local organizations , in conjunction with the National Association for the Education of Young Children , are celebrating The Week of the Young Child , April 16 through April 20 , 2018 ; and WHEREAS , these organizations are working to promote and inspire high quality early childhood education and experiences for our state’s youngest citizens , that can provide a foundation of learning and success that require police , fire or emergency medical services ; the E - 911 Communications Center was created to provide a vital contribution to the quality of life enjoyed by citizens and visitors to Johnston County ; and WHEREAS , when an emergency occurs , the access to a 911 center dramatically improves the prompt response of police officers , firefighters and paramedics , is critical to the protection of life and preservation of property ; and WHEREAS , the Telecommunicators are trained , prepared and ready ; the safety of our police officers , firefighters and EMS personnel are dependent upon the quality and accuracy of information obtained from citizens who telephone the Johnston County E - 911 Communications Center ; and WHEREAS , Public Safety Telecommunicators are the first and most critical contact our citizens have with emergency services ; and WHEREAS , Public Safety Telecommunicators are the single vital link for our police officers , firefighters and EMS annual spring statewide roadside cleanup to ensure clean and beautiful roads in North Carolina ; and WHEREAS , the spring 2018 LITTER SWEEP roadside cleanup will take place April 14 - 28 , 2018 , and encourages local governments and communities , civic and professional groups , businesses , churches , schools , families and individual citizens to participate in the Department of Transportation and he encouraged the Board to contact him whenever needed The Board welcomed Mr Mancuso B Citizen Comments – Ken Taylor Ken Taylor , 1755 Gordon Road , Clayton , addressed the Board in follow up to his comments from the th March 5 meeting regarding his concerns with language in the Johnston County Code of Ordinances related to Emergency Services Mr Taylor asked if any progress has been made to update the ordinance Mr Taylor also asked for an update concerning an e - mail he had previously sent the Board of Commissioners regarding safety concerns related to the Novo Nordisk expansion site construction and access road County Manager Rick Hester responded that staff will review the ordinance language to determine what updates will be needed Mr Hester also stated he has a meeting soon with representatives from Novo Nordisk and can relay Mr Taylor’s concerns at that meeting PagePage pageNumber5181 April 2 , 2018 – 10 00 am Continued 4 Johnston Health Foundation – Proclamation for Portofino Derby Classic Day Johnston Health Foundation Chairman Stewart McLeod requested the Board to adopt a proclamation for Saturday , May 5 , 2018 as “ Portofino Derby Classic Day ” Mr McLeod reported the Foundation is the fundraising arm of Johnston Health and raises money for cancer patient assistance , the healthy kids fund , the heart fund , as well as capital projects for the hospital Mr McLeod spoke on some of their projects recalling the Foundation raised over 4 million to construct the hospice house in Johnston County He noted most recently , the Foundation raised money to help Johnston Health purchase two 3D mammography machines with one used in the Smithfield Medical Center and the other at the Clayton Medical Center Mr McLeod commented that the Foundation does all it can to help improve the health of the residents in Johnston County Mr McLeod explained today’s proclamation is for the Portofino Derby Classic , stating on May 5 , 2018 the Foundation will sponsor the Derby Classic at Portofino on Hwy 42 East outside of Clayton He stated the event will have thoroughbred horse racing , exhibitions , and food followed by a live broadcast of the Kentucky Derby Mr McLeod invited the Commissioners to attend the event and stated all funds raised will go to the Foundation’s angel fund , which helps cancer patients Mr McLeod read aloud the proclamation and asked the Board to adopt it Commissioner Ted G Godwin thanked Mr McLeod and the Foundation for all they do and moved the Board adopt the proclamation for Portofino Derby Classic Day , seconded by Commissioner Larry Wood , and carried by unanimous vote PROCLAMATION Whereas , in 2012 , the Clayton Rotary Club started the Clayton Derby Day event and hosted for 3 years until 2015 , simultaneous with the popular Kentucky Derby ; and Whereas , May 5 , 2018 marks the revival of the Clayton Derby Day , relaunched as Portofino Derby Classic with Johnston Health Foundation as lead proponent , in collaboration with local business and community leaders ; and Whereas , the event will promote the Town of Clayton and Johnston County to the Triangle and Eastern North Carolina , expecting at least 1,000 visitors from neighboring counties and states ; and nd Whereas , cancer is the 2 leading cause of death in Johnston County which is 22 of all deaths in 2016 and nd the 2 leading significant health need in Johnston County ; and Whereas , education on early screening and access to resources for treatment and support for the underinsured and uninsured is important ; and Whereas , the financial challenges of a patient in need who is diagnosed with cancer is enormous and assistance from individuals and organizations will go a long way ; and Whereas , the net proceeds of the Derby Classic will benefit local cancer patients in need through the Johnston Health Foundation’s Angel Fund ; and Whereas , the Derby Classic is an opportunity to increase cancer awareness and the growing April 2018 , while in regular session PagePage pageNumber6182 April 2 , 2018 – 10 00 am Continued 5 Tax Appeal – Nelson Wright Tax Administrator Sheila Garner reported the Board is being asked to consider a request from Nelson Wright for refund of property tax pursuant to North Carolina General Statute § 105 - 381 Ms Garner stated the Tax Office received the foregoing request from Mr Wright for refund of property taxes paid in the current and prior fiscal years She explained in this case , Mr Wright has requested a refund for tax years 2013 - 2016 and claims the Tax Office taxed a barn on his property as a house and that he has been paying taxes as such Ms Garner stated the barn was previously valued at 13,70000 ; however , after the Tax Office reviewed the structure this year , the value was reduced to 3,73000 Ms Garner explained the Tax Office has to make many judgement calls on properties they value and staff believes that Mr Wright sees this as a judgement error based on what the appraiser saw at the time the former value was determined Ms Garner stated based on this being an appraisal judgement and not a clerical error , the decision should be based on North Carolina General Statute § 105 - 287 c which provides that an increase or decrease in value is effective as of January 1 , in the year in which it is made and is not retroactive Property Owner Nelson Wright addressed the Board and stated had he known the barn was being taxed as a house when he purchased the property , he would have asked the Tax Office to correct it at that time Mr Wright stated he does not believe he should have to pay the additional taxes and requests a refund At the inquiry of Commissioner Allen L Mims , Jr , Mr Wright stated he purchased the property in 2004 Ms Garner submitted photos of the structure in question to the Board Upon questions by Commissioner Larry Wood , Ms Garner explained that pursuant to the statute , in order for a refund to be legal , the taxpayer must demonstrate that there was a a tax imposed through clerical error ; or b an illegal tax ; or c a tax levied for an illegal purpose She stated a clerical error is considered a transcription error Ms Garner stated she is unsure what the previous owners of the property had deemed the structure to be Mr Wright stated the previous property owner installed vinyl siding on the structure , but there is no meter box or septic tank Upon a question by Commissioner Ted G Godwin , Mr Wright stated he did receive notice from the County regarding the tax value as a lot consisting of 165 acres Commissioner Lee Jackson asked for clarification if there is a septic tank noting one of the photographs appears to show a toilet Mr Wright reiterated there is no septic tank to the building Commissioner Chad M Stewart commented that it appears plumbing was only roughed - in where it could be used eventually if a septic tank were installed Commissioner Stewart stated as he understands from the perspective of the Tax Office , the structure looks like a house , but after that was questioned , staff reviewed the property and determined it was a barn ; therefore , it will be taxed at the new value going forward Ms Garner confirmed Commissioner Stewart’s understanding of the situation and stated the Tax Office , going forward , will tax the property at the new value of 3,73000 pursuant to North Carolina General Statute § 105 - 287 c Ms Garner stated when Mr Wright purchased the property in 2004 , he paid a purchase price of 64,00000 and the Tax Office valued the overall property at 62,52000 in 2011 so staff had no reason to believe anything was wrong with the property’s value She noted that a notice was sent out in 2011 during revaluation explaining a property owner’s right to appeal and further , each January the annual notice states the same Commissioner Stewart asked the County Attorney if the statute