Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Ted G Godwin , Vice Chairman Chad M Stewart , Larry Wood , Tony Braswell , and Patrick E Harris Absent Commissioners Jeffrey P Carver and RS “ Butch ” Lawter , Jr Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Ted G Godwin called the meeting to order at 10 00 am Commissioner Patrick E Harris opened the meeting with a prayer American Legion Post 346 Four Oaks led those in attendance in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Patrick E Harris , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Tony Braswell , seconded by Commissioner Chad M Stewart , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – January 6 , 2020 10 00 am and 6 00 pm B Proclamation – All In Red Week The Board adopted the following proclamation proclaiming February 7 – 14 , 2020 as “ All In RED Week ” in Johnston County in support of County wide heart health awareness PROCLAMATION Whereas , February 7 , 2020 marks the launch of an 8 - day County wide heart health awareness campaign called “ ALL In RED Week ” , presented by Johnston Health and Dr Eric Janis & the Janis Family Fund , and organized by the Johnston Health Foundation ; and Whereas , heart disease is the leading cause of death in the United States , North Carolina and Johnston County ; and Whereas , per the Center for Disease Control and Prevention CDC , 80 of cases are preventable through education , resources and prevention ; and Whereas , per the 2019 Johnston County Community Health Needs Assessment , significant health needs identified are Access to Health Services , Economy , Exercise , Nutrition & Weight and Heart Disease & Stroke ; and Whereas , per the 2019 Johnston County Community Health Needs Assessment Implementation Plan , Heart Disease and Stroke are on the top 5 health priorities in this county ; and Whereas , education on early screening and access to resources for quality treatment and is important ; and Whereas , the financial challenges of a heart patient in need is enormous and assistance from individuals and organizations will go a long way ; and Whereas , the campaign invites all of Johnston County and Town residents , business owners and visitors to participate in this initiative by wearing RED on February 7 , 2020 which is National Wear Red Day , and or run a RED promo or fundraiser from February 7 - 14 ; and Whereas , all funds raised within this campaign period will benefit local heart patients in need through the Johnston Health Foundation’s Heart Fund ; andPage204 February 3 , 2020 – 10 00 am Continued Whereas , the ALL IN RED week supports Johnston Health’s mission to Retired Col Rudy Baker , Chairman of the Veterans Services Advisory Board , provided the Board with an update on upcoming events for Veterans Mr Baker reported that on February 10 , 2020 at 6 30 pm in the Smithfield American Legion Building , Retired Col Ron Rabin will review a plan outlining how the State of North Carolina can better assist Veterans and the Military Mr Baker stated they are encouraging Veterans to attend and provide feedback to help enhance the plan and all Commissioners are invited Mr Baker also reported the Wall that Heals will be on display at the Benson Park in Garner from April 16 , 2020 until April 19 , 2020 He stated this wall is a ¾ replica of the Vietnam Memorial Wall in Washington , and it will be open to the public and all Johnston County Citizens are encouraged to visit The Board thanked Mr Baker for the update C Update from the Johnston County Health Department Health Director Dr Marilyn Pearson reminded everyone to get their flu vaccine Dr Pearson also distributed information regarding the Coronavirus and stated the Health Department is monitoring the situation and working closely with the North Carolina Division of Public Health and the CDC regarding prevention She reported as of today , there are no confirmed cases in North Carolina Dr Pearson encouraged citizens to follow the same practices as they would during the regular flu season with regular handwashing , staying home when sick , and covering coughs or sneezes Dr Pearson stated more information is available on the CDC’s website Dr Pearson also reported the Health Department recently participated in a full - scale pandemic flu exercise with other agencies including the Sheriff’s Office and other Law Enforcement Agencies , Emergency Services and EMS , Environmental Health , Behavioral Health , Human Resources , the Department of Social Services , Johnston County Schools , Johnston Community College , Johnston Health , and Smithfield Manor Dr Pearson stated the exercise was successful and the State reported that Johnston County did a great job She thanked all those that participated in the exercise Dr Pearson finally reported that the North Carolina Association of Local Health Directors recently named Representative Donna White as the Legislator of the Year for her work with and for Public Health in North Carolina