Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Jeffrey P Carver , and carried by unanimous vote , the Board approved the agenda as presented 2 Resolution Honoring Retired Pine Level Town Clerk Sharon Thompson Chairman Ted G Godwin announced that the resolution honoring retired Pine Level Town Clerk Sharon Thompson would be held at the 6 00 pm meeting Note At the 6 00 pm Vice Chairman Chad M Stewart led the meeting Corinth - Holder Volunteer Fire Department Chief Larry Woodard requested the Board to adopt a resolution approving tax exempt loan status so they can borrow up to 65,000 from KS Bank for the purchase of a Pierce Contender 2004 International DuraStar 4400 Water Tender at an interest rate of 262 with a 2 year term Chief Woodard offered to answer any questions Finance Director and Assistant County Manager Chad McLamb reported the fire department requested three proposals with two received Mr McLamb stated he reviewed the proposals and recommends financing through KS Bank Commissioner Patrick E Harris moved the Board adopt the following resolution approving tax exempt loan status for the Corinth - Holder Volunteer Fire Department Commissioner Larry Wood seconded the motion , which carried unanimously with Chairman Godwin abstaining NOW , THEREFORE , BE IT HEREBY RESOLVED , that the Board of Commissioners of Johnston County , North Carolina , does hereby approve a tax - exempt loan to the Corinth - Holder Volunteer Fire Department , Inc the “ FD ” , from KS Bank in an amount up to 65,00000 for the purchase of a Pierce Contender 2004 International DuraStar 4400 Water Tender RESOLVED , FURTHER , that the approval of the loan to the FD set forth above is given solely for purposes of the public approval requirements for tax - exempt financing applicable to the FD because of Section 150 e 3 and Section 147 f of the Internal Revenue Code of 1986 , as amended , and such approval does not obligate the County or its Board of Community Advisory Committee Update Jimmy Parker , Chairman of the Nursing Home Adult Care Home Community Advisory Committee , provided the Board with an annual update on the Committee’s work Mr Parker stated the mission of the Committee is to serve as grassroots volunteer advocates for residents in long term care in Johnston County He added their vision is that citizens of Johnston County and the residents of long term care facilities in Johnston County will recognize the Committee as a key advocate and resource for information about long term care issues Mr Parker stated the Committee’s responsibility is to visit all the long term care facilities in the County and apprise themselves of the general conditions , assure that the residents ’ Bill of Rights are being upheld , assist residents with any concerns , and educate and inform the community about long term care Mr Parker reported they currently have 13 active committee members and are allowed to have up to 25 He stated recruitment efforts are ongoing and the new appointment process under House Bill 248 is working very well Mr Parker thanked Carolyn Pennington for her work as the Regional Ombudsman for Johnston County stating she provides expert guidance and great support to the Committee Mr Parker also noted that Ms Pennington spends a great deal of time in the long term care facilities in Johnston County assisting residents on issues of resident rights , quality of care , care planning , and improper eviction or inadequate discharge planning He noted Ms Pennington also provides classroom training for new applicants , in - service training to facilities staff , and leadership training to allow committee leaders in the region to have opportunities to share experiences and learn from each other Mr Parker reported the following on the long term care facilities in the County 27 facilities with a capacity of approximately 1,253 residents 5 Skilled Nursing Rehabilitation Facilities - total capacity 670 residents 10 Adult Care Homes Assisted Living - total capacity 495 residents 12 Family Care Homes 6 or fewer residents - total capacity 88 residents Dementia care special care capacity 188 beds ~ 15 of total beds - Assisted Living facilities – 168 beds in secure units - Nursing Home – 20 beds in secure units Facilities that do not have secure units will accept dementia patients depending on the level of care required Construction has been completed on an Assisted Living Facility in Smithfield with a capacity of 60 residents including some dementia care beds An opening date has not been announced Mr Parker stated facility visits are conducted by teams of three to five members grouped by geographic regions in the County to reduce travel He stated the teams rotate facility assignments quarterly Mr Parker reported for 2019 the Committee teams conducted over 72 facility visits devoting more than 1,065 hours and logging more than 5,473 miles He explained the teams document the visits and file reports with the full Committee for review which are then sent to the Ombudsman and finally placed on the County’s website Mr Parker stated any issues or concerns encountered during the visits are discussed with the staff administration , with the resident’s permission He continued that members always encourage communication with staff and any unresolved issues are immediately referred to the Regional Ombudsman