10 160 Meeting of the Johnston County Board of Commissioners March 5 , 2018 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , March 5 , 2018 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Jeffrey P Carver , Vice Chairman Ted G Godwin , Cookie Pope , Allen L Mims , Jr , Chad M Stewart , Larry Wood , and Lee Jackson Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Jeffrey P Carver called the meeting to order at 6 00 pm and the following business was transacted 1 Public Comment None 2 Public Hearing Rezoning and Special Use Requests Advertised – The News & Observer Friday Zone Edition – February 23 and March 2 , 2018 Certified letters were mailed to adjoining property owners on February 16 , 2018 Notices were posted at the locations on January 2 , 2018 for Cases 14 - 03 MOD , 14 - 10 MOD , and 18 - 01 The Chairman opened the Special Use Hearing for Case 14 - 03 MOD Case 14 - 03 MOD Petition to modify a Special Use Permit for 669 acres zoned General Business – Special Use District GB - SUD located at 6275 NC Hwy 50 in Elevation Township This modification request is to remove the condition that all outdoor display and or sales shall be located no closer to the road than the existing office building Tax ID 07E07199K Owner Roger Dale Williams and Cynthia R Williams Applicant Roger Dale Williams Those wishing to speak on Special Use Case 14 - 03 MOD were sworn in by the Clerk to the Board Planning Director Berry Gray introduced the special use case and stated the petition is to modify a special use permit for 669 acres zoned General Business – Special Use District located at 6275 NC Hwy 50 in Elevation Township The modification request is to remove the condition that all outdoor display and or sales shall be located no closer to the road than the existing office building Mr Gray entered the fact sheet , supporting documents in the agenda packet , and introduced the following summary of evidence into the record A pre - application consultation was held with the applicant for Case 14 - 03 MOD on November 28 , 2017 At that time , the applicant was informed of the following ? If approved , applicant must provide to the Planning Office a Site Plan for their review and approval ? Applicant must comply with the requirement of the Johnston County Land Development Code regarding landscaping , buffering and fence or any additional requirements as approved by this Board ? Applicant will be notified in writing of the Board’s decision ? If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to the Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of County Commissioners ? Applicant’s Special Use Permit will expire at the end of twenty - four 24 months if it is not used as permitted within the time period ? When necessary , staff informed the applicant of further Planning and Zoning Department requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements ? Subsequent to the pre - application consultation , all required notices were mailed to property owners within 500 feet The property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On January 16 , 2018 the Johnston County Planning Board held a public hearing regarding Special Use Permit Case 14 - 03 MOD and made the following recommendations Page161 March 5 , 2018 – 6 00 pm Continued Mr Letchworth made a motion to approve the Special Use Modification for Case 14 - 03 , seconded by Ms Hackler and th carried by a unanimous vote of 9 - 0 Special Use Modification for Rezoning Case 14 - 03 was approved at the January 16 , 2018 Planning Board Meeting Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; Applicant Operate from an existing commercial facility Do not anticipate any negative impact on existing facility or community 2 That the use of the development appears to comply with all required use and intensity regulations of Articles II & IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - 257 and with all applicable regulations ; Applicant This facility has ample parking for the intended use and will not negatively affect the other businesses in the center 3 That the use or development is located , designed , and proposed to be operated so as to maintain or enhance the value of contiguous property , or that the use or development is a public necessity ; Applicant New owner will display a few pieces of equipment that he sells out front 4 That the use or development conforms to general plans for the physical development of the County’s Planning jurisdiction , the Design Manual , or other development policies as adopted by the Board of Commissioners Applicant New owner intends to operate his service sales business in 51 of the business and lease the remaining Has no plans to do flea market or bingo business Specific Land Uses APPLICANT Add Flea Market and Bingo in addition to the permitted uses in the General Business District to exclude certain uses Special Use Conditions 1 Permitted Uses To allow for the operation of a Flea Market and Bingo in addition to the permitted uses in the General Business District except those