the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Chad M Stewart , Vice Chairman Larry Wood , Ted G 00 pm Commissioner Patrick E Harris opened the meeting with a prayer Commissioner Fred J Smith , Jr led everyone in the Pledge of Allegiance to the American Flag 1 Approval Discussion of Agenda Upon a motion by Commissioner Fred J Smith , Jr , seconded by Commissioner Larry Wood , and carried by unanimous vote , the Board approved the agenda as presented 2 Consent Agenda Items Upon a motion by Commissioner Larry Wood , seconded by Commissioner Butch Lawter , and carried by unanimous vote , the Board approved the consent agenda items as follows A Approval of Minutes – August 2 , 2021 6 00 pm B Department of Transportation – Additions to System The Board concurred with the Department of Transportation’s recommendation to add the following roads to the State Maintained System Barberry Lane and Quince Court – Charlestowne Subdivision – Boon Hill and Smithfield Townships Kyndallee Lane SR 3413 , St Jiles Drive SR 2916 , Bornean Drive SR 3712 , and Brakas Lane – Kyndal Subdivision – Cleveland Township Newman Lane – Carlton Pointe Subdivision – Wilders Township C Johnston County Schools – Surplus of Property at Pine Level Elementary School A neighboring property owner Lynn Selby of the Pine Level Elementary School has requested to purchase a portion of vacant property near the school for 7,29655 The property is adjacent to Ms Selby’s property located at 101 North Capps Street in Pine Level and measures approximately 3,652 square feet roughly 007 acres The Johnston County Board of Education has reviewed the request and concluded that the property is not needed for public school purposes nor would the disposal of the property have an adverse impact on the current or future of the Pine Level Elementary School Pursuant to North Carolina General Statutes , Johnston County Schools must first offer Johnston County the option of purchasing the property Per a request by Johnston County Schools , the Board declined to purchase the property so that it may be disposed of by Johnston County Schools pursuant to the upset bid process 3 Public Comments None Page379 September 20 , 2021 – 6 00 pm Continued 4 McGill Associates – Nitrogen Offset Credits for Detention Center and Public Safety Center Construction Projects Chad Simmons , with McGill Associates , requested the Board to approve the purchase of nitrogen offset credits for the new Detention Center and Public Safety Center Construction Projects Mr Simmons explained that nitrogen pollution is generated during construction projects and the higher the impervious area , the higher the nitrogen runoff , which is carried off the site through stormwater Mr Simmons stated this is a requirement through the stormwater permit from the Town of Smithfield and if the maximum amount of nitrogen is exceeded , then it can be treated onsite with the construction of stormwater measures , or the owner can purchase offsetting credits through private mitigation banks Mr Simmons reported the limit will be exceeded with both the Detention Center construction and the Public Safety Center construction Mr Simmons recommended the Board approve the purchase of credits at a total cost of 91,86244 47,91744 for the Public Safety Center and 43,94500 for the Detention Center At the inquiry of Commissioner Ted G Godwin , Mr Simmons stated this purchase would have no impact on the County’s Public Utilities Department continuing to purchase nitrogen credits for their own projects Commissioner Fred J Smith , Jr moved the Board approve the purchase of the nitrogen offset credits at a total cost of 91,86244 47,91744 for the Public Safety Center and 43,94500 for the Detention Center Commissioner Butch Lawter seconded the motion , which carried unanimously 5 Parks , Greenways , & Open Space – East Clayton Elementary School Boat Ramp Property Purchase Parks , Greenways , & Open Space Coordinator Adrian O’Neal explained that at the July 6 , 2020 meeting , the Board of Commissioners approved the transfer of a 2840 acre tract of land Parcel No 16K05012F located beside the East Clayton Elementary School from the Board of Education to Johnston County Mr O’Neal reported that pursuant to North Carolina General Statutes , the County must purchase the property from Johnston County Schools at fair market value He requested the Board to approve the agreement for purchase and sale of the property at a cost of 34,08000 and offered to answer any questions Commissioner Butch Lawter expressed his support for the project and moved the Board approve the following agreement for purchase and sale of the property at a cost of 34,08000 Commissioner Patrick E Harris seconded the motion , which carried unanimously STATE OF NORTH CAROLINA