10 523 Meeting of the Johnston County Board of Commissioners September 8 , 2020 10 00 am The Johnston County Board of Commissioners met in regular session Tuesday , September 8 , 2020 at 10 00 am in the Auditorium of the Johnston County Agricultural Center located at 2736 NC Highway 210 in Smithfield , North Carolina The following members were present Present Chairman Ted G Godwin , Vice Chairman Chad M Stewart , Jeffrey P Carver , Larry Wood , Tony Braswell , and Patrick E Harris Commissioner RS “ Butch ” Lawter , Jr participated remotely via conference call Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Ted G Godwin called the meeting to order at 10 00 am Commissioner Patrick E Harris opened the meeting with a prayer Commissioner Chad M Stewart led everyone in the Pledge of Allegiance to the American Flag The Chairman announced that Commissioner Butch Lawter would be participating remotely via conference call 1 Approval Discussion of Agenda Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner Tony Braswell , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner Larry Wood , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – August 3 , 2020 – 10 00 am and 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Arrow Lane – Archers Crossing – O’Neals Township Merritt Drive , S Lumina Lane , and N Lumina Lane – Merifield Subdivision – Wilders Township Nashville Drive Ext SR 3286 and Swindell Drive – Heritage – Phase 4 – Wilders Township Summerwind Plantation Drive and Horizon Trail SR 3362 ext – The Harvest at Summerwind Plantation – Cleveland Township C Proclamation – Child Passenger Safety Week and National Seat Check Saturday , adopted as follows CHILD PASSENGER SAFETY WEEK 2020 PROCLAMATION WHEREAS , Every day in America , millions of parents and caregivers travel to work , school , and after - school activities with their children While many of those children are riding in correctly installed car seats for their ages and sizes , most are not On average , two children under 13 were killed , and an estimated 377 were injured every day in 2018 while riding in cars , SUVs , pickups , and vans While the fatality numbers are significantly lower than they were in 2017 — a 7 decrease in fatalities , there is still more work to be done to keep all children safe on America’s roadways ; andPage524 September 8 , 2020 – 10 00 am Continued WHEREAS , Today all 50 states , the District of Columbia , and all US territories require the use of car seats for children traveling in motor vehicles In 2018 , of the 634 children 12 and younger who were killed while riding in passenger vehicles , approximately one in three were not in a car seat , booster seat , or wearing a seat belt While fatalities decreased from 2017 to 2018 , it is imperative that we work together toward eliminating these preventable deaths and injuries ; and WHEREAS , That is why Johnston County is committed to educating parents and caregivers about the best ways to keep kids safe while traveling in cars , no matter how short or long the trip We know that the list of things that parents do out of love for their children is long Adding car seat safety to that list is essential to a child’s well - being During Child Passenger Safety Week , car seat safety checks will be held across the country We encourage all parents and caregivers to take advantage of this free service to make sure their children are in the right car seats for their ages and sizes , and that the seats are installed correctly To locate an inspection station in your area , and to get more information about child passenger safety , visit wwwbuckleupncorg NOW THEREFORE , We , the Johnston County Board of Commissioners , do hereby proclaim September 20 - 19 pandemic seven days a week trying to keep the citizens safe and healthy Dr Pearson also thanked the Johnston County Sheriff’s Office , Emergency Services , Human Resources , County Attorney Jennifer Slusser , and all others that have been supporting the Health Department throughout the pandemic Dr Pearson reported as of September 7 , 2020 , Johnston County had 4,089 positive cases of COVID - 19 She noted there have been 52 deaths and currently 31 citizens are hospitalized Dr Pearson stated they have seen an increase in the number of hospitalizations over the last month She stated over 3,500 cases are presumed recovered at this point Dr Pearson reported testing continues across the County and she urged citizens to continue practicing frequent handwashing and social distancing The Board took a 3 minute recess for staff to address audio visual technical difficulties Emergency Services Director Kevin Hubbard reported the Emergency Services Department continues their support of the Health Department during the pandemic He stated the EMS Division is averaging six COVID - 19 calls a day and they are doing a great job utilizing the Personal Protective Equipment PPE and taking care of the citizens Mr Hubbard stated the PPE supplies are currently stable Mr Hubbard stated staff continues to monitor the weather and noted there are a few