excluded below 2 The Special Use Permit may be revoked with the violation of any Special Use Condition 3 Applicant shall submit a detailed site plan for review and approval by the Planning and Zoning Department Staff 4 All buildings and or structures must comply with rules enforced by Federal , State and Local agencies 5 Installation of at least a Class B buffer along all property lines 2 large trees , 3 small trees , and 9 shrubs every one hundred 100 linear feet Existing natural vegetation may be used if more intense than the buffer requirement 6 Outdoor storage must be enclosed by an 8 ’ opaque fence or vegetative screening 7 All signage must comply with the sign code as stated in Section 14 - 509 8 The following uses shall NOT be permitted in this General Business Special Use District a Bar Club b Business – Convenience Store c Campgrounds - Travel Trailer Parks d Day Care , Home – Child e Dry Cleaning Establishment f Funeral Home g Hospital h Hotel i Libraries Museums Art Galleries j Nursing Home k Recreation – Outdoor l Retail Center m Rifle , Skeet & Trap n Theater 9 All outdoor display and or sales associated with flea market uses shall be located no closer to the road than the existing office building 10 Hours of Operations shall be Mon - Sun 8am – 10pm for flea market and bingo operations Mr Gray stated the property was rezoned in 2014 and there is an existing building used for offices along with parking lot and mini - storage facility on the site Mr Gray stated the property was originally zoned to allow all uses within the General Business classification except for those listed within condition # 8 which at that time included the flea market use He explained the special use permit was later modified to allow for flea markets and a condition was added regarding outdoor display and or sales to be located no closer to the road than the existing office building Mr Gray stated the applicant wishes to modify the special use permit so he can display equipment for sale ; and Industrial 1 and formerly used for automotive and equipment repair and storage of shipping containers The area is located within a designated “ Secondary Growth Area ” on the County’s Comprehensive Land Use Plan which denotes areas in which low to moderate levels of growth pressures are anticipated over the next 20 years Applicant Brent Atkinson , 1910 Wendell Road , Wendell , stated he has acquired the new land from his parents and would like to move his shop to the north side of the property which requires the rezoning There being no further public comments , the Chairman closed the public comment portion of the hearing Mr Gray reported the Planning Board recommended approval of the rezoning and adoption of a Resolution for the Statement of Consistency as submitted in the agenda packet There being no further comments , the Chairman recessed the Rezoning Hearing for Case 14 - 10 MOD Decision on Rezoning Case 14 - 10 MOD Case 14 - 10 MOD Petition to rezone 03 acres tract located at 1900 Wendell Road NCSR 1701 in Wilders Township from Agricultural Residential AR to General Business – Special Use District GB - SUD Tax ID 16P99007D Owner Brent P Atkinson Applicant Brent P Atkinson Commissioner Ted G Godwin moved the Board adopt the following Statement of Consistency Resolution and approve the rezoning request for Case 14 - 10 MOD Commissioner Cookie Pope seconded the motion which carried by unanimous vote RESOLUTION FOR CASE NUMBER 14 - 10 MOD RESOLUTION APPROVING A ZONING AMENDMENT AND ADOPTING A STATEMENT OF CONSISTENCY REGARDING AN ORDINANCE AMENDING THE OFFICIAL ZONING MAPS OF JOHNSTON COUNTY WHEREAS , pursuant to NC Gen Stat § 153A - 341 , prior to adopting or rejecting a zoning amendment , the governing board is required to adopt a statement approving or rejecting the zoning amendment and describe if the amendment is consistent or inconsistent with the comprehensive zoning plan and why the board considers the action taken to be reasonable and in the public interest ; WHEREAS , the County Planning Board has reviewed a proposed amendment to The Official Zoning Maps of Johnston County , for the parcel identified as tax Tag ID 16P99007D located at 1900 Wendell Road as shown on the attached Exhibit A , from Agricultural Residential to General Business Special Use District for automotive repair , towing , and automotive storage WHEREAS , based on a review of the proposed amendment the Planning Board found that the proposed amendment is consistent with the Johnston County Comprehensive Land Use Plan and updates and further recommended that the Board of Commissioners approve the proposed amendment ; 1151 and NC Gen Stat Article 20 Chapter 160A , whereby Alliance was designated as the Lead LME for purposes of operating as a risk - based Medicaid Managed Care Organization “ MCO ” and administering MH I - DD SA services in Johnston County ; and WHEREAS , Alliance and the Johnston County Area Authority entered into a Subcontract dated February 1 , 2013 for Johnston Area Authority to perform certain of the