AGREEMENT FOR PURCHASE AND SALE OF REAL PROPERTY COUNTY OF JOHNSTON THIS AGREEMENT “ Agreement ” made by and between JOHNSTON COUNTY BOARD OF EDUCATION , a Governmental Entity hereinafter referred to as “ Seller ” , and COUNTY OF JOHNSTON , a body politic , existing under the laws of North Carolina hereinafter the “ Buyer ” FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES SET FORTH HEREIN AND OTHER GOOD AND VALUABLE CONSIDERATION , THE RECEIPT AND SUFFICIENCY OF WHICH ARE HEREBY ACKNOWLEDGED , THE PARTIES HERETO AGREE AS FOLLOWS Section 1 Terms and Definitions The terms listed below shall have the respective meaning given them as set forth adjacent to each term a “ Property ” See attached Exhibit A , which is fully incorporated by reference herein b “ Purchase Price ” shall mean the sum of thirty four thousand and eighty dollars 34,08000 c “ Closing ” shall occur on or before November 30 , 2021 as approved by the Johnston County Board of Commissioners and the Johnston County Board of Education The closing date may be modified by mutual agreement of the Buyer and Seller d “ Examination Period ” shall mean the period beginning on the date hereof and extending through November 12 , 2021 e “ Intended Use ” shall mean the use of the Property for the Proration of Expenses and Payment of Costs The Buyer is a Governmental Purchaser under NCGS § 105 - 385 c and as such the full amount of property taxes will continue to be exempt Seller shall pay for Seller’s attorney fees Buyer shall pay for deed preparation , recording costs , costs of any title search , title insurance , survey , Buyer’s attorney fees , and all other customary costs associated with the purchase of the Property Section 3 Sale of Property Seller agrees to sell the Property for the Purchase Price set forth in Section 1 of this Agreement Section 4 Payment of Purchase Price Buyer shall pay the Purchase Price in accordance with all the terms and conditions of this Agreement Section 5 Title Seller agrees to convey fee simple marketable title to the Property by Special Warranty Deed , subject only to the exceptions hereinafter described Seller represents and warrants that Seller is the fee simple owner of the Property , and at Closing , Seller shall deliver to Buyer good and marketable fee simple title to said Property , free and clear of all liens , encumbrances and defects of title other than zoning ordinances affecting the Property , utility easements of record serving the Property , taxes not yet due and payable , road rights - of - way of record and those other encumbrances , reservations , restrictions and easements and other exceptions currently of public record “ Permitted Exceptions ” Section 6 Conditions This Agreement and the rights and obligations of the parties under this Agreement are hereby made expressly conditioned upon fulfillment or waiver by Buyer of the following conditions a Title Examination After the date of execution of this Agreement by Seller , Buyer shall , at Buyer’s expense , cause a title examination to be made of the Property before the end of the Examination Period , as defined in Section 1 d In the event that such title examination shall show that Seller’s title is not good , marketable , fee simple and insurable , then the Buyer shall immediately notify the Seller in writing of all such title defects and exceptions , as of the date Buyer learns of the title defects , and Seller shall have ten 10 days to cure said noticed defects If Seller does not cure the defects or objections within ten 10 days of notice thereof , the Buyer may terminate this Agreement If Buyer is to purchase title insurance , the insuring company must be licensed to do business in the state in which the property is located Title to the Property must be insurable at regular rates , subject only to standard exceptions and Permitted Exceptions b Intended Use Seller represents and warrants that , to the best of Seller’s knowledge , use of the Property for its Intended Use will not violate any private restrictions or governmental regulations If Buyer determines , prior to the date of Closing , that use of the Property for its Intended Use will violate any such private restrictions or governmental regulations , then Buyer may terminate the Agreement by written notice , and neither party shall then have any further obligations in connection with this Agreement It is acknowledged that Seller is selling the property “ AS IS ” without any express or implied warranties and Buyer has the right to inspect the property as set forth herein c Same Condition If the Property is not in substantially the same condition as of the date of the offer , reasonable wear and tear excepted , then the Buyer may terminate the Agreement d Inspections Buyer , its agents