Dr Pearson spoke on the work by Representative White for public health matters and how helpful she has been D Remarks by Selma Mayor Cheryl Oliver Selma Mayor Cheryl Oliver thanked the Board for hosting the recent Growth Management Community Meeting at West Johnston High School Mayor Oliver stated she was pleased at the number of citizens who attended as well as the variety of ideas presented Mayor Oliver shared her thoughts with the Board regarding growth management , stating she agrees with the proposed amendments that set forth a strategy of growing the County outward from the towns Mayor Oliver spoke on the benefits of growing outward from the towns stating it would help the towns thrive and she encouraged the Board to continue working through this issue E Citizen Comments by Anthony Barnes Anthony Barnes , 414 Madison Avenue , Princeton , asked the County to consider working towards bringing Google Fiber to the Princeton area Mr Barnes spoke on internet difficulties in his area and noted he went to the Town of Princeton with his concerns and they referred him to the County Commissioners Mr Barnes stated they have Spectrum in the area ; however , it is very slow Mr Barnes stated on the 6 00 pm agenda as a special use modification request Chairman Ted G Godwin reported the County has received word from the Attorney for Martin Marietta that they are going to request tonight’s case to be postponed until the March 2 , 2020 6 00 pm meeting and it would be more appropriate to view the video at that time G Citizen Comments by Ken Taylor Ken Taylor , 1755 Gordon Road , Clayton , addressed the Board and agreed with earlier comments by Anthony Barnes that internet service is needed across the entire County Mr Taylor also spoke on the decal system for solid waste disposal and asked the Board that if they decide to change the decal system , how it would affect citizens who may have just purchased a decal The Board assured Mr Taylor that if the decal system were changed , there would be some time before the new system was implemented and citizens would be informed well ahead of time 4 Presentation of Audit Report for Year Ending June 30 , 2019 Stewart Hill , with Thompson , Price , Scott , Adams & Co PA , presented the audit report for the fiscal year ending June 30 , 2019 Mr Hill stated his firm issued an unmodified report or “ clean report ” and there were no significant audit findings He continued that no difficulties were encountered while performing the audit , there were no disagreements with management , management did provide a representation good job when it comes to school construction and education funding Commissioner Larry Wood moved the Board accept the audit as presented for fiscal year ending June 30 , 2019 Commissioner Patrick E Harris seconded the motion , which carried by unanimous vote 5 Moseley Architects – Detention Center Update and Approval of Next Phase Jason Hopkins with Moseley Architects provided an update to the Board on the Detention Center Project Mr Hopkins stated they have completed the final phase of drawings and have submitted the plans and specifications to all the reviewing authorities for the project Mr Hopkins stated they have submitted the plans to the North Carolina Department of Insurance who has already approved for the project to move forward as well as the Department of Health Service Regulations who primarily review jails and hospitals Mr Hopkins reported they also submitted the documents to the Johnston County team for review as of this morning He noted some of the site permits are either under review or already approved and they would like to receive approval from the Board to begin the general contractor prequalification process later this week Mr Hopkins continued that they received their latest cost estimate yesterday and he is pleased to report the County has done a great job of controlling the project scope and the estimate of 485 million for the building and site has not changed Mr Hopkins stated they are seeking approval to move forward with the bidding phase of the project in the hopes of advertising for bids in mid - March He stated if approved , bids would be opened in mid - April and the Board of Commissioners could consider awarding the project in May Mr Hopkins stated if the project is awarded in May then construction could begin towards the end of May or early June followed by a 22 - month construction period Mr Hopkins offered to answer any questions At the request of the Board , Sheriff Steve Bizzell reported the population of the jail continues to increase and they are currently having to house inmates in Wayne County and Sampson County He stated if the increase continues , inmates would then go to Craven County or Alamance County Sheriff Bizzell stated they continue to meet with Mosely often and they are doing a great job on this project Page3215 February 3 , 2020 – 10 00 am Continued Jimmy Boykin , the County’s Consultant on the project , addressed the Board and agreed with Sheriff Bizzell that they meet regularly and so far , he is pleased to report they have been able to hold down the project scope while making sure it prequalification bidding process and for Mosely to proceed with the bidding phase of the project 6 Four Oaks EMS – Approval of Power Load Stretcher System Purchase Johnston County EMS Division Chief Dan Gagne stated Four Oaks EMS is requesting to purchase a power load stretcher system , including a power load cot Mr Gagne reported the purchase will allow for the standardization of stretchers and is consistent with other loading systems within EMS He stated Four Oaks EMS Chief April Matthews has one quote in the amount of 50,28713 and is looking into getting a lower quote , similar to the last purchase by Johnston County EMS He stated Chief Matthews agrees to go with the lowest bid Mr Gagne stated the Johnston County Emergency Medical Services Advisory Committee met in regular session on Tuesday , January 7 , 2020 and voted to recommend approval of the purchase Upon questions by Commissioner Chad M Stewart , Mr Gagne reported Four Oaks EMS already has one loading system and this purchase would retrofit their last truck He noted the County began this same process approximately 2 ½ years ago At the inquiry of Commissioner Tony Braswell , Emergency Services Director Kevin Hubbard reported Four Oaks EMS has the funds on hand to pay for the purchase Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Patrick E Harris , and carried unanimously , the Board approved the purchase by Four Oaks EMS of a power load stretcher system , including a power load cot 7 ReEntry – Update and Overview of Services Executive Director Dot Ehlers thanked the Board for their past support and provided the Commissioners with an overview of the services offered by ReEntry Ms Ehlers stated ReEntry offers several programs with one of those being the Family PRIDE Program Preserve , Reunite , Improve , Develop , and Empower which is for parents that have substance abuse problems or have trouble providing for their children’s basic needs She stated most of the families through the PRIDE Program are referred to them through the Johnston County Department of Social Services She continued they offer another domestic violence prevention program known as HALT Halting Abuse through Learning and Treatment which is for men who have been convicted of or have allegations of domestic violence against them Ms Ehlers stated they also offer a program for children called the Healthy Choices Program , which is funded with a grant from the Juvenile Crime Prevention Council , and they hope to expand that program very soon Ms Ehlers provided the Board with a history of ReEntry stating they began in 1993 as a court program funded through the Administrative Office of the Courts AOC Ms Ehlers stated in the beginning the AOC funded them at 100 to offer alternative sentencing options , but in 2014 the State eliminated the funding for that program She noted at that time , they were one of the highest producing programs in the State Ms Ehlers reported ReEntry tries to provide services that are not available anywhere else in the hopes of filling the gaps in the system She stated because of the decline in funding over the years , they have had to cut back on employee benefits and some employees have chosen to take salary cuts in an effort to keep the programs running Ms Ehlers concluded her remarks by stating she has been with ReEntry for 25 years and at some point she hopes to step down which is why she wants the Board to know who they are in the hopes of continued support for the future Ms Ehlers commended her employees stating they are the best at their jobs At the inquiry of Chairman Ted G Godwin , Ms Ehlers reported they no longer receive any funding from the Administrative Office of the Courts The Board thanked Ms Ehlers for the information Page4216 February 3 , 2020 – 10 00 am Continued 8 Public Utilities – Duchess Downs Wastewater Pump Station Abandonment Proposed Wastewater Facilities Project Budget Utilities Director Chandra Farmer , PE , reported the County’s Capital Improvements Plan includes a 2021 project identified as “ New Interceptor from Duchess Downs to Adams Pointe – Abandon Duchess Downs WWPS ” She stated the proposed project includes a gravity sewer outfall from the existing Duchess Downs Wastewater Pump Station WWPS to Adams Point WWPS located in Adams Pointe Subdivision Ms Farmer explained the outfall will allow for the abandonment of the existing Duchess Downs WWPS She stated the existing WWPS is currently at capacity , based on actual and committed flows , and station upsizing would be very expensive due to no three - phase power available in the vicinity Ms Farmer stated the proposed wastewater facilities will serve existing and future development on the west side of the I - 40 NC 42 interchange and the area between NC 50 and Old Drug Store Road Ms