tropical depressions they are tracking Mr Hubbard thanked the Board and County Manager Rick Hester for their support to the Emergency Services Department Mr Hubbard also took a moment to thank all the firefighters and first responders in the County and he asked everyone to keep the Clayton Fire Department in their thoughts as their membership is dealing with an outbreak of COVID - 19 4 Public Comments A Comments from Citizen David Johnson David Johnson , 125 Cypress Pointe , Smithfield , stated he owns a business property located at 1621 S Brightleaf Boulevard in Smithfield Mr Johnson informed the Board that the property was flooded in 2016 by Hurricane Matthew and he expressed concerns that nothing has been done to address the issues since that time Mr Johnson reported the building was flooded again just last week from a heavy rain and he is concerned there will be even more flooding events with the hurricane season Mr Johnson stated he was informed that there is a culvert underneath the CSX railroad that seems to be contributing to the problem Mr Johnson spoke on the difficulties of working with the railroad and he asked for assistance on how to remedy the situation Mr Johnson stated he feels he has no recourse and needs someone to act on his behalf to fix the problem The Board discussed the situation with Mr Johnson At the inquiry of Commissioner Chad M Stewart , County Manager Rick Hester stated he believes the Town of Smithfield has also contacted CSX at some point and perhaps a letter from the Board of Commissioners to CSX about the situation would be appropriate It was the consensus of the Board to send a letter to CSX regarding the issue B Comments from Board of Education Candidate Rick Mercier Rick Mercier , 193 Fireweed Place , Clayton , introduced himself to the Board and the audience and stated he is a candidate for the Board of Education Mr Mercier provided everyone with a background on his work and experience and explained why he is running for the Board of Education Mr Mercier spoke on his thoughts regarding educational capital needs and per pupil expenditures 5 Emergency Services – Resolution for Firefighters Week in Johnston County Johnston County Fire Marshal Adam Stanley presented a resolution to the Board and requested its adoption declaring the week of September 6 - 12 , 2020 as Firefighters Week in Johnston County Mr StanleyPagePage pageNumber6528 September 8 , 2020 – 10 00 am Continued recognized Thanksgiving Fire Department Chief Paul Zias representing the Fire Chiefs Association and Cleveland Fire Department Chief Chris Ellington representing the Firefighters Association who joined him in presenting the proclamation Mr Stanley thanked all firefighters as well as all first responders , 911 telecommunicators , and law enforcement officers in the County for all they do every day , stating the past week was especially difficult given the tragic events that occurred in Four Oaks during the heavy rain storm Commissioner Chad M Stewart stated he was on the scene in Four Oaks last week and sadly , while that event did not end the way everyone had hoped it would , he was personally able to witness the efforts put forth by all those that responded Commissioner Stewart spoke on how those that responded literally put their lives on the line that evening and throughout the emotional event , they acted professionally and never hesitated to put their own lives in danger Commissioner Patrick E Harris stated he could speak from personal experience having spent his career in that field , and everyday those first responders put their lives in danger every single time they leave the station Commissioner Harris spoke on how a routine call for assistance can turn into a life - threatening situation in a matter of minutes Commissioner Harris stated Johnston County is fortunate to have a tremendously talented team consisting of 911 telecommunicators , first responders , firefighters , EMS personnel , law enforcement officers , and emergency management personnel Commissioner Butch Lawter expressed his appreciation for the firefighters and first responders , noting that they are a true family and he has been able to witness that relationship recently with all the support shown to the Clayton Fire Department as they deal with a COVID - 19 outbreak Commissioner Lawter stated the event last week in Four Oaks once again shows the sacrifices that they make every day to save lives Commissioner Lawter also thanked the 911 telecommunicators , EMS personnel , and law enforcement officers for what they do and their families for allowing them to serve others Commissioner Butch Lawter moved the Board adopt the resolution declaring the week of September 6 - 12 , 2020 as Firefighters Week in Johnston County Commissioner Chad M Stewart seconded the motion which carried by unanimous vote RESOLUTION PROCLAIMING FIREFIGHTERS WEEK IN JOHNSTON COUNTY Whereas , fighting fires is one of the most hazardous professions requiring physical strength , stamina , extensive training , courage , and selfless concern for the welfare