or representatives , at Buyer’s expense and at reasonable times during normal business hours , shall have the right to enter upon the Property for the purpose of inspecting , examining , performing soil boring and other testing , and surveying the Property Buyer shall also have a right to review and inspect all agreements affecting or related directly to the Property Buyer assumes all responsibility for the acts of itself , its agents or representatives in exercising its rights under this Paragraph and agrees to indemnify and hold Seller harmless from any damages resulting therefrom Except as provided in Section 6 a above , Buyer shall have from the date of acceptance through the end of the Examination Period to perform the above inspections , examinations and testing to determine if the Property is suitable for the Intended Use If , prior to the expiration of the Examination Period , Buyer determines that the Property is unsuitable , and provides written notice to Seller thereof , then this Agreement shall terminate Seller agree to cooperate with the Buyer for purposes of inspections and surveying Section 7 Risk of Loss Damage Repair Until the Closing , the risk of loss or damage to the Property , except as otherwise provided herein , shall be borne by Seller In the event the Property is damaged so that the Property cannot be conveyed in substantially the same condition as it was prior to Closing , Buyer may elect to terminate this Agreement Except as to maintaining the Property in its same condition , Seller shall have no responsibility for the repair of the Property , including any improvements , unless the parties hereto agree in writing Page381 September 20 , 2021 – 6 00 pm Continued Section 8 Closing The Closing shall consist of the execution and delivery by Seller to Buyer of a Special Warranty Deed and other documents customarily executed by a seller in similar transactions , including without limitation , an owner’s affidavit , lien waiver forms and a non - foreign affidavit and the payment by Buyer to Seller of the Purchase Price in accordance with the terms of the Purchase Price The Closing shall be held at the office of Buyer’s attorney or such other place as the parties hereto may mutually agree Possession shall be delivered at closing , unless otherwise agreed herein Section 9 Notices Unless otherwise provided herein , all notices and other communications which may be or are required to be given or made by any party to the other in connection herewith shall be in writing and shall be deemed to have been properly given and received on the date delivered in person or deposited in the United States mail , registered or certified , return receipt requested , to the addresses set out in Section 1 f as to Seller and in Section 1 g as to Buyer , or at such other addresses as specified by written notice delivered in accordance herewith Section 10 Entire Agreement and Applicable Law This Agreement constitutes the sole and entire agreement among the parties hereto and no modification of this Agreement shall be binding unless in writing and signed by all parties hereto This Agreement shall be construed under the laws of the state of North Carolina and shall be binding upon the heirs , executors and assigns of the parties hereto No further signatures are necessary for this contract to be valid and binding upon the parties hereto IN WITNESS WHEREOF , the parties hereto have executed this Agreement the date and year first below written 6 Parks , Greenways , & Open Space – Feasibility Study – East Coast Greenway and Mountains to Sea Trail Parks , Greenways , & Open Space Coordinator Adrian O’Neal reported on a Feasibility Study opportunity for the East Coast Greenway and Mountains to Sea Trail between Clayton and Smithfield Mr O’Neal explained that the study would be managed through the Upper Coastal Plain RPO and has received approval from the North Carolina Department of Transportation He stated the total anticipated cost of the study is 150,000 and he requested the Board to approve a contribution of 7,500 from the County’s Open Space Fund for the County’s share of the cost Mr O’Neal stated the remaining cost is being funded in cooperation by the North Carolina Department of Transportation and the North Carolina State Parks Mr O’Neal stated the feasibility study will look at the current proposed route between Clayton and Smithfield to determine where there may be obstacles so that alternatives can be found in an effort to plan the final route He stated the completion date of the study would be July 2022 Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Butch Lawter , and carried unanimously , the Board approved an allocation of 7,500 from the County’s Open Space Fund for the County’s share of the