10 889 Meeting of the Johnston County Board of Commissioners July 8 , 2019 6 00 pm The Johnston County Board of Commissioners met in regular session Monday , July 8 , 2019 at 6 00 pm in the Commissioners Meeting Room , Johnston County Courthouse Annex , Smithfield , North Carolina The following members were present Present Chairman Ted G Godwin , Vice Chairman Chad M Stewart , Jeffrey P Carver , Larry Wood , Tony Braswell , Patrick E Harris , and RS “ Butch ” Lawter , Jr Absent None Also Present County Manager Rick J Hester , Clerk to the Board Paula G Woodard , Finance Officer and Assistant County Manager J Chad McLamb , County Attorney Jennifer J Slusser , and Paralegal Deputy Clerk to the Board Dana Cuddington Chairman Ted G Godwin called the meeting to order at 6 00 pm and the following business was transacted 1 Public Comment A Citizen Comment – Permissions for Hunting Fishing on Property Charles Stewart , 1514 Joyner Bridge Road , Four Oaks , addressed the Board regarding the types of permissions needed to hunt and or fish on other people’s property located in Johnston County Mr Stewart explained that currently in Johnston County , written permission is required from landowners to allow someone else to hunt and or fish on their property and he along with some others would like to see that reconsidered Mr Stewart clarified that they believe permission should be granted ; however , they feel permission should be granted either verbally or in writing and they would like for the Board to support legislation changing the law from “ written permission ” to just “ permission ” Mr Stewart spoke on his reasoning for requesting the change noting that many property owners are willing to give verbal permission ; however , they are unwilling to give written permission because they believe it then creates a liability Mr Stewart stated Johnston County is one of only about ten counties in North Carolina that requires written permission on all property and he would like to see it changed The Board discussed the issue with County Attorney Jennifer Slusser who informed the Board that the requirement for written permission was through a local act in 2007 and in order to change the legislation , it would have to go back through the process at the North Carolina General Assembly , which the Board would have to request from the legislators The Board continued to discuss various scenarios as well as the pros and cons of asking for the legislation to be changed Commissioner Chad M Stewart stated as he understands , North Carolina State law requires an individual to obtain written permission to hunt on someone else’s property that has been posted , but if the land is not posted , then only verbal permission is required noting that he owns property some of which is posted and some of which is not Commissioner Stewart continued that the issue is the local act passed in 2007 for Johnston County and a few other counties , requires written permission on all property and not just posted land Commissioner Larry Wood expressed a concern that by changing the law , it could then put a burden on landowners to have their properties posted Commissioner Jeffrey P Carver stated before the Board considers asking for a change in the local law , he would like for staff to research why the local legislation requiring written permission was passed in 2007 , noting there must have been a reason for it then or else the Board would not have requested the local act Chairman Ted G Godwin stated the Board would take the request under advisement to allow time for more research in to the matter B Request for Johnston County Water Service in Wake County Mike Stewart , 4716 Carolton Drive , Raleigh , representing Developer David Manning , addressed the Board and requested the Commissioners to revisit a matter from their May 7 , 2018 meeting regarding an Amendment No 6 to the interlocal agreement between the County and the City of Raleigh Mr Stewart stated the amendment would allow Johnston County water service to be extended to property proposed for developmentPage890 July 8 , 2019 – 6 00 pm Continued in Wake County Mr Stewart explained that since the May 7 , 2018 meeting , Wake County has approved a subdivision on the property in question and they have drilled and tested three different wells but have not found adequate water or water that does not require treatment Mr Stewart continued that the other option of drilling for individual wells on each lot would provide water that is not treated Mr Stewart stated Johnston County water service is available and they would like for the Board to reconsider their decision from May 2018 in which the request to approve Amendment No 6 was denied At the inquiry of Commissioner Tony Braswell , Mr Stewart stated Wake County does not provide water service and the City of Raleigh’s infrastructure is