Mr Parker reported on the strengths and weaknesses with the County’s long term care facilities He stated some of the weaknesses include inadequate staffing ratios , lack of or little variety of activities , high turnover rates for staff and administrators , and improvements needed in making the dining experience more meaningful Mr Parker spoke on the strengths stating the skilled nursing facilities provide excellent rehabilitation services , most facilities have active resident councils , there are renovations and improvements in several facilities , and many churches and civic groups are providing religious services and entertainment at facilities Mr Parker stated the Committee members continue to educate the public on the issues of long term care for the elderly by attending community events to hand out literature and answer questions Mr Parker noted they have Committee Members serving on local , regional , and State level boards in an effort to stay informed of the issues facing the elderly Mr Parker concluded the update by stating the Committee has developed good working relationships with facility staff and administrators and the administrators welcome the Committee’sPagePage pageNumber6256 March 2 , 2020 – 10 00 am Continued perspective and suggestions He stated most residents express satisfaction with the care received Mr Parker thanked Commissioner Chad M Stewart for his participation with the Committee and the entire Board for their support to the Committee members Upon a question by Commissioner Patrick E Harris , Mr Parker reported the Committee sees the same complaints and issues every year and the key is to stay on top of those concerns and assist residents in negotiating through problems Commissioner Chad M Stewart thanked Mr Parker and all the Committee members stating this is an actively working committee and he appreciates all they do for Johnston County Commissioner Stewart also thanked Ms Pennington for her work with the Committee and the facilities in the County At the inquiry of Commissioner Tony Braswell , Mr Parker stated that he believes the capacity within Johnston County is adequate as there are few waiting lists Mr Parker noted the Committee is also seeing a trend towards an increase for in - home care services , which is the ultimate goal The Board thanked Mr Parker and all the members on the Committee for their work and dedication 7 GoTriangle – Regional Commuter Rail Study Update and Next Steps County Manager Rick Hester explained that during the Fiscal Year 2019 - 2020 budget adoption , the Board allocated funds to participate in Phase I of the regional commuter rail study Mr Hester stated since that time , there has been an average of two meetings a month regarding this project and the Board must now decide how it would like to proceed GoTriangle Chief Development Officer Katharine Eggleston addressed the Board and stated GoTriangle is the public transportation authority for the Research Triangle Region , which serves the Counties of Wake , Durham , and Orange Ms Eggleston stated they also serve the ten - mile radius known as the Greater Triangle Region She reported that GoTriangle has been working with Johnston County and others on the study over the last eight to ten months Ms Eggleston introduced GoTriangle Project Consultant Monica Barrow along with Scott Saylor and Catherine Knudson from North Carolina Railroad Ms Eggleston presented the following update to the Board PagePage am Continued Chairman Ted G Godwin asked how the range of ridership estimates are generated and if input from local citizens is considered during that process Ms Eggleston explained the numbers were developed using a model published by the Federal Transit Administration which is recommended for projects such as this in order to predict the amount of riders on major transit investments She stated that information is paired with locally developed projections of population and employment data in the corridor as well as existing data for public transportation ridership and other transportation data Ms Eggleston stated the opportunity for citizen input is generally obtained as part of the Metropolitan Planning Organization’s process as they develop their transportation plans Upon questions by Commissioner Butch Lawter , Ms Eggleston reported GoTriangle is looking at two stations in Garner with one of those in the downtown area and the other in the east Garner Auburn area She stated they have been working with the Town of Clayton staff on a possible station site in Clayton and are proposing that it be located very close to the intersection of Hwy 70 and NC Hwy 42 Ms Eggleston stated any possible crossing closures is something that would be studied once they move into the design phase of the project She stated one of the next key upcoming steps is to conduct a screening of the corridor to identify locations where it would be difficult to add an additional track at the existing crossings Commissioner Chad M Stewart asked how additional land would be secured for track expansion Ms Eggleston responded that the North Carolina Railroad Company owns a 200 ft wide corridor throughout the State that they anticipate could accommodate the majority of the additional track needed for the commuter rail service She stated additional right - of - way may be needed to accommodate