feasibility study cost 7 Town of Princeton – Request for Funding – Drainage and Waterline Projects Princeton Mayor Don Rains addressed the Board regarding a request for funding assistance that the Town of Princeton made to the Board at their September 7 , 2021 evening meeting The request consisted of funding in the amount of 715,000 for a stormwater drainage project and 400,000 for a waterline project Mayor Rains stated both projects are not a want , but a need in the Town Mayor Rains spoke on how the projects are not just unique to Princeton , but are a concern in other areas of the County Mayor Rains stated they have issues with poor water quality due to the lack of waterline connections from the Brogden Water District He stated this also affects fire protection in the Massey - Holt Road area in that the current water pressures are not high enough the meet the demand needed for fire hydrants Princeton Town Manager Marla Ashworth explained that in relation to the water quality issues , since July of 1993 , the Town has had 27 water violations related to trihalomethanes which are a byproduct of the chlorination process She stated the Town must then flush tens of thousands of gallons of water out of their system to come into compliance Johnston County Fire Marshal Adam Stanley stated Mayor Rains and Princeton Fire Chief Randy Jones asked him to attend the meeting and speak on the fire protection concerns Mr Stanley stated a waterline in the Massey - Holt Road area would help enhance fire protection because fighting fires is much easier when there are hydrants available He noted that the fire department does have alternate means of fire protection through the use of a tanker task force so the area is protected ; however , response times and manpower needed are less when there are hydrants available PagePage pageNumber5382 September 20 , 2021 – 6 00 pm Continued Chairman Chad M Stewart clarified that there are two separate requests from the Town of Princeton , one involving a stormwater drainage issue and the other is the waterline project Chairman Stewart stated he wanted everyone to understand that even though both projects are in the town , the requests are separate from one another and should be considered as two separate issues Commissioner Butch Lawter agreed with Chairman Stewart and suggested the Board consider the waterline request first Commissioner Larry Wood commented that with regards to the waterline funding request , he believes that there is a percentage of that project that will also benefit the County Commissioner Wood asked if that percentage could be defined At the request of Commissioner Fred J Smith , Jr , County Manager Rick Hester stated he has had several discussions with staff and the Town of Princeton on the waterline request Mr Hester stated he recommends the Board consider contributing one third of the estimated 400,000 cost Mr Hester stated it is his understanding that the waterline project is still in design so that cost amount could change and if the project comes in over 400,000 , then the Board could discuss again Princeton Town Councilman Mike Rose thanked the Board for their consideration of the request Mr Rose stated he respectfully disagrees with Mr Hester’s recommendation because the waterline project will primarily benefit County water customers and will add no revenue to the Town in the foreseeable future Mr Rose stated the Town purchases water from the County and the Town has had the violations from the water purchased from the County Mr Rose stated this project would help enhance that waterline quality Mr Rose stated he would ask the Board to consider funding the project at 100 since it is a product the County sells to the Town Mr Hester thanked Mr Rose for his remarks and stated the main reason he recommends one third of the cost is because the waterline will run by many large vacant tracts of land that one day could be developed for residential and the County has not subsidized future residential development in the past Mayor Rains stated the waterline project is eligible for funding from the American Rescue Plan Act of 2021 ARPA He stated there would be future housing in that area as the Town grows , but it is not an immediate need because they are approximately three to five years away from expanding their sewer treatment facilities which would be needed to expand residential growth in that area Commissioner Wood commented that going forward he would like to see houses , schools , and growth in the towns where there are parks , sidewalks , trash service , and other similar amenities versus having more “ pop up towns ” in the rural areas of the County Chairman Stewart agreed and noted that he recently met with a citizen who made some good points that while some of the