10 440 Meeting of the Johnston County Board of Commissioners July 6 , 2020 10 00 am The Johnston County Board of Commissioners met in regular session Monday , July 6 , 2020 at 10 00 am in the Second Floor Meeting Room of the Public Library of Johnston County and Smithfield located at 305 E Market Street in Smithfield , North Carolina The following members were present Present Chairman Ted G Commissioner Butch Lawter opened the meeting with a prayer Commissioner Larry Wood led everyone in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner Chad M Stewart , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner Patrick E Harris , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – June 1 , 2020 10 00 am and 6 00 pm ; June 8 , 9 , and 15 , 2020 B Emergency Services – Call for Public Hearing Per the request of the Emergency Services Department , the Board scheduled a public hearing for the August 3 , 2020 10 00 am meeting to allow for public comment on a proposed ordinance amendment as it relates to first responder franchises The amendment would allow all fire departments in the County to provide first responder services without having to obtain a franchise C Emergency Services – Removal of Ambulance Franchise for Samaritan Ambulance The Board removed the ambulance franchise for Samaritan Ambulance Service due to the closure of their business effective June 20 , 2020 D Public Utilities – Request to Declare Vehicle Surplus Per the request of Public Utilities , the Board of July 4 , Johnston County had 1,706 positive COVID - 19 cases with 86 of those related to outbreaks She stated there have been 33 deaths with 22 of those related to outbreaks and hospitalizations are increasing Dr Pearson reported testing continues throughout the County She stated in addition to the Health Department , CommWell Health and Benson Health have been hosting community testing sites in the County Dr Pearson asked the Board to consider allocating 5,000 each to Benson Health and CommWell Health to assist them with purchasing testing supplies and to offset some of their staffing costs Dr Pearson stated they are providing great assistance to the Health Department by offering testing sites in the County and she would like to help them continue this service Dr Pearson also took a moment to introduce and recognize Captain Laura Draski with the US Public Health Service Dr Pearson stated in addition to the State providing assistance with contact tracing , the US Public Health Service has four individuals working at the Health Department Captain Draski stated the US Public Health Service is dedicated to helping during the COVID - 19 Pandemic and they look forward to working with Johnston County The Board thanked Dr Pearson for the update and Captain Draski for working with Johnston County Upon a motion by Commissioner Jeffrey P Carver , seconded by Commissioner Chad M Stewart , and carried unanimously , the Board voted to allocate 5,000 each to CommWell Health and Benson Health to be used to support their continued testing efforts across Johnston County and to be reimbursed with any COVID - 19 funds when received PagePage pageNumber6445 July 6 , 2020 – 10 00 am Continued Dr Pearson also updated the Board regarding supply quantities as it relates to Personal Protection Equipment PPE as well as ventilators and available hospital beds Emergency Services Assistant Director Josh Holloman reported the Emergency Services Department’s primary role is to continue their support to Dr Pearson and the Health Department He stated they have been working to secure additional PPE and while the PPE utilization is high , the supply as of today is stable He asked the Board to keep all the healthcare workers , EMS personnel , and first responders in their thoughts as they continue to respond to COVID - 19 Mr Holloman stated he continues to be impressed with the professionalism and resilience of the County’s EMS and 911 - Communications personnel going into the fifth month of the pandemic Mr Holloman stated the Emergency Management Division continues to prepare for hurricane season and working to implement social distancing into the sheltering plans Finance Director and Assistant County Manager Chad McLamb provided the Board with an update regarding funding for COVID - 19 Mr McLamb stated the County has received approximately 36 million in CARES Act funds and expects to receive an additional 4 million He noted the County will be using a portion of those funds to cover expenses and needs associated with the response to COVID - 19 He also noted that eight of the towns have requested a portion of those funds and staff will be working on a distribution to the towns Mr McLamb stated staff would also be working with the North Carolina Pandemic Recovery Office NCPRO on how the funds can be distributed and spent Mr McLamb reported the County has received 180,000 for the Board of Elections to purchase PPE supplies needed for the upcoming elections Mr McLamb asked the Board to give blanket approval and acceptance of any COVID - 19 funds that have been received and will be received in the future with the understanding that staff will be working with NCPRO on how to distribute and spend those monies Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Patrick E Harris , and carried unanimously , the Board voted to approve and accept any and all COVID - 19 funding previously received as well as additional future funds that will be received with the understanding that staff will be working with NCPRO on the distribution and expenditure of those funds 4 Public Comments A Request to Support Body Cameras for