a new station or park and ride lot , but they feel the existing corridor will be able to accommodate most of their needs At the inquiry of Commissioner Tony Braswell , Ms Eggleston explained that very often projects such as this are developed on an incremental basis where it focuses on an initial phase where there is a large population and employment and then over time as the region grows , the system is incrementally expanded She stated even if any of the areas choose not to move forward in the initial phase , there will be opportunities for expansion in the future Page1261 March 2 , 2020 – 10 00 am Continued Upon a question by Commissioner Patrick E Harris , Ms Eggleston stated their estimates presented today do not include any offset for fare revenue or any subsidy that could come from the Federal Transit Administration or the State Upon a question by Commissioner Larry Wood , Ms Eggleston stated GoTriangle’s modeling does consider how people will get to and from the train stations and they anticipate the park and ride lots would be utilized significantly She continued that they see riders either walking the remaining distances to work or taking a bus Commissioner Stewart asked if GoTriangle has reached out to the corporate partners to see how this could affect economic development Ms Eggleston responded that they have been working with the Chambers of Commerce in Johnston County throughout this project and as they move forward , they would work closely with the business community as well as the County and municipal economic development teams Ms Eggleston continued with the presentation as follows Page2262 March 2 , 2020 – 10 00 am ContinuedPage3263 March 2 , 2020 – 10 00 am Continued Chairman Godwin asked with the idea of putting an additional track in with the existing North Carolina Railroad , if that idea has been developed enough to get an assurance from North Carolina Railroad that this project can happen as planned Ms Eggleston responded that part of the next phase of study would be to conduct detailed capacity modeling not only with the North Carolina Railroad but also with Norfolk Southern and CSX in an effort to model the reliability of the system with the addition of a commuter rail service She stated part of that next phase would be to identify an operating plan along with the associated infrastructure that would be accepted by the rail companies in order to get a certainty for the project Page4264 March 2 , 2020 – 10 00 am Continued Commissioner Stewart noted that Johnston County’s portion of the next phase is 250,000 and he asked what the County could expect to receive out of that next phase Commissioner Stewart also asked for an estimated timeframe for project completion Ms Eggleston stated the intent of the next phase of study would be to get information needed to support a decision on whether or not to move forward with implementation of design , engineering , and ultimately construction She stated projects such as this generally take approximately ten years to complete , although timeframes can widely vary Commissioner Lawter asked if preliminary engineering would be involved in the next phase Ms Eggleston responded the next phase would go through the end of the planning phase and in key areas , some preliminary engineering would be performed for areas in downtown Durham and downtown Cary Commissioner Lawter commented that part of the mission statement of the Board of Commissioners is to “ enhance the quality of life for present and future generations of the people of Johnston County ” and he sees this project as something that coincides with that mission statement for the future of Johnston County as it continues to grow Mr Hester noted if the Board chooses to move forward with the next step , there will also be choices after the study is complete as to whether or not Johnston County wants to be a part of this project He stated at that point , the County could look at specific costs involved with construction and determine how to pay for those costs Chairman Godwin commented that the project cost is of great concern to him He stated although Johnston County may not be ready for a project of this magnitude yet , at some point in order to be ready there has to be a start Ms Eggleston stated over the next several weeks , GoTriangle will be presenting to Orange , Durham , and Wake Counties as well as the MPO Boards She stated they would need to know something from Johnston County by April if the County would like to move forward in the next phase Chairman Godwin thanked Ms Eggleston for the information and stated the Board would take the request under advisement 8 Triangle Trails Initiative – Resolution of Support Parks , Greenways , and Open - Space Coordinator Adrian O’Neal introduced Mr Chuck Flink with Greenways Incorporated March , 2020 9 Parks , Greenways , and Open - Space Update to the Board Parks , Greenways , and Open - Space Coordinator Adrian O’Neal provided an update to the Board Mr O’Neal reported the implementation of the open space grant cycle is ongoing and all applications have been received for this round of funding with an anticipated funding recommendation coming to the Board in April Mr O’Neal noted the development of a communication chain between his office and Johnston County Schools , the athletic associations , and