10 167 Meeting of the Johnston County Board of Commissioners December 2 , 2019 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , December 2 , 2019 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Ted G Godwin , Vice Chairman Chad M Stewart , Jeffrey P Carver , Larry Wood , Tony Braswell , Patrick E Harris , and RS “ Butch ” Lawter , Jr Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Ted G Godwin called the meeting to order at 6 00 pm and the following business was transacted 1 Recognition of Pastor Lee Colbert and the First Baptist Church of Smithfield Emergency Services Director Kevin Hubbard and Emergency Management Coordinator Sandy Wood recognized Pastor Lee Colbert and the First Baptist Church of Smithfield for their assistance to Johnston County during emergency events by presenting them with the Partners in Protection Award Mr Hubbard commended Pastor Colbert and the Church stating whenever Emergency Services has called , they have never failed to respond Ms Wood stated the awards are presented in appreciation of the partnership and dedication to the collaborative efforts with Emergency Services in minimizing the impact of disasters and other emergencies to the health , safety , and property of the citizens of Johnston County Ms Wood stated Pastor Colbert answers the phone anytime they call and she is very appreciative of everything the Church does for Johnston County Accepting the awards on behalf of Pastor Colbert and the Church were Deacons Mike Carroll and David Lasater Mr Carroll stated that Pastor Colbert could not attend the meeting due to the birth of a grandchild Mr Carroll noted that Pastor Colbert is planning to retire soon and they will miss him greatly The Board expressed their appreciation for Pastor Colbert and the First Baptist Church of Smithfield for all they have done for Johnston County 2 Recognition of the Johnston County 4 - H Target Sports Club State Tournament Event Mr Jonathan Stovall , Johnston County 4 - H Target Sports Club Leader , reported that a number of their members recently attended the North Carolina State 4 - H Shooting Sports Tournament in Ellerbe , North Carolina and were fortunate to place in several of the events Mr Stovall stated they have been a club for over 15 years and shoot a variety of events along with archery The members shared with the Board the events they placed in at the tournament , as follows Senior Team Daniel Clayton , Elizabeth Hall and Sarah Guffey placed second in 22 pistol , second in recurve archery , second in air pistol , and second in air rifle Individual Daniel Clayton placed third in recurve archery match class and third in compound archery Individual Hannah Winspear placed second in air rifle and seventh in air pistol Junior Team Tyler Clayton , Luke Clayton and Jacob Davis placed third in recurve archery , third in air pistol , and second in air rifle Junior Team Rhett Dorman , Cutter Dorman , and Chase Dorman placed sixth in recurve archery The members of the club provided the Board with a background of their club activities and spoke on how it helps them develop life skills , self - worth , discipline , and conservation ethics The Board congratulated the Target Sports Club and commended them on their success at the recent State Tournament Chairman Ted G Godwin presented letters of recognition and congratulations to the members Page168 December 2 , 2019 – 6 00 pm Continued 3 Public Comment A Citizen Comments – Ken Taylor Ken Taylor , 1755 Gordon Road , Clayton , addressed the Board and stated he appreciated the Commissioners asking good questions at the morning meeting during the request by Johnston County Schools for additional funding Mr Taylor spoke on the importance of educating children while monitoring the finances 4 Public Hearing Rezoning and Special Use Requests Advertised – The News & Observer Friday Zone Edition – November 22 and 29 , 2019 ; The Johnstonian News and The News in Review – November 20 and 27 , 2019 Certified letters were mailed to adjoining property owners on November 18 , 2019 Notices were posted at the locations on September 25 , 2019 for Cases 19 - 20 and 19 - 21 The Chairman opened the Rezoning Hearing for Case 19 - 20 Case 19 - 20 Petition to rezone a 153 acre tract located at 20 Josie Drive in the Pleasant Grove Township from Agricultural Residential - Special Use District AR - SUD to Agricultural Residential AR Tax ID 13D05052G Owner Clearwater Investment Properties , Inc Applicant Clearwater Investment Properties , Inc Planning Director Braston Newton stated the petition is to rezone a 153 acre tract located at 20 Josie Drive in the Pleasant Grove Township from Agricultural Residential - Special Use District to Agricultural Residential Mr Newton stated the site at one time was used as a community swimming pool ; however , it has not been in use for a number of years The surrounding land uses are zoned Agricultural Residential and used for residential and agricultural purposes The area is located within a designated “ Secondary Growth Area ” on the County’s Comprehensive Land Use Plan which denotes an area in which low to moderate levels of growth pressures are anticipated over the next 20 years Mr Newton noted the request is a downzoning At the inquiry of Commissioner Jeffrey P Carver , Mr Newton explained that he believes the property was initially intended to be an amenity for the neighborhood , although it was not a requirement for the developer Mr Newton stated because there was very little neighborhood participation , the developer opened it up to the general public as a community pool and sold shares ; If approved , applicant must provide to the Planning Office a Site Plan for their review and approval ? Applicant must comply with the requirement of the Johnston County Land Development Code regarding landscaping , buffering and fence or any additional requirements as approved by this Board ? Applicant will be notified in writing of the Board’s decision ? If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to the Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of County Commissioners PagePage pageNumber5171 December 2 , 2019 – 6 00 pm Continued ? Subsequent to the pre - application consultation , all required notices were mailed to adjacent property owners The property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On October 15 , 2019 the Johnston County Planning Board held a public hearing regarding Rezoning Special Use Permit Case 19 - 21 and made the following recommendations Upon a motion by Mr Letchworth to approve Rezoning Case 19 - 21 , seconded by Mr Creech , Rezoning Case 19 - 21 was approved by a unanimous vote of 7 - 0 at the October 15 , 2019 Planning Board Meeting Upon a motion by Mr Caldwell to approve the Special Use Conditions for Rezoning Case 19 - 21 with striking # 9 and the change to # 6 stating no more than 15 vehicles on site , seconded by Mr Creech , with Mr Sapir and Mr Smith opposing , the Special Use Conditions for Rezoning Case 19 - 21 was approved by a vote of 5 - 2 at the October 15 , 2019 Planning Board Meeting Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; Applicant This parcel of land has been used solely for