Law Enforcement Officers Mr James Gathers of Four Oaks requested the Board to work with Sheriff Steve Bizzell as well as Police Chiefs in the municipalities regarding the implementation of body cameras for all law enforcement officers Mr Gathers stated he feels this would help protect the citizens as well as the law enforcement officers Mr Gathers stated given the times we are currently in , many people are fearful of law enforcement while law enforcement officers are also fearful when responding to situations Mr Gathers stated when two groups are afraid of each other it can cause many problems Mr Gathers stated the body cameras would speak for themselves and he would ask the Commissioners to talk with the Sheriff regarding this matter Chairman Ted G Godwin thanked Mr Gathers for attending the meeting and stated the Board can certainly have a dialogue with the Sheriff regarding the request B Request to Adopt Juneteenth as a County Holiday Smithfield Town Councilman Marlon Lee requested the Commissioners to consider adopting Juneteenth as a County holiday Mr Lee stated the Wake County Board of Commissioners will be considering a resolution at their meeting today to formally recognize Juneteenth as a County holiday in Wake County and he would like to see the same in Johnston County Mr Lee stated he has been involved in many historical moments in Johnston County recently and he has marched with the protesters , attended rallies , and orchestrated the “ Together We Mean Business ” event just last weekend Mr Lee stated he is proud of those moments , but now there needs to be a movement Mr Lee read from the Proclamation that Wake County will be considering at their meeting and stated it is time that Johnston County shows it values diversity and is united in opposition to racism and hate Mr Lee asked the Board to vote unanimously to make Juneteenth a County holiday and be part of the movement Commissioner Butch Lawter thanked Mr Lee for bringing the matter to the Board and stated this is a conversation that needs to be had Commissioner Lawter stated as Johnston County moves forward there needsPagePage pageNumber7446 July 6 , 2020 – 10 00 am Continued to be a discussion and communication on a much broader scale and as a Commissioner he is committed to being a part of that process Commissioner Chad M Stewart thanked Mr Lee for his personal involvement in the issues and for helping to keep things peaceful in the County Mr Lee stated he is willing to sit down and talk further with the Board Chairman Ted G Godwin stated he would like to volunteer himself as well as Commissioner Lawter to meet with Mr Lee and begin a dialogue C E - mail from Citizen Ken Taylor Chairman Ted G Godwin read an e - mail received from Mr Ken Taylor of Clayton , regarding his concerns with weather drills conducted by Novo Nordisk of Clayton Mr Taylor indicated that while he understands the need for such drills , they can create confusion and concern for the surrounding community if they are not identified as a drill versus an actual event Mr Taylor asked that this issue be raised with the Emergency Services Department who could perhaps voice this concern to local businesses and industries as they coordinate emergency response plans Mr Taylor also shared his concerns as to how the COVID - 19 Pandemic has impacted industries that have received an Economic Development Incentive Grant EDIG from the County Mr Taylor questioned if the grants are being adjusted to compensate for jobs that may not be created or lost Mr Taylor expressed concerns that the risk is being passed on to the taxpayers At the inquiry of the Board , County Manager Rick Hester stated he has spoken with a representative at Novo Nordisk and he believes the concern regarding the emergency drills has been resolved Mr Hester also noted that staff verifies all components of the EDIG agreements have been met before disbursing any grant funds 5 Public Hearing – First Responder Franchise Request – 50 - 210 Fire Department Advertised – The News & Observer Friday Zone Edition – June 26 and July 3 , 2020 ; The Johnstonian News and The News in Review – June 24 and July 1 , 2020 The Chairman opened the public hearing Emergency Services Assistant Director Josh Holloman stated the purpose of the public hearing is to receive public comment on a request from the 50 - 210 Fire Department to receive a first responder franchise allowing it to operate as a first responder unit within their district Mr Holloman reported the EMS Advisory Committee met on June 23 , 2020 and recommended approval of the franchise Mr Holloman stated the request was also included in the Fiscal Year 2020 - 2021 budget There being no further comments , the Chairman closed the public hearing Upon a motion by Commissioner Patrick E Harris , seconded by Commissioner Larry Wood , and carried unanimously , the Board voted to approve a first responder franchise for the 50 - 210 Fire Department Note A second vote will be required at the August 3 , 2020 meeting 6 Public Hearing – Community Development Block Grant CDBG Advertised – The News & Observer Friday Zone Edition – June 26 , 2020 ; The Johnstonian News and The News in Review – June 24 , 2020 The Chairman opened the public hearing Economic Development Director Chris Johnson stated the purpose of the public hearing is to obtain citizen input into the identification of community needs and desired CDBG activities Mr Johnson stated Johnston County is interested in seeking funds from the State’s Small Cities Community Development Block Grant Program CDBG The CDBG program is administered by the North Carolina Department