the municipal park programs is ongoing He stated he has had meetings with Johnston County Schools and a representative from Johnston County Schools will be included in the next Sports Council meeting Mr O’Neal stated he has been conducting a baseline assessment of the facilities throughout the County by visiting the municipal programs as well as the athletic associations Mr O’Neal reported he also met with the Mountains to Sea Trail and the East Coast Greenways organizations about their interest in the County and he feels good communication has transpired between the groups Mr O’Neal continued that in an effort to further the development of a relationship with outside land conservancy organizations to create open space parameters to enhance the selection of potential park sites , he has enlisted the aid of the Triangle Land Conservancy and the Upper Coastal Plains Rural Planning Organization Mr O’Neal stated plans are also in development to update the Recreation Master Plan , which has been in place for five years and in order to be eligible for grant funding that plan needs to be current He stated the plan for this update is to solicit as much public input as possible in an effort to see what the needs are Mr O’Neal stated in looking at future opportunities he plans to apply for grant funding to complement County budget funding as well as open space funds He stated opportunities will be sought through the Land Water Conservation Fund , the Parks and Recreation Trust Fund , the Recreational Trails Program , and the Department of Transportation Planning Program Mr O’Neal stated he also hopes to enhance the existing indoor and outdoor facility use through Johnston County Schools because there are many facilities sitting unused during the summer months , which could be utilized Mr O’Neal concluded his update by stating he heard positive sentiment for increasing the open space fee - in - lieu at the recent stakeholder community meetings concerning growth management At the inquiry of Commissioner Larry Wood , Mr O’Neal stated he has met with Johnston County Schools and is working on sending out a survey to determine exactly what the concerns issues are as it relates to the use of school facilities He stated some athletic associations are able to use the school facilities easily while others have difficulties and it is important to determine exactly what the issues are Upon a question by Commissioner Chad M Stewart , Mr O’Neal stated in meeting with the athletic associations and municipal programs , he found a few at first to be somewhat standoffish ; however , he has now been able to create a good dialogue with everyone and the groups are now calling him asking for advice and technical support Mr O’Neal stated he believes things are going well at the moment Commissioner Tony Braswell noted that Johnston County owns various pieces of property throughout the County and he would like Mr O’Neal to create a database of that property which would be helpful in the future as the available through the Capital Area Metropolitan Planning Organization CAMPO as the County looks at expanding trail systems Mr O’Neal agreed with Commissioner Lawter , stating he is familiar with the programs and will be looking into those opportunities Commissioner Patrick E Harris thanked Mr O’Neal for his coordination with Johnston County Schools stating those properties are paid for with taxpayer money and he believes the use of those facilities are a key component in parks and recreation At the inquiry of Commissioner Braswell , Mr O’Neal reported in the last round of application submittals for open space funds , he asked the groups to list all their needs in an effort to develop an inventory as the Board looks at future bond referendums 10 Public Utilities – Resolutions for reported in recent years , the County has experienced several instances of ductile iron pipe failure on wastewater force mains She stated in most cases , the failure appears to be due to corrosion from hydrogen sulfide gas Ms Farmer stated on February 18 , 2020 , a failure occurred on the existing 12 ” force main on Cornwallis Road and this was the second occurrence of pipe failure on this force main in three years Ms Farmer noted that although the corrosion may have been caused by the hydrogen sulfide gas , corrosion on this main could also have been caused by cathodic protection for the natural gas line in the area Ms Farmer stated in any case , staff reports that all ductile iron pipe on the existing 12 ” and parallel 6 ” force main in this vicinity should be removed and replaced with PVC pipe She stated this will require removal and replacement of approximately 300 LF of sewer force main and modified connection to the existing HDPE pipe where the force mains cross under Swift Creek by directional drill Ms Farmer reported the Water and Sewer Capital Improvements Plan includes a project for “ Force Main Replacement ” beginning in 2024 ; however , due to the potential risk of ductile iron force main failure , the Department of Utilities recommends initiation of an immediate program to begin evaluating , planning andPage2272 March 2 , 2020 – 10 00 am Authority Chairman Ted G Godwin called on Mr Trey Walters to address the Board as he had requested during Public Comments Trey Walters , Owner of Blue Line Aviation , 3149 Swift