of others ; and Whereas , firefighters provide valuable services to the citizens of Johnston County , their communities , and the County ; and Whereas , firefighters make sacrifices to protect the lives and financial interests of the citizens of Johnston County ; and Whereas , firefighters respond to emergencies without hesitation when the call of duty arises ; and Whereas , firefighters work with public safety officials and law enforcement officers to protect the integrity of crime scenes , which is necessary to resolve arson cases ; and Whereas , firefighters reside in the community in which they serve and have a great appreciation for protecting their communities ; and Whereas , it is appropriate to recognize the duties and services that firefighters perform by observing Firefighters Week in Johnston County Now Therefore Be It Resolved by the Johnston County Board of Commissioners that all firefighters deserve to be honored for the invaluable service they provide to the County , its citizens , and communities The Board of Commissioners encourages the citizens of Johnston County to observe the week of September 6 - 19 began in March Ms Hickey stated going forward even after the COVID - 19 pandemic is over , staff hopes to continue utilizing teleworking in an effort to help with office space needs Ms Hickey stated in speaking with the various departments , Human Resources became aware of the many benefits that teleworking offers Ms Hickey reviewed points within the policy with the Board and offered to answer any questions Commissioner Jeffrey P Carver asked how workers compensation claims and data security would be addressed Commissioner Carver also asked about the long - term goal is to continue teleworking where it is feasible to do so and at the discretion of the departments At the inquiry of Commissioner Chad M Stewart , Ms Hickey acknowledged that there are some positions that deal mainly with the public and it may not be realistic to continue teleworking in those situations or at least not all the time Ms Hickey reiterated that teleworking would be at the department’s discretion along with the County as a whole to determine the feasibility Chairman Ted G Godwin noted there are some departments that are not able to telework , such as the 911 - telecommunicators and law enforcement He asked Ms Hickey if she anticipates morale problems in those situations where employees do not have the opportunity to telework Ms Hickey stated anytime a new policy is put into place where not everyone will be eligible , there is always the risk that it can cause morale problems Ms Hickey explained that in this instance , most of the employees already know who can and cannot telework because those positions were identified early on during the COVID - 19 pandemic Ms Hickey noted that even in most of those situations there is some associated paperwork and those employees could have the opportunity to telework half a day every so often , again at the department’s discretion Commissioner Carver asked about the associated expenses with teleworking Ms Hickey stated the computers have already been ordered and were paid for with CARES Act funds She stated software would tie back into the employee’s desktop at the County Ms Hickey stated employees must be able to provide internet access themselves from their homes Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Patrick E Harris , and carried unanimously , the Board adopted the following telework policy and agreement Johnston County Telework Policy Effective Date Upon Board Approval Policy Overview Johnston County’s telework program is designed as a work alternative that may be offered to some employees when there is a benefit to both the County and the employee A telework arrangement allows an employee to perform work , during any part of regular , paid hours , at an approved alternative worksite eg home or telework center Telework is not a benefit or entitlement , but an alternative work arrangement intended to enhance productivity , creativity , employee satisfaction , reduce operational costs or other reasons as deemed necessary by the County Johnston County will place precedence in the needs of the County and the ability to serve internal and external customers when considering the decision to allow telework Telework alternatives will be available for some positions , due to the nature of their duties and responsibilities , whereas others will not Standard operating hours are Monday – Friday from 8 AM – 5 PM , when an agency is open to the public Unless otherwise arranged with Department Head and communicated to the Human Resources Director , employees are expected to be available and working during this time Telework does not change the basic terms and conditions of employment with the County and employees are subject to all County policies that apply when working at a County facility This telework policy and its accompanying guidelines provide a general framework for teleworkers in County departments ; it does not attempt to address the special conditions and