located several miles away with no plans to extend to the area in question Mr Stewart noted the City of Raleigh made the actual request in May of 2018 and Wake County wrote a letter in support of the request Chairman Ted G Godwin stated the Board would take the request under advisement C Citizen Comments – Ken Taylor Ken Taylor , 1755 Gordon Road , Clayton , addressed the Board Mr Taylor spoke on the earlier request by Mr Charles Stewart regarding the requirement for written permission in order to hunt on someone else’s property Mr Taylor suggested that perhaps that written permission could be something as simple as getting an e - mail or text from the landowner that could be carried on a cell phone Mr Taylor also spoke on how cyberattacks against governments are increasing and he asked if Johnston County has any type of insurance in the event of such an attack Finance Director Assistant County Manager Chad McLamb confirmed the County is properly insured in the event of a cyberattack Mr Taylor noted the Board is scheduled to discuss the solid waste decal system later in the meeting and he stated if the Board is successful in sorting out the decal system , he would then like for the County to concentrate on more enforcement of open trash burning and the dumping of trash and other debris along the roadways 2 Public Hearing Rezoning and Special Use Requests Advertised – The News & Observer Friday Zone Edition – June 28 and July 5 , 2019 ; The Johnstonian News and The News in Review – June 26 and July 3 , 2019 Certified letters were mailed to adjoining property owners on June 22 , 2019 A notice was posted at the location on May 1 , 2019 for Case 19 - 12 The Chairman opened the Rezoning Hearing for Case 19 - 12 Case 19 - 12 Petition to rezone 735 acres of a 1217 acre tract located at 757 Creech Road in the O’Neals Township from Agricultural Residential AR to General Business - Special Use District GB - SUD Tax ID 11O03003C Owner NC Golf Cars Plus , LLC Applicant Bartlett Engineering & Surveying , PC Planning Director Braston Newton stated the petition is to rezone 735 acres of a 1217 acre tract located at 757 Creech Road in the O’Neals Township from Agricultural Residential to General Business - Special Use District He noted the special use request associated with the rezoning is to allow for outdoor RV , vehicle , boat storage and mini - storage units Mr Newton stated the site is currently used for agricultural and residential purposes The surrounding land uses are zoned Agricultural Residential and used for agricultural and residential purposes ; and General Business – Special Use District and used for outdoor RV , vehicle , boat , and mini - storage units The area is located within a designated “ Agricultural Rural Conservation Area ” on the County’s Comprehensive Land Use Plan which denotes areas in which low levels of growth pressures are expected over the next 20 years Mr Steve Oliverio with Bartlett Engineering & Surveying , the applicant , requested the Board to approve the rezoning and offered to answer any questions There being no further public comments , the Chairman closed the public comment portion of the hearing Mr Newton reported the Planning Board recommended approval of the rezoning and adoption of a Resolution for the Statement of Consistency as submitted in the agenda packet Page891 July 8 , 2019 – 6 00 pm Continued There being no further comments , the Chairman closed the Rezoning Hearing for Case 19 - 12 Decision on Rezoning Case 19 - 12 Case 19 - 12 Petition to rezone 735 acres of a 1217 acre tract located at 757 Creech Road in the O’Neals Township from Agricultural Residential AR to General Business - Special Use District GB - SUD Tax ID 11O03003C Owner NC Golf Cars Plus , LLC Applicant Bartlett Engineering & Surveying , PC Commissioner Chad M Stewart moved the Board adopt the following Statement of Consistency Resolution and approve the rezoning request for Case 19 - 12 Commissioner Butch Lawter seconded the motion which carried by unanimous vote RESOLUTION FOR CASE NUMBER 19 - 12 RESOLUTION APPROVING A ZONING AMENDMENT AND ADOPTING A STATEMENT OF CONSISTENCY REGARDING AN ORDINANCE AMENDING THE OFFICIAL ZONING MAPS OF JOHNSTON COUNTY WHEREAS , pursuant to NC Gen Stat § 153A - 341 , prior to adopting or rejecting a zoning amendment , the governing board is required to adopt a statement approving or rejecting the zoning amendment and describe if the amendment is consistent or inconsistent with the comprehensive zoning plan and why the board considers the action taken to be reasonable and in the public interest ; WHEREAS , the County Planning Board has reviewed a proposed amendment to The Official Zoning Maps of Johnston County , for the parcel identified as tax Tag ID 11O03003C located at 757 Creech Road partial 735 acres only , as shown on the attached Exhibit A , from