functions of the 1915 b c Medicaid Waiver Contract , those functions being Care Coordination and Community Relations in Johnston County ; and WHEREAS , considering geographic proximity , historic working relationship , organizational values , advantages to providers and consumers , and cost efficiencies , the Alliance Board of Directors and the Johnston County Board of County Commissioners believe that it is in the parties ’ best interests to formally join Johnston County into the Alliance catchment area , and terminate the Interlocal Agreement and Subcontract ; and WHEREAS , the terms of these Deal Points are intended to establish the process whereby the parties will add Johnston County into the Alliance catchment area ; and WHEREAS , the parties have the authority to enter into this transaction pursuant to NC Gen Stat § 122C - 115 c 1 NOW THEREFORE , in consideration of the mutual promises and considerations set forth herein , the parties agree as follows 1 Governance a Two seats will be designated on the Alliance Area Board both to be appointed by the Johnston BOCC , upon recommendation from the Alliance Area Board utilizing the process for appointments currently utilized by Alliance and its other catchment area counties b Johnston County may create a Johnston County Local Advisory Committee , which will include the 2 Johnston County Alliance board members as well as other community stakeholders The purpose of the Local Advisory committee is to review local operations and make recommendations to the Alliance Board of Directors through its representatives on the Local Advisory Board Responsibilities would include i monitoring the local service continuum , including but not limited to , number of clients served , service utilization , expenditure of service funds , provider network size and composition , access to care , and outcomes ; ii Review local Medicaid , State , and County service data provided by Alliance to fulfill responsibility i above and iii Participate in the Alliance annual needs assessments to determine local priorities and make recommendations for Alliances Network Plan Alliance agrees to staff this Committee in order to provide Alliance input and ensure concerns are voiced to Alliance leadership 2 Johnston County Public Health Services a The parties both acknowledge and agree that Johnston County Public Health provides a vital role in community wellness in the areas of behavioral and physical health The Public Health Department plays a critical role in the community as its safety net provider It is imperative that services provided by Johnston County Public Health continue in the future to ensure that Johnston County consumers are receiving the quality care and service they deserve It is imperative that Crisis Services and Integrated Care opportunities are expanded as well Alliance agrees to continue to collaborate with the Johnston County Public Health Department on special initiatives to align its capacity with Alliances strategic plan and the communitys needs b Alliance currently has a contract with Johnston DSS is for DSS WF CPS FNS program TANF programs utilizing Block Grant funding So , long as the outcomes are successful and funding continues to be available , Alliance has no plans to discontinue the contract with DSS Three - 16 and is submitted to the North Carolina Department of Health and Human Services by June 1 , 2017 as required by DHHS - MCO contracts The 2017 Alliance Community Needs Assessment and Gaps Analysis includes a summary of the previous year’s actions , review of provider capacity , assessment of service accessibility and choice , and incorporation of community feedback about needs and gaps The resulting analysis and conclusions are the basis for network development priorities and the Alliance Network Development Plan for FY17 - 18 As part of its Provider Network Development Plan , Alliance will maintain the proposed expansion of Johnston County services as outlined in the most current Network Plan Input from the Local Advisory Committee should be a part of this process both at the needs assessment and the feedback stages b A pilot program in Johnston County Public Health for integrated care is under development between Alliance Clinical staff and the Public Health Director and will continue 5 Johnston County MH IDD SA Service Funding Alliance requests that the County provide Alliance County funding for services at the current rate so that Alliance may continue to invest those funds back into the Johnston County community for services If provided with county funding , 1 administrative fee may be used for managing those county dollars and ensuring reporting requirements are met for Johnston County If Johnston provides county funding to Alliance , the parties will negotiate a funding agreement at that time 6 Office Space Personal Property Assets of Johnston Area Authority a Johnston County agrees to lease to Alliance the current LME space located at 521 North Brightleaf Boulevard Smithfield , NC 27577 for at least one year rent -