of Commerce and the North Carolina Department of Environment and Natural Resources The State of North Carolina’s CDBG Program permits grant funds to be used toward infrastructure projects that address health safety needs public water and sewer projects ; neighborhood revitalization needs housing development , acquisition ,PagePage pageNumber8447 July 6 , 2020 – 10 00 am Continued disposition , clearance and remediation activities , relocation , public facilities , senior center , housing for homeless persons , housing or shelters for victims of domestic violence , transitional housing facility , community neighborhood recreation facility , or other and public infrastructure or support ; and Economic Development public infrastructure , building demolition , and vacant building renovation projects Mr Johnson explained that CDBG projects require two public hearings ; one being a general hearing discussing the program and the other specifically for an identified project Mr Johnston stated the County’s Grants Consultant has recommended holding a general public hearing every July so if a specific project is identified later in the year , it will only require the second public hearing He stated no action is required at this hearing There being no further comments , the Chairman closed the public hearing 7 Sheriff’s Office – 2019 Edward Byrne Memorial Justice Grant Funds County Manager Rick Hester presented the following Memorandum from Sheriff Steve Bizzell and informed the Board of Commissioners that the Johnston County Sheriff’s Office has applied for 2019 Edward Byrne Memorial Justice Grant Funds in the amount of 13,13800 Mr Hester stated the grant funds will be used to purchase six 6 Harris brand portable radios to be used by six 6 new deputy sheriff positions to be assigned as School Resource Officers in the middle schools Mr Hester requested the Board to enter the memorandum of official notification of the grant funding into the minutes as part of the rules set forth in obtaining the federal grant funds by the US Department of Justice , Bureau of Justice Assistance and he offered to answer any questions Commissioner Larry Wood moved to accept the memorandum of official notification below as part of the minutes and approve the grant Commissioner Tony Braswell seconded the motion which carried by unanimous vote 8 Child Fatality Prevention Team 2019 Annual Report Child Fatality Prevention Team Review Coordinator Kathleen Lanc presented the following annual report to the Board of Commissioners PagePage pageNumber9448 July 6 , 2020 – 10 00 am Continued Background Why We Do What We Do In Article 14 of North Carolina’s General Statute 7B , the General Assembly finds it the public policy to prevent the abuse , neglect and death of juveniles Child fatality prevention is designated as a community responsibility Multidisciplinary reviews of the abuse , neglect and death of children can lead to a greater understanding of the causes and methods of preventing these deaths The General Assembly mandated the establishment of a statewide multidisciplinary , multi - agency child fatality prevention system that consists of the State team GS 7B - 1404 and local teams GS 7 - B 1406 In 1991 , the Johnston County Child Fatality Prevention Team CFPT was established Present What We Do As directed by the GS 7B - 1400 , the CFPT assesses the records of all deaths of Johnston County’s children , aged birth to 18 years , in order to 1 develop a community - wide approach to the problem of child abuse and neglect , 2 understand the causes of childhood deaths , 3 identify any gaps or deficiencies that may exist in the delivery of services to children and their families by public agencies that are designed to prevent child abuse , neglect or death , and 4 make and implement recommendations for changes to laws , rules and policies that will support the safe and healthy development our children and prevent future abuse , neglect and death NC GS 7B - 1400 The review process includes a delay of approximately 1 year after the date of death before review in order to secure necessary and complete information Review Information The CFPT meets four times a year 2019 25 deaths reviewed 10 infants birth to 1 year 4 10 - 14 years 8 1 - 4 years 1 15 - 17 years 2 5 - 9 years Causes Premature births 10 Motor vehicle accidents 3 Illnesses 7 Home fires accidental 2 Choking 1 Homicide 1 Suicide 1 One 1 child death received intensive review by the NC Division of Social Services and members from both the state and local CFPTs Criteria for such reviews include cases in which “ a report of suspected abuse or neglect has been made about the child or the child’s family to the county DSS within the previous 12 months , or the child or the child’s family was recipient of child protective services within the previous 12 months NC GS gt; 7B 1406 a 1 b Actions and Recommendations All findings and recommendations made by the CFPT are submitted to the NC Child Fatality Prevention Team coordinator Focal Points of 2019 reviews included Unsafe sleeping conditions environments that include “ co - sleeping ” or “ bed - sharing ” with infants as well as infant sleep spaces that have blankets , pillows , wedges or other items Lack of , or non - working smoke detectors in the home Choking hazards These conditions contributed to some of Johnston County’s infant deaths In general , the team’s findings and recommendations have addressed and supported the following Initiatives to promote early and consistent prenatal care ; Existing agencies , programs and initiatives for the prevention of childhood trauma and