Farmer continued that a developer , Triple B # 29 ODS , LLC , has proposed projects in this area and has requested to enter into a “ Reimbursement Agreement ” with the County for the wastewater project design and construction Ms Farmer explained that Triple B needs the wastewater transmission capacity sooner than the County’s planned project in 2022 She stated Triple B # 29 ODS , LLC would be responsible for a maximum project cost of 575,000 , with the remainder being the responsibility of the County Ms Farmer reported the current estimated project costs are 2,055,000 ; therefore , the County would be responsible for 1,480,000 The developer will be responsible to design , permit and construct the project in accordance with County standards The County would be responsible to reimburse the developer for the agreed upon costs and acquire the necessary public utility easements Ms Farmer stated in order to proceed with the proposed project , a capital project budget would need to be adopted She presented the following proposed project budget Construction 1,480,00000 Easement Acquisition 75,00000 Contingency 148,00000 Total 1,703,00000 Ms Farmer stated funding for the project would come from the Wastewater System Development Fee Capital Reserve account and the Board is being asked to consider approving for the County to enter into a reimbursement agreement with Triple B # 29 ODS , LLC and approve the proposed project budget At the inquiry of Chairman Ted G Godwin , Ms Farmer confirmed that the project is already included within the County’s adopted Capital Improvements Plan ; however , the developer needs the wastewater transmission capacity sooner than the County’s timeline and by entering into a Reimbursement Agreement with the developer , the developer would be paying 575,000 towards the project Upon a question by Commissioner Chad M Stewart , Ms Farmer stated the 575,000 is the developer’s cost to go ahead and construct the facilities and the County would not have to reimburse any of that amount Commissioner Tony Braswell asked what the developer is planning Ms Farmer reported the developer has several proposed projects , which she does not believe have been approved by the County yet She stated some the plans may include multi - family and commercial development Ms Farmer stated if those projects do not move forward then the wastewater project would stop and the County would then pay its share of the engineering costs to date and take ownership of the documents She stated those documents would be used to complete the design and construction when it meets the County’s schedule Commissioner Braswell expressed concerns with entering into an agreement with the developer when the Board does not know exactly what is planned , especially in an area where there are already growth issues Ms Farmer stated the Reimbursement Agreement would be specific to sewer facilities only and any approvals of the developer’s projects would have to go through the required processes Ms Farmer stated this would be similar to upsizing agreements the County has had in the past where developers construct offsite wastewater facilities and upsizes those facilities for the County’s existing and future needs with the County reimbursing the developer a portion of the construction costs Commissioner Patrick E Harris asked would it not be more prudent for the developer’s projects to go through the process first and receive approvals before entering into an agreement with the County Page5217 February 3 , 2020 – 10 00 am Continued Ms Farmer stated while some of the developer’s existing commercial development has been approved , she is unsure if the entire subdivision has been approved at this time She stated the developer has other properties they are looking at and had hoped to move everything along simultaneously because of the lead - time involved with design , engineering , and construction of wastewater facilities At the inquiry of Commissioner Stewart , Ms Farmer confirmed there would be no risk or loss to the County if the developer’s projects do not move forward She stated the County would pay their share of the engineering design , take ownership of the design , and then move it forward at the County’s schedule Ms Farmer stated if the projects do move forward , then the developer would be contributing 575,000 towards the project , which the County would not have to reimburse Commissioner Braswell asked if the matter could be tabled to allow the Board more time to consider the request , noting that two Commissioners were absent from today’s meeting Commissioner Harris stated he has concerns with approving the request when additional space is needed to provide this final service for County residents She stated staff has been exploring options in addition to the space provided at the hospital for these services and the additional space would be utilized only as needed She stated the proposed fee for use of the facilities is 