2019 The Board scheduled a public hearing for the June 4 , 2018 10 00 am meeting to allow public comment on the proposed budget for FY 2018 – 2019 D Proclamation – Children’s Mental Health Awareness Day – May 10 , 2018 , adopted as follows PROCLAMATION National Children’s Mental Health Awareness Day WHEREAS , addressing the complex mental health needs of children , youth , and families today is fundamental to the future of Johnston County , North Carolina ; andPage222 May 7 , 2018 – 10 00 am Continued WHEREAS , the need for comprehensive coordinated mental health services for children , youth , and families places upon our community a critical responsibility ; and WHEREAS , it is appropriate that a day should be set apart each year for the direction of our thoughts toward our children’s mental health and well - Two Ten , Archer Lodge , Banner and Benson , Bentonville , Beulah and Kenly , Blackman’s Crossroads , Boon Hill and Princeton , Brogden , Claytex and Clayton , Corinth - Holder , Elevation , McLemore , Meadow , Micro , Nahunta , Newton Grove , Oakland , O’Neal , Pi - Le and Pine Level , Selma and Selma Rural , Shoe Heel , Smithfield and Smithfield Rural , Stricklands Crossroads , Thanksgiving , West Johnston , Wilson’s Mills , and Wynn and Four Oaks collectively known as the “ Fire Service Districts ” have been operating as county service districts providing fire protection services since their creation by the Johnston County Board of Commissioners ; and WHEREAS , the Board has determined that the boundary lines of the Fire Service Districts should be relocated to align the fire service district boundaries with the fire insurance district boundaries and to maximize the five - mile coverage area for fire insurance grading purposes ; and WHEREAS , pursuant to NC General Statutes § 153A - 3043 , the Board has determined to relocate the boundary lines of the Fire Service Districts consistently with the maps attached hereto and incorporated by reference ; and WHEREAS , pursuant to NG General Statutes § 153A - 3043 , a report was prepared containing the maps of the proposed districts , showing the proposed boundaries , statements showing the proposed districts meet the standards as required by law , and plans for providing fire protection services to the proposed districts WHEREAS , pursuant to NC General Statutes Section § 153A - 3043 c a notice of public hearing was prepared stating the date , hour and place of the hearing and its subject and stating that the report required by § 153A - 3043 b , including maps of the Fire Service Districts and the boundary lines to be relocated was available for public inspection in the office of the Clerk to the Board , and such notice was properly and timely published ; and WHEREAS , a public hearing was held at 10 00 AM on May 7 , 2018 , in the Commissioner’s Meeting Room , Johnston County Courthouse , Smithfield , North Carolina at which time all interested persons appeared and were heard , or had an opportunity to appear and be heard , concerning the question of relocation of the boundary lines of the Fire Service Districts of Johnston County ; andPage1231 May 7 , 2018 – 10 00 am Continued WHEREAS , at such meeting the Board determined that it was appropriate to relocate the boundaries of the Fire Service Districts , and that the proposed boundary relocation meets the requirements of § 153A - 3043 ; and WHEREAS , the Board , following the public hearing , finds that the relocation of the fire district boundaries is in the best interest of the citizens to align the fire service district boundaries with the fire insurance district boundaries and to maximize the five - mile coverage area , that the Fire Service Districts are capable of providing fire protection services in the areas affected , and that the effect that changes in the amount of taxable property will have on the ability of the Fire Service Districts to provide services or service debt will be negligible and in any event outweighed by the benefits to the people and property located in the districts NOW , THEREFORE , BE IT RESOLVED BY the Johnston County Board of Commissioners , meeting in regular session at Smithfield , North Carolina , on May 7 , 2018 , that the boundary lines of the Fifty - The Town agrees to receive an additional 025 MGD of wastewater from the County system with no allocation charge ? The County shall pay the Town the prevailing treatment rate charged by the Town in accordance with the existing agreement for any wastewater delivered to the Town plant ? The Town will lease to the County up to 10,000 lbs yr of effluent nitrogen as available and as needed ? The lease rate will be based on the prevailing lease rate among members of the NRCA Neuse River Compliance Association at the time of the lease ? The agreement term is 5 years with automatic renewal in one year increments thereafter Ms Farmer stated staff respectfully requests the Board’s consideration of the proposed agreement between the Town of Benson and Johnston County Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Cookie Pope , and carried unanimously , the Board approved the following Memorandum of Agreement with the Town of Benson Memorandum of Agreement Between Town of Benson and Johnston County Concerning Availability of Wastewater Treatment Capacity and Lease of Wastewater Treatment Plant Effluent Nitrogen Credits General The Town of Benson hereinafter called the “ Town ” has a wastewater treatment plant with a capacity of 190 MGD NPDES Permit NoNC0020389 The Town and Johnston County hereinafter called the “ County ” have existing wastewater agreements dated April 14 , 1999 , May 17 , 2005 and June 25 , 2009 for treatment of up toPage6266 May 7 , 2018 – 10 00 am Continued 192,160 gpd of wastewater from the County’s system Further , the County previously constructed pumping and piping improvements to deliver the County’s wastewater to the Town’s treatment plant The Town’s wastewater treatment plant currently has surplus treatment capacity and surplus effluent total nitrogen mass effluent limits The County is planning an expansion of its wastewater treatment plant NPDES Permit No NC0030716 , but until the expansion of the plant is complete and the County acquires additional total nitrogen effluent limit credits and or expands its reclaimed water system , the County needs