recent smaller changes to the Land Development Code were done in an effort to begin pushing growth to the towns , what has the County done to help the towns accommodate that growth Mr Hester stated if the Board chooses to contribute any funding towards the waterline project , he would respectfully request that those funds come from the Public Utilities Enterprise Fund since there are funds available for projects like this Motion – Waterline Project Commissioner Butch Lawter moved the Board fund 50 of the waterline project , up to 200,000 based on current estimates , with funds to come from the Public Utilities Enterprise Fund and that if the project exceeds the estimated budget , then the Town could come back to the Board Commissioner Fred J Smith , Jr seconded the motion Discussion At the inquiry of Commissioner Ted G Godwin , Mr Hester confirmed that there are funds available within the Public Utilities Enterprise Funds for the waterline project PagePage pageNumber6383 September 20 , 2021 – 6 00 pm Continued Vote The motion carried by unanimous vote Chairman Stewart stated the Board could now discuss the stormwater drainage request Commissioner Lawter stated because the Board is talking about using some of the ARPA funds , there should be criteria in place for the Board to use as a basis when making decisions noting that there are other towns in the County that may also have needs Commissioner Lawter stated the Board must also make sure that for any projects which receive funding , that those projects meet a public purpose not just for individual towns , but also for the County overall Commissioner Lawter stated he would like for staff to come up with recommendations on criteria the Board could use as a basis for making decisions Commissioner Lawter suggested the Board delay a decision on the stormwater request until the next meeting to allow staff time to work on the criteria Chairman Stewart stated regarding the drainage project , as it relates to meeting the public purpose , there are those that would say the stormwater issue is the result of things that the County has done Commissioner Godwin agreed with Chairman Stewart , stating he would be in favor of funding the drainage project Commissioner Godwin stated a lot of the stormwater Princeton is dealing with comes from the County and further , when it leaves Princeton it comes back to the County Commissioner Smith stated in listening to his fellow Commissioners everyone has made good points ; however , the Board needs to have facts before it can make a decision Commissioner Smith stated he would like for staff to look at the stormwater issue and try to determine how much of it comes from the County and what the County’s responsibility should be Commissioner Smith stated the Board needs to have a plan in place so that all requests are evaluated fairly th Commissioner Lawter stated based on the data the Board received at the September 7 meeting , it appears that perhaps the stormwater issue could be more of a localized problem th Mayor Rains spoke on the information presented at the September 7 meeting and stated delaying the project for two weeks or longer will not help matters Commissioner Smith stated he understands the concerns by the Town of Princeton , but he would like for the County staff to have two weeks to research the issue further and bring that information back to the Board Commissioner Lawter stated the Board must look at things from an overall County perspective and must be careful with setting any precedents Commissioner Lawter stated he is not against the project by Princeton , but he would like to have a basis for making decisions fairly Motion – Drainage Project Commissioner Fred J Smith , Jr moved to instruct staff to draft criteria recommendations for the Board to consider as it relates to funding projects through the American Rescue Plan Act Funds ; and further , for staff to review the stormwater drainage project from the Town of Princeton and determine a contribution recommendation for the Board to consider at the October 4 , 2021 meeting Commissioner Ted G Godwin seconded the motion Discussion Princeton Town Councilman Scottie Brown stated everyone that lives within the Town of Princeton is also a citizen of Johnston County and he expressed concerns that they are not being treated as citizens of the County Commissioner Smith stated the Princeton residents are very important and the Board wants to meet their needs Commissioner Smith continued that the issue is not if the project is good or bad , but whether or not the governing body is using taxpayer monies properly to discharge the purpose for which they were entitled to take that money PagePage pageNumber7384 September 20 , 2021 – 6 00 pm Continued Commissioner Patrick E