Agricultural Residential to General Business - Special Use District to allow for outdoor RV , vehicle , boat storage , and mini - storage units WHEREAS , based on a review of the proposed amendment the Planning Board found that the proposed amendment is consistent with the Johnston County Comprehensive Land Use Plan and updates and further recommended that the Board of Commissioners approve the proposed amendment ; and WHEREAS , this Board has reviewed and considered the above written recommendation of the Planning Board and has held a public hearing on the proposed amendment , and this Board desires to approve the zoning amendment and adopt a statement describing why the adoption of the proposed amendment is consistent with the Johnston County Comprehensive Land Use Plan and updates and the Board considers the proposed amendment to be reasonable and in the public interest NOW , THEREFORE , BE IT ORDAINED BY THE JOHNSTON COUNTY BOARD OF COMMISSIONERS THAT 1 This Board finds and determines that the adoption of the proposed amendment to the Official Zoning Maps of Johnston County is consistent with the Johnston County Land Use Plan and updates thereto because the Land Use Plan and updates indicate that a The amendment request is consistent with the Comprehensive Land Use Plan Goal 3A “ Business Expansion and Development , ” that states that the county should encourage and promote the development of new and existing business and industries by offering a progressive atmosphere that will diversify the local economy , expand the tax base , and enhance the quality of life in Johnston County 2 This Board finds and determines that it is reasonable and in the public interest to adopt the proposed amendment because a The General Business zoning is compatible with surrounding land uses and zoning with the required conditions for use and operation 3 This Board approves the proposed zoning amendment from Agricultural Residential AR to General Business - Special Use District GB - SUD th Adopted this the 8 day of July , 2019 The Chairman opened the Special Use Hearing for Case 19 - 12 Case 19 - 12 To allow for outdoor RV , vehicle , boat storage & mini - storage units Owner NC Golf Cars Plus , LLC Applicant Bartlett Engineering & Surveying , PC Those wishing to speak on Special Use Case 19 - 12 were sworn in by the Clerk to the Board Planning Director Braston Newton introduced the special use case and stated the petition is to allow for outdoor RV , vehicle , boat storage , and mini - storage units Mr Newton entered the fact sheet , supporting documents in the agenda packet , and introduced the following summary of evidence into the record Page892 July 8 , 2019 – 6 00 pm Continued A pre - application consultation was held with the applicant for Case 19 - 12 on March 29 , 2018 At that time , the applicant was informed of the following ? If approved , applicant must provide to the Planning Office a Site Plan for their review and approval ? Applicant must comply with the requirement of the Johnston County Land Development Code regarding landscaping , buffering and fence or any additional requirements as approved by this Board ? Applicant will be notified in writing of the Board’s decision ? If denied , no application can be accepted for the same use affecting the same property for a period of twelve 12 months and that their right of appeal to the Superior Court must be exercised within thirty 30 days of the receipt of notice of denial by the Board of County Commissioners ? Applicant’s Special Use Permit will expire at the end of twenty - four 24 months if it is not used as permitted within the time period ? When necessary , staff informed the applicant of further Planning and Zoning Department requirements and the requirements of other departments such as soil erosion and sedimentation requirements , Health Department regulations , stormwater and public utility requirements ? Subsequent to the pre - application consultation , all required notices were mailed to adjacent property owners The property was posted and notices of public hearings were advertised in accordance with the requirements of the North Carolina General Statutes On May 21 , 2019 the Johnston County Planning Board held a public hearing regarding Rezoning Special Use Permit Case 19 - 12 MOD and made the following recommendations Upon a motion by Ms Stewart to approve Rezoning Case 19 - 12 , seconded by Mr Sapir , Rezoning Case 19 - 12 were approved by a unanimous vote of 8 - 0 at the May 21st , 2019 Planning Board Meeting Upon a motion by Mr Letchworth to approve the Special Use Conditions for Case 19 - 12 , seconded by Ms Stewart , carried st by a unanimous vote of 8 - 0 , the Special Use Conditions for Case 19 - 12 were approved at the May 21 , 2019 Planning Board Meeting Finding of Facts for the Special Use Permit 1 That the use or development