and desires additional wastewater capacity and effluent nitrogen limit credits on a temporary basis The term of the interim period of need is five years Agreement The Town agrees to receive up to an additional 025 MGD of wastewater from the County system for treatment in its plant The 025 MGD of treatment capacity will be provided with no capacity allocation charge since the period of availability is limited The Town will charge the County for treatment of the additional th wastewater under the terms of the June 25 2009 agreement , however , notwithstanding the foregoing , the County shall pay to Town the current and prevailing rate charged by the Town for treatment of wastewater under this agreement The Town shall lease to the County up to 10,000 lbs per year of effluent nitrogen allocation , as available by the Town and as needed by the County The lease rate charged by the Town shall be based on the prevailing lease rate among members of the NRCA Neuse River Compliance Association at the time of the allocation to the County from Town The agreement shall be effective on July 1 , 2018 , and shall extend for 5 years The agreement will automatically renew in one year increments unless either party provides a written request for termination at least 30 days prior to the expiration date Priority of Town Wastewater Needs In event the Town requires either wastewater treatment capacity or effluent nitrogen limit credits during the term of this Agreement , with One Hundred Twenty 120 days written notice the Town may withdraw all or part of 025 MGD treatment capacity allocation and or decline to lease or make provision of all or part of the 10,000 lbs of effluent nitrogen Third Party Approval Lease of effluent nitrogen credits must be approved by the Neuse River Compliance Association NRCA under the terms of Permit No NPDES NCC000001 and the by - Carter as well as Johnston County Youth Services Program Director Deborah Bolin She recognized Commissioner Chad M Stewart for his representation on the Council and thanked County Manager Rick Hester and Finance Director Chad McLamb for their assistance Judge Rawls presented the following to the Board We are mandated by statute to recommend to the Board of County Commissioners funding for dispositional alternatives for sentencing juveniles who have been adjudicated delinquent orPage7267 May 7 , 2018 – 10 00 am Continued undisciplined Currently , it costs each individual county 12200 per day for a juvenile that is held in detention and the State 126,401 per year for each juvenile that is committed to a Youth Development Center , formerly known as training school Currently Johnston County has at least 1 committed in training school There are three levels of sanctions Level 1 includes community service , restitution , emergency home shelter and community based programs that target changing the negative behavior of delinquent youth Level 2 sanctions include community service and restitution , structured day and other out of home placements Level 3 is commitment to training school We recommend funding for the following programs Johnston County Youth Services This program has several components The Structured Day Program is used for juveniles who have been short and long term suspended from school and are on juvenile probation This a Level 2 sanction and is frequently used by the Court to prevent further delinquent behavior of youth suspended from the school system The actual cash money requested from the County is used to pay for the instructor in this program The State funds will not pay for an instructor and this program cannot exist without an instructor The next component is New Directions , which is a Guided Growth Program with a male group that meets twice a week and a female group that meets twice a week This program will address the needs of juveniles by providing mentors and counselors to deal with anger management , conflict resolution and problem solving The third component is Restoration Alternatives , a program that provides community service and restitution It is one of our most used programs and it actually provides restitution to victims of crimes The juveniles perform contract work for the citizens of Johnston County and the money paid is applied towards that juvenile’s court obligations The program coordinator of this program actually works on site with the juveniles and has limited part - time help Recommended Funding 201,661 , plus anticipated 39,000 county funds for instructor Healthy Choices This program will provide an environment for at - risk juveniles to become receptive to exploring their dysfunctional behavior and initiate change The means through which services are provided include group intervention , group activities , case management , and coordination with families , schools , social service agencies , and the courts A Nationally recognized curriculum is presented in a group setting focusing on a variety of possible deficits , including but not limited to , conflict resolution , anger management , social skills training , assertiveness training , and substance abuse Healthy Choices currently accepts children from all youth serving agencies in the County Recommended Funding 25,970 Preparing To Soar Teen Court Teen Court provides an alternative to prosecution of youth between the ages of 11 - 17 Youth are sanctioned with constructive sentences by a jury of their peers This program trains volunteers as courtroom clerks , bailiffs , jurors , defense and prosecuting attorneys Recommended Funding 20,000 , plus anticipated 20,000 county funds Administrative Budget These are funds set aside to cover the expenses of the committee which includes salary of the administrative assistant , mail and other administrative costs As a committee , we must advertise the availability of funds and meet at the very least on a monthly basis We currently have at least ten meetings per year and minutes are taken at these meetings Additionally , we provide for community awareness through conferences , yearly achievement recognitions of juveniles in our programs , training , and expenses of the board members The State allows us to set aside up to 15,000 , but we only allocate a minimum amount Any overage is usually allocated back to our programs Recommended Funding 3,600 Please note We have not increased our request of county