Harris stated his concern is fairness and if the Board decides to fund the request , then how does the Board administer that across the County Chairman Stewart stated while a matrix or criteria can be created , the Commissioners were elected to make the difficult decisions , and he thinks that ultimately it will come down to a case by case basis Mayor Rains reiterated that the funding they are asking for to help with the drainage project would come from the ARPA funds , the project is needed , and they need to move forward as soon as possible Vote The motion carried by unanimous vote 8 Soil & Water Conservation – Conservation Easements Program Soil & Water Conservation Director Greg Walker presented the following information as it relates to a Conservation Easements Program for Johnston County PagePage pageNumber8385 September 20 , 2021 – 6 00 pm ContinuedPagePage Mr Walker offered to answer any questions Commissioner Ted G Godwin asked if there has been any study of possible impacts to the County’s ad valorem taxes Natural Resources Conservationist Joe David Austin responded that a cost analysis study was completed some time ago by Mount Olive College for Johnston County to show the cost of goods and services on easements and farmlands , which he can locate and share with the Board Mr Austin further stated in most cases a farm or farmland is typically already in the farm use tax program so the tax value would not change Mr Austin stated the owner would still get the benefit of the farm use program and the County’s revenue would not change At the inquiry of Commissioner Larry Wood , Mr Walker stated there is no minimum or maximum acreage of a parcel that could be considered Mr Walker stated funds for the actual conservation easement would be in place first before surveys , appraisals , and other due diligence begin Commissioner Patrick E Harris noted that the owner is giving up their development rights to the property and he asked what the advantages are of putting property in a conservation easement CommissionerPage3390 September 20 , 2021 – 6 00 pm Continued Harris also asked what would happen in a situation where future heirs or owners of the property wanted to get the development rights back Mr Walker responded once the property is put into a conservation easement , it is forever and the property can never be developed Mr Walker stated the incentive is that the current landowner receives money for the property , which they often use to pay off mortgages or debt while still being able to farm the land or lease it for farming Commissioner Butch Lawter stated this information would be very useful for the Comprehensive Land Use Plan Steering Committee and suggested it be presented to them Mr Walker stated they would be happy to share the information with the committee The Board thanked Mr Walker for the information 9 Public Utilities – Proposed Sedimentation and Erosion Control Fees Utilities Director Chandra Farmer , PE , explained that Johnston County is a delegated local government with Sedimentation and Erosion Control approval authority for new development She reported the County collects plan review fees in order to cover expenses associated with the program Ms Farmer stated on August 23 , 2021 , the Governor signed Session Law 2021 - 121 House Bill 489 which amends several provisions of NCGS Chapter 113A , Article 4 Sedimentation Pollution Control Act of 1973 She stated Section 5 c of Session Law 2021 - 121 amends NCGS Chapter 113A - 60 to limit the review fee charged by local governments for sedimentation and erosion control plans Ms Farmer presented the following table that identifies the County’s existing and proposed associated review fees Item Existing Fee Proposed Fee Sedimentation Erosion Control Plan Review for Non - Residential and Residential development plans 380 disturbed acre up to 10 acres ; 380 disturbed acre up to 10 acres ; that include entire development 125 for each additional acre 125 for each additional acre disturbance prior to Financial Responsibility & 15000 Permit Transfer 15000 Permit Transfer Ownership Transfer Requiring New Permit Ms Farmer requested the Board’s approval of the proposed revised fees for all plans submitted on or after October 1 , 2021 , in accordance with Session Law 2021 - 121 Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Larry Wood , and carried unanimously , the Ted G Godwin commented that the Board has discussed the purchase of property from Mr Larry Cox for property identified as Parcel ID Numbers 15L11014 , 15L11014F , 15L11014G , and 15L11014E during closed sessions ; however , the Board has not had a chance to discuss in open session Commissioner Godwin noted the absence of Commissioner Tony Braswell and stated he would prefer to postpone the