is located , designed , and proposed to be operated so as to maintain or promote the public health , safety , and general welfare ; Applicant The proposed development will be an accepted use for the proposed GB - SUD zoning and will be placed upon the site and designed to follow all current Johnston County Design Standards and Specifications 2 That the use of development appears to comply with all required use and intensity regulations of Articles II & IV of the Johnston County Land Development Code and the applicable specific standards in section 14 - 257 and with all applicable regulations ; Applicant This property will be developed in accordance with the required use and intensity regulations of the Johnston County Land Use Code as well as all state and federal regulations 3 That the use or development is located , designed , and proposed to be operated so as to maintain or enhance the value of contiguous property , or that the use or development is a public necessity ; Applicant The proposed use of this property will be an extension of the current use adjacent , and to the north , within this same tax parcel 4 That the use or development conforms with general plans for the physical development of the County’s Planning jurisdiction , the Design Manual , or other development policies as adopted by the Board of Commissioners Applicant This allowed use within the requested GB - SUD zoning shall be in accordance with the County’s Planning Policies by extending an already in place and operating use within the same tax parcel , providing a low - impact use that blends with the rural setting the Board had requested some options from staff regarding solid waste disposal at the March 2019 annual work session Chairman Godwin stated those options presented at the work session were as follows 1 Stay with the current funding model and keep the decals Decal fees increase over the planning period to 150 per year 2 Eliminate the decals and add an annual general fund contribution of 23 million to cover convenience site recycling costs 3 Eliminate the decals and add a convenience fee to all homes in the County outside of Town jurisdictions - 36 per year per residence 4 Eliminate the decals and add a convenience fee to all homes in the County outside of Town jurisdictions and a recycling fee to all homes in the County including inside Towns - 20 per year per residence convenience fee and 12 per year recycling fee Chairman Godwin reported that option # 4 appealed to him the most , and stated his concern deals more with trash flow and the fact that Johnston County has restricted access to the convenience sites Chairman Godwin continued that he understands the enterprise fund aspect and he is all for running government like a business as much as possible , but certain services must run as a government function and he believes this is one of those services At the inquiry of Commissioner Chad M Stewart , County Manager Rick Hester stated when he learned that the issue would be coming back up for discussion , he asked the Solid Waste Services staff to go back and look at the numbers within the four options to make sure they included costs for any necessary capital improvements that may be needed Mr Hester noted staff is still in the process of updating those numbers Solid Waste Director Rick Proctor confirmed that staff is still in the process of updating the numbers within the options Mr Proctor stated in order to complete the analysis , he would like to receive feedback from the Board as to which options are preferred Mr Proctor stated for example , if the Board decides to go with option # 4 , then staff has estimated there could be as much as a 30 increase in usage at the convenience sites which would necessitate additional staff , trucks , and possibly the need for more convenience sites within the system Upon questions by Commissioner Tony Braswell , Mr Proctor stated Chatham County used to charge a lower annual fee to citizens that had a private hauler ; however , they have since changed that policy because they determined it was too cumbersome for staff to keep up with who had a private hauler versus who did not Mr Proctor confirmed that even though some counties charge an annual fee , they still send out decals to residents as more of an identification system for the convenience site attendants Mr Proctor stated it costs approximately 800,000 annually to administer the decal system He noted it costs approximately 25 million annually to run the entire convenience site program , which includes recycling Mr Proctor stated currently anyone can bring recycled materials , appliances , and tires to the convenience center sites at no charge Mr Hester noted that the General Fund subsidizes the recycling program by approximately 400,000 annually and if the Board chooses to change the overall program , the