needs of all employees With the approval of the Department Director , Human Resources Director and County Manager , eligible employees may be permitted and or required to perform work functions from locations other than their normal office location Organizational Rules Employee EligibilityPage2534 September 8 , 2020 – 10 00 am Continued Employee eligibility for telework will be based on all of the following ? The position can function independently and the supervisor can adequately assess the work performance in a telework arrangement ? Offering the opportunity to work at home is a management option ; telework is not a universal employee benefit The employee , supervisor , department director or county manager may terminate telework at any time and for any reason ? The teleworkers conditions of employment with the County remain the same as for non - telework employees and employees are subject to the same policies that apply when working at a County facility ? To ensure hardware and software security , all software used for telework must be approved by and or through Technology Services before installation Networking can only be established using compatible hardware and software Only approved communication sources may be accessed using County equipment ? Troubleshooting basic equipment software problems are the responsibility of the teleworker ? Equipment , software , or files that are stolen must be reported immediately to the Supervisor ? Unless otherwise agreed to in writing prior to any loss , damage or wear , Johnston County does not assume liability for loss , damage or wear of employee - owned equipment It is not possible to identify all of the situations that may arise from a specific telework relationship As such , issues will be addressed on a case by case basis and may not be binding to other arrangements Procedures ? The Department Director will assess the nature of the position and determine the compatibility of the position and the employee’s past performance to determine suitability for telework in accordance with the requirements of this policy ? Pisgah , Ingrams Township , Little Creek , Little River , McGee’s Crossroads , Meadow , O’Neals , Princeton - Kenly and Wilson’s Mills Water District Boards The Chairman introduced the following resolution , a summary of which had been provided to each Commissioner , a copy of which was available with the Clerk to the Board and which was read by title RESOLUTION APPROVING AMENDMENTS TO CERTAIN EXISTING OBLIGATIONS OF WATER DISTRICTS CREATED BY THE COUNTY AND PROVIDING FOR CERTAIN OTHER RELATED MATTERS WHEREAS , the Johnston County Finance Corporation the “ Corporation ” has previously executed and delivered the Johnston County Finance Corporation Limited Obligation Bonds County of Johnston , North Carolina , Series 2013 , dated July 31 , 2013 the 2013 LOBs ; WHEREAS , the proceeds of the 2013 LOBS were advanced from the Corporation to the County pursuant to an Installment Financing Contract , dated July 1 , 2013 , between the County and the Corporation ; and the County used a portion of the proceeds of the 2013 LOBs to purchase General Obligation Refunding Bonds , each dated as of July 31 , 2013 the “ 2013 District Refunding Bonds ” , from certain of the Districts ; WHEREAS , the Corporation has previously executed and delivered the Johnston County Finance Corporation Limited Obligation Bonds County of Johnston , North Carolina , Series 2014 , dated June 27 , 2014 the 2014 LOBs ; WHEREAS , the proceeds of the 2014 LOBS were advanced from the Corporation to the County pursuant to an Amended and Restated Installment Financing Contract , dated June 1 , 2014 , between the County and the Corporation ; and the County used a portion of the proceeds of the 2014 LOBs to purchase a General Obligation Refunding Bonds , each dated as of June 27 , 2014 the “ 2014 District Refunding Bonds ” , from certain of the Districts and b Installment Financing Contracts , each dated as of June 27 , 2014 the “ 2014 District Refunding Contracts ” and , together with the 2013 District Refunding Bonds and the 2014 District Refunding Bonds , the “ 2013 2014 District Refunding Obligations ” , from certain of the Districts ; WHEREAS , the Corporation has previously executed and delivered the Johnston County Finance Corporation Taxable Limited Obligation Bonds County of Johnston , North Carolina , Series 2020B , dated July 8 , 2020 the 2020B LOBs ; WHEREAS , the proceeds of the 2020B LOBS were advanced from the Corporation to the County pursuant to an Installment Financing Contract , dated July 1 , 2020 , between the County and the Corporation ; and the County used a portion of the proceeds of the 2020B LOBs to advance refund the 2013 and 2014 LOBs ; WHEREAS , the use of a portion of the proceeds of the 2020B LOBs to advance refund the 2013 and 2014 LOBs also indirectly and economically advance refunded the 2013 2014 District Refunding Obligations ; WHEREAS , the Board , acting as the governing body of the Districts , has determined that as a result of the indirect and economic