matching funds Most of the 20 match required by each program is through in - kind services Our programs have gone out of their way to find other sources to meet the 20 match with the exception of 39,000 which is used to pay for the following Instructor in Structured Day Program ; Community Service Restitution Assistant ; also , to help pay for increased transportation expenses and utilities Total Anticipated Amount from State 251,231 Total Anticipated Requested from County 59,000Page8268 May 7 , 2018 – 10 00 am Continued Judge Rawls spoke on the juvenile numbers in the County and stated whereas Johnston County used to be one of the better counties , the numbers are now steadily increasing Judge Rawls stated she is unsure why the increase is occurring and if it perhaps relates to the changes in the alternative school program Judge Rawls noted so far , Johnston County does not have the number of egregious crimes as seen in other counties , but she cautioned everyone must be progressive and proactive moving forward Commissioner Ted G Godwin asked if the Juvenile Crime Prevention Council had been asked or would like to provide any input regarding changes in the alternative school program Judge Rawls responded that Deborah Bolin , through Johnston County Youth Services , has been actively participating with the alternative school program changes and she continues to cooperate with them with respect to addressing the needs Judge Rawls noted she is available to help and in an effort to remain involved , she still serves on the Clayton High School Advisory Council even though her children have graduated Judge Rawls commented that some of the children seem to be doing better in the second alternative school program and she is actually a proponent of working with children within their own environments She stressed that even though there are different thoughts on how to address problems , there is a need to focus on prevention The Board thanked Judge Rawls and the JCPC for their work Upon a motion by Commissioner Chad M Stewart , seconded by Commissioner Cookie Pope , and carried by unanimous vote , the Board approved the Juvenile Crime Prevention Council’s proposed budget for Fiscal Year 2018 - 2019 ; and further approved the 59,000 County allocation request , pending final adoption of the County Budget for Fiscal Year 2018 - 2019 10 Public Utilities – Request for Sole Source Purchase – Water Treatment Plant Claricone No 9 and No 10 Utilities Director Chandra Farmer , PE , reported after receiving the Notice of Intent to Fund from NCDEQ – Division of Water Infrastructure , the Board of Commissioners adopted a budget for the 20 MGD Water Treatment Plant Expansion in October of 2017 and the proposed project is under design Ms Farmer stated one component of the project is the addition of a solids contact clarifier Ms Farmer explained the County’s process train currently consists of eight solids contact clarifiers The existing clarifiers were purchased from Chicago Bridge & Iron Company CB & I and are referred to as Claricones ® She stated in order to maintain standardization , compatibility and consistency for operation , staff would like to request an exemption to the formal bidding requirements for the addition of Claricone ® No 9 as part of the 20 MGD expansion project and Claricone ® No 10 , which will be included in a future project Ms Farmer noted the requested exemption is in accordance with the standardization and compatibility exemption allowed under the statutes and would allow the County to negotiate a contract with CB & I Ms Farmer stated the contract with CB & I will contain all necessary provisions to meet funding agency , Local , State and Federal requirements Ms Farmer stated staff respectfully requests approval to sole source purchase Claricone ® No 9 and No 10 from Chicago Bridge & Iron Company CB & I Commissioner Allen L Mims , Jr stated it makes good sense to keep everything the same and moved the Board approve the sole source purchase of Claricone ® No 9 and No 10 from Chicago Bridge & Iron Company for the 20 MGD Water Treatment Plant Expansion Project Commissioner Cookie Pope seconded the motion which carried by unanimous vote 11 Public Utilities – Call for Public Hearing – System Development Fee Analysis Utilities Director Chandra Farmer , PE , stated in April 2018 , Willdan Financial Services completed a System Development Fee analysis for the review and development of water and wastewater system development fees in accordance with the General Assembly of North Carolina Session Law 2017 - 138 She noted the analysis is currently published on the County’s website and the public will have 45 days to submit written comments Ms Farmer reported after comments are received and evaluated , a public hearing must be held to consider adoption of the analysis and system development fees She stated staff respectfully requests the Board to schedule a public hearing to consider the System Development Fee analysis and proposed revisions to the County’s “ Water and Sewer Policies ” related to defining system development fees Commissioner Cookie Pope moved that the public hearing be held on June 4 , 2018 at the 6 00 pm meeting Commissioner Ted G Godwin seconded the motion which carried by unanimous vote Page9269 May 7 , 2018 – 10 00 am Continued Upon a question by Commissioner Larry Wood , Ms Farmer reported to date , staff has received no comments or questions from the public regarding the analysis 12 Public Utilities – City of Raleigh Memorandum of Understanding – Regional Wastewater Planning Utilities Director Chandra Farmer , PE , stated the Johnston County Utilities staff has communicated with the City of Raleigh Public Utilities staff regarding future wastewater treatment planning She reported as both entities plan to meet future demands for wastewater treatment , staff has discussed a joint study to evaluate potential regional options Ms Farmer stated a joint study is outlined in a proposed “ Memorandum of Understanding MOU Between the County of Johnston and the City of Raleigh ” and includes the following ? Participation in joint study workshops and meetings ? Cooperation in distributing available information to the other party as well as third parties required ? Review infrastructure and wastewater treatment alternatives ? Develop a regional study report ?