parking straight boxed trucks used for transportation of US mail Pate Trucking has been in business for 56 years and we have parked these trucks on premises for 40 of those years 2 That the use of development appears to comply with all required use and intensity regulations of Articles II & IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - 257 and with all applicable regulations ; therefore , the County contacted the engineer to assess the situation Ms Farmer reported the engineer determined that the originally designed bore and jack creek crossings could not be completed , and the bestPagePage pageNumber7173 December 2 , 2019 – 6 00 pm Continued method of installation would be by open - cut , which would require modified environmental permitting Ms Farmer explained that much of the project area , including the vicinity of the creek crossings , is in wetlands or areas with extremely wet conditions and prone to flooding , particularly in late 2018 and early 2019 Furthermore , the project is located in an environmentally sensitive area and a habitat with Federally protected and endangered species Ms Farmer stated in attempting to install the sewer main consistent with the original design , the contractor’s disturbed areas exceeded the allowed limits of disturbance in the approved permit To further complicate matters , the plans approved by the permitting agencies contained some provisions that were in conflict with the issued permit Therefore , extensive inspections and conversations with the US Army Corp of Engineers , US Fish and Wildlife , the Division of Water Quality and other environmental agencies were required in order to obtain compliance and a revised permit to move forward with an open - cut installation Ms Farmer stated the revised permit was received on November 5 , 2019 She reported the additional costs associated with the revised design are ? Contractor shut - down delays ? Contractor re - mobilization ? Modified pipe material and size ? Increased length of sewer alignment , requiring additional piping and manholes ? recorded 7 Strategic Growth Planning Continued Discussion Planning Director Braston Newton reported staff is in the process of working with the McGee’s Crossroads Middle School to schedule a community meeting during the evening hours hopefully sometime during the second week of January Mr Newton stated once a date has been confirmed , staff will make every effort to publicize the details so citizens can attend and give their feedback regarding strategic growth planning At the inquiry of Commissioner Butch Lawter , Mr Newton stated he did receive some suggestions from a few citizens in the week after the first community meeting held at the Agricultural Center Mr Newton stated staff will be taking those suggestions into consideration Commissioner Tony Braswell stated he recently spoke to Cooperative Extension Director Bryant Spivey who informed him that the agriculture community is very interested in this topic and would like to attend an evening community meeting PagePage agriculture organizations and individual farmers if needed to discuss their concerns and thoughts 8 Solid Waste Decal System Continued Discussion Chairman Ted G Godwin called on Commissioner Butch Lawter to report on a recent meeting he had with a staff member from Cumberland County regarding solid waste disposal Commissioner Lawter stated that he along with Commissioners Chad M Stewart and Patrick E Harris recently met with the Cumberland County Solid Waste Management Director regarding Cumberland County’s solid waste disposal system and that she is willing to meet with the other Commissioners Commissioner Lawter explained that Cumberland County charges an availability fee on every household in their County once a year through the tax bills and because of the availability fee , there is no tipping fee for residential waste Commissioner Lawter noted there are several factors involved with the program , but it is one solution to eliminating the decal program and spreading the burden on everyone versus making one group of people pay for another group of people Commissioner Lawter stated for those in towns , there should be some cost offset since the tipping fee would be eliminated Commissioner Chad M Stewart stated as he understands , for those with a private hauler that live outside of a town , those customers should have some leverage with their private hauler to lower their fee to offset the tipping fee that they no longer would have to pay for residential waste Commissioner Lawter commented that there would be matters to work through such as franchises or permits for the private haulers , but this was a scenario that he was willing to consider looking into further as an alternative to the decals Commissioner Tony Braswell noted there are some private haulers that do not use the County’s landfill so their customers would not have any leverage over them regarding tipping fees Commissioner Stewart responded that he thinks customers would most likely change haulers in those instances and contract with a private hauler that utilizes Johnston County’s landfill to get a cheaper rate Commissioner Patrick E Harris stated in talking with Cumberland County , the availability fee system was proposed as a package deal that made for a cleaner county He stated the availability fee was set at an amount where it offered benefits that included funding for things like cleaning up litter from the roadways and hiring an enforcement officer to go out and investigate cases of illegal dumping Commissioner Harris suggested the Board could look at a similar program that would eliminate the decals , provide for unrestricted access to Johnston County citizens , and hopefully make for a cleaner Johnston County Johnston County Solid Waste Services Director Rick Proctor reported that staff has looked into the availability fee method and it would waive the tipping fees for residential waste Mr Proctor stated in Cumberland County’s scenario , they have a permit system that allows trucks to operate within their County He noted that because the haulers can take the waste out of Cumberland County , it is up to the hauler as to whether they lower their fees or not The Board continued to discuss a franchise or permit system for private haulers and how the savings would or would not be passed onto customers Commissioner Braswell also noted that in rural areas like the one he lives in , sometimes there is only one private hauler offering service and customers may not have a choice to switch to someone else for a lower fee Following discussion , staff was instructed to look further into the availability fee system and calculate numbers based on Johnston County’s improved properties Mr Proctor stated staff would begin research and report make sure that the citizens are aware the Board is trying to work on the issues surrounding strategic growth planning Commissioner Harris spoke on the difficulties of finding a solution that benefits everyone ; however , the Board is studying the issues very closely There being no further business , Commissioner Jeffrey P Carver moved the Board adjourn Commissioner Patrick E Harris seconded the