would allow the refund as requested by Mr Wright for prior years County Attorney Jennifer Slusser advised the statute would not allow for a refund for prior years in this instance PagePage pageNumber7183 April 2 , 2018 – 10 00 am Continued Ms Garner reported the Tax Office has already refunded the current year’s tax since it is allowed by the statute and will tax the property at the new value going forward Mr Wright clarified that he paid 60,50000 for the property in 2004 and confirmed he did receive a refund for 2017 Commissioner Ted G Godwin moved the Board deny the request for refund , seconded by Commissioner Allen L Mims , Jr , and carried by unanimous vote 6 Recognition of Clerk to the Board The Board took the opportunity to recognize and congratulate Clerk to the Board Paula Woodard for receiving the 2017 Howard Holly Outstanding Clerk of the Year Award on March 23 , 2018 during the North Carolina Association of County Clerks Annual Conference 7 Department of Social Services – Proclamation – Child Abuse Prevention Month April 2018 and Update to the Board Department of Social Services Interim Director Denise Boyette introduced DSS staff member Robert Tarpey to talk about activities that will be going on this month as part of Child Abuse Prevention Month Mr Tarpey requested the Board to adopt the proclamation proclaiming April 2018 as Child Abuse Prevention Month th in Johnston County Mr Tarpey invited everyone to attend the April 5 kick - off event from 12 00 pm until 2 00 pm at the DSS Campus Building 3 to promote awareness for Child Abuse Prevention Month Mr Tarpey thanked the Board for considering the proclamation and offered to answer any questions Commissioner Chad M Stewart read aloud the proclamation and moved for its adoption , seconded by Commissioner Ted G Godwin , and carried by unanimous vote Child Abuse Prevention Month Proclamation Whereas , children are vital to our County and State’s future success , prosperity , and quality of life as well as being our most vulnerable assets ; and Whereas , all children deserve to have safe , stable , nurturing , and healthy homes and communities that foster their well - being ; and Whereas , child abuse and neglect is a public responsibility affecting both the current and future quality of life ; and Whereas , parents need support and resources to cope with stress and nurture their children to grow to their full potential ; and Whereas , effective child abuse prevention strategies succeed because of partnerships created among citizens , human service agencies , schools , faith communities , health care providers , civic organizations , law enforcement agencies , and the business community Now , Therefore , the Johnston County Board of Commissioners does hereby proclaim April 2018 as Child Abuse Prevention Month and calls upon all citizens , community agencies , faith groups , medical facilities , elected officials and businesses to increase their participation in our efforts to support families , thereby preventing child abuse portion of House Bill 630 , known as “ Ryan’s Law ” , and how it could affect the Social Services Department Ms Boyette presented the following information to the Board PagePage pageNumber8184 April 2 system still has many issues and cannot be considered a reliable source for data She noted the County has piloted the program since 2012 and the problems still have not been addressed and will not be until the Legislature is willing to allocate more funding to fix the current problems Ms Boyette stated there would be more information to come regarding House Bill 630 Commissioner Chad M Stewart thanked Ms Boyette for the information and asked her to keep the Commissioners and the DSS Board updated Commissioner Stewart stated as he understands , some smaller counties would prefer the regionalization concept ; however , he believes that Johnston County’s Department of Social Services operates very well and would prefer to stay a county agency Ms Boyette agreed with Commissioner 15L11011 at 20,000 per acre , to be considered for a proposed public safety center Ms Slusser reported the agreement will allow due diligence to begin on the property County Manager Rick Hester reported he along with Sheriff Steve Bizzell had met or spoken with the immediate surrounding property owners and those conversations went well Upon a motion by Commissioner Ted G Godwin , seconded by Commissioner Cookie Pope , and carried unanimously , the Board voted to approve the Option to Purchase Agreement for 2539 acres located at US Hwy 70 Business East and Yelverton Grove Road in Smithfield Tax ID # 15L11011 at 20,000 per acre , to be considered for a proposed public safety center , as presented by staff Note The executed agreement is on file in the County Attorney’s Office
