurance , or service district ad valorem taxes , or any other charge , fee , assessment , or tax other than the County’s primary general revenue ad valorem tax which shall not include such tax on the unimproved value of the Site 3 The County and Town acknowledge the need for infrastructure upgrades and expansions to support expansion of current companies and recruitment of new companies in and around the District The County and Town agree to work collaboratively to hold discussions with various agencies of the State of North Carolina about the infrastructure needs in the District and potential funding opportunities for needed upgrades and expansions Furthermore , the County agrees to work collaboratively with the Town to identify means of funding for necessary infrastructure decrease in the collection rate from last year at this same time is due to a large mortgage company bank not yet paying for the 2020 year She noted that in 2019 it paid the tax escrow on st October 31 Commissioner Ted G Godwin stated the Board recognizes it has been a difficult time during the COVID - 19 Pandemic and he thanked Ms Andrews and her staff for their work Commissioner Tony Braswell spoke on the devastation that COVID - 19 has caused for many businesses and asked if State law provided some kind of process by which interest and penalties could be waived perhaps th up until April 15 for those businesses that are struggling Ms Andrews stated interest is set pursuant to North Carolina General Statutes and unfortunately , nothing can be done to waive interest She continued that regarding penalties for business listing forms , th businesses can ask for an extension until April 15 to list Ms Andrews noted that last year , a number of businesses were unable to file their listing form on time due to circumstances surrounding COVID - 19 She stated in those instances , the Board of Equalization & Review does have the authority to waive penalties and they did waive a number of penalties for appeals that were filed last year Ms Andrews stated she strongly encourages if there is anyone or any business that has concerns to contact the Tax Office and discuss their situation with the staff and perhaps they can talk through the issue Commissioner Braswell stated he and his fellow Commissioners are just looking for ways to help the small businesses especially considering another waive of the pandemic is coming 16 Voting Delegate for the NCACC Virtual Legislative Goals Conference Chairman Chad M Stewart stated the North Carolina Association of County Commissioners is requesting counties to designate a voting delegate for this year’s Legislative Goals Conference that will be held January 14 - 15 , 2021 via a virtual platform Commissioner Tony Braswell nominated Commissioner Ted G Godwin as the delegate for Johnston County , seconded by Commissioner Larry Wood , and carried unanimously 17 Manager Reports and Comments A Construction Administration Contract Amendment for Phase 2 of the Public Safety Detention Center Project At the request of staff , upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Butch Lawter , and carried unanimously , the Board voted to approve an amendment to the construction administration contract with Jimmy Boykin to cover his services for Phase 2 of the Public Safety Detention Center Project B Public Information Officer Human Resources Director Lu Hickey stated at the request of Commissioner Lawter , information has been provided to the Board as it relates to a general job description and cost information for the creation of a fulltime Public Information Officer and she asked if the Board had any questions Ms Hickey stated it is the Board’s discretion as to how staff should proceed Commissioner Butch Lawter stated given the times everyone is seeing , he believes the public is looking for more information which the County should provide , particularly as the Board begins the process of updating the Comprehensive Land Use Plan Commissioner Lawter also stated in looking ahead to 2021 , it would be helpful to get information out regarding the Board’s additional their job would consist of and who that person would report to Chairman Stewart stated he wants everyone to understand what is expected of a Public Information Officer so there are no disappointments Chairman Stewart stated he has a few more things that he would like to consider before making a decision Commissioner Tony Braswell stated he wanted to make it clear that the discussions regarding the possibility of a fulltime dedicated Public Information Officer is not a reflection on the County’s current Public Information Officers who hold that title along with their other fulltime jobs and the