1,00000 per month with a 15 per event fee during normal business hours and 30 per event fee outside of normal business hours for logging cases in or out Dr Pearson stated the event fee would only be used if County staff were unavailable Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Larry Wood , and carried unanimously , the Board approved contracting with Underwood Funeral Home as requested by staff C Additional Funding for Johnston County Schools County Manager Rick Hester noted that a few weeks ago , the Board asked him and Commissioner Jeffrey P Carver to meet with Johnston County Schools regarding their financial situation Mr Hester stated he and Commissioner Carver have had several discussions with Johnston County Schools and requested a lot of information , of which most has been received by the County Mr Hester reported he expects to receive additional information later this week and he presented the following recommendation for the Board to consider An additional allocation to Johnston County Schools for current expense , as Chad M Stewart thanked Mr Hester and Commissioner Carver for their work with Johnston County Schools and stated he will support the recommendation Commissioner Stewart further stated he would like to see an outside audit firm come in and review the schools finances , at the County’s expense Commissioner Stewart stated he feels the audit is necessary not because of anything that was done Commissioner Stewart regarding the need to have an outside firm come in and look at the finances Commissioner Braswell stated he thinks the taxpayers expect the County to ensure the school system is adequately funded , but also that their tax dollars are spent wisely and where they should be Commissioner Braswell thanked Interim Superintendent Dr Ben Williams and Johnston County Schools stating he thinks they have shown their commitment to working together going forward Commissioner Stewart also thanked Johnston County Schools for working with the County and stated he thinks they have been very cooperative Mr Hester noted the recommendation was also from Commissioner Jeffrey P Carver and he would have presented it himself had he not been absent from today’s meeting Chairman Ted G Godwin stated he spoke with Commissioner Butch Lawter and he supports the recommendation Commissioner Patrick E Harris stated he can agree with the recommendation , but he feels it is very important to know that the citizens have expectations that the Board will be wise stewards of the tax dollars Commissioner Harris stated he feels it is important to determine what happened and make sure it never happens again Commissioner Harris stated he looks forward to working on next fiscal year’s budget and hopes that everyone can come together in complete transparency and come up with a realistic budget Mike Powell in the audience who are candidates for the District 6 County Commissioner seat in the upcoming election B Recent Growth Management Meetings Commissioner Larry Wood stated the recent meetings regarding growth management were very productive and he thanked the staff for their work in putting those meetings together Commissioner Wood asked the Board to discuss the next steps Commissioner Tony Braswell commented that the next steps would be to move the proposed amendments through the Planning Board and then on to the County Commissioners for a public hearing Commissioner Braswell stated if the Planning Board could look at the proposed amendments in February , then perhaps the Board of Commissioners could hold a public hearing as early as March Following brief discussion , County Manager Rick Hester stated that Planning Director Braston Newton would be at the 6 00 pm meeting and ready to discuss the next steps C Recognition of the Johnston County Health Department Commissioner Patrick E Harris recognized Health Director Dr Marilyn Pearson in the audience and commended her along with Assistant Health Director Steve Strickland and all the staff at the Health Department for their work and dedication Commissioner Harris noted he sits on the Health Board and he is able to witness first - hand the phenomenal work the Health Department does every day to keep the citizens safe and healthy D Introduction of Johnston County Schools Interim Superintendent Commissioner Tony Braswell introduced Johnston County Schools Interim Superintendent Dr Ben Williams Acquisition of Property Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Larry Wood , and carried by unanimous vote , the Board recessed regular session to sit in closed session for the purposes of consulting with an attorney employed by the Board in order to preserve the attorney - client privilege pursuant to North Carolina General Statute 143 - 31811 a 3 , to discuss matters relating to the location or expansion of industries or other businesses in the area , pursuant to North Carolina General Statute 143 - 31811 a 4 , and to establish or instruct staff concerning