Creek Road , stated his company represents the largest private investment in the history of the Johnston Regional Airport with the construction of a 10 million facility Mr Walters reported they have also helped to secure approximately 6 million in grant funding from the North Carolina Division of Aviation for the Airport He recognized Airport Director Phil Lanier for his work and efforts to grow the Airport Mr Walters continued that the County is experiencing significant growth , especially at the Johnston Regional Airport and he sees the Airport as a largely untapped resource Mr Walters spoke on the amount of tax revenue he feels could be generated at the Airport not only from his investment , but also from other future opportunities Mr Walters stated he believes historically the Airport Authority membership has consisted of mostly pilots , which is a concern to him Mr Walters stated some of the current members have a financial interest in the Airport either through the ownership of hangars or airplane space He spoke on situations involving Airport Authority members and conflicts of interest or perceived conflicts of interest Mr Walters noted it became challenging for him as a business owner trying to invest in the Airport to get his project moving forward due to possible conflicts of interest by the Authority membership He encouraged the Commissioners to consider appointing individuals to the Authority that have no financial interest in the Airport Commissioner Chad M Stewart stated the Commissioners have recently been discussing the memberships of the various boards and committees they appoint with the intent of trying to better spread the representations across the County Commissioner Stewart stated the Authority membership is currently set at five positions and he asked Mr Walters for his thoughts on expanding that membership to seven Mr Walters responded that when more people are involved , more input and feedback can be given , which he believes is a good thing Mr Walters stated he thinks the most important piece going forward is to appoint people that can evaluate the Airport’s opportunities in an unbiased manner Mr Walters also suggested appointing a County Commissioner to serve on the Authority Commissioner Stewart commented that he understands the concerns of Mr Walters ; however , he spoke on the difficulty of appointing members to the Authority who have no interest in aviation or affiliation with planes , asking how effective of a member could someone be if they did not have any knowledge or involvement with such matters Mr Walters stated Mr Lanier is an Airport Director that truly understands how airport operations work and he cautioned against having an Authority that micromanages the daily operations Chairman Godwin thanked Mr Walters Board of Commissioners strongly encourages all members of the General Assembly to act in accordance with the needs of the State and support Johnston County by taking measures to ensure these important programs , included in the proposed state budget , are funded for the communities that they will so clearly benefit nd Adopted this the 2 day of March , 2020 B Update from Commissioner Butch Lawter – School Funding Formulas Commissioner Butch Lawter reported that he along with Chairman Ted G Godwin , Commissioner Tony Braswell , and Finance Director Chad McLamb recently had a conversation with another county regarding school funding formulas Commissioner Lawter shared information from that conversation on a funding formula utilized by that County and how it helped them during their budget discussions each year Page7277 March 2 , 2020 – 10 00 am Continued Commissioner Lawter noted that while their formula may not be right for Johnston County , the conversation was very informative as he looks for better ways to consider education funding each year with Johnston County Schools C Future Joint Meeting with Johnston County Board of Education Chairman Ted G Godwin noted there has been talks about the Board of Commissioners and the Board of Education having a joint meeting in the near future to review updated OREd information and that meeting date time will be announced when scheduled Chairman Godwin also stated he would like to consider having three volunteers from the Commissioners to begin meeting on a quarterly basis with three volunteers from the Board of Education Chairman Godwin stated he thinks these quarterly meetings would be helpful for both parties going forward 19 Closed Session – NCGS 14331811 a 3 – Attorney - Client Privilege and NCGS 14331811 a 5 – Acquisition of Property Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Patrick E Harris , and carried by unanimous vote , the Board recessed regular session to sit in closed session for the purposes of consulting with an attorney employed by the board in order to preserve the attorney - client privilege , pursuant to North Carolina General Statute 143 - 31811 a 3 to include Johnston County vs West - 18 CVS 1847 and to establish or instruct staff concerning the negotiation of the price and terms of a contract concerning the acquisition of real property , pursuant to North Carolina General Statute 143 - 31811 a 5 No action was taken Commissioner Larry Wood moved the Board adjourn closed session and resume regular session Commissioner Chad M Stewart seconded the