Board could still choose to subsidize recycling At the inquiry of Chairman Godwin , Mr Proctor stated if the Board changes the program and allows all residents to use the convenience center sites , staff does expect to see an increase in usage ; however , it wouldPagePage pageNumber7895 July 8 , 2019 – 6 00 pm Continued depend upon the specific area of the County He stated staff expects there would be increases around the Clayton area while areas near Meadow and Bentonville would possibly have less of an increase He stated staff definitely expects an increase at the Barber Mill Road convenience site The Board continued to discuss various scenarios where citizens who normally do not use the convenience center sites , may choose to begin using them if the decal system were eliminated The Board also discussed if decals were eliminated , it could decrease the usage at the landfill because all residents could then use the convenience sites Mr Proctor stated staff does expect to see larger loads taken to the convenience sites versus the landfill if the decal system is eliminated , which would require additional trucks Chairman Godwin stated the real question is whether the Board views solid waste disposal as an enterprise or a government function Upon a question by Commissioner Butch Lawter , Mr Proctor stated currently the State trash disposal average is one ton per person per year Commissioner Lawter questioned how that average would change for Johnston County if the Board eliminated the decal system and Mr Proctor briefly reviewed how staff determines their projected estimates based on different scenarios Upon a question by Commissioner Jeffrey P Carver , Mr Proctor stated the County sold 16,000 decals the year before the decal fee increased to 100 versus 13,000 after the price increased The Board continued to discuss how surrounding counties manage their systems as well as the decrease in the decal sales after the price increased and alternatives that citizens may have decided to use for trash disposal , including a private hauler Commissioner Stewart noted that while he does not believe the littering problem would be completely solved if the convenience sites were opened to everyone , he does think it would help the situation Commissioner Patrick E Harris commented that if the decal price is continually increased , then it becomes advantageous for citizens to begin contracting with a private hauler for curbside service Commissioner Harris also noted that there are residents who will still use their private haulers simply for the convenience of curbside service , even if the decal system is eliminated Commissioner Harris stated he feels the Board needs a lot more information in order to make an informed and reasonable decision Commissioner Harris also stated he struggles with the enterprise fund part of the system and how it could negatively reflect on the County’s bond rating if the subsidization increases Commissioner Larry Wood expressed concerns that if the decal system is eliminated , the Board does not know exactly how much it will cost to fund necessary capital improvements and additional staffing Chairman Godwin stated the Board has been studying the issue for a long time and a decision needs to come to fruition Chairman Godwin asked staff to finish updating their numbers and report back to the Board with that information as soon as possible Commissioner Carver agreed that the Board needs more information and he asked if staff could go back and gather data beginning five years ago with regards to the number of contract haulers , loads per day or per week , the number of decals sold , as well as individual waste loads versus commercial Commissioner Carver stated he wants to see all the information in order to hopefully determine how residents are disposing of their trash Mr Hester confirmed that staff would complete an update of the numbers within the four options and provide that information to the Board along with the information that Commissioner Carver has requested At the inquiry of Mr Proctor , it was the consensus of the Board for staff to include some options as it relates to littering and possible roadside collection PagePage pageNumber8896 July 8 , 2019 – 6 00 pm Continued 5 Manager Reports and Comments A Clarification of Lynch Road Property for Johnston County Schools County Manager Rick Hester reported that at the June 17 , 2019 special meeting of the Board , the Commissioners approved the purchase price of property located on Lynch Road in Selma for Johnston County Schools Mr Hester stated Johnston County Schools had requested the approval via a letter received in the County Administration Office which stated the property was to be used for a new middle school Mr Hester th noted that since the meeting on June 17 , staff has been notified that the letter of request was