advance refunding of the 2013 2014 District Refunding Obligations , which resulted in debt service savings for the Districts with respect to their respective 2013 2014 District Refunding Obligations , it is in the best interest of the Districts to amend certain provisions of their respective 2013 2014 District Refunding Obligations to conform to the debt service requirements of the 2020B LOBs ; WHEREAS , there have been submitted to this meeting draft forms of the following documents with respect to the proposed amendments to the 2013 2014 District Refunding Obligations 1 a Bond Form R - 2 for each of the Districts who issued the 2013 District Refunding Bonds to the County , each proposed to be dated on or about October 1 , 2020 , and to be issued to the County to replace the existing Bonds R - 1 heretofore issued to the County as the 2013 District Refunding Bonds collectively , the “ Amended 2013 District Refunding Bonds ” ; 2 a Bond Form R - 2 for each of the Districts who issued the 2014 District Refunding Bonds to the County , each proposed to be dated on or about October 1 , 2020 , and to be issued to the County to replace thePage8540 September 8 , 2020 – 10 00 am Continued existing Bonds R - 1 heretofore issued to the County as the 2014 District Refunding Bonds collectively , the “ Amended 2014 District Refunding Bonds ” ; 3 an Amended and Restated Installment Financing Contract for each of the Districts who executed and delivered the 2014 District Refunding Contracts to the County , each proposed to be dated on or about October 1 , 2020 , and to be executed and delivered to the County to replace the existing Installment Financing Contract heretofore executed and delivered to the County as the 2014 District Refunding Contracts collectively , the “ Amended 2014 District Refunding Contracts ” and , together with the Amended 2013 District Refunding Bonds and the Amended 2014 District Refunding Bonds , the “ Amended 2013 2014 District Refunding Obligations ” ; and WHEREAS , the Board of Commissioners desires to approve the Amended 2013 2014 District Refunding Obligations and to authorize other actions in connection therewith ; NOW , THEREFORE , BE IT RESOLVED by the Board of Commissioners , acting in such capacity and as the governing body of each of the Districts , as follows Section 1 The amendments contemplated by the Amended 2013 2014 District Refunding Obligations referenced in this Resolution are hereby ratified and approved Section 2 Each of the Amended 2013 2014 District Refunding Obligations is hereby approved in substantially the form submitted to this meeting , and each of the Chairman or Vice - Chairman of the Board or the County Manager is hereby authorized to execute and deliver each of those documents in the name and on behalf of the County and or in the name and on behalf of the respective Districts , with such changes , insertions or omissions as the persons executing such documents may approve , their execution and delivery thereof to constitute conclusive evidence of such approval The County Clerk is hereby authorized to affix the seal of the County to each of said documents as may be appropriate and to attest to the same Section 3 The Chairman or Vice - Chairman of the Board , the County Manager , the Director of Finance and the County Attorney are hereby authorized to take any and all such further action , including approval of modifications to the Amended 2013 2014 District Refunding Obligations , and to execute and deliver for and on behalf of the County and or for and on behalf of any or each District , such other documents and certificates including , without limitation , financing statements and or other documents and agreements as they may deem necessary or advisable to carry out the intent of this resolution and to effect the amendments contemplated by the Amended 2013 2014 District Refunding Obligations The County Clerk is hereby authorized to affix the seal of the County to such documents and certificates as may be appropriate and to attest to the same and to execute and deliver the same as may be needed Section 4 This Resolution shall become effective immediately upon its adoption Thereupon , upon motion of Commissioner Jeffrey P Carver , seconded by Commissioner Chad M Stewart , the foregoing resolution entitled “ RESOLUTION APPROVING AMENDMENTS TO CERTAIN EXISTING OBLIGATIONS OF WATER DISTRICTS CREATED BY THE COUNTY AND PROVIDING FOR CERTAIN OTHER RELATED MATTERS ” was passed by the following vote Ayes Commissioners Ted G Godwin , Chad M Stewart , Jeffrey P Carver , Larry Wood , Tony Braswell , Patrick E Harris , and Butch Lawter Noes None Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Patrick E Harris , and carried by unanimous vote , the Board adjourned as the Archer Lodge , Brogden , Buffalo , Clayton , Cleveland , Elevation , Hopewell - Jones , William W Massengill , Jr , and Jeff Parlier for three year terms to expire on September 30 , 2023 Commissioners Stewart and Carver commented again that the Board had a great list of applicants to choose from for