promotion of childhood safety ; and Safe sleep initiatives , activities and recommendations for the prevention of Sudden Unexplained Infant Death SUIDS and Sudden Infant Death Syndrome SIDS Page0449 July 6 , 2020 – 10 00 am Continued Conclusions Thank you to the members of the Johnston County Commissioners and the Board of Health for the opportunity to share with you the successes and dedicated work of the local team as we continue to review child fatalities , make recommendations and take actions to prevent future child deaths Currently the team is in need of the appointment of a local county law enforcement representative to assist in the review of child deaths , make recommendations and facilitate or participate in prevention activities The Board thanked Ms Lanc for the report 9 JCATS – New Facility Construction Project and Request for Funds Community & Senior Services Executive Director Neal Davis presented information to the Board as it relates to a new facility construction project for JCATS and requested funds from the County to complete the project Mr Davis explained that approximately five years ago , his Board of Directors and the Transportation Advisory Board began looking at the future of JCATS He stated in 2017 they completed a feasibility study which determined what the future needs would be Mr Davis reported it became apparent that a new facility would be needed for JCATS to accommodate future growth and public transportation needs in Johnston County Mr Davis stated they began the process of reviewing opportunities for federal funding as well as cost estimates for a new facility Mr Davis presented the following information to the Board Mr Davis stated that in considering options for a new facility and in an effort to keep costs minimal , they settled upon a standardized design similar to a fire station at an estimated cost of 3 million Mr Davis stated once a design was settled upon , they began the long process of securing federal funding He stated inPage1450 July 6 , 2020 – 10 00 am Continued November of 2019 , they received notification from the Federal Transportation Authority that JCATS had been selected to receive a grant of over 2 million to be applied towards the project Mr Davis reviewed the following information with the Board Page2451 July 6 , 2020 – 10 00 am ContinuedPage3452 July 6 , 2020 – 10 00 am Continued Mr Davis reviewed the cost estimate with the Board and requested the Commissioners to consider allocating 597,800 towards the project and stated JCATS would be contributing 571,000 from their own funds and would cover any additional cost overruns that may arise Mr Davis offered to answer any questions Chairman Ted G Godwin commented that in his time serving on the JCATS Board of Directors , he was never sure if the project would receive a federal grant and he commended Mr Davis for his success in seeking funds Page4453 July 6 , 2020 – 10 00 am Continued At the inquiry of Commissioner Tony Braswell , County Manager Rick Hester stated staff recommends approving the allocation to support the JCATS facility construction project Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Patrick E Harris , and carried unanimously , the Board approved an allocation in the amount of 597,800 to come from the undesignated fund balance to be applied towards the JCATS new facility construction project Upon a question by Commissioner Jeffrey P Carver , Mr Davis stated they would employ a project manager certified in federal programs to oversee the project and that cost has been included in the project budget 10 Parks , Greenways , and Open Space Coordinator – Property Transfer Parks , Greenways , and Open Space Coordinator Adrian O’Neal presented an opportunity to the Board that would involve the transfer of a 2840 acre tract of land Parcel No 16K05012F located beside the East Clayton Elementary School from the Board of Education to Johnston County Mr O’Neal explained that this parcel would be beneficial to both the Parks and Open Space Program and the Department of Public Utilities He stated staff has had positive discussions with the Board of Education about this transfer who has indicated that they are in favor Mr O’Neal reported the site currently has a County wastewater pumping station in the design phase of an upgrade He also noted the parcel is on the proposed route of the Mountains to Sea Trail and the location poses great potential value as a river access for car top vessels such as canoes and kayaks Mr O’Neal stated the site , with improvements , would also give consistent emergency access to the river in this area for search and rescue and medical emergencies Mr O’Neal continued that the Town of Clayton has expressed interest in developing this property into a trailhead and for car top river access He stated this could be accomplished through a lease with proper engineering and development done by the lessee Mr O’Neal stated the site would be managed and maintained by the lessee in its entirety , minus the area required for Public Utilities Mr O’Neal stated that maintaining this property in County ownership would be of great benefit to the community and the County as a whole and he requested the Board to approve the transfer Commissioner Butch Lawter spoke in support of the project especially given that it will be a good connection for the Mountains to Sea Trail Commissioner Lawter stated this is another example of everyone working together Commissioner Patrick E Harris agreed that this is a good utilization of the property and a great cooperative effort Upon a motion by Commissioner Butch Lawter , seconded by Commissioner Patrick E Harris , and carried by unanimous vote , the Board approved the transfer of a 2840 acre tract of land Parcel No 16K05012F located beside the East Clayton Elementary School from the Board of Education to Johnston County 11 Parks , Greenways , and Open Space Coordinator – Grant Update Cleveland Property Parks , Greenways , and Open Space Coordinator Adrian O’Neal requested the Board to consider approving the purchase of property located at the corner of Polenta Road and Matthews Road Parcel No 06F04034F for open space preservation Mr O’Neal stated staff secured a Phase 1 Environmental Study on the property , which came back positive He also stated a State Historic Property Office Review has been completed which came back positive and a survey should be completed by the end of next week Mr O’Neal recommended the Board consider purchasing this property Mr O’Neal updated the Board with regards to grant fund applications to be used towards the purchase of this property if successful Mr O’Neal stated he hesitates to predict the success of those funds at this time ; however , the County could apply for a waiver that would allow for a second application period if unsuccessful during the first round of funding Mr O’Neal stated the purchase price is 16 million and the Greater Cleveland Athletic Association has stated they will be willing to manage the property Mr O’Neal introduced Mr Denton Lee from the Cleveland Community Recreation Association that currently holds the note on the property Page5454 July 6 , 2020 – 10 00 am Continued Chairman Ted G Godwin noted the Board has had a lot of discussion about banking land for recreation and open space preservation throughout the County and this piece of property could certainly begin that process At the inquiry of Commissioner Butch Lawter , County Manager Rick Hester stated staff recommends approval of the purchase with the funds coming from the undesignated fund balance and that any grant funds received would be applied back towards the cost Mr Hester stated Mr O’Neal has done a great job working with the community on this project Commissioner Chad M Stewart stated he would like for staff to continue looking for property all across the County so other communities can have the benefits of open space Mr Hester agreed and stated he feels this is the start of a countywide program Mr O’Neal recognized the Cleveland community for coming together and finding property that could be used for this purpose and he encouraged other communities in the County to contact him in an effort to look at similar opportunities Commissioner Patrick E Harris agreed that the Cleveland community has done a great job and this is a tremendous opportunity to begin preserving open space for an enhanced quality of life Commissioner Tony Braswell stated he is glad to Farmer acknowledged Commissioner Carver’s concerns and noted that a big portion of that debt was recently refinanced and the number of years was reduced The Board briefly discussed continuing to extend water and sewer to the unincorporated parts of the County and if this is something the Board wants to keep doing Commissioner Chad M Stewart stated he agrees with Commissioner Carver in that while he is not in favor of continuing to extend residential sewer , he believes everyone is entitled to clean drinking water Ms Farmer noted that the Department of Utilities , over the course of a year , adds anywhere from 1,500 to 1,800 water services to the County’s system and that is a water supply demand that must be met She stated projects like this are critical to meeting that demand Commissioner Stewart stated he would like to see water extended to areas of the County where there are lifelong residents that would like to have it but it is not currently available Ms Farmer stated the County has a looping lines project coming in Fiscal Year 20 - 21 which could extend water to some of the areas where it is not currently available Commissioner Tony Braswell noted the County is in Ms Andrews commended her staff for their continued hard work and dedication 22 Voting Delegate for the 2020 North Carolina Association of County Commissioners Virtual Conference Business Session It was the unanimous consensus of the Board to designate Chairman Ted G Godwin as the voting delegate and Commissioner Butch Lawter as the alternate voting delegate The Board recessed until 1 00 pm Commissioner Larry Wood left the meeting due to previously scheduled commitments 23 Discussion - Residential Sewer Service Policy Land Development Code Update At the request of the Chairman , Planning Director Braston Newton shared with the Board a summary of the proposed Land Development Code amendments as it relates to minimum residential lot size in the Agricultural Residential District , Water Supply Watershed Overlay WSW , and Environmentally Sensitive Area Overlay ESA He also provided a summary of the proposed Municipal Transition District MTD Zoning Map amendment and related Land Development Code text amendments as follows ? Establish minimum lot size in AR District of 40,000 sf 10 unit acre with well and septic , and 30,000 sf 145 units acre with public water and septic ? Establish minimum lot size of 40,000 sf 10 unit acre in WSW and ESA overlay districts ? Re - establish MTD around communities that were granted 2 mile ETJs in 2007 2008 This would be a one boundary beyond their respective ETJs ? Allow for residential development on public water and septic within the MTD at a density of 20 units acre with no minimum lot size , and 40 units acre with public water